Mohammadi, Sargul, Mustonen, Saara January 2015 (has links)

Právní ochrana před nezákonnou nečinností ve veřejné správě / Protection against unlawful failure to act in public administration

Hansel, Nona January 2011 (has links)
A purpose of my thesis was an analysis of problems with legal regulation of protection against unlawful failure to act in public administration. Firstly I described institutes which should prevent illegal inactivity so I focused on regulations of time for taking a decision and other institutes, especially regulation presented by the Administrative Procedure Rules. The regulation in Administrative Procedure Rules caused a lot of questions which are nowadays answered thanks to the Highest Court of Administration and procedure according the Administrative Procedure Rules is connected with protection given by an administrative justice. In this system there is also included regulation of liability for damages caused by unlawful official procedure. The purpose of this institute is not to prevent inactivity but to compensate consequences it caused. The legislature completed this topic with a result that injured party can require (since 2006) compensation for suffering moral damage independently of property damage. We can find some positive elements of recent regulation, such as specific regulation of time for taking a decision, formulation of fundamental principles of action of administrative bodies or possibility to provide compensation of moral damages. But the regulation has imperfections too. Since basic...

The Embarrassment Paradox: Encouraging Compensatory Consumption in Morality-Laden Contexts

Bennett, Andrea Rochelle 08 1900 (has links)
This research introduces the unique context of immoral inaction—situations in which consumers have the opportunity to engage in virtuous behaviors but opt against doing so. Through five studies I demonstrate that in such contexts, embarrassment—a negatively valenced self-conscious moral emotion evoked by the perception that one's behavior is worthy of judgment by others—interacts with the use of approach-motivated coping strategies to lead consumers to engage in prosocial compensatory behaviors. Though extant literature suggests that marketers seeking to evoke prosocial behaviors should employ communications and promotions framed to elicit consumers' guilt, such studies are based in contexts whereby individuals feel guilty and/or embarrassed because of something they have done, not for something they did not do. This research suggests that that the condition of immoral inaction serves to evoke a contrasting psychological mechanism that reverses these findings, making embarrassment a more effective driver of desired outcomes when marketers seek to promote overcoming past inactions. These findings are discussed in light of their implications for research and application.

Représentations de l'homme immobile : inaction et réclusion dans la littérature occidentale des XVIIIe et XIXe siècles / Representations of the Immobile Man : inaction and Reclusion Throughout the Eighteenth and Nineteenth Centuries Western Literature

Chateau, Jérémy 04 July 2016 (has links)
Between the eighteenth and nineteenth centuries, European literature fundamentally redefines its relation to travel writing: notions of apprenticeship and formation, as they appear during the age of Enlightenment and the Bildungsroman era, become eroded and are gradually replaced by eccentric or parodist accounts of the travel experience. In 1795, Xavier de Maistre’s Journey Around My Room enhances the educational virtues of a contemplative seclusion. From then, the tradition of travel writing is supplanted by stories of excursions that provide very little educational value, on the one hand; and stories of valuable teachings inherited by captivity, despite a lack of physical mobility, on the other hand. Inspired by Xavier de Maistre’s book, dozens of imitators follow his path throughout the XIXth century and write their own accounts of room travel, a little studied phenomenon in French literature. After the revolutions that hit Europe and America in the late eighteenth century, a new model of character, the immobile man, appears in literature. Characterized by his problematic presence in a fast-changing society, which is undergoing some very profound changes, he occupies the narrative space like a ghost, refusing to engage in social action, as he would much rather investigate the new opportunities of living in his own private space. Essential 19th-century texts—be they euphoric of dysphoric—hint at these new narrative modalities: American fiction from New England, for example, tells the painful transition from a spiritual age to a political age, characterized by a lethargic climate alternately depicted by Charles Brockden Brown, Washington Irving, Edgar Allan Poe, Nathaniel Hawthorne or Hermann Melville. On the margins of this troubled literature, the transcendentalist movement advocates a more favorable return to solitude. In France, Joris-Karl Huysmans’s A rebours, through its author’s determination in the search for unity, certainly marks an important milestone among all the narratives of reclusion.

Inações midiáticas: singularidades da cobertura sobre manifestações culturais subalternas nos jornais Folha de S.Paulo e O Estado de S.Paulo / Media inactions: coverage singularities about subaltern cultural manifestations in the newspapers Folha de S. Paulo and O Estado de S.Paulo

Santos, Moises dos 06 December 2010 (has links)
This research studies the behavior of the print media, termed media inaction, in relation to subaltern popular manifestations. Discusses some characteristics of the hegemonic print media and its role of informing in order to collaborate in building a society that values its various cultural goods. This study analyses, for example, the singularities of two major newspapers of São Paulo: Folha de S.Paulo and O Estado de S.Paulo. This thesis suggests a epistemological deepening of relation between the print media, society through appropriate actions of public policies and subaltern popular culture, grouping them into two main axes of reflection: the relation media and globalized society, articulating concepts of citizenship and culture, and the relation media and new technologies, investigating the globalization effects and the benefits from the new media protagonists for the subaltern culture.

Exploring the impacts of sugarcane expansion in La Montaña, Guatemala: A feminist community-based research project

Easby, Angela 04 January 2016 (has links)
Sugarcane cultivation is expanding throughout the Pacific coast of Guatemala, with political and ecological consequences for subsistence communities. The majority of sugar production occurs in the departments of Santa Rosa, Escuintla, Suchitepequéz and Retalhuleu on the Pacific coast. As sugarcane expands into fincas (large plantations owned by an agricultural elite), the amount of land available for rent to landless or land-poor farmers is reduced. Sugarcane expansion provokes various forms of environmental degradation, including deforestation, air pollution, water contamination, and draining of rivers and wetlands. Sugarcane cultivation also provokes health problems for workers and those who live near these sites, including kidney failure, dehydration, and respiratory and skin problems. As sugarcane expands, subsistence communities in the surrounding area are subject to these detrimental effects of sugarcane cultivation. Building academic knowledge on the impacts of sugarcane expansion is necessary in order to be better equipped to be in solidarity with, or support subsistence communities facing this expansion. It is crucial to meaningfully involve subsistence communities in this process of knowledge production since it is the inhabitants of these places, not researchers, who are the experts on these issues. In this thesis, I describe a feminist community-based research project in the community of La Montaña, Guatemala, on the impacts of sugarcane in their community. The key goals of this research were to 1) collaboratively identify with participants specific areas of interest regarding sugarcane impacts, and investigate these areas; 2) analyse data with an awareness of gender and 3) share research findings with the community to facilitate the possibility of action or critical reflection. I used public group discussions, semi-structured interviews, participant observation and drop-in sessions to collect data. Through this process, the issues of political inaction (as a response to sugarcane) and deforestation (driven by sugarcane) emerged as two key areas of interest which I explore in this thesis. The main finding of my research was that sugarcane cultivation is a divisive force in La Montaña: while community members agree on the negative aspects of sugarcane cultivation, they disagree about how to address this issue. As I find, these divisions occur along the axes of gender and age. These divisions also constitute an obstacle to a collective political platform to address sugarcane expansion, and a potential site for intracommunity violence as sugarcane continues to expand. These findings were presented to the community in a public presentation in February 2015, to provide a space for critical discussion of these issues. Overall, this research identifies a key difficulty that subsistence communities face in the context of agroindustrial expansion: as the importance of collective action grows, so too do intra-community divisions. This research highlights the need for long-term solidarity-building work in communities on the Pacific coast of Guatemala, in order to be able to achieve the changes that community members feel powerless to enact alone. / Graduate

Sexto apresenta, no livro I das Hipotiposes, a concepção geral do ceticismo.
