Styrelseansvarsförsäkring för bostadsrättsföreningar : Vad är det som försäkras?

Styrelser i bostadsrättsföreningar har ett omfattande ansvar för beslut de tar rörande föreningens ledning och förvaltningen av föreningens angelägenheter. Lider en part skada av styrelsens beslut kan styrelsen bli skadeståndsskyldig utifrån bestämmelserna i bostadsrättslagen och lagen om ekonomiska föreningar. Utredningen har visat att denna skadeståndstalan kan avse sak- och personskador samt rena förmögenhetsskador. Ansvaret är således vidsträckt och kan komma som en överraskning då många bostadsrättsföreningsstyrelser kan bestå av lekmän. För att skydda sig mot dessa skadeståndanspråk tecknar många bostadsrättsföreningar ansvarsförsäkringar för sina styrelseledamöter. Detta innebär att ansvarsförsäkringen tar på sig betalningsansvaret vid eventuell skadeståndsskyldighet. Uppsatsens syfte är att utifrån Länsförsäkringar Göteborgs styrelseansvarsförsäkring för bostadsrättsföreningar utreda i vilken omfattning ansvarsförsäkringen åtar sig att skydda styrelsen mot eventuella skadeståndsanspråk. Syftet med uppsatsen har genomförts genom en studie av relevanta rättskällor tillsammans med försäkringsvillkoren för ansvarsförsäkringen. Komparationen mellan det lagstadgade styrelseansvaret och försäkringsvillkoren i ansvarsförsäkringen har frambringat en konkret slutsats i vilken omfattning styrelsen skyddas mot eventuella skadeståndsanspråk. Utanför tillämpningsområdet för ansvarsförsäkringen kvarstår många situationer där skadeståndsskyldighet kan uppkomma för styrelsen. Följden av detta blir att försäkringstagaren i realiteten kan bli utan skydd i många situationer även om det existerar en ansvarsförsäkring.

Genetic information and insurance : a contextual analysis of legal and regulatory means of promoting just distributions

This thesis analyzes the rationale, appropriateness and value of the available legal and regulatory means to deal with genetic discrimination in the context of insurance. Insurance is used as a paradigm case for discussing the legal means to address the concerns related to the impact of new medical technologies. A new framework is proposed for evaluating the potential impact of such new technologies on people's ability to participate fully in social life and to have access to important social goods without unfair discrimination based on certain inherited traits. / A "thick" contextual method is used, which involves a detailed description of the medical, social, and legal context of the debate. The approach is based on Michael Walzer's theory of justice, which posits that in assessing the fairness of the distribution of a particular good, one must take into account the nature of the good as determined by the specific socio-historical context in which it obtains its shared meaning. Walzer's theory is used in the thesis to critically analyze the regulatory and legislative means introduced in several countries to curb genetic discrimination. It is further argued that Walzer's contextual analysis resembles the approach taken by the Canadian Supreme Court in the context of anti-discrimination law. Canadian human rights law is analyzed in detail to describe how genetic discrimination could be dealt with under the current provisions and how human rights law can be used to create conditions of substantive equality. The thesis concludes with an analysis of various legal and regulatory options to deal with genetic discrimination and its impact on human rights in the Canadian context. The establishment of a regulatory body is proposed, with the mandate to review the appropriateness of the use of new tests in the context of insurance. I argue that this review process, and the contextual analysis that should be involved in this process, would constitute a useful step towards creating conditions for substantive equality, not only for those who are genetically disabled, but for all those who are affected by real or perceived disabling conditions and stigmatizing traits.

Essays on Health and Development Economics

This dissertation explores the impact of policy and economic conditions on the current economic crises of crime, substance abuse, and financial exclusion faced domestically and abroad. Although these issues span the income distribution, impoverished regions are disproportionately affected by the highest rates of risky behaviors such as drug abuse and crime. The ability for public policy makers to affect large populations of at-risk individuals can be difficult; oftentimes, these groups operate outside of the public sphere and large-scale interventions can miss the mark. In my first substantive chapter, I investigate the efficacy of state-wide insurance reform aimed at reducing drug dependency by requiring insurance providers to cover rehabilitation and detoxification. Utilizing state-level panel data in a generalized differences-in-differences framework, I find that states which enact laws expanding insurance coverage are successful at encouraging treatments for some types of conditions but are limited in their ability to reach individuals struggling with opiate addiction and, correspondingly, have little impact on deterring accidental overdose deaths. In my second substantive chapter, I question the assumptions made in previous empirical work regarding the relationship between economic conditions and crime. Existing literature finds that property crime rates are positively correlated with the unemployment rate. In this paper, I investigate whether this relationship is evolving over time and find that the relationship between property crime rates and unemployment has diminished toward zero. Moreover, I find evidence that there is a non-zero relationship between unemployment and violent crimes during certain periods in time. In my last substantive chapter, we develop a theoretical model illustrating the basic trade-offs in the functioning of financial institutions (Village and Savings Loan Associations) designed to provide financial inclusion to under-served populations in developing countries. We develop a theoretical model which suggests that these groups lack a mechanism to ensure equilibrium in the supply and demand for funds. We test the predictions of this model using experimental data from newly formed groups in Uganda and find that groups operate with excess demand for loans but are often able to generate a high return on savings. This dissertation includes previously unpublished co-authored material.

This thesis provides a comprehensive overview of insurance supervision in the Czech and European law. First part outlines the basic concepts and then briefly discusses the evolution of supervision in the Czech lands. The thesis observes expanding goals of insurance supervision and growing number of institutions performing the supervision during the history. Next part follows insurance supervision in terms of applicable regulations according to the Czech law and establishes list of entities under supervision, deals with supervisory authority and its competences, and proceeds to breakdown the subject of supervision. It also focuses on oversight by individual sectoral laws and offers a view of the upcoming changes. The work also presents insurance supervision from the perspective of the European law. It deals with the requirements that EU law on supervision poses, as well as the newly established authorities of macro- and micro-prudential supervision. In the conclusion section the upcoming changes in supervision of the insurance industry are discussed.
