Composantes multidimentionnelles de l’arbitrage : de la considération locale à l’interculturalité internationale / Multidimensional components of arbitration : from local consideration till international interculturalityWehbe, Fatima Sara 09 December 2016 (has links)
La mondialisation a permis l’instauration de plusieurs institutions d’arbitrage. Cette multitude de choix offerte aux investisseurs pourrait induire les parties à choisir une institution défavorable quant à la résolution de leur litige. L’objectif de la thèse est de présenter un modèle de gestion pour les juristes qui facilite le choix de la juridiction la plus efficace ceci avec la mise en œuvre d’un tableau de notation associant des critères multidimensionnels accordant une notation selon le degré d’importance vue par les parties. A ce sujet, le tableau mis en place regroupe les quatre juridictions les plus connues internationalement qui sont les juridictions étatiques, la CCI, le CIRDI et la CNUDCI. L’arbitrage est composé de plusieurs fondements qui lui accordent sa spécificité. L’analyse multidimensionnelle permettrait donc de faire une analyse arithmétique des valeurs comparatives des composantes juridiques et extra-juridiques de l’arbitrage qui forment le tableau de notation afin de faciliter la prise de décisions des investisseurs. Afin de vérifier l’efficacité du tableau de notation, un questionnaire a été adressé aux investisseurs ainsi que des interviews effectuées avec des juristes ont permis de déceler l’impact de l’expérience sur le choix du centre le plus efficace. L’étude de cas de l’affaire COMMISIMPEX est un exemple de l’effet du choix inefficace sur la résolution du litige et explique comment l’expérience pourrait affecter la décision de l’institution d’arbitrage le plus efficace à la résolution du litige. Pour en conclure qu’il n’y a pas de juridiction intrinsèquement meilleure que les autres. Il faut donc procéder au cas par cas et selon ce que les parties recherchent suite à leur litige, pour en déduire la juridiction ou l’institution qui leur serait la plus favorable afin de leurs garantir le plus de droits lors de la résolution de leur litige / Globalization has established several arbitral institutions. They offer a multiple of choices to the investors that could induce the parties to choose an unfavorable institution.The aim of this thesis is to present a management model for jurist which facilitates the choice of the most efficient jurisdiction in resolving their dispute, with the implementation of a scoring table combining multidimensional criteria, giving a rating according to the degree of importance for the parties. In this regard, the table regroup four of the most well-known internationally jurisdiction, the State court, the ICC, the ICSID and the UNICITRAL. Arbitration is composed of several fundaments that give it its specificity. Multidimensional analysis thus would make an arithmetical analysis of the comparative values of the legal and extra-legal components of arbitration which form the scoring table to facilitate decision making of investors. To verify the effectiveness of the scoring table a questionnaire was sent to investors as well as an interview conducted with lawyers have identifies the impact of the experience on the choice of the most efficient arbitral center. The Case study of COMMISIMPEX is an example of the effect of inefficient choice on the resolution of the dispute and how the experience may affect the decision of the most effective arbitration institution to the resolution of the dispute. To conclude none of the jurisdiction is inherently better than the others. We must proceed case by case and according to what the parties are looking after their dispute, to deduce the court or institution that would be most favorable to them by guarantying more rights in the settlement of their dispute.

Counterpublics and Aesthetics: Afro-Hispanic and Belizean Women Writers.Persico, Melva M. 03 May 2011 (has links)
My project explores ways in which legitimacy is granted within the literary field. This is done through an analysis of literary anthologies, university course syllabi, publishing trends, literary prizes, and levels and sources of critical attention. The project seeks to determine the extent to which the works of Afro-descendant Spanish American and Belizean writers are reflected in the hegemonic Spanish American and Anglophone Caribbean literary canons. I examine the works of Cristina Rodríguez Cabral (Uruguay), Shirley Campbell Barr, and Delia McDonald Woolery (Costa Rica), and Zee Edgell, and Zoila Ellis (Belize). The project records the varying degrees of legitimation these writers have received and the factors that have had an impact on their recognition. It also shows that literary interculturality is possible in Spanish America and the Anglophone Caribbean through the aesthetics some writers employ and the activities of legitimizing agencies. Further I propose a plurality of canons based on the concept of plural public spheres/counterpublics as outlined by Nancy Fraser and Michael Warner. My analysis of Belizean works emphasizes ways in which a national literary canon can be considered a counterpublic within a regional literary corpus. The concept of counterpublics I use to present the works analyzed is a model other scholars can employ in their examination of other minority literatures.

Guru, kritisk vän och förebild : En kvalitativ undersökning om hur några studenter på Södertörns högskola upplevt sin VFUJacobsson, Linda January 2011 (has links)
The Swedish teacher education is continuously changing along with the understanding of learning. The teacher education at Södertörn University has an intercultural profile, which is considered modern and innovative. In this essay, students’ experiences from their practical training are analyzed to examine the correspondence between teacher practice and the modern teacher role conveyed by the University. The results show that some students have experienced practical training where the standards of the University’s teacher role were met, whereas others feel that they have not received the practical guidance needed to be able to wholly use their education in their future employment. Consensus between what the students and the tutors expect from each other is a possible reason for the lack of adequate guidance. Tutors sometimes seem uncertain of what role to adopt to provide the teacher students a constructive practical training. The issue of the role of the tutors during practical training ought to be an important discussion for teacher education. Moreover, it is important to point out that many of the involved people, both the responsible at Södetörns University and scientists are aware of the situation. A solution for this problem is likely to be considerably long-term since a beneficial solution would be an established view on teaching, from all parties involved, as something intercultural with focus on a reflective approach. The effect the intercultural teacher education has on future teaching is yet to be discovered.

Trata-se de uma pesquisa exploratório-descritiva que tem como objetivo entender como os executivos expatriados e executivos itinerantes estão vivenciando uma nova realidade cultural no âmbito profissional e pessoal. O problema de pesquisa constitui-se em identificar e analisar os entraves e os facilitadores com os quais os executivos expatriados e os executivos itinerantes se defrontam ao iniciarem suas atividades profissionais em outro país e utilizar este conhecimento para desenvolver meios para facilitar o contato intercultural, focando no executivo itinerante. Os dados foram coletados através de questionários abertos com quarenta executivos da empresa transnacional (quatorze executivos expatriados, onze executivos expatriados retornados e quinze executivos itinerantes). Para a análise das respostas às perguntas do questionário, utilizou-se a metodologia de análise de conteúdo. Os resultados são apresentados em três conjuntos de categorias: vinte categorias iniciais, posteriormente reagrupadas em nove categorias intermediárias e, por último, sintetizadas nas categorias finais: A preparação para o contato com outras culturas, O contato com outras culturas e Desenvolvendo a interculturalidade. Os resultados obtidos apontam para a importância de não só executivos expatriados receberem treinamento intercultural, mas também os executivos itinerantes, que transitam entre as diferentes culturas das diversas localidades da empresa transnacional, necessitam de um treinamento cultural para embasar o contato intercultural. A pesquisa também indica características necessárias em um executivo itinerante e a importância do conhecimento prévio do idioma da localidade. / This is an exploratory-descriptive research, with the objective to understand how the expatriate and itinerant executives are experiencing a new cultural reality in a professional and personal ambit. The researched problem consist in identify and analyze the barriers and facilitators that the expatriate and itinerary executives are exposed to when performing professional activities in other countries, and use this knowledge to develop ways to facilitate the intercultural contact, focusing on the itinerate executive. The data was collected using an open questionnaire with forty executives from a transnational company (fourteen expatriates’ executives, eleven returned expatriate executives and fifteen itinerant executives). Content analyze methodology was used to analyze the answers given to the questionnaire. The results are presented in three groups of categories: twenty initial categories, posterior rearranged in nine intermediary categories and, at last, synthesize in three final categories, which are: the preparation for the contact with other cultures, the contact with other cultures and developing interculturality. The obtained results indicate the importance that not only expatriate executives should receive intercultural training, but also itinerant executives, which transit the different cultures of the various transnational company localities, need a cultural training to base the intercultural contact. parceria entre uma organização equatoriana e outra brasileira, e com a aquisição de outra organização brasileira. A questão central é quais os reflexos da interculturalidade na organização Inaceres? O objetivo geral é compreender
como a interculturalidade se reflete na organização Inaceres; e os objetivos
específicos são construir a história da Inaceres, e analisar a interculturalidade
nessa história. Trata-se de uma abordagem histórica da interculturalidade em
uma organização de origem em países distintos e que é caracterizada por
experiências e símbolos compartilhados através da convivência e interação de
diversas culturas. O conceito de cultura adotado é de sistema de símbolos e
significados compartilhados em comportamentos e ações. O conceito de
interculturalidade adotado é de interação e convivência marcada por experiências e símbolos compartilhados por membros envolvidos em uma realidade construída por seus comportamentos e ações. A abordagem histórica caracteriza-se por: ser interdisciplinar; ter como objeto a interculturalidade; utilizar e integrar diversas técnicas de pesquisa (análise documental, entrevista narrativa, história de vida, história oral); utilizar diversas fontes de pesquisa em um conceito amplo de documento histórico; e ser construída a partir de uma questão que é formulada no presente e respondida no passado. Privilegiam-se as narrativas ancoradas no mundo vivido por quinze sujeitos, sendo alguns exfuncionários e outros funcionários da Inaceres. O processo analítico e interpretativo desenvolve-se: primeiro, na apresentação dos sujeitos através dos breves relatos das histórias de vida de cada um deles; segundo, na
construção de uma história da Inaceres; terceiro, na análise dos conteúdos das
falas de todos os sujeitos, com a identificação dos temas recorrentes (culturas, convivência e interação, comunicação, aprendizagem, centralização e
descentralização, e desafios culturais) e construção da narrativa dos reflexos
da interculturalidade na organização Inaceres; e quarto, no diálogo teórico
reflexivo que permite afirmar que as diferentes culturas resultaram em uma
interculturalidade integrada em toda trajetória histórica da Inaceres. / The study object of this thesis is interculturality in an organization originating in different countries. The organization studied is Inaceres – Agrícola e Indústria de Processamento de Palmito, which was constituted in Brazil from the partnership between an Ecuadorian organization and another Brazilian, and the acquisition of another Brazilian organization. The central question is: what are the reflections of interculturality in the Inaceres organization? The overall objective is to understand is how the interculturality is reflected in the Inaceres organization; and the specific objectives are to construct the history of Inaceres;
and to analyze the interculturality in this history. It is a historical approach of interculturality in an organization originating in different countries, which is characterized by experiences and symbols shared by the coexistence and
interaction of diverse cultures. The concept of culture adopted is system of
shared symbols and meanings, in behaviors and actions. The concept of
interculturality adopted is interaction and coexistence marked by experiences
and symbols, which is shared by members who are involved in a reality constructed by their behavior and actions. The historical approach is characterized by: to be interdisciplinary; to have as object the interculturality; to use and integrate various research techniques (document analysis, narrative interview, life's history, oral history); use various sources of research in a broad concept of historical document; and to be constructed from a question, which is formulated in the present and answered with the past. Preference is given to the narratives which are anchored in the world lived for fifteen subjects, who are some former employees and other employees of Inaceres. The analytical and interpretive process is developed: first, in the presentation of the subjects through brief accounts of the life's history of each one; second, in the
construction of a history of Inaceres; third, in the analysis of the contents of the speeches of all subjects, with the identification of recurring themes (cultures, coexistence and interaction, communication, learning, centralization and decentralization, and cultural challenges) and construction of the narrative of the reflections of the interculturality in the Inaceres organization; and fourth, in the reflective theoretical dialogue which allows to state that the different cultures resulted in an interculturality which is integrated throughout historical trajectory of Inaceres.

Interculturalité et expertise dans les services : Cas d’une PME internationale prestataire de services linguistiques / Interculturality and expertise : Case study on an international SME language services providerJerinic, Zorana 23 November 2018 (has links)
Devant faire face aux exigences imposées par l’internationalisation de plus en plus prononcée, les entreprises de services misent sur l’enrichissement du capital humain dont elles disposent. Cette recherche ambitionne de proposer une compréhension du processus d’apprentissage qui favorise cet enrichissement. Plus particulièrement, nous souhaitons comprendre l’impact de la culture de l’individu sur les compétences constitutives de son capital humain, et l’évolution de la compétence interculturelle qui est la composante essentielle de ce dernier dans un contexte international. Basée sur l’étude d’une PME internationale et, plus précisément, d’une de ses business units en France qui fait preuve d’une expertise en termes de prestation de service, notre thèse ambitionne de mettre en évidence les éléments constitutifs d’une relation de service de haut niveau. Pour cela, nous avons mobilisé une revue de la littérature reposant sur le management international, le management interculturel et la gestion des ressources humaines. Elle a été alimentée par une étude de cas unique dans le cadre de laquelle nous avons réalisé 25 entretiens semi directifs et environ 83 heures d’observation (non participante et participante). Les résultats obtenus révèlent que l’expertise de l’unité étudiée repose sur la compétence transculturelle du directeur-manager, qui est créatrice d’une culture managériale et de relations pérennes avec les clients, et qui est porteuse de résultats pour l’entreprise. / Faced with the demands imposed by increasingly marked internationalization, service companies are banking on the enrichment of human capital they have. This research aims to provide an understanding of the learning process that promotes this enrichment. More specifically, we want to understand the impact of the culture of the individual on the skills that make up his human capital, and the evolution of intercultural competence which is the essential component of the latter in an international context. Based on the study of an international SME and, more precisely, of one of its business units in France which demonstrates an expertise in terms of service delivery, our thesis aims to highlight the constituent elements of a high level service relationship. For this, we have mobilized a review of the literature based on international management, intercultural management and human resources management. It is based on a unique case study in which we conducted 25 semi structured interviews and approximately 83 hours of observation (non participant and participant). The results obtained reveal that the expertise of the unit studied is based on the transcultural competence of the manager, who creates a managerial culture and lasting relationships with customers, which brings results for the company.

Le concept de décloisonnement, est élaboré à partir d'une réflexion sur la complexité des enjeux culturels, notamment, lorsqu'une pluralité de cultures, coexiste et se confronte dans un espace commun. L'étude, le développement et la discussion du décloisonnement sont issus d’une généalogie de la culture et des cultures dans l'histoire des idées, notamment à travers les Sophistes, Las Casas, Montaigne, Rousseau, Volney et Lévi-Strauss et par une analyse historique des concepts de nomos, coutume, et civilisation. Le décloisonnement est bâti autour de trois pôles : décentrement, pluralité et hiérarchie affaiblie ou reconfigurée. La pertinence du concept est testée en regard des rencontres interculturelles et de leurs significations. A partir d'observations historiques, sociologiques et philosophiques, le décloisonnement est rattaché à un cloisonnement initial dans un équilibre sous tension constante et nécessaire. Aux principes absolus du couple ouverture/fermeture est substitué le décloisonnement/cloisonnement. Les dynamiques étudiées sont inévitablement antagonistes et complémentaires. Les tensions, apories et contradictions rencontrées conduisent à l'élaboration d'une triple balance des concepts et aspects trans- inter- et multi- culturels. La triple balance pose la nécessité d'un équilibre entre la pluralité intérieure et la transculturalité dans une perspective de dialogues et de rencontres. La notion conclusive de proximétrie pose la recherche nécessaire d'une mesure des distances culturelles, d'où procède un art délicat du discernement d'un équilibre dans le décloisonnement culturel. / The concept of Dis-closure is based on a reflection on the complexity of cultural confrontations in an intercultural space. The study, development and discussion of the concept of Dis-closure stem from a genealogy of culture in the history of ideas, notably through the Sophists, Las Casas, Montaigne, Rousseau, Volney and Lévi-Strauss and by a historical analysis of the concepts of nomos, custom, and civilization. The Dis-closure is built around three poles: decentralization, plurality and hierarchy weakened or reconfigured. The relevance of the concept is tested in a selection of different cultural fields. On the basis of historical, sociological and philosophical observations, the Dis-closure is related to an initial partitioning in an equilibrium under constant and necessary tension. The absolute principles of Openness / Closeness are substituted with Dis-closure / Closure. The dynamics studied are inevitably antagonistic and complementary. The tensions, aporias and contradictions encountered lead to the development of a triple balance of trans-, Inter- and Multi-cultural poles. The triple balance raises the need for an equilibrum between inner plurality and transculturality in a perspective of dialogues and encounters. The conclusive notion of proximetry poses the necessary search for a measure of cultural distances, their degrees and qualities, from which proceeds a delicate art of discerning a balance in a cultural Dis-closed context.
