”Vad har du gjort på internet?” : Skolkuratorers erfarenheter av unga utsatta för sexuella övergrepp på internet / “What have you done on the internet?” : School counsellors’ experiences of young people exposed to sexual assault online

Vid frågor som rör barns utsatthet för sexuella övergrepp har internet fått en allt större roll där den omfattande teknikutvecklingen har lett till nya möjligheter för personer att ta kontakt med unga för sexuella ändamål. Syftet med denna studie var att undersöka skolkuratorers erfarenheter av att möta och arbeta med unga som utsatts eller riskerar att utsättas för sexuella övergrepp på nätet. Studiens empiri baseras på kvalitativa semistrukturerade intervjuer med sju skolkuratorer som arbetar på högstadium. Empirin analyserades med hjälp av en teoretisk referensram bestående av yrkeskompetens samt tidigare forskning. Resultatet visar att skolkuratorerna arbetar till med förebyggande insatser såsom kunskapsspridning och utbildning till både elever och föräldrar. Det framkommer dock att insatserna ter sig resultatlösa då alltfler elever blir utsatta och skolkuratorerna har inte har kunnat se några förändringar. För att fånga upp elever som blivit utsatta för nätövergrepp utgör relationen ett viktigt verktyg. När det gäller att stödja elever som blivit utsatta utförs arbetet vid misstanke eller när skolkuratorerna har fått kännedom om att en elev har blivit utsatt. En utmärkande utmaning är skolkuratorernas kunskapsbrist kring fenomenet som leder till svårigheter i det förebyggande, upptäckande och intervenerande arbetet. / The internet has gained an increasing role when it comes to issues regarding child sexual abuse, where the extensive technology development has led to new opportunities for people to contact young people for sexual purposes. The aim of this study was to investigate school counselors' experiences of meeting and working with young people who are exposed or at risk of being subjected to sexual abuse online. The empirical study is based on qualitative semi-structured interviews with seven school counselors’ working at high school. The empiric material was analyzed using a theoretical framework consisting of professional competence and previous research. The result shows that school counsellors’ work on preventive measures such as information work for both students and parents. However, it appears that the efforts seem futile as more students are being exposed and the school counsellors’ have not been able to see any changes. In order to capture students who have been subjected to sexual abuse online, the relationship is an important tool. When it comes to supporting students who have been exposed, the work is carried out on suspicion or when the school counsellors’ have become aware that a student has been exposed. A distinct challenge is the lack of knowledge about the phenomenon that leads to difficulties in preventive, spotting and intervening work.

The child's right against exploitation in the form of pornography on the Internet : a South African perspective

Thesis (LL.M.) -- University of Stellenbosch, 2001. / ENGLISH ABSTRACT: With the arrival of the Internet, the availability of pornography, and especially child pornography, has increased tremendously. This rapidly developing technological wonderworld has brought the dark syndicate of sexual exploitation of children to the living room of each home equipped with a computer. In South Africa the right of the child to not be sexually exploited or abused is enshrined in section 28 of the Constitution, 108 of 1996, as well as in several international documents. This thesis analyses the legislative framework in this regard and comes to the conclusion that South African legislation concerned shows much room for improvement. Legislation concerning sexual offences against children makes use of archaic terms that are outdated in the present context. It is also vague, inconsistent and provides insufficient protection to children in this regard. The sexual exploitation of children does not, despite promises made by the South African government in ratifying several international documents, receive high priority in the South African community. This finding is made in view of the examination of certain key concepts to the subject, international documents such as the United Nations Convention to the Rights of the Child, 1989, and the activities of international organisations combating the sexual exploitation of the child. An analysis of the manner in which countries such as the United States of America, Canada, the United Kingdom, Germany and Japan has implemented protection measures against this form of abuse, is also made. Proposals to increase the protection of children in South Africa are submitted in conclusion. Although this new domain needs urgent measures of regulation, it is not an impossible task to govern the Internet. Formulating comprehensive, consistent and effective legislation is a fundamental part in the battle against the sexual exploitation of children. The co-operation of all relevant sectors, including the government, the Internet industry and members of the community, however, remains essential. / AFRIKAANSE OPSOMMING: Die beskikbaarheid van pornografie, en veral kinderpornografie, het met die koms van die Internet onrusbarend toegeneem. Hierdie vinnig ontwikkelende tegnologiese wonderwereld het die seksuele eksploitasie van kinders vanuit die donker onderwereld na die voorkamer van elke huis met 'n rekenaar gebring. In Suid-Afrika word die reg van die kind om teen seksuele uitbuiting en mishandeling beskerm te word in artikel 28 van die Grondwet, 108 van 1996, asook verskeie internasionale dokumente verskans. Hierdie tesis ondersoek die wetgewende raamwerk rakende die groeiende probleem van seksuele eksploitasie op die Internet en vind dat Suid-Afrikaanse wetgewing in hierdie verband nog ver te kort skiet. Wetgewing met betrekking tot seksuele misdade teen kinders maak tans gebruik van arqaise terme wat glad nie meer in vandag se konteks relevant is nie. Dit is voorts ook onsamehangend, onduidelik en verskaf onvoeldoende beskerming aan kinders in hierdie verband. Ten spyte van beloftes deur die Suid-Afrikaanse regering, gemaak tydens die ratifisering van verskeie internasionale dokumente, geniet die aangeleentheid van beskerming van die kind teen seksuele uitbuiting op die Internet nog nie prioriteit in die Suid- Afrikaanse samelewing nie. Hierdie bevinding word gemaak in die lig van die bestudering van definisies van sekere kernbegrippe, internasionale dokumente soos die Verenigde Nasies se Konvensie van die Regte van die Kind, 1989, en die werksaamhede van internasionale organisasies bemoeid met die bekamping van seksuele eksploitasie van die kind. Daar word ook veral aandag gegee aan die wyse waarop lande soos die Verenigde State van Amerika, Kanada, die Verenigde Koninkryk, Duitsland en Japan te werk gegaan het om kinders in die onderskeie lande te beskerm. Voorstelle ten einde die beskerming van Suid-Afrikaanse kinders teen seksuele eksploitasie op die Internet te verbreed, word ter konklusie gegee. Alhoewel die nuwe terrein dringend regulering benodig, is dit nie In totaal onmoontlike taak om die Internet te kontroleer nie. Die formulering van omvattende, eenvormige en effektiewe wetgewing in die verband is In fundamentele proses in die stryd om kinders te beskerm. Die samewerking van relevante rolspelers en veral die regering, die Internet sektor en lede van die gemeenskap is egter van uiterste belang.

Análise dos riscos e efeitos nocivos do uso da internet: contribuições para uma política pública de proteção da criança e do adolescente na era digital / Analysis of the risks and harmful effects of internet use: contributions to public policy child protection and adolescents in the digital age

O uso da internet e jogos eletrônicos online, em desarmonia com as demais atividades humanas, independentemente do dispositivo tecnológico para acesso, pode se tornar um vício e produzir efeitos nocivos em vários aspectos da vida dos usuários, potencializados quando os usuários são crianças e adolescentes, pessoas em fase especial de desenvolvimento biopsicossocial. O foco da investigação em pauta foi a análise dos riscos e danos do vício em internet, pressupondo a proteção integral das crianças e dos adolescentes nos aspectos de educação, saúde e segurança. Para tanto, buscou-se referências teóricas em artigos científicos no âmbito mundial, evidências empíricas em pesquisas de campo com adolescentes e no Programa de Pais de Dependentes de Internet do Ambulatório de Transtorno de Impulso do Instituto de Psiquiatria da Universidade de São Paulo. Como as crianças e os adolescentes são sujeitos de direito, com prioridade absoluta de proteção, sentiu-se a necessidade de haver uma intervenção e, para isso, foram propostos conteúdos e metodologias de planejamento de políticas de prevenção a esses riscos e danos, elaborados de forma interinstitucional e interdisciplinar. O método científico utilizado foi o de pesquisa-ação política, socialmente crítica e intervencionista. Para fundamentação teórica, buscaram-se subsídios na análise crítica do determinismo tecnológico e dos riscos envolvidos com a concepção e uso das tecnologias de Feenberg (1991), Giddens (1991), Marcuse (1999), Lima Filho (2005), Setzer (2002), Armstrong e Casement (2001), Smith (2009), entre outros. O trabalho de pesquisa utilizou documentos de base legal, com amparo na Declaração Universal dos Direitos Humanos (1948), na Constituição da República Federativa do Brasil (1988) e no Estatuto da Criança e do Adolescente (1990), os quais priorizam, em termos absolutos, as crianças e os adolescentes na formulação e na gestão de políticas públicas para todas as esferas de execução. Nas fases de observação, diagnose e primeiros registros, a pesquisa partiu da preocupação sobre a fala dos adolescentes de duas escolas públicas de Curitiba, em 2009, quando o problema dessa tese foi delineado riscos e efeitos nocivos da adição à internet e em jogos eletrônicos online. Para a fase de intervenção da pesquisa foi elaborado um plano de ação com foco no eixo de “Tecnologia e Dignidade Humana”, desenvolvido durante as onze audiências públicas no Estado do Paraná, coordenadas pela autora, articuladas ao Projeto UFPR Unindo Talentos com apoio da CAPES, contemplando conteúdos estruturantes para elaboração de uma política pública de prevenção ao vício na internet e, sobretudo, da internet gaming disorder, distúrbio mental previsto pela Associação Americana de Psiquiatria na quinta edição do Diagnostical and Statistical Manual of Disorder (DSM V), de maio de 2013. Desse trabalho resultaram contribuições à elaboração do eixo “Tecnologia e Dignidade Humana” da primeira edição do Plano Estadual de Educação em Direitos Humanos do Paraná (PEEDH/PR). / The use of internet and on-line video games, in harmony with other human activities, irrespective of the technological device to access, can be addictive and cause adverse effects in various aspects of life of users, potentiated when the users are children and adolescents people in particular phase of biopsychosocial development. The focus of research on the agenda was the analysis of the risks and vice damage, assuming the full protection of children and adolescents in the aspects of education, health and security. Therefore, we sought theoretical references in scientific papers at the global level, empirical evidence on field research with adolescents, and internet Dependent Parent Program Dependence Center for the Impulse Disorder Clinic at the Institute of Psychiatry, University of São Paulo. As children and adolescents are subjects of rights, with priority protection, felt the need for an intervention, and for this have been proposed content and planning methodologies prevention policies to such risks and damage, prepared in inter-institutional and interdisciplinary way. The scientific method used was the policy action research, socially critical and interventionist. For theoretical foundation sought to subsidies in the critical analysis of technological determinism and the risks involved with the design and use of technologies Feenberg (1991), Giddens (1991), Marcuse (1999), Lima Filho (2004, 2005), Andrade (2004) Setzer (2002, 2009), Armstrong and Casement (2001), Smith (2009), among others. The research used a legal basis documents, with support in the Universal Declaration of Human Rights (1948), the Constitution of the Federative Republic of Brazil (1988) and the Statute of Children and Adolescents (1990), who prioritize in terms absolute, children and adolescents in the design and management of public policies for all enforcement spheres. In phases of observation, diagnosis and first records research came from concern about the speech of adolescents from two public schools in Curitiba, in 2009, when the problem of this thesis was designed, the risks and harmful effects of adding internet and electronic games on-line. For the research intervention phase was prepared an action plan in inter-institutional focused on the “Technology and Human Dignity” axis developed in the eleven public hearings in the State of Paraná, coordinated by the author, contemplating structuring content for development of policy public prevention addiction on the Internet, and especially the internet gaming disorder, mental disorder provided by the American Psychiatric Association in the fifth edition of Diagnostical and Statistical Manual of Disorder (DSM V), May 2013. This work resulted in important contributions to the development axis “Technology and Human Dignity” of the first edition of the State Plan for Education in Human Rights of Paraná (PEEDH / PR).
