Para isso, decidiu-se trabalhar com a tese do sociólogo Jessé Souza de que o Brasil teria vivido uma modernização seletiva, que ao importar as práticas modernas sem uma correspondente homogeneização das classes sociais, teria relegado pelo menos um terço da população à subcidadania. Após realizar uma análise crítica desta tese, confrontando-a ainda com o que seria, para o próprio Jessé Souza, o cânone tradicional de interpretação do Brasil, formado pelas obras de Sérgio Buarque de Holanda, Raymundo Faoro e Roberto DaMatta, procurou-se refletir sobre as repercussões da tese da modernização seletiva para o campo do direito. Sob a chave de que a cidadania, entendida como uma igual dignidade, é a próprio fundamento dos direitos, discutiu-se que a existência de uma subcidadania no Brasil deveria ser levada em conta pelo campo do direito, tanto para se problematizar a distância entre a positivação dos institutos e sua concretização como para promover uma abertura do direito às lutas por reconhecimento e cidadania / This dissertation aims to discuss the existence of a Brazilian undercitizenship and its impact on the field of law. With this intent, we decided to work with the sociologist Jessé Souza thesis that Brazil would have lived a selective modernization, that imported modern practices without a corresponding homogenization of social classes, would have relegated at least on third of the population to undercitizenship. After performing a critical analysis of this thesis, including confronting it with what would be, even for Jessé Souza, the traditional canon of interpretation of Brazil, formed by the works of Sérgio Buarque de Holanda, Raymundo Faoro and Roberto DaMatta, we reflect on the effects of selective modernization thesis to the field of law. Under the key of citizenship, understood as an equal dignity, is the very foundation of rights, we concluded that the existence of a undercitizenship in Brazil should be taken into account by the law field, both to problematize the distance between the positive law and its realization as to promote an entitlement to struggles for recognition and citizenship.

[pt] A tese lida com escritos do século XX agrupados pela designação interpretações do Brasil , focando-se nos usos do conceito de formação nesses textos. Identifiquei cinco traços expostos nesses usos: (1) a centralidade da nação; (2) a incompletude da transição da condição colonial para a condição moderna; (3) a desigualdade interna no país; (4) a mobilização de parâmetros externos na definição do Brasil; e (5) o foco nas especificidades do processo formativo brasileiro. Esses cinco traços são comuns a todos os textos selecionados; no entanto, eles se expressam de maneiras diferentes de acordo com cada texto. A Parte I destaca a recorrência do conceito de formação nas interpretações do Brasil (capítulo 2); depois disso, expõe linhas gerais da perspectiva a partir da qual os usos de formação serão interpretados (capítulo 3). A Parte II (capítulos 4-12) se dedica à interpretação dos textos selecionados, com foco nos usos do conceito de formação e nos traços mencionados antes. A Parte III começa com uma controvérsia ocorrida principalmente no final dos anos 1980 e que se mostra expressiva de muitos aspectos levantadas na Parte II (capítulo 13); em seguida, abordo três intérpretes do Brasil que têm avançado, de formas diferentes, abordagens similares à que desenvolvo no final da tese; isto é, buscam uma interpretação alternativa da formação do Brasil contemporâneo (capítulos 14-16). Finalmente, a Parte IV parte da discussão precedente, a fim de refletir sobre os cinco traços de formação nas interpretações do Brasil , teorizando a partir de certo lugar. / [en] The dissertation deals with writings from the XX century grouped under the notion of interpretations of Brazil , focusing on their uses of the concept of formation . I have identified five traces exposed in those uses: (1) the centrality of the nation; (2) the incompleteness of the transition from the colonial to the modern condition, marking a coexistence of the old and the new; (3) the internal inequality within the country; (4) the mobilization of external parameters in the definition of Brazil; and (5) the focus on the specificities of Brazilian formative process. These five traces are shared by all the texts selected; but, at the same time, they are expressed in different ways according to each text. Part I stresses the recurrence of the concept of formation in the interpretations of Brazil (chapter 2); after that, it lays out general lines of the perspective from which the uses of formation will be interpreted in the texts selected (chapter 3). Part II (chapters 4-12) is devoted to the interpretations of the texts, focusing on the uses of formation and those five traces previously mentioned. Part III begins with a controversy that took place mainly in the late 1980s and that is expressive of many aspects raised in Part II (chapter 13); then, it tackles three interpreters of Brazil that have advanced, in different ways, efforts similar to the one I will embrace myself in the last part of the text, that is, an alternative interpretation of the formation of contemporary Brazil from some kind of engagement with previous interpretations of Brazil (chapters 14-16). Finally, Part IV (chapter 17) builds on the previous discussion, in order to reflect upon, or theorize from, the five traces of formation in the interpretations of Brazil .

O mais extenso é o livro Brazil (1962), escrito sob encomenda dos editores da revista Life. O livro foi renegado pela autora, inconformada com as intervenções dos editores, e publicado sob coautoria. O cotejo entre os originais (preservados nos arquivos de Bishop, no Vassar College), o texto publicado em 1962 e as anotações da autora em seu exemplar (preservado na Harvard University) permite apontar as similaridades e, especialmente, os importantes contrastes entre a perspectiva de Bishop e a dos editores. Uma investigação sobre o momento em que o livro surgiu na vida da autora e na história do Brasil e dos Estados Unidos auxilia a compreensão não só do texto, mas também de sua escrita e dos episódios associados à sua edição. Her largest piece is a book called Brazil (1962) which was commissioned by the editors of Life magazine. However, the book was rejected by the author who refused to accept the interventions made by the editors. As a result, they co-authored it. Comparing the original (preserved in the Bishop archives at Vassar College) with the published text allows us to compare two different views of Brazil, to highlight similarities and especially the important contrasts between them. A research on the period the book was published focused on the author\'s life, as well as on the history of both Brazil and the U.S.A. helps to understand not only the text itself, but also how it was written and the episodes associated to its edition. The present work includes five additional texts, remains of a project that was abandoned by Bishop: the making of another book on Brazil. Two of these texts have remained unpublished to date, even in English.
