Face à la multiplication des détours participatifs dans la conduite des politiques publiques, il est important de s’interroger sur la capacité de la démocratie participative à constituer un facteur de la mutation de l’action publique locale. Cette réflexion s’est longtemps incarnée dans des positions critiques interprétant son développement comme une imposture destinée à jeter un voile démocratique sur des procédures toujours aussi opaques et sclérosées ainsi que dans des postures normatives cherchant à promouvoir une forme d’engagement civique idéelle et authentique. Notre étude se propose quant à elle d’enrichir une approche pragmatiste visant à déterminer les conditions réelles de sa mise en œuvre et ses effets concrets. Ce travail est mené, afin de mieux rendre compte de l’hétérogénéité des logiques et des pratiques participatives, sur une analyse comparée de plusieurs dispositifs, à l’échelle de la ville de Nancy et du département de Meurthe-et-Moselle. Dans ce cadre, nous avons pu observer un phénomène d’institutionnalisation de la participation citoyenne au sein des collectivités locales. Les conditions de l’émergence d’une norme participative guidant l’action publique paraissent cependant indiquer une certaine retenue, caractérisée par la restriction du champ d’application des procédures participatives ou des savoirs citoyens mobilisés. Les effets provoqués par l’application de la norme participative sur l’espace public local ne manquent pas de susciter de nombreuses interrogations. Les dispositifs étudiés semblent très éloignés des cadres théoriques délibératifs et participatifs. Le défaut d’inclusion, de même que la persistance de logiques de politisation propres au système représentatif interrogent sur la capacité de la démocratie participative à relever les défis qu’elle se propose de surmonter. / In front of the multiplication of the participative bends in the management of public policies, it is crucial to wonder about the capacity of participative democracy to constitute an element of the mutation of local politics. This reflection collided for a long time with critical positions interpreting its developement as an imposture intended to throw a democratic veil on procedures still so opaque and calcified as well as in normative postures trying to promote a shape of civic commitment pure and authentic. Our study proposes to enrich a pragmatic approach to determine the real conditions of its implementation and its concrete effects. This work is led, to report better the heterogeneousness of the participative logics and practices, on a comparative analysis of several devices, on the scale of the city of Nancy and the departement of Meurthe-et-Moselle. In this framework, we were able to observe a phenomenon of institutionalization of the citizen participation within local authorities. The conditions of the emergence of a participation standard guiding public action however appear to indicate a certain restraint, characterized by the limitation of the field of application of the participative procedures or of the kind of citizens knowledges mobilized. The effects provoked by the application of the participative standard on the local public space also raise numerous ambiguities. The studied devices seem very remote from deliberative and participative theoretical frames. Also, the lake of inclusion as well as the obstinacy of logics of politicization appropriate for the representative system questions about the capacity of the participative democracy to meet the challenges which she suggests nevertheless surmounting.

Mock audition som pedagogiskt verktyg : Hur man som orkestermusiker ska förhålla sig till en jury vid en provspelning

I detta arbete har jag utforskat hur mock auditon kan användas som pedagogiskt verktyg särskilt som förberedelse inför en symfoniorkesterprovspelning. Jag valde ut 13 av de vanligaste orkesterutdragen för tuba och höll en mock auditon för en jury representativ för en symfoniorkesterprovspelning. Jag sammanställde deras kritik för varje utdrag och skapade övningsmetoder utefter det. Efter det höll jag en andra mock audition med samma jury.   Jag kommer fram till att det inte är möjligt att tillfredsställa alla i en jury musikaliskt men det finns aspekter som de flesta professionella orkestermusiker är överens om. Följer man notbilden noggrant och är övertygande i sin egen musikaliska tolkning ökar chansen för positivt utfall. En annan slutsats jag drar är att mock audition är ett väldigt bra pedagogiskt verktyg och att arbetsmetoden ger en tydlig struktur för instudering av orkesterutdrag och bidrar till personlig utveckling i att ta kritik på ett bra sätt och kunna omvandla det till något praktiskt. / <p>Den klingande delen av arbetet utgörs av följande inspelningar: inspelning av mock audition nr. 2 första rundan och inspelning av mock audition nr. 2 andra rundan. Theoretical and Legal Analysis of Lay Element in Judiciary Abstract This work is dealing with the lay element in judiciary. The main emphasis in laid on the institute of lay judges in the Czech legal order. The main goal of the work is to answer the questions whether the lay element in judiciary is still a democratizing component, further if there are fulfilled enough the constitutional conditions of an independent, impartial and statutory judge principle in case of lay judges, whether the democratic or the expert legitimacy may prevail and at last, if the lay element should be preserved in the Czech legal order. In the first chapter, there is described a historical development of the lay element in judiciary. In modern times, it has appeared firstly in the form of jury courts in the Czech lands, more precisely in the Austrian monarchy, after the revolutionary year 1848. Its functioning is illustrated on two famous cases, which were the process with K. H. Borovský and with Leopold Hilsner. On the one hand, these cases show the advantage of participation of lay people into judiciary, as it can serve as correction of the state's despotism. Factors Influencing Juror Decision Making In Criminal Trials Involving Recovered Memory Of Childhood Sexual Abuse

The current study examined the impact of expert witness orientation (researcher or clinical practitioner) and type of testimony (testimony for the prosecution, for the defense, for both prosecution and defense, and no testimony) on mock jurors‟ decisions in a sexual abuse trial. Participants read a summary of a sexual abuse criminal trial based on recovered memory; the summary included expert witness testimony (varied across participants based on the conditions described above). Participants then completed a juror decision making task. Results showed that expert witness testimony provided by a researcher did not impact mock jurors‟ guilt ratings any differently than the expert witness testimony provided by a clinical practitioner. However, type of testimony had a significant effect on jurors‟ guilt ratings. The prosecution witness expert testimony influenced mock jurors‟ decision in favor of the prosecution and testimony by a defense expert influenced the jurors‟ decisions in favor of the defense.

Sexual Harassment Of Women in the United States Military: Juror Decisions of Reserve Officer Training Corps (ROTC) and Civilian College Students

The present research examined the influence of military status, organizational climate type, gender, and attitudes toward sexual harassment on juror decisions in a sexual harassment trial. Military participants rated themselves as having more stereotypical masculine characteristics and they rated sexual harassment allegations more seriously. The permissive climate type elicited less serious allegation ratings. Females rated all climates as more permissive, found the defendant more liable, and chose more severe punishments. Tolerant attitudes toward sexual harassment predicted juror decisions for both ROTC and civilian mock jurors. The results highlight the need for further education about sexual harassment to reduce tolerant attitudes and permissive organizational climates, and to increase fairness in harassment trials.

Political Economy of Committee Voting and Its Application

This dissertation consists of three essays on information aggregation in committees and its application. The first essay analyzes how the distribution of votes affects the accuracy of group decisions. In a weighted voting system, votes are typically assigned based on the criteria that are unrelated to the voters’ ability to make a correct judgment. I introduce an information aggregation model in which voters are identical except for voting shares. If the information is free, the optimal weight distribution is equal weighting. When acquiring information is costly, by contrast, I show that the accuracy of group decisions may be higher under some weighted majority rules than under unweighted majority rule. I characterize the equilibrium and find the optimal weight distribution to maximize the accuracy of group decisions. Asymmetric weight distributions may be optimal when the cost of improving signal is moderately high. The second essay analyzes how intergenerational family transfers can be sustained. Why are generous transfers from the younger to the older generations made in some families and not in others? My paper argues that differences in intergenerational dependence are due to variation in community networks. My analysis of the sustainability of intergenerational transfers posits game theoretical models of overlapping generations in which breadwinners make transfers to their parents and children. A novel feature of my models is that there is a local community that may supply information about its members past behaviors. I demonstrate that an efficient level of intergenerational transfers can be sustained if neighbors gossip about each other. The third essay, co-authored with Fuhito Kojima, investigates a jury decision when hung juries and retrials are possible. When jurors in subsequent trials know that previous trials resulted in hung juries, informative voting can be an equilibrium if and only if the accuracy of signals for innocence and guilt are exactly identical. Moreover, if jurors are informed of numerical split of votes in previous trials, informative voting is not an equilibrium regardless of signal accuracy. / Government
