Para tanto, tentar-se-á redescobrir o papel do jurisprudencialismo a partir da predominância do que denominaremos princípio geral de inclusão, em contraposição à ideia sedimentada de que a função do Direito seja primordialmente funcionar como uma máquina de seleção e preservação de formas de vida previamente determinadas por um grupo de atores políticos. Com isso, fixaremos o papel da jurisdição constitucional na adjudicação de direitos às minorias como medida de integridade em uma comunidade política formada por parceiros livres e iguais. Por fim, tentaremos utilizar o material teórico assim construído para interpretar a decisão do Supremo Tribunal Federal no julgamento da ADI 4.277, que reconheceu a união formada por casais do mesmo sexo como entidade familiar. _______________________________________________________________________________________ ABSTRACT / This work seeks to consolidate the basis for a possible ontology in the interpretation of the modern legal tools according to the demands of a post-metaphysical world. In order to achieve that, a new role for jurisprudence will be found, based on the predominance of what we will call the general principle of inclusion, in contrast to the consolidated idea that the main function of the Law is to work as a machine for the selection and preservation of forms of life previously determined by a group of political actors. After that, we will fix the role of the constitutional jurisdiction in the adjudication of right to the minorities as a measure of integrity in a political community formed by free and equal partners. In the end, this so built theoretical tools will be used to interpret the Supreme Federal Court´s opinion in the trial of the ADI 4.277, in which the union formed by same sex couples was recognized as a family entity.

Previous issue date: 2017-04-24 / The New Civil Procedure Code (Law nº 13.105, of March 16th, 2015) appears to some theorists, as an important solution in the judicial process, to the instability resulting from the exegetical controversies on tax regulations. Some processualists present the prescription of art. 927 of the New Civil Procedure Code, as a legal and procedural manner that can promote uniformity of interpretation, because it requires that judges and courts to comply with the decisions of the Superior Courts. Constitutional rule of tax jurisdiction arises as definition and interpretation vector of legal precedent on tax matters, because according to the National Constitution of 1988, which articulates a kind of Brazilian constitutional system of skills, there is a set of constitutional rules governing the distribution of tax revenues (arts. 145, 148, 149, 149-A, 153, 154, 155, 156 and 195) with the allocation of administrative and legislative powers (arts. 21, 22, 23, 24, 25, 30 and 32). This correlation is important because of regulatory innovations introduced by the New Civil Procedure Code, in particular the impacts of the prescription of art. 927, according to which judges and courts will abide by the decisions of the Supreme Court in concentrated control of constitutionality, the statements of binding precedent, the judgments on competence-taking incident or resolution of repetitive demands and trial of extraordinary resources and special repetitive utterances of the precedents of the Supreme Court in constitutional matters and the Superior Court of Justice in infra matter and the orientation of the plenary or special body to which they are linked. The objective of this study is to demonstrate that you can only set a legal precedent in tax matters, from which prescribes the art. 927 of the New Civil Procedure Code, if the court has, according to the Republican Constitution, the power to decide, ultimately, the legal and tax matters discussed in concrete case, object of the tax process / O Novo Código de Processo Civil (Lei nº 13.105, de 16 de março de 2015) apresenta-se, para alguns teóricos, como uma importante solução, no âmbito do processo judicial, à instabilidade decorrente das controvérsias exegéticas sobre as normas tributárias. Alguns processualistas apresentam a prescrição do art. 927 do Novo Código de Processo Civil, como uma forma jurídico-processual que pode promover a uniformidade interpretativa, porque obriga que juízes e tribunais observem as decisões das Cortes Superiores. Norma constitucional de competência tributária surge como vetor de definição e interpretação do precedente judicial em matéria tributária, porque segundo a Constituição Nacional de 1988, que articula uma espécie de sistema constitucional brasileiro de competências, há um conjunto de regras constitucionais de distribuição de rendas tributárias (arts. 145, 148, 149, 149-A, 153, 154, 155, 156 e 195) com a repartição de competências administrativa e legislativa (arts. 21, 22, 23, 24, 25, 30 e 32). Essa correlação é importante porque das inovações normativas introduzidas pelo Novo Código de Processo Civil, em especial os impactos decorrentes da prescrição do art. 927, segundo o qual os juízes e os tribunais observarão as decisões do Supremo Tribunal Federal em controle concentrado de constitucionalidade, os enunciados de súmula vinculante, os acórdãos em incidente de assunção de competência ou de resolução de demandas repetitivas e em julgamento de recursos extraordinário e especial repetitivos, os enunciados das súmulas do Supremo Tribunal Federal em matéria constitucional e do Superior Tribunal de Justiça em matéria infraconstitucional e a orientação do plenário ou do órgão especial aos quais estiverem vinculados. Previous issue date: 2005-11-28 / This paper deals with the principle of the appellate jurisdiction, and attempts to
construe it from the perspective of the 1988 Federal Constitution, offering as well a critique of
recent changes introduced in the Procedural Civil Law Code by statute number 10.352 of
December 26th, 2001, specially the ones made in articles 475 and 515.
The reason for the choice of the current subject was influenced by the study of
Procedural Constitutional Law, which led to an even deeper analysis whose conclusions
encompass both Constitutional and Procedural Law. It was precisely the possibility of this
remarkably updated interdisciplinary study that made this paper possible.
Discussing the full implication and outreach of the appellate jurisdiction principle
means to question the very behavior of the State, under the rule of law, in relation to its
citizens since such a right prevents them from State arbitrary power and enables the revision
and adjudication by a higher court of any matter that has been tried in a court of original
jurisdiction. Needless to say that the State is well-known for being the most encompassing
defendant in the country.
The restrictions brought about on the principle of the appellate jurisdiction by the new
statute rekindle the old-time debate, which has inflamed so many scholars around the world,
over how to reconcile judicial predictability and procedural celerity, which aims at an
effective judicial protection.
In order to properly answer whether the changes brought about by statute 10.352/01
are constitutional or not, it was necessary to follow a long path of document and bibliography
research which included the study of principles in general, above all the constitutional
principles with special focus on the definition and outreach of the appellate jurisdiction
principle. It also involved analyzing and establishing relationship between that principle and
the existing Appeals, as well as the constitutional exam of the mandatory review law, its legal
exceptions that represent a limit or a suppression of the aforementioned guarantee.
Based on this study we came to the conclusion that the command of the article 515, #
3rd of the statute 10.352/01, as well as the mandatory review law are unconstitutional.
Although following different way of reasoning, we based both conclusions on the unshakable
grounds of the Major Law. / Tratamos no presente trabalho do princípio do duplo grau de jurisdição, procurando
compreendê-lo à luz da Constituição Federal de 1988 para, em seguida, promover uma análise
crítica sobre a constitucionalidade das recentes reformas introduzidas pela Lei 10.352, de 26
de dezembro de 2001, no Código de Processo Civil, especialmente as que se operaram nos
artigos 475 e 515.
A escolha do tema sofreu os influxos dos estudos desenvolvidos em Direito
Processual Constitucional, propiciando o aprofundamento de matéria que interessa tanto ao
Direito Constitucional quanto ao Direito Processual. Foi justamente a possibilidade desse
estudo interdisciplinar, notadamente atual e relevante, que motivou a elaboração do presente
trabalho.
Discutir a garantia do duplo grau de jurisdição, sobretudo seu alcance e sua inserção
constitucional, implica questionar as próprias ações do Estado em relação aos jurisdicionados,
no âmbito de um Estado Democrático e de Direito, já que tal garantia viabiliza o reexame de
decisões judiciais, inclusive, contra arbitrariedades do Poder Público, o qual, aliás, é
reconhecidamente o maior litigante habitual dos processos judiciais em trâmite no nosso País.
As limitações trazidas pela nova lei ao duplo grau de jurisdição reabrem nova
discussão sobre a antiga polêmica de como conciliar segurança jurídica e celeridade
processual, com vistas à obtenção de uma tutela jurisdicional efetiva, da qual vêm se
ocupando processualistas de todo o mundo.
Para responder à indagação sobre a constitucionalidade ou não das alterações
anteriormente mencionadas, foi necessário percorrer um longo trajeto, que exigiu o
desenvolvimento de pesquisa documental e bibliográfica envolvendo o estudo dos princípios,
em particular, dos princípios constitucionais, a compreensão do princípio do duplo grau de
jurisdição, sua definição e alcance, bem como suas relações com outros importantes
princípios previstos expressamente na Constituição Federal em vigor. Foi necessário, ainda,
estabelecer as ligações entre o princípio do duplo grau e os recursos previstos no ordenamento
pátrio e daquele com o instituto do reexame obrigatório, analisando-se, outrossim, do ponto
de vista constitucional, as exceções dispostas em lei que limitam ou suprimem a garantia em
tela.
A partir do estudo desenvolvido, pôde-se concluir pela inconstitucionalidade da nova
regra constante do parágrafo terceiro do artigo 515, bem como pela inconstitucionalidade da
remessa necessária, por fundamentos diversos, porém seguramente construídos com amparo
na Lei Maior.

Previous issue date: 2018-02-26 / One of the subjects with few studies, but that represents one of the foundations of the Law,
is the jurisdiction. Its historical origin is intrinsically related to the evolution of society, and
the practical purpose of discussing this interesting institute is to understand the growing
search for alterative solutions to conflicts. It couldn’t be ignored, in a discourse on
jurisdiction, the concept of the State, from its formation, to the most recent three Powers
theory, and the system of checks and balances inserted in the Federal Constitution. On the
other hand, the Judiciary is a clearer and more evident manifestation of the jurisdiction
practical application, and its concept and characteristics, the extension and, finally, the limits
of jurisdiction are extracted. Once composed of a solid scientific substrate, we present the
didactic classification currently accepted and well accepted by most of the doctrine, closing
the first stage of this paper. The static scenario, from this point onwards, is the subject of
provocations, in which obstacles as exceptions to the inafasability of jurisdiction, notably by
the presentation of alternative methods of conflict resolution, ilustrates the current needs of
a dynamic, complex and constantly changing society. Increasingly, there is the presence of
private nature entities in conflict resolution, including through international cooperation
among countries. Arbitration is the most classic example of an alternative method of conflict
resolution, whose performance and participation of private entities is a result of the
strengthening of the expression of will in clauses and contracts more prestigiously designed
to the autonomy of the parties. The Sport Court, in its turn, although autonomous and
independent, maintains certain influence of the State due to its traces of public, social law.
And article 217, especially §§ 1 and 2, could have extended these characteristics if the text
had clearly restricted the matter to be known by the Judiciary, in order to confer greater
permanence to the decisions rendered by the Courts of Sports Justice. Although a long way
to go, the study that we propose come from premises seen and recognized by the various
branches of law, in order to establish a reasoning that leads to a proposal of repositioning
the jurisdiction and, consequently, the Sports Court. Comparative analysis, similarity of
some procedural aspects, applicable principles and decisions in the field of Arbitration and
Sports Justice undoubtedly depict a fertile substratum for legal constructions, a challenge
that we intend to follow and overcome / Um dos temas pouco estudados, mas que representa um dos alicerces do Direito, é o da
jurisdição. Sua origem histórica está intrinsecamente relacionada à evolução da sociedade,
e a finalidade prática de discorrer sobre este interessante instituto é compreender a
crescente busca por soluções alterativas de conflitos. Não se poderia deixar de lado, em
um discurso sobre jurisdição, o conceito de Estado, desde a sua formação, até a mais
recente teoria dos três Poderes, do sistema de freios e contrapesos inserido na Constituição
Federal. Já adentrando em aspectos mais específicos, apresenta-se o Poder Judiciário
como manifestação mais clara e evidente da aplicação prática da jurisdição, extraindo-se,
a partir daí seu conceito e características, a extensão e, por fim, os limites da jurisdição.
Uma vez composto um sólido substrato científico, apresenta-se a classificação didática
atualmente recepcionada e bem aceita pela maior parte da doutrina, fechando a primeira
etapa deste trabalho. O cenário estático, deste ponto em diante, é objeto de provocações,
em que obstáculos como exceções à inafastabilidade da jurisdição, notadamente pela
apresentação de métodos alternativos de solução de conflitos, retratam as necessidades
atuais de uma sociedade dinâmica, complexa e em constante modificação. É cada vez mais
presente a atuação de entidades de natureza privada na solução de conflitos, inclusive
mediante cooperação internacional entre países. A Arbitragem é o mais clássico exemplo
de método alternativo de solução de conflitos, cuja atuação e participação de entidades de
natureza privada é fruto do fortalecimento da manifestação de vontade em cláusulas e
contratos arquitetados com maior prestígio à autonomia das partes. A Justiça Desportiva,
de seu turno, embora autônoma e independente, mantém certa influência do Estado em
razão de seus traços de direito público, social. E o artigo 217, notadamente os §§ 1 e 2º,
poderia ter alargado estas características se a redação houvesse restringido com clareza a
matéria a ser conhecida pelo Judiciário, de modo a conferir maior definitividade às decisões
proferidas pelos Tribunais de Justiça Desportiva. Ainda que longo caminho a ser percorrido,
o estudo que se propõe parte de premissas vistas e reconhecidas pelos diversos ramos do
direito, de sorte a erigir um raciocínio que leve a uma proposta de reposicionamento da
jurisdição e, consequentemente, da Justiça Desportiva. Análises comparativas, semelhança
de alguns aspectos procedimentais, princípios aplicáveis e decisões no âmbito da
Arbitragem e Justiça Desportiva sem dúvida retratam substrato fértil para construções
jurídicas, desafio este que pretende-se percorrer e suplantar

Verte-se nova luz a respeito de vários temas, introduzindo-se novidades que reverberam
profundamente no estudo analítico do direito processual. É preciso levar em consideração as
influências do neoconstitucionalismo e do marco cooperativo do processo para uma profunda
compreensão no tema das provas. Este estudo se debruça sobre a produção, o controle e a
valoração das provas técnicas e científicas. É indispensável compreender o direito à prova
como direito fundamental. Nesta medida, a prova é ato do processo, tendo como destinatários
todos os sujeitos do processo. O problema das provas que exigem um conhecimento
especializado é exatamente a necessidade de aportar um conhecimento especializado,
indisponível aos demais sujeitos processuais, de difícil controle e avaliação. É preciso remeter
à ordem jurídica estadunidense para compreender como as influências do sistema adversarial
proporcionaram o surgimento de um complexo sistema de controle da prova técnica e
científica. A solução para a questão não é fácil, mormente porque envolve a participação das
partes, do magistrado e do experto em cooperação. A aplicação de conhecimentos científicos
na produção da prova exige cuidado especial tanto na escolha do expert quanto no controle de
sua atuação. Não basta ao juiz valorar o resultado da prova científica, é imperioso que
fiscalize também sua produção, em constante diálogo com partes e auxiliares. Inseridos em
um ambiente cooperativo e de amplo debate, o dever de fundamentação imposto tanto ao
perito quanto ao magistrado é instrumento de controle da prova. É preciso reforçar o diálogo
processual e os critérios de controle da produção da prova técnica e científica em seus três
principais momentos: prévio, concomitante e posterior a sua produção. / The new Civil Procedure Code represents a paradigm shift in the study of the subject. It sheds
new understanding on various topics, introducing new developments that reverberate deeply
in the analytical study of procedural law. It is needed to take into account the influences of
neoconstitutionalism and cooperative process framework for a deep understanding of the
subject of evidence. This study focuses on the production control and evaluation of the
technical and scientific evidence. It is essential to understand the right to prove as a
fundamental right. To this extent, to understand the proof as a procedure's act, addressed to all
the plaintiffs in the process. The problem of those evidences that require specialized
knowledge is exactly the need of introducing specialized knowledge unavailable to other
procedural actors, difficult to control and evaluate. It must refer to the US legal system, to
understand how the influences of the adversarial system provided the emergence of a complex
control system of technical and scientific evidence. The solution to the question is not easy,
especially because it involves the participation of the parties, the judge and the expert in
cooperation. The application of scientific knowledge in the production of evidence, required
to elucidate many of the subjects matters of judicial consideration, requiring special care in
the choice of the expert witness and in control of its operations. It is not enough to the judge
to value the result of scientific proof, it is imperative to also oversee production, in constant
dialogue with the parties and process aids. Inserted into a cooperative and broad debate
environment, the duty to state reasons are evidence control instruments. We must strengthen
the procedural dialogue and control the criteria of the technique of evidence and scientific in
its three main stages: prior, concurrent and subsequent to its production.
