A critical review of issues in applying restorative justice principles and practices to cases of hate crimeKelly, Terri Lee 01 January 2002 (has links)
A restorative approach to justice focuses on accountability for healing the harm done to victims and communities as a result of criminal acts. Hate crimes are intended to send a threatening message to a particular group of people. There is enough reliable research on restorative justice principles and practices, and on the causes, meaning and impact of hate crimes, to bring together a representative selection of available literature for a critical review. This thesis critically reviews the literature of restorative justice principles and practices, and the literature of hate crime causes, definitions, laws, and typologies of offenders, using as a model Comstock's seven-step Critical Research Method. Findings suggest that congruencies between the two fields of study are primarily found in how activities appropriated to define the fields have increased the ambiguity of the definitions. Further findings suggest that there are important underlying issues of class and power distribution in need of attention in both fields of research. These findings are discussed and suggestions are made for future areas of research.

Abstract:
Among public tax authorities, in addition to economic booming, the work
performance of tax collector is the major point of deciding the variation of tax collection. Whether a tax collector shows his organizational citizenship behavior is the key resource of edge in public organizational competition. The effect on the members¡¦ metal sense and their own working attitudes enable the encouragement of these members¡¦ organizational citizenship behavior to render the first business of managers. Many studies discover that a tax collector acknowledges the organizational justice can influence both individual and organizational results, as well as the performance of the trust in their superiors and colleagues or organizational citizenship behavior.
This research probes into related document, and construes a tax collector¡¦s mental sense with organizational justice to construct a theoretical model with the research ideas, such as trust and organizational citizenship behavior, taking Ministry of Finance, National Tax Bureau of Kaohsiung City as research subjects, furthermore to take organizational equity (including distributional equity, procedure equity) as self-variable item, trust (including trust to superior and colleagues) as intermediary variation, organizational citizenship behavior (including justice, helping colleagues, no producing quarrels or pursuit of fame, obey the rule and solid, identifying the organizations) as variable item to discuss the correlation and effect among individual tendency variation, organizational justice, trust and organizational citizenship behavior in order to offer references for public resource development, and further upgrade the service efficiency of public servants. This research has handed out 707 questionnaires with 415 effective copies, and through the statistical analysis, such as Independent test, One-way ANVOVA, Person Correlation Analysis, and Hierarchical Multiple Regression , we get the significant discoveries as follows:
1. It presents a direct relation and influence on each dimension of organizational equity, trust and organizational civil behavior.
2. Public servant¡¦s characteristics, such as sex, marriage, age, seniority, and education degree and director levels, influence obviously distributional justice of organizational justice, procedural justice, trust and organizational civil behavior.
3. Through level multiple regression analysis, trust holds a media relation toward organizational justice and organizational civil behavior, that is, the organizational justice factor indeed influences organizational civil behavior through the intermediary of trust.
Based on reality prove that when a public servant put more emphasis on a tax collector and reaches a status of fair distribution, a tax collector senses the trust toward public institute and furthermore perform organizational civil behavior. This research suggests to enhance the interaction between directors and employees, establish effective questioning authority system, value on just promotional and rewarding systems, advocate the achievement evaluation of interactive fair OCB (Organizational Civil Behavior), etc.

Pursuing justice in post conflict situations in AfricaNdirangu, Stella Wambui January 2013 (has links)
Post conflict justice is a concept that has in the last two decades gained notoriety and support across the world. The commitment by states to fight impunity by embracing accountability measures has increasingly gained support. This however, was not always the case. Before the 1980s the approach by most of the world was to turn a blind eye to serious violations committed during wars, insurgencies and serious conflict. This was done in the name of respecting state sovereignty, where other states were required to respect the conflict state by not intervening irrespective of egregious violations being committed to mankind. The tide eventually changed and many states have adopted numerous instruments as a sign of their commitment to fight impunity and bring accountability to the perpetrators of serious conflict. African states embraced this development, in 1998 during the Rome conference where the Rome Statute for the International Criminal Court was adopted. African states participated in large numbers during the negotiations. Subsequently, African states signed and adopted the Statute overwhelmingly. To date, 33 African States have ratified the Rome Statute making Africa the most represented region in the Rome Statute system. With Africa's share of countless conflicts, where serious human rights violations have been violated, post conflict justice is increasingly a reality in Africa. The application of post conflict justice is an emerging and ever evolving field in Africa. The implementation of post conflict justice has been the center of contested debates. These debates have in the recent past become more pronounced especially where international intervention has been applied in assisting African post conflict societies to deal with the past and bring accountability. The impact that the accountability mechanisms play in restoring a post conflict society has been overshadowed by these debates. This study therefore seeks to provide a balanced discussion on the role that the accountability mechanisms can play in African post conflict societies. The study gives an overview of the evolution of post conflict justice and also looks into the different post conflict justice approaches adopted by African countries and their potential role in accountability and societal healing. The empirical cases of South Africa and Kenya are analysed in the study as practical examples of the application of post conflict justice approaches. The impact of the accountability mechanisms adopted is also discussed. The unique role that the African Union plays in fighting impunity in the continent is also discussed and the impact of positions taken by the continental body on accountability in post conflict countries is analysed. In the end the study seeks to establish the growing pattern in Africa in dealing with post conflict situations and recommendations are made in the final chapter on how to improve the general approach by Africa to eradicate the culture of impunity for serious crimes committed in the continent.

The thesis also analyzes the economic aspects of selected projects as well as discusses the technological aspects of some technologically advanced projects. On the basis of the analysis of present situation and description of e-Justice issues the contribution of this process for the Czech judiciary system as well as the public government or private persons will be described. The main contribution of this thesis is to objectively evaluate the effects of judiciary digitization for the Czech public administration information systems and related areas.
