O menor abandonado e delinquente em Sergipe : da instrução ao cárcere (1942 - 1974)

This dissertation was a research subject and the waif delinquent Sergipe period 1942-1974. It is a historical survey of bibliographical and documentary approach to the Cultural History. The overall goal was to analyze how the authorities dealt with the problem of homeless children and delinquent. The time frame is associated with the creation of the first public institution to host sergipana offenders and abandoned children, called the City of Minors Getúlio Vargas, which ran from 1942, the year of its inauguration in 1974, when it closed its doors after a crisis in the system welfare of minors. In the first section, i worked the representations of the lowest in the nineteen hundreds, the current legislation, the relationship of education, discipline and moral criminology child. In the second section, i presented the relationship of Social Assistance and the judiciary in the face of the problem smaller, the importance of education and education to work for the rehabilitation of the minor, the origin and the end of the Lower City of Sergipe; analysis of its resemblance to the models in which it was inspired , the problem of lower Sergipe, taking into account the judicial referrals: from education to prison, the House of Girls Santa Inês, as an institution to house abandoned girls in Sergipe and configuration of minors from legal proceedings; documents and newsletters individual judiciary, besides interviews with people who were part of the City of Minors Getúlio Vargas . Adopted as main concepts: "abandoned" (PEREIRA, 1994 and VEIGA and FARIA FILHO, 1999); "delinquent" (RIZZINI, 1995 and VEIGA and FARIA FILHO, 1999),"education" (DURKHEIM, 1978 and JINZENJI, 2010); statement (JINZENJI, 2010) and "minor" (RIZZINI, 2010; PERES, 2002 and VEIGA and FARIA FILHO, 1999). So with this research, i intend to contribute to the historiography sergipana about the history of education of homeless children and delinquent in Sergipe. / Esta dissertação teve como objeto de pesquisa o menor abandonado e delinquente de Sergipe do período de 1942 a 1974. É uma pesquisa histórica, de cunho bibliográfico e documental, com abordagem na História Cultural. O objetivo geral foi analisar como as autoridades lidavam com o problema do menor abandonado e delinquente. O recorte temporal está associado à criação da primeira instituição pública sergipana para acolher menores abandonados e delinquentes, chamada Cidade de Menores Getúlio Vargas, que funcionou de 1942, ano da sua inauguração, a 1974, ano em que fechou suas portas após uma crise no sistema de assistencialismo aos menores. Na primeira seção trabalhei as representações sobre o menor nos Novecentos; a legislação vigente; a relação da educação, disciplina e moral com a criminologia infantil. Na segunda seção apresentei a relação da Assistência Social e do Poder Judiciário em face o problema do menor; a importância da educação e da educação para o trabalho para a ressocialização do menor; a origem e o fim da Cidade de Menores de Sergipe; uma análise da sua semelhança com os modelos em que foi inspirada; o problema do menor em Sergipe, levando-se em consideração os encaminhamentos judiciais: da educação ao cárcere; a Casa das Meninas Santa Inês, como uma instituição para acolher meninas abandonadas em Sergipe e a configuração dos menores a partir dos processos judiciais; documentos e boletins individuais do judiciário; além de entrevistas com sujeitos que fizeram parte da Cidade de Menores Getúlio Vargas. Reading and Math Outcomes for Incarcerated Youth with Emotional and Behavioral Disorders

Helping youths acquire educational skills is one of the most effective approaches to the prevention of delinquency and reduction of recidivism. Access to a high-quality education is particularly important for the growing number of youth committed to juvenile corrections, especially for those who have been diagnosed with a disability. Research has shown a tremendous gap about the academic outcomes of incarcerated juveniles with emotional disabilities. Thus, the focus of this study was to examine the academic outcomes in reading and math for youth with emotional/behavioral disorders (E/BD) released from Texas Youth Commission (TYC) programs between September 2003 and September 2004. The study examined if the rate of academic growth in reading and math as indicated by pre- and post-test scores on the Test of Adult Basic Education (TABE), are different for youth with E/B as compared to youth with other disabilities and youth without disabilities who were adjudicated in TYC programs.

Untangled: The Effects Family Structure Has on Juvenile Delinquency

Juvenile delinquency is an issue in today's society for various reasons. This issue can result due to different motives, but family dynamics is one of the most vital factors. The current study extends prior research done in regards to the family factors that affect juvenile delinquency and what policies and programs are available to eliminate these factors. The seven family dynamics that are studied are socioeconomic status, divorce, cohabiting, family transitions, parental incarceration, parental control, as well as parental substance abuse. A subsample of policies and programs are assigned to each factor and researched of whether or not they are effective. Majority of the programs were effective and were found to minimize antisocial behaviors among adolescents. The programs that were not evaluated were still found to have a positive impact on juveniles' behaviors due to the outcomes of the policies. Investing in these programs and policies are beneficial for juveniles and the impact that family dynamics play on delinquency.

"An I don't give a damn 'bout my bad reputation": The Effects of Family Type and Patriarchy in the Home on Female Adolescent Delinquency and Mental Health

This study examined the connection between household type and delinquency and depressive symptoms for female adolescents. The present study draws its claims from Power-control theory which, at its most abstract level, predicts gender differences in delinquency based on the level of patriarchy in the family and the theoretical works of Sarah Rosenfield, who argues that it is the over control of females that causes them to have higher rates depression than males. This study hoped to build on research that links differences in family type and parental control to sex differences in delinquency by using the Power-control theory to look depressive symptoms among female adolescents. Past studies looking at female delinquency attempt to understand why females are under representative in crime statistics when compared to their male counterparts. These studies focus most of the attention on the social control placed over females. Using the National Longitudinal Study of Adolescent Health, the findings showed that, contrary to claims made by power-control theory, patriarchal family did not predict delinquent behavior or depressive symptoms for female adolescents. Further analysis included an instrument of control, parental attachment, risk perceptions and found significant results. Race was also significant in several models. The parent-daughter relationship was most significant in predicting outcomes of depressive symptoms and delinquent behavior. Those who reported close relationships with their parents were less likely to report depressive symptoms and delinquency behavior.

A criminological analysis of the transfer of juveniles to adult correctional centre

Many young people in South Africa are involved in crime, especially violent crime. This statement is supported by statistics obtained from the Annual Report (2013:37) of the Judicial Inspectorate for Correctional Services which indicates that 26 282 young people were serving sentences in South African Correctional Centres at the end of the 2012/13 financial year. This annual report of the Department of Correctional Services (2013:13) indicates that at the time of the report, 11 000 offenders were sentenced to life imprisonment and a third of them were youth offenders. The majority of these young people have to be transferred from juvenile facilities to adult centres to continue their incarceration when they turn twenty one. This transition holds a number of challenges, both for these young people and the Department of Correctional Services. Young people are confronted with the reality of possibly falling victim to HIV/AIDS, gangs, sodomy and rape in overcrowded, adult correctional facilities. The Department of Correctional Services encounters problems in assisting these young people to adjust to this transition and the protection of these young people from assault and abuse by older inmates remains an institutional concern. The main aims of this research are to examine: the age at which juveniles are transferred to adult correctional centre to continue with their sentences; the factors taken into account before transfer; the challenges faced by youth offenders in adult correctional centre; and the needs of youth offenders in adult correctional facility. The study addresses the following questions: • At what age are youth offenders transferred to adult correctional centre? • What other factors besides age are considered before youth are transferred to adult correctional centre? • Are there any preparatory measures in place to assist youth with the transfer? • Are there any induction programmes available to assist youth adjusting in adult correctional facility? • What are the challenges faced by youth in adult facility? • What are the needs of youth offenders in adult facility? / Criminology and Security Science / M.A. (Criminology)

The impact of solution-focused brief therapy on young youth offenders

Thesis (MA) -- Stellenbosch University, 2003. / ENGLISH ABTSRACT: The aim of this project was to evaluate the effectiveness of Solution-Focused Brief Therapy (SFBT) in a South African Youth Centre for young offenders, to which the court had sentenced them for two years. The study focused on the competencies and strengths of youth offenders, as well as on their capacity to find solutions to their problems, whilst being realistic and trying to accomplish positive change within the limits of the youth centre facility. An experimental and control group design was used in order to assess the impact of the therapeutic intervention. The effectiveness of the intervention was evaluated within three main domains of human experience: (1) subjective discomfort, (2) interpersonal relationships, and (3) social role performance. Two measures were used, namely the OQ-45.2 (outcome questionnaire) and unstandardised scaling questions relating to participants' personalised goals. Results show that no statistically significant improvement had occurred on the three measured dimensions. However, data obtained from the scaling questions reflected a more complete picture of the three areas of functioning identified and explored in this study. Improvement towards the achievement of young offenders' personalised goals seemed to be rapid at first, followed by a slightly slower rate of improvement and subsequent stabilisation. Scaling questions proved to be a useful technique for making complex aspects of these young offenders' lives more concrete and accessible to both the therapist and themselves. SFBT proved to be an effective method of intervention within group format in a facility for young offenders. / AFRIKAANSE OPSOMMING: Die doel van die navorsingsprojek was om die effektiwiteit van Oplossingsgerigte Terapie binne 'n Suid-Afrikaanse jeugsentrum vir jong oortreders, waartoe hulle vir twee jaar deur die hof gevonnis is, te evalueer. Hierdie studie se fokus was op die bevoegdhede en sterk punte van jeugdige oortreders, sowel as op hul vermoe om oplossings vir hul probleme te vind. Hierdie oogmerk was terselftertyd realisties in die poging om positiewe verandering binne die beperkinge van 'n jeugsentrum teweeg te bring. 'n Eksperimentele en kontrolegroepontwerp is gebruik om die impak van die terapeutiese intervensie te evalueer. Die effektiwiteit van die ingreep is ten opsigte van drie hoof areas wat verwant is aan menslike ervarings geevalueer: (1) subjektiewe ongemak, (2) interpersoonlike verhoudings, en (3) sosiale rolvervulling. Twee meetinstrumente is gebruik, naamlik die UV-45.2 (uitkomste vraelys) en ongestandaardiseerde skaleringsvrae wat verwant was aan deelnemers se persoonlike doelstellings. Resultate het getoon dat geen beduidende statistiese verbetering in die drie dimensies plaasgevind het nie. Data wat egter deur die stel van skaleringsvrae ingewin is, het 'n meer volledige beeld van die drie areas van funksionering wat in die studie geYdentifiseer en verken is, gereflekteer. Dit blyk dat die verbetering in die jong oortreders se persoonlike doelstellings aanvanklik vinnig geskied het, en gevolg is deur 'n effense stadiger tempo van verbetering en stabilisering. Volgens die navorsingstudie blyk dit dat skaleringsvrae 'n baie suksesvolle tegniek kan wees om komplekse aspekte van hierdie jong oortreders se lewens vir beide die terapeut en hulself meer konkreet en meer bereikbaar te maak. Dit blyk ook dat Oplossingsgerigte Terapie 'n effektiewe intervensiemetode binne groepformaat in 'n inrigting vir jong oortreders is.

An analysis of the implementation of a diversion programme for juvenile offenders

Thesis (MPhil)--Stellenbosch University, 2004. / ENGLISH ABSTRACT: This study focuses on the implementation of, as well as identifying problem areas associated with the YES-programme offered by NICRO. This specific programme was chosen because most of the young offenders referred to NICRO complete this programme. Young offenders are referred to the programme by the magistrates' court. These are youth that have been arrested for petty crimes such as shoplifting, damage to property and possession of drugs. This programme is also aimed at first time offenders but it became evident throughout the study that these youths might have been arrested once but seems to have been involved in crime at some level prior to being arrested. Youth between the ages of thirteen and eighteen years are accepted into the programme, with exceptions sometimes made for nineteen year olds who are still attending school. Participation in the programme is strictly voluntary, but there must be an admission of guilt on the part of the youth before he/she will be considered for this kind of diversionary alternative. The programme attempts to involve both parent and child in the process of learning and therefore parents are required to attend the first and last sessions with their children. Sessions attended by parents. focus on the improving relationships and communication between parent and child. The programme is viewed as an alternative sanction, and will enable youth to be punished for their crimes whilst at the same time learning new skills, and most importantly, not gaining a criminal record. The programme stretches over eight weeks with weekly sessions that focus on self-concept, decision-making, children's rights and respecting both themselves and those around them. The researcher formed part of the process through both facilitating sessions as well as observing sessions. For these reasons the research methodology focussed primarily on participant observation and interviews. / AFRIKAANSE OPSOMMING: Die studie fokus op die proses van implementering en die identifisering van probleemareas binne die YES-program wat deur NICRO aangebied word. Die YES-program was spesifiek gekies omdat meeste van die jeugdiges wat na NICRO verwys word hierdie program voltooi. Jeugdiges word deur die hof verwys na die program wat dien as 'n afwentelingsprogram. Hierdie jeugdiges word meestal gearresteer vir geringe misdade soos winkeldiefstal, beskadiging van eiendom, en die besit van dwelms. Die sessies wat deur die ouers bygewoon word fokus veralop die verbetering van verhoudings en kommunikasie tussen ouer en kind. Deelname aan die program is vrywillig maar die jeugdige moet skuldig pleit voordat hy/sy inaggeneem kan word vir die afwentelingsprogram. Die navorser het deel van die proses uitgemaak deur beide programme waar te neem sowel as programme te fasiliteer. Die navorsingsmetode wat dus benut was, was deelnemende waarneming sowel as onderhoudvoering.
