Music with a Racial Nexus: Culture Clash in Los Angeles Punk Rock Communities, 1976-1981

The chief argument of this work rests on the idea that culture-blindness—especially White ethnic-cultural blindness—contributed as much as issues of race to the heavily documented social rift between predominantly Chicanx, Eastside punk and the mostly-White, Westside punk rock communities of Los Angeles, 1976-1981. To date, historical blame for the divide has centered on racism, including racist intent. The second area of analysis directly relates to the first in that it demonstrates the inextricable link between cultural and spatial identity formation and assignment among the various scenes. This aspect of the study evaluates the complaints of some Eastside acts who have contended that based on racist attitude(s), they were prohibited from playing in Westside venues, thereby limiting their opportunities for gaining notoriety in the industry overall. This evaluation attempts to weigh the validity of that complaint against other determinative, influential aspects of the entire punk phenomenon. Lastly, through historically tracking the remnants of cultural Chicanismo clear into L.A.’s first and succeeding punk waves, this work analyzes the art of protest, and the protest in art as applied to that city’s diverse punk aesthetics.

La Llorona Don't Swim The L.A River: A Trickster's Guide To The Poetics Of The Pit

La Llorona Don’t Swim The LA River is a collection of poems that explore the issues of growing up in East LA as a young, bilingual Chicana. These poems are an attempt to capture my experiences through story telling by blending Spanish, English, street slang, and the casual spoken diction. The speaker embodies several versions of the trickster figure: linguistic tricksterism, cultural tricksterism, gender tricksterism, and religious tricksterism. She navigates linguistic tricksterism through the code switching of English and Spanish, using Spanglish as her main dialect, and often blending in slang, creating Slanglish. In cultural tricksterism, she focuses on the experiences of the working class, the migrant workers, the bilingual speakers, and the overall generational changes in the Mexican culture. The speaker constantly searches for the meaning of what it is to be a woman and what it means to love through gender tricksterism. She looks to her mother, la Virgen De Guadalupe, and La Llorona to try and understand her complex identity. La Llorona Don’t Swim The LA River works to form a different type of spirituality through sacred humanism from the point of view of the religious trickster. These poems pose the question: where else can God be found other than church and the bible? The speaker seeks God in tattoos, in punk music, in the moshpit, in the city, and in people. She forms a new approach to tradition through the persistence of kind rebellion, her own personal version of love.

A presente dissertação investiga os limites do Direito, em seus sentidos normativo e descritivo, segundo a Filosofia do Direito de Herbert Hart,com foco nos conceitos de derrotabilidade, vagueza e textura aberta. Mostra que o Direito é permeado por uma indeterminação relativa, resultante da indeterminação da linguagem ordinária e dos limites da cognição humana, temas que estão implicados no problema filosófico clássico da adequação das regras gerais a casos particulares. Objetiva mostrar que o quadro conceitual desenvolvido por Hart dá conta de explicar, adequadamente, a relação entre o Direito, a linguagem e as exceções às regras e ao raciocínio jurídico, esclarecendo a atividade judicial de aplicação do Direito. Conclui que esta indeterminação não é um problema para o positivismo jurídico hartiano, tampouco é incompatível com o ideal do Estado de Direito, dada sua concepção de poder discricionário, restrito aos casos de penumbra e constrangido pelo significado dos termos gerais, que é extraído do contexto da comunidade lingüística relevante, dos objetivos sociais do ordenamento jurídico, bem como da finalidade das regras e das consequências de sua aplicação. / This dissertation investigates the limits of law, in its normative and descriptive sense, according to Herbert Hart’s Philosophy of Law, focusing on his concepts of defeasibility, vagueness and open texture. It shows that law is permeated by a relative indeterminacy, due to ordinary language indeterminacy and to the limits of human cognition, issues implicated in the problem of the adequacy of general rules to particular cases. It aims to show that the conceptual framework developed by Hart is able to correctly explain the relation between law, language and the exceptions to legal rules and legal reasoning, turning light into judicial adjudication. It concludes that legal indeterminacy is not a problem to Hart’s legal positivism, neither incompatible to the ideal of the Rule of Law, given his conception of discretion, restricted to penumbral cases and constrained by the meaning of general terms, extracted from the context of the relevant linguistic community, by the social aims of the legal system and by the purpose of the rules and the consequences of their application.

Exploring Los Angeles as a Character in Film

In film, the construction of Los Angeles as a character has been defined through a series of specific theories that have seemingly misrepresented the unique and diverse nature of the city. Broken into two discussions, my paper will attempt to address 1) the way in which urbanization has influenced the landscape of the city of Los Angeles and how the creation of a heavy materialist culture in Amy Heckerling’s Clueless, the illusionary nature of Hollywood in Billy Wilder’s Sunset Boulevard, and corruption and abuse of power within the LAPD in Curtis Hansen’s L.A. Confidential manifest themselves as products of the this process and 2) the dominant narratives and themes that have been used to construct Los Angeles as a character in film.

This dissertation is a museological study of the coming into being of a natural history museum, its building and its adherent zoological exhibition during the years around the First World War. The main problem of the dissertation is the opposition between the curator´s program 1903 for the exhibit and its realization twenty years later. The theoretical perspective is that in its synchronic aspect science, in accordance with the views of swedish sociologist, Thomas Brante, is divided into three levels interdependent upon one another in varying degrees – theoretical, sociological and psychological level. In the present study, the main issue is the weighing of the relative significance of each of these levels. The exhibit was structured as along a scale, or chain, from lesser to greater animals. In this and in other respects it belonged to the legacy of Swedish naturalist Carolus Linnæus. Interest in maintaining this tradition was powerful in the Swedish society during the years before the First World War. Not until around 1950 was the modern theory of evolution explicitly announced to the visitor of the exhibit, still however without the representation of the forces behind it By an investigation of the milieu to which the museum belonged is shed light upon the scientific and other ideals which are represented in its exhibit. The result of an assess of the significance of the theoretical, the sociological ant the psychological level is that contemporay theory does not stand out as a driving force behind the creation of the exhibit in 1923. Orientador: Ângela Viana Machado Fernandes / Banca: Murilo José D'Almeida Machado / Banca: Edson do Carmo Inforsato / Resumo: Este trabalho teve como objetivo identificar a representação corporal de jovens infratores da cidade de Araraquara que se encontram em liberdade assistida, e entender qual sua relação com o mundo, discutindo o papel da disciplina Educação Física no contexto da construção da imagem corporal. Para a realização desta pesquisa foi escolhida a Rede Salesianos de Araraquara L.A. (Liberdade Assistida), por ser considerada modelo de atendimento ao jovem em conflito com a Lei. O Salesianos reúne condições necessárias para a realização da investigação proposta: jovens em conflito com a lei e em liberdade assistida. Entendendo a Rede Salesianos L.A. Araraquara como uma instituição social, fizemos uma discussão a respeito da representação corporal desses jovens abordando a especificidade da formação social e seus desdobramentos no que diz respeito às possibilidades da juventude no cenário atual. Analisamos essa representação a partir dos escritos de Michel Foucault (1987) sobre o poder e a disciplina dos corpos e a identidade e sentimento de pertencimento segundo Zigmunt Bauman (2004). A análise das representações sociais foi pautada por entrevistas compreensivas realizadas com cinco jovens internos de 14 a 17, que já cometeram algum delito entre os anos de 2008 e 2009. A pesquisa apresentou uma discussão satisfatória para os nossos interesses nos limites do tempo de mestrado. Focalizou as representações corporais desses jovens, tendo em vista as inquietações em relação ao papel da escola e da educação física na vida dos mesmos, atreladas às questões da juventude e às instituições de controle social. A análise da representação corporal de jovens em liberdade assistida é o primeiro passo para entendermos como estes jovens lidam com seus corpos e como estão inseridos na sociedade em que vivem, isto é, o trajeto... (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: This study aimed to identify the body representation of young offenders who are under counseling and assisted probation orders in the city of Araraquara, as well as to understand their relation with the world by discussing the role of Physical Education in connection with the construction of body image. For this research we chose Rede Salesianos de Araraquara L.A. (Assisted Probation), since it is considered a model in which young people are required to behave in an acceptable manner while being offered appropriate opportunities to manage their conflict with the law and social reintegration. The Salesianos gather up necessary conditions for carrying out the proposed research: youth in conflict with the law and probation. Considering Salesianos in the city of Araraquara a social institution, we analyzed the body representation of young people addressing the particularity of social formation and its consequences concerning the possibilities of youth people in the current scenario. We analyzed this representation from the view of Michel Foucault (1987), regarding the power and discipline of bodies and the identity and sense of belonging, according to Zigmunt Bauman (2004). The analysis of social representations was guided by comprehensive interviews with five young interns aging from 14-17 years old, who have committed any offense between the years 2008 and 2009. This research presented a satisfactory discussion on our interests in the limits of a Masters work. We focused on body representations of these youngsters, paying attention to the role of the school and the Physical Education in their lives, tied to youth issues and institutions of social control. A pretensão do positivismo jurídico é o esclarecimento teórico para se realizar uma descrição correta do direito. A presente dissertação busca verificar qual a abordagem mais adequada para se alcançar a concretização da separação do direito da moral, sendo que o fio condutor é a obra de H.L.A. Hart, na qual se destaca o livro The Concept of Law. Dessa maneira, o problema a que se propõe o trabalho é evidenciar a complexidade da separação do direito da moral. Pretende-se demonstrar, principalmente através da teoria e obra de Herbert Hart, que Oliver Holmes e Hans Kelsen ao apresentarem seus projetos para separação do direito da moralidade, trataram o direito do ponto de vista descritivo, perdendo a caracterização do próprio direito. O primeiro capítulo é dedicado a apresentar e explicar o projeto positivista, já que condutas exigíveis por regras jurídicas não se confundem com as condutas exigidas por regras morais, ainda que conjuntamente possam existir. Ainda nesse capítulo apresentam-se algumas noções importantes para a compreensão e desenvolvimento do trabalho em relação à teoria de Hart, em especial no que tange ao ponto de vista interno e externo. No segundo capítulo é abordada a obra de Holmes, The Path of the Law, e as principais críticas construídas por Hart e discutidas por Stephen Perry e Scott Shapiro. Partindo-se da perspectiva do homem mau presente na teoria, pretende-se demonstrar que esta é insuficiente para compreender a teoria do direito, em especial nas razões pelas quais um cidadão segue o direito, já que nem todos estariam preocupados em qual é a sanção que receberão do Estado caso desobedeçam à regra. No terceiro e último capítulo demonstra-se quais os problemas da teoria de Kelsen apontadas por Hart. Especialmente no que se refere à ideia de Kelsen de que o direito é só forma, podendo ter qualquer conteúdo, enquanto que Hart acredita que o direito deve possuir conteúdo mínimo. Segundo Kelsen, a estrutura normativa é pressuposta, sendo que a regra funciona como esquema de interpretação e a principal função desta é a sanção. O objetivo final do trabalho é demonstrar que neste projeto de tentar salvar a autonomia do direito, Holmes e Kelsen descaracterizaram o fenômeno jurídico como uma prática social. / The claim of legal positivism is the theoretical clarification to perform a correct description of the law. This work aims to verify the most appropriate approach to achieving the implementation of the separation of law from morality, and the common thread is the work of H.L.A. Hart, which stresses the book The Concept of Law. Thus, the problem that is proposed work is to show the complexity of separating law from morals. We intend to show, especially through the theory and work of Herbert Hart, that Oliver Holmes and Hans Kelsen when presented their projects for separating the right of morality, they treated law of the descriptive point of view, losing the characterization of the law itself. The first chapter is dedicated to present and explain the positivist project, as required by legal conduct rules are not confused with the conduct required by moral rules, albeit jointly may exist. Although this chapter presents some important concepts for understanding and development work in relation to Hart's theory, especially with regard to internal and external point of view. The second chapter discussed the work of Holmes, The Path of the Law, and the main criticisms built by Hart and discussed by Stephen Perry and Scott Shapiro. Starting from the bad man present perspective in theory, intended to demonstrate that this is insufficient to understand the theory of law, in particular the reasons why a citizen follows the law, since not everyone would be worried about what is the sanction which receive if they disobey the rule. In the third and last chapter shows is that the problems of Kelsen's theory pointed out by Hart. Especially with regard to the idea of Kelsen that law is shaped and can have any content, while Hart believes that law should have a minimum content. According to Kelsen, the regulatory framework is presupposed, and the rule works as interpretation scheme and the main function of this is the sanction. The ultimate goal of the work is to demonstrate that this project of trying to save the autonomy of law, Holmes and Kelsen misrepresent the legal phenomenon as a social practice.
