Robert, Xavier 27 November 2008 (has links) (PDF)

Fourniture de main-d’œuvre, prêt de main-d’œuvre et droit pénal / Subcontracting of labour force, leasing of labour force and criminal law

Caressa, Myriam 06 February 2018 (has links)
Built around the employment contract, labour law is based on a bilateral relationship between an employer and an employee. The leasing and subcontracting of labour force disrupt this balance because the employee's labour force benefits a third party to the employment contract. The original mistrust resulted in two criminally sanctioned prohibitions: illegal subcontracting and illegal labour leasing. The evolution of the economic market has forced the legislator to go beyond repression alone and to consider the legalization and supervision of more and more types of manpower leasing. These numerous legislative interventions, in the absence of the revalorization of the incriminations, question the effectiveness of the criminal prohibition. Is criminal law still suited to fight against the excesses of labour leasing and subcontracting? Although the current repressive framework and its implementation are open to criticism, decriminalization alone is not the only solution.

Main street evolved: envisioning a comprehensive approach to main street redevelopment in small mountain communities

Murner, Cory James January 1900 (has links)
Master of Landscape Architecture / Department of Landscape Architecture/Regional and Community Planning / Blake M. Belanger / The main streets of the Rocky Mountain West are the social, economic, and cultural centers of their respective communities. Often, these main streets may deteriorate or become abandoned as a result of edge shopping malls and strip style economic development. Thus, a downtown or main street redevelopment effort by the community can help to ensure these economic centers remain. Yet, too often, the redevelopment efforts are oversimplified and fail to integrate the most current street development principles and design initiatives that can benefit not only the community but also the surrounding environment. I n the modern American city, almost half of all daily trips are less than three miles and a third are under one mile. (McCann 2010) “These are distances easily traversed by foot or bicycle, yet 65 percent of trips under one mile are made by automobile.” (McCann 2010) This mobility trend has led to the foundation of programs and organizations that try to promote non-motorized travel. Although these initiatives respond to the human/physical environment, they are far from comprehensive. Today, an integration of smart ecological ideals is essential. How can the revitalization efforts of Rocky Mountain communities be guided to ensure they consider not only the built environment; but also the natural environment? The face of the future main street will be multi-modal and ecologically responsible. Yet, there is presently no clear method of combining the two. A union of the multi-modal principles behind Complete Streets and the ecologically responsible ideals green infrastructure can provide a framework for a new and more inclusive redevelopment approach. The merging of modern ecological and street design principles can lead to a comprehensive Main Street redevelopment program and therefore successfully guide the revitalization efforts of small Rocky Mountain communities in a way that is responsive to future development needs as well as the cultural and ecological aspects of the region. Main Street Evolved will provide a set of tools to guide Colorado Rocky Mountain Main Street redevelopment efforts by providing strategies and implementation guidelines that focus on balancing multi-modal ideals and ecological stormwater management techniques within a small-town mountain context.

Performance improvements using dynamic performance stubs

Trapp, Peter January 2011 (has links)
This thesis proposes a new methodology to extend the software performance engineering process. Common performance measurement and tuning principles mainly target to improve the software function itself. Hereby, the application source code is studied and improved independently of the overall system performance behavior. Moreover, the optimization of the software function has to be done without an estimation of the expected optimization gain. This often leads to an under- or overoptimization, and hence, does not utilize the system sufficiently. The proposed performance improvement methodology and framework, called dynamic performance stubs, improves the before mentioned insufficiencies by evaluating the overall system performance improvement. This is achieved by simulating the performance behavior of the original software functionality depending on an adjustable optimization level prior to the real optimization. So, it enables the software performance analyst to determine the systems’ overall performance behavior considering possible outcomes of different improvement approaches. Moreover, by using the dynamic performance stubs methodology, a cost-benefit analysis of different optimizations regarding the performance behavior can be done. The approach of the dynamic performance stubs is to replace the software bottleneck by a stub. This stub combines the simulation of the software functionality with the possibility to adjust the performance behavior depending on one or more different performance aspects of the replaced software function. A general methodology for using dynamic performance stubs as well as several methodologies for simulating different performance aspects is discussed. Finally, several case studies to show the application and usability of the dynamic performance stubs approach are presented.
