The impact of the labour inspection and enforcement strategy on occupational health and safety : the case of Tzaneen Labour Centre Limpopo Province

Thesis (MPAM.) -- University of Limpopo, 2021 / The study explored the impact of Labour inspection and enforcement strategy on Occupational Health and Safety with specific reference to Tzaneen Labour Centre in the Limpopo Province. The international Labour Organisation (ILO) 2017 world statistics indicate that 2.3 million women and men around the world succumb to work-related accidents or diseases every year and this corresponds to over 6 000 deaths every single day. The Department of Labour (DOL) Annual Reports (2007) indicates that in the Province of Limpopo, 1 717 workplaces were inspected to determine compliance with Occupational Health and Safety and only 825 were found to be compliant. Literature indicate that most accidents and fatalities at the workplace are primarily due to reluctance by employers to provide safety clothing and equipment, lack of proper training on OHS, lack of safety policy and enforcement procedures, poor safety consciousness among workers and lack of strict operational procedures amongst others. A qualitative approach was used to conduct this study and a case study was selected as the most direct method to conduct the study and obtain insight. Interviews were conducted with DOL managers, OHS inspectors and farm employers. Questionnaires were administered to farmworkers. The study revealed that there are few OHS inspectors at the Tzaneen Labour centre hence inspections are very minimal at the farms, this can assist in increasing number of places to be inspected and enforcing compliance. Findings also indicate that most farm employees are not cognisant with the OHS policies enacted to protect them and OHS records non-existent on many farms. The study recommends further rigorous training of the OHS inspectors, beefing up their numbers and equipping them with safety clothing and detection gadgets

Study analyzes the question of staff documentation administration: inadequacies are detected in Lithuanian enterprises and establishments that are relative to law acts regulating labour law. Peculiarities and factors that ease or aggravate the labour of staff are also detected. Gaining the goals of study the nonfiction about staff management, administration, and audit was examined. After nonfiction and the requirements of law acts concerning labour intercourse examination a table ant the chart of data that is used in staff documents is made. Furthermore comparative analysis of administration peculiarities is accomplished in public and private sectors. The requirements of labour law acts are explored. Much attention is focused on exploring the frequent breaches in enterprises and establishments of Lithuania. Questionnaire revealed: • Factors mostly disturbing administrative work, • Factors mostly easing staff work, • Electronic devices mostly used by enterprises workers for staff needs, • Etc. The analysis of questionnaire is throughout. The matrix of factors mostly creating the risk to staff administration is made.

Les relations de travail et d'emploi sont devenues des enjeux importants en Chine. La Chine a ratifié 25 conventions internationales du travail et a travaillé en étroite collaboration avec l'OIT pour améliorer la sécurité et la santé au travail. Malgré ces efforts, la Chine est souvent critiquée pour des violations du travail. Face à ces problèmes, un système législatif d'administration de travail a été développé au niveau national. Mais l’application de ces règlements demeure problématique.. En particulier, les difficultés rencontrées par les inspecteurs du travail dans l'application de ces lois constituent un élément clé du problème. Notre mémoire s'intéresse essentiellement au rôle de l'inspecteur du travail dans l'administration publique de la sécurité du travail en Chine. Ces fonctionnaires jouent un rôle important et peuvent parfois exercer leur discrétion en tant qu'acteurs de première ligne, faisant d'eux de vrais décideurs politiques. Par conséquent, la compréhension de leur rôle et de leur discrétion dans l'application des normes du travail en Chine est cruciale. Notre mémoire est centré sur une étude de cas qualitative d'un bureau d'inspection du travail dans la région de Beijing. Dans le cadre de notre recherche nous avons examiné le rôle des inspecteurs du travail au moyen d’entretiens semi-structurés, d’une recherche documentaire ainsi qu’à l’occasion d’une brève observation des inspecteurs sur lors de la visite d’un lieu de travail. Les résultats démontrent que la définition du pouvoir discrétionnaire des inspecteurs du travail de première ligne en Chine est un enjeu très complexe. L’étude de cas permet cependant d’élaborer un cadre permettant l’identification des facteurs critiques déterminants pour l'évaluation et la compréhension de la nature du pouvoir discrétionnaire de l'inspecteur du travail en application de la loi. / Labour and employment relations have become important issues in China. China has ratified 25 international labour conventions and has worked closely with the ILO to improve occupational safety and health. Despite these efforts, China is often criticized for labour violations. China has in response built a relatively complete legal and regulatory picture of labour regulations nationwide. The problem facing China today is enforcing these laws and regulations. A key part of this problem is the critical question of examining the challenges faced by labour inspectors in implementing these laws. This research project focuses on the role of labour inspection in the public administration of work safety in China. These public servants play an important role and may at times exercise their own discretion as street-level actors, making them the real policy decision makers. Consequently, understanding their role and discretion in the application of labour standards in China is crucial. This research is a qualitative case study of one labour inspection office in the Beijing area and examines the role of labour inspectors through semi-structured interviews, documents, and a brief observation of labour inspectors on-the-job. The results indicate that defining the discretionary power of street-level labour inspectors in China is a very complex task, but a framework is developed through this case study to identify critical issues important to evaluating and understanding the nature of street-level labour inspector discretion in enforcement.

A Reforma neoliberal do Estado orientou-se pelo primado da sujeição ao comando da lógica de ajuste fiscal, da privatização e da desregulamentação. Transplantou-se a racionalidade da gestão empresarial para o setor público, adotando-se o denominado modelo gerencial. Neste contexto, o estudo tem como objetivo geral analisar o processo de fiscalização do trabalho no setor de Saúde e o modo pelo qual as ações fiscais têm sido desenvolvidas. Devido à grandeza do fenômeno, a pesquisa requereu examinar o processo de implantação da Reforma Administrativa e seus efeitos sobre ação do fiscal do trabalho a partir dos dados históricos disponíveis, bem como investigar a evolução do modus operandi, a amplitude e perfil da intervenção da auditoria-fiscal do trabalho no serviço de Saúde e levantar dados e evidências do grau de alcance desta intervenção fiscal. O percurso metodológico abrangeu a classificação e delimitação das categorias profissionais do Setor Saúde e a seleção de fontes, variáveis e indicadores das características do mercado de trabalho em Saúde e do perfil e alcance da fiscalização do trabalho. Quanto à contextualização do setor de Saúde, as fontes utilizadas foram o Cadastro Nacional de Estabelecimentos de Saúde do Ministério da Saúde (CNES/MS), o Cadastro Central de Empresas (CEMPRE/IBGE), a Pesquisa Nacional por Amostra de Domicílios (PNAD/IBGE) e a Pesquisa de Assistência Médico-Sanitária (AMS/IBGE) e para a análise dos aspectos fiscais foram colhidos e sistematizados os dados do Sistema Federal de Inspeção do Trabalho (SFIT). A pesquisa confirma a hipótese principal, verificando-se que ocorreu um estreitamento do foco fiscal com forte caráter arrecadatório em detrimento de dimensões como jornada e segurança e saúde, apresentando grau mais acentuado no Serviço de Saúde. Foi evidenciado ainda que a Reforma Administrativa tornou a auditoria-fiscal do trabalho flexível e menos punitiva, gerando perda de credibilidade institucional, estimulando sensação de impunidade e posturas de resistências pelas empresas em razão da reduzida probabilidade de flagrar infrações e o baixo custo das multas trabalhistas. O estudo também traz evidências de que a ruptura com do sistema de avaliação de desempenho vinculado à remuneração dos fiscais do trabalho parece ter iniciado um processo de reversão dos efeitos do modelo gerencial, apontando a necessidade de novas pesquisas para investigar a evolução da transição do modelo gerencial para uma nova política de administração da fiscalização do trabalho e respostas a questões concernentes à construção e adequação de indicadores de monitoramento e avaliação da eficácia fiscal que possam contribuir para construção e captação de um novo modo de atuar da inspeção trabalhista com vistas a promover o cumprimento da lei e a desprecarização do mercado do trabalho. / The precariousness of work has been identified as one of the main effects of restructuring the production process. The neoliberal state reform was guided by the rule of subjection to command logic fiscal adjustment, privatization and deregulation. The managerial public administration model transplanted the rationality of business for the public sector. In this context, the study aims at analyzing the process of labor inspection in Healthcare sector and the way interventive actions have been developed. Because to the magnitude of the phenomenon, the research required to examine the process of implementation of administrative reform and its effect on the action of the Labour Inspection. from the available historical data and, to investigate the evolution of the modus operandi, the amplitude and profile of the intervention of the work fiscal in the Service of Health and to collect data and evidence as to the reach of this fiscal intervention. The methodological approach included the classification and definition of the professional categories of the Health Sector and the selection of sources, variables and indicators of the characteristics of the labor market Health and profile and scope of labor inspection. For the contextualization of Health sector, the sources used were the National Register of Health Care of the Ministry of Health (CNES / MS), the Central Register of Enterprises (CEMPRE / IBGE), the National Household Sample Survey (PNAD / IBGE) and the Survey of Medical-Sanitary (AMS / IBGE) and the analysis of the fiscal aspects were collected and systematized data of the Federal Labour Inspection System (SFIT). The research confirms the main hypothesis, verifying that there was a narrowing of focus tax revenue collection with strong character rather than dimensions such as working hours, safety and health, presenting greater degree in Health Service. It was evidenced that the Administrative Reform has turned out flexible and less punitive the Labour Inspecton, causing loss of institutional credibility, stimulating feeling of impunity and postures of resistance by companies because the reduced probability of catching violations and the low cost of labor fines. The study also provides evidence that the break with the performance measurement systems linked to the remuneration of labor inspectors appears to started a process of reversing the effects of managerial public administration model, pointing out the need for further research to investigate the evolution of the transition model management to a new administration policy of the Labour Inspecion and answers to questions concerning the construction and adaptation of indicators for monitoring and evaluating the inspection effectiveness may contribute to the construction and funding of a new way of acting Labour Inspection in order to promote the law enforcement and the reversion of the precariousness of the labor market.

Violation of the Employment Act Abstract The purpose and aim of this dissertation work was compactly and coherently to describe the individual types of violations of legal regulations in relation to their consequences for individual entities against whom the negative impacts are directed. The work, based on the current legal regulation of employment, divides the violations of obligations into individual areas, which can be further broken down by entities violating obligations and (by) the seriousness of individual violations. The issue of violation of the Employment Act includes two fundamental areas. The first area, which forms an inherent part of most substantive regulations, is the area of administrative offenses, responding primarily to violations of obligations imposed upon employers. Especially the third, fhe fifth and the sixth chapter focus on this field. The second area of the Employment Act, which is vital for the topic at hand, regulates and sets obligations for individuals, persons interested in the job and especially job seekers who, through the Labour Office, exercise their basic social rights guaranteed by the Charter of Fundamental Rights and Freedoms, i.e. the right to work. This dissertation is about the changes in the regulation of labour migration in the Czech Republic, specifically between the period of economic boom in 2007 and 2008 and the beginning of the global economic and financial crisis. The developments of labour migration processes and policies were studied in relation to the political economy of foreign direct investment and the rise of the competition state in the Czech Republic. The materialisation of these developments resulted in the Czech Republic's further integration into the global labour market. Labour migration policy changes in the case of the Green Card project, however, did not confirm the thesis that the Czech Republic's migration policy eventually became subordinated to the competition state project. Not only did the Ministry of Industry and Trade lack bureaucratic capital in the field of migration regulation but also, there were tensions between different notions of the competition state project while 'migration management' was reorganised in the interest of the Ministry of the Interior. Closely following struggles over the regulation of labour migration in the administrative and political fields, this dissertation contributes to literature on the labour migration perspective of the competition state. Construit autour du contrat de travail, le droit du travail s’appuie sur une relation bilatérale entre l’employeur et le salarié. Le prêt et la fourniture de main-d’œuvre perturbent cet équilibre parce que la force de travail du salarié bénéficie à un tiers au contrat de travail. La méfiance originelle s’est traduite par deux prohibitions de principe pénalement sanctionnées : le marchandage et le prêt illicite de maind’œuvre. L’évolution du marché économique a contraint le législateur à dépasser la seule répression pour envisager la légalisation et l’encadrement de mises à disposition de plus en plus variées. Ces nombreux à-coups législatifs, en l’absence de revalorisation des incriminations, remettent en cause l’efficacité de la prohibition pénale. Le droit pénal est-il encore adapté pour lutter contre les dérives des prêts et fournitures de main-d’œuvre ? Si l’encadrement répressif actuel et sa mise en œuvre sont critiquables, la dépénalisation « sèche » n’est pas pour autant la seule solution. / Built around the employment contract, labour law is based on a bilateral relationship between an employer and an employee. The leasing and subcontracting of labour force disrupt this balance because the employee's labour force benefits a third party to the employment contract. The original mistrust resulted in two criminally sanctioned prohibitions: illegal subcontracting and illegal labour leasing. The evolution of the economic market has forced the legislator to go beyond repression alone and to consider the legalization and supervision of more and more types of manpower leasing. These numerous legislative interventions, in the absence of the revalorization of the incriminations, question the effectiveness of the criminal prohibition. Is criminal law still suited to fight against the excesses of labour leasing and subcontracting? Although the current repressive framework and its implementation are open to criticism, decriminalization alone is not the only solution.

The area of safety and health protection in the construction industry, concept of Safe enterprise and "Švarc" systém are processed separately. Finally, analysis of the Labour Inspection activities in construction between 2006 - 2011 is performed, with a detailed focus on the year 2011.

職業災害調查係為勞動檢查之一環,係發生重大職業災害後,所執行之行政調查,為判斷重大職業災害過失責任關係、分析事故發生因素、防範再度發生之預防措施,不僅可以讓勞工及其家屬了解職業災害事故始末,也可透過調查報告書讓有過失責任者受到應有之懲罰,對受職業災害之勞工及其家屬可謂非常重要。職業災害調查通常具備強制性行政調查權,但在調查過程中,並無權限封鎖重大職災現場來保持證據的完整性,本文將探討目前職業災害調查制度之成效?以及目前法院對職業災害調查報告書之見解為何?此外並探討美、日兩國之職業災害調查制度?以上為本文探討重點。 本文發現我國職業災害調查制度雖有不足之處,但目前勞動法令授與勞動檢查員強制性行政檢查權、停工權…等權限,已賦予執行職業災害調查之基本權限,規劃出職業災害調查制度的雛形,本文認為目前雖有不足之處,但已能處理大多數的重大職業災害案件,至於勞動法令是否應讓勞動檢查員,於發生重大職業災害下,得執行特別司法警察官權限進行調查的問題,本文綜觀美、日兩國制度及相關文獻後,認為目前尚不需授與特別司法警察官權限,但必須要加強勞動檢查員與警察、消防機關之職務聯繫及協助,並賦予勞動檢查員行政封鎖之權限,使職業災害調查制度更加完善,能夠妥善處理每一件重大職業災害案件。並提出下列建議: 一、建立職業災害事故現場的行政封鎖制度 二、加強與其他機關的職務協助關係 三、縮短雇主通報義務時間 四、強化專業分工與在職訓練 五、釐清勞動派遣之雇主關係 六、加強雇主預防責任
