No uso da Máfia Norte-Americana como assunto principal percebemos nuances que projetam uma ideia tradicional de crime organizado regido por famílias, destacada, sobretudo, em “O Poderoso Chefão” (Francis Ford Copolla, 1972). Em “Scarface” (Brian De Palma, 1983), a perspectiva da película se encontra no cartel internacional de drogas e na relação conflitante do protagonista e o seu vício em cocaína. A utilização de padrões estilizados no cinema expressam uma abordagem recorrente nessas películas. Em “Os Bons Companheiros” (Martin Scorsese, 1990), o enfoque é direcionado à vida boêmia dos personagens. Já em “Os Intocáveis” (Brian De Palma, 1987), a Lei-Seca Norte-Americana assume papel destacado. Em todos os filmes dessa seleção, lançados entre 1972 e 1990, duas questões requerem destaque: o padrão estético recorrente das obras, sobretudo após o sucesso comercial de “O Poderoso Chefão” e o protagonismo da violência exacerbada nas produções audiovisuais. Neste sentido, esta dissertação intenciona estabelecer relações e analisar o uso da representação das Máfias nos Estados Unidos da América no cinema e na feitura da redação historiográfica. / The cinematic representations of a particular topic do not essentially treat about its formal and/or academic conception. Having as the main subject the American Mafia, it is possible to perceive nuances that project a traditional idea of organized crime governed by families, especially highlighted in “The Godfather” (Francis Ford Copolla, 1972). In “Scarface” (Brian De Palma, 1983), the movie perspective is based on drugs’ international cartel and also in the clashing relationship between the main character and its addiction in cocaine. The usage of stylized patterns at the cinema expresses a recurrent approach in these movies. In “Goodfellas” (Martin Scorsese, 1990), the focus is in the bohemian lifestyle of the characters. In “The Untouchables” (Brian De Palma, 1987), the focus is in the North-American Prohibition. In all these movies, released between 1972 and 1990, two questions demand to be highlitghted: the reccurent esthetic pattern of them, especially after the commercial success of “The Godfather”, and also the excess of violence as the main point in these audiovisual productions. This thesis intend to establish relations and analyse the way how American Mafias are represented in movies and also at the historiographical writing.

The work examines the hypothesis that the Italian debt has already reached its critical level and the creditors no longer trust the country. I concluded that it's far from having reached its critical level. Despite the rising debt and internal problems, Italy borrows more cheaply than before and thanks to economic growth and some reforms we can expect this trend to continue. On the other hand, the country still has major structural problems and struggles with high unemployment and declining competitiveness. In the case of failure to introduce necessary reforms, in a longer-term can Italy suffer by significant problems.

Devenu clef de lecture des enjeux internationaux dans le nouveau désordre mondial, le crime organisé transnational concurrence l’État par ses propres moyens de coercition et investit la sphère publique de telle manière que, dans certaines régions du monde, son influence est indispensable pour remporter une élection ou un marché public. Il va même jusqu’à agir au détriment des engagements des États en matière de préservation de l’environnement ou du patrimoine, de politique urbaine ou de non-prolifération des armes de destruction massive. Dans quelle mesure les changements géopolitiques et les mutations juridiques en ex-URSS ont eu des conséquences sur la nature et l’évolution du crime organisé russe postsoviétique ? Anciennement garants des traditions carcérales, la nouvelle génération des Voleurs dans la loi (Vory v zakone) s’est largement développée durant la transition démocratique avant d’investir durablement les États occidentaux, au point qu’Interpol qualifie cette organisation de « grave menace pour le développement économique ». D’une part, seront étudiés la « sous-culture criminelle russophone » bien spécifique, la typologie et la structure des groupes criminels russes, ainsi que le contexte juridique de leur développement en Russie et en Géorgie. D’autre part, sera analysée l’évolution en Europe occidentale de cette criminalité russophone, davantage qualifiable « d’association de type mafieux » par ses liens politiques et ses activités économiques « légalisées ». L’étude des réponses juridiques de différentes législations sur le blanchiment de capitaux établit que la confiscation élargie sur le modèle italien reste le principal instrument de lutte efficace. / From disruptive element to key factor of international stakes in the new world disorder, transnational organized crime competes with the State with its own coercive means and invests in public sector in a way it becomes inevitable in some parts of the world to win an election or obtain a procurement contract, often in spite of international agreements on environmental preservation, protection of holdings or town planning or even non-proliferation of weapons of mass-destruction. To what extent did the geopolitical and legal changes and their consequences in the ex-USSR impact the nature and evolution of post-soviet organized crime? Formerly guardians of the prison criminal traditions, the new generation of Thieves in Law (Vory v zakone) has developed throughout the democratic transition and expanded in Western Europe to such extent Interpol considers it a tremendous threat to economic development, international security and Russian democratic institutions. The first part will study the indigenous Russian-speaking criminal prison “culture” and give an analyzed overview of the structure of current types of Russian criminal groups and the legal context that led to their development in Russia and Georgia throughout the democratic transition. On the second hand, I will study the expansion in Western Europe of Russian-speaking criminality which can be qualified as “association of mafia-type” (cf. Art. 416bis of the Italian Criminal Code) because of its political links and its “legalized” profits. Forfeiture and seizure on the Italian legal model remain the most effective instrument as established from the study of different legislations against money laundering.

This final thesis attempts to provide a closer ovierview of specific features of the Italian political arena, which is a mutual penetration of one sphere of organized crime - mafia and politics. The first part of this thesis defines the theoretical structure of the mafia phenomenon and essays to contextualize it within organized crime. The second part begins with an excoursion into the history of the mafia in Sicily from its beginings in the 19th century until the 1970s. The deeper analysis is then devoted to the crucial period of the 1980s and 1990s. The final part of the thesis examines the period of bomb attacks (1992-1993) through the aspect of new investigations. Key words: mafia, Cosa Nostra, politics, Italy, Palermo, organized crime.

The Book of Mormon and the Book of Moses, sacred scripture of The Church of Jesus Christ of Latter-day Saints have woven into their pages a brief history of secret combinations on the "American" continent. Secret combinations have caused the destruction of three previous civilizations that have existed on this continent. The prophet Moroni warned the Latter-day American inhabitants that "This secret combination... shall be among you..." (Ether 8:24). The evidence summarized in this study leads one to the conclusion that the American Mafia Organization (Cosa Nostra) is the same organization warned against in sacred scripture.

Defended Neighborhoods And Organized Crime: Does Organized Crime Lower Street Crime?

The literature suggests that neighborhoods with organized criminal networks would have lower crime rates than other neighborhoods or communities, because of the social control their organization exerts on residents and visitors. The strictly organized Italian-American Mafia seems to have characteristics that would translate throughout the neighborhood: People will not participate in overt illegal behaviors because they do not know who is watching, and the fear of what the Mafia might do keeps residents and visitors to the neighborhood relatively well-behaved. Using crime statistics from the NYPD and census data for neighborhood characteristics, four linear regressions were calculated. The results indicate that low socioeconomic status is the main factor explaining neighborhood crime rate variations in New York City. The percent of the population under 18 and density were also listed as influential factors for some variables. The percent of foreign-born Italians was noted as significant in the correlation models, though it is not yet clear what this might truly indicate. The proxy variable for Mafia presence was not significant, and this can either be due to inaccuracies of the measurement of the variable or a true decrease in the influence of Mafia presence after the string of RICO arrests in the 1980s and 1990s. The results imply that Mafia presence does not influence neighborhood social control, but they do reinforce social disorganization theory. The foundation of this theory is neighborhood stability; the more unstable a neighborhood is, the more susceptible the neighborhood is to crime and dysfunction. Factors like low socioeconomic status and density influence neighborhood stability. Future research should attempt to have more accurate representations of Mafia presence and neighborhood characteristics.

Invisible in Plain Sight: The Troubling Connections Between the National Hockey League and the Russian Mafia

Professional sports leagues in North America have seen scandals, controversies, and tragedies. There is, however, a forgotten scandal that happened in the 1990s: the Russian Mafia came dangerously close to the National Hockey League. This thesis explores the alleged Mafia connections by examining newspaper and magazine articles and documentaries focused on the issue. The limited public response to allegations of Russian Mafia involvement is contrasted with other professional sports controversies that were met with an immediate response by the leagues and fans. How North Americans viewed Russians during the post-Soviet era is also explored in this paper. This thesis examines why evident Mafia involvement with National Hockey League players did not provoke attention and sanctions by the league nor an outcry from the fans. This study will conclude the League did not react to the allegations because it felt as if the games were not harmed directly. Also, hockey fans did not find the allegations surprising because of the media's constant reports of corruption within Russia's borders, especially involving organized crime. Perhaps the lack of reaction by the National Hockey League and its fans suggests why this particular scandal is forgotten a mere 20 years later.

Le pluralisme juridique relativise le monopole étatique dans la production normative, en laissant aux autres groupes sociaux la possibilité de créer du droit. La mafia en tant qu’organisation soumise à des règles qui lui sont propres représente un véritable ordre juridique qui entre en contradiction avec la légalité et la structure de tout l’ordre juridique étatique. Il paraît difficile, au premier abord, de considérer la mafia comme un ordre juridique, car elle s’oppose aux critères étatiques et juridiques traditionnels. En effet, les analyses en matière de pluralisme font rarement le lien entre le pluralisme juridique et les systèmes violents, arbitraires et illégaux. Cependant, d’un point de vue sociojuridique, il est possible d’envisager le pluralisme juridique à partir de l’analyse du phénomène mafieux. Cette hypothèse explore la relation entre divers ordres (étatique, mafieux et communautaire) de nature contradictoire et dans un contexte violent.L’organisation criminelle du trafic de drogue en Colombie durant les années 1980 et 1990 sert de base à la réflexion. Cet exemple est riche d’enseignements du fait de l’imbrication des intérêts des narcotrafiquants, de l’État et des classes sociales. Ce travail de recherche explore ainsi la mafia pensée et vécue comme un ordre juridique sui generis à caractère contre-étatique, possédant une force normative sans limites. / The legal pluralism relativises the state’s monopoly to create norms by taking into consideration the possibility that different social groups contribute to the production of law. The mafia and its rules can form a legal order in contradiction with the legality and the structure of the state legal order. It seems difficult to consider the mafia as a legal order because it is in contradiction with the traditional legal and state criteria. Indeed, the analysis of legal pluralism rarely does this link between legal pluralism and violent, arbitrary and illegal systems. However, from a socio-legal perspective, it is absolutely possible to affirm a sort of legal pluralism issued from the mafia phenomenon. This hypothesis explores, in a violent context, the contradictory relation between different kinds of orders, such as State, mafia and community order.In order to analyse this issue, the Colombian drugs traffic between the 80’s and 90’s shows a specific legal culture and legal consciousness, which in a specific context reveals interesting characteristics for a socio-legal study. The mafia and its multiple networks can infiltrate the legal culture of the regions where it acts, and sometimes, its actions and operations may be intertwined with the State and other legal actors. In this sense, it is appropriate to consider a mixed legal system, where the legal and illegal co-exist; and where the mafia, popular and state law became a "mélange" as a product of the interaction between the different legal systems as well as a product of the porosity existing between all the legal systems. This research explores the mafia, in real life and in theory, as a sui generis legal order that has a normative force without limits.
