The human rights based approach to climate change mitigation : legal framework for addressing human rights questions in mitigation projects

Olawuyi, Damilola Sunday January 2013 (has links)
Over the last decade, the effects of an unprecedented rise in global temperature due to climate change, on the enjoyment of human rights, especially the right to life, have been subjects of intensive scholarly attention. Gallons of juristic ink have been spilled on the need for States to adopt policy measures aimed at combating climate change. However, recent findings show that policy measures and projects aimed at mitigating climate change are in turn producing even more serious human rights concerns, especially in developing countries. These human rights issues include: mass displacement of citizens from their homes to allow for climate change mitigation projects; lack of participation by citizens in project planning and implementation; citing and concentration of projects in poor and vulnerable communities; lack of governmental accountability on projects and the absence of review and complaint mechanisms for victims to obtain redress for these problems. These secondary human rights impacts of policy measures and projects aimed at mitigating climate change have not received sufficient attention in existing literature. The aim of this research is to examine and analyse the effects of climate change mitigation projects, specifically Clean Development Mechanism (CDM) projects, on the enjoyment of fundamental human rights. It considers how lessons from the approval and execution of CDM projects could inform thoughts on the value and requirements for mainstreaming human rights safeguards into international climate change regimes in general. It analyses the legal and theoretical prospects and paradoxes of adopting the United Nations Human Rights Based Approach (HRBA) as a framework through which human rights standards may be systemically integrated and mainstreamed into extant and emerging international legal regimes on climate change.

The Role of the 'Legal Rule' in Indonesian Law: environmental law and the reformasi of water management

Waddell, Sarah Kathleen January 2004 (has links)
In examining the role of the legal rule in Indonesian law, and in particular environmental law related to water quality management, this thesis questions the often expressed view that laws in Indonesia are sound, they merely fail to be implemented. It proposes that this appraisal of the situation does not take a sufficiently deep assessment and that a cause for non-implementation lies within the drafting of the laws themselves. It is argued that the ineffective system for environmental protection in Indonesia can be related to a failure to recognise the role of the legal rule in environmental law. A proposition presented in this thesis is that the arrangements for environmental law making in Indonesia lacks a strong rule foundation and, for this reason, it is not capable of producing shared understandings by lawmakers about producing and reproducing environmental law as legal sub-system. Another central proposition is that Indonesian environmental law has a form and style, which negates the role of the legal rule in environmental management and control. Despite the changes brought by reformasi, the central position of the legal rule in environmental law and, indeed, the necessary rule foundation to the development of the legal system, has yet to achieve full recognition. If this situation is related to the system of water quality management and pollution control in Indonesia, it can be seen that environmental improvement will not be achieved until underlying issues concerning the structure, form and style of environmental law making are addressed.

Svensson, Emelie January 2017 (has links)
When stress-related diseases are increasing, the preventive work becomes increasingly important. The aim with this essay is to determine established law about psychosocial working environment. With the legal dogmatic method, an investigation has been made about the law on working conditions and what it says about preventive work to the psychosocial working environment. After a profound investigation regarding the frameworks pros and cons, it is possible to draw the conclusion that the law on working environment should keep the character of framework. Even if this entails difficulties with interpretation, it is not suitable to regulate the details in a law that should be appropriate for every profession. By studying the regulations of Swedish Work Environment Authority, the law is clarified. However, they should also clarify the concepts, which the law refers to, in order to know when the law should be applied. The same problem occurs when an analysis is made of the declaration forms of accidents and incidents. As a consequence of a weakly formulated definition of “serious incident”, problems arise when applying the law. How stress-related incidents should be treated is also weakly formulated, which could complicate and delay the preventive work. This is because the employers only know that they should report the diseases but not the incidents.

Larsson, Frida, Widmark, Emelie January 2018 (has links)
The purpose of this study was to examine social workers view on the implementation of routines and guidelines related to workplace violence. How it is prevented and their thoughts about how the routines and guidelines around this subject are working from paper to practice. Violence is a general problem, although it´s more pronounced in organisations with close contact with clients. Laws regarding workplace state that both employers and employees are obligated to see to that the prevention work is fulfilled. The essay aims to find out if this is working in the real life or what the problem could be if it´s not working. The research approach of this study is qualitative and four semi-structured interviews are used. The obvious results were that there are flaws in the staff's knowledge of their own guidelines and action plans. The staff perceived that the workplace offers training about workplace violence and that there are meetings revolving around this subject but nonetheless they felt insecure about what to really do if a situation of violence occurs. The social workers also admitted that none of them had read the documents for prevention work. Although the workplace has clear routines and guidelines, much more work needs to be done to engage the employees and make everyone work together.

La contractualisation du droit de l'environnement / The contractualization of the law of the environment

Monteillet, Vanessa 23 November 2015 (has links)
Environmental law is a relatively young law. Due to its natural filiation to public interest, it was exclusively governed by the public authorities. But today, while "everyone has the duty to participate in the conservation and in the improvement of the environment" (article 2 of the Charter for the environment), it could not remain quartered in the realm of public law. The contemporary trend to the law contractualization, crossing lots of branches, concerns environmental law which draws from it the resources of its deployment. To this end, speaking about "contractualization of the environmental law" covers two realities. It is, at first, to notice that environmental law moves into the contract, whether it is a question of diversifying its environmental object or of letting proliferate environmental obligations there. The strategy is simple. Environmental law takes place in the contract. And the contract, like a Trojan horse, makes it penetrate the enclosure of the interpersonal relations. Like a vehicle for dissemination of environmental law, the contract becomes one management tool favoring its reception by individuals. It is, then, to notice that the contract acts on environmental law. In this connexion, the contractualization overlaps, for one part, the hypothesis of the negotiated law carrying a collective dimension in the elaboration of the law, and for another part, that of the spontaneous law revealing the normative potential of the individual contract. A profound structural transformation of environmental law is at work, putting the foundations of an ecological public order, the architecture of which slides "from the pyramid to the network". Such a change of face comes along with a change in philosophy, towards a sustainable development law. But it is more in the support of a sustainable development of environmental law that the dynamics of contractualization will find its relevance. In the contract and by the contract, environmental law expands: it shines and it stands out, ready to take up the challenge of its "modernization".

Right of the environment and the sustainable development in a French region with a measure of autonomy : the case of Mayotte

Roux, Vincent 22 November 2013 (has links)
In what measure does the legal status of a region with a measure of autonomy allow a better consideration of the right(law) of the environment and does it favor the sustainable development of a territory? The role of legal frameworks in enabling transparency in water utilities' regulation

Mova Al'Afghani, Mohamad January 2012 (has links)
This thesis evaluates transparency in the context of water utilities’ regulation by comparing legal frameworks in three jurisdictions: Victoria (Australia), England (United Kingdom) and Jakarta (Indonesia). Each of these jurisdictions is selected because of their particular ownership and regulatory model. The thesis analyses whether specific ownership or regulatory models will have implications for transparency. The terms “transparency” and “water utilities’ regulation” are first defined and form the thesis’ analytical framework. This is then applied against the three jurisdictions compared. By evaluating each of the three jurisdictions, the thesis expects to provide explanation on how transparency is enabled or inhibited by the legal frameworks. The thesis recommends a solution by comparing the three jurisdictions and generating “lessons learned”.

The participative processes in the management of the ecosystems in western Africa : a contribution to the environmental democracy

Niang, Pathé Marame 01 June 2015 (has links)
The participative processes basing on the principles of information and participation regarding environment contribute to the environmental democracy in Africa the West. This contribution is made beyond the implementation of these principles in the management of the ecosystems, by the research for an environmental social justice and the attempt to implement (operate) the principles of good governance in the service of the management of the ecosystems and the respect for human rights in the field of the environment. However, so that the participative processes make a better contribution to the environmental democracy in western Africa, it is necessary that the legal framework of the participation of the public is clarified. This legal framework concerns as well the access to the information, the procedures of participation of the public in the decision-making and in the management regarding environment, but especially to offer the possibility to the public to be listened by the justice or by of other one methods of payment of the disputes regarding environment and regarding management of the ecosystems.
