This study focuses on the impact of legal representation in general as well as on CCMA proceedings involving unfair dismissals relating to conduction on capacity. The study also touches on the common law position before the enactment of Labour Relations Act 28 of 1956 and Labour Relations Act 66 of 1995. Rule 25 of CCMA rules which makes provision that legal representation at CCMA arbitration proceedings relating to fairness of dismissal and party has alleged that the reason for dismissal relates to the employees conduct on capacity, the party is not entitled to be represented by a legal practitioner. The dissertation analyses the effect of this provision on the Constitutional rights to legal representations well as rights relating to fair procedure. Refusal of legal representation in certain instances is justified in the right of legislative requirements on obligation placed particularly on the arbitrator legislative measures which, justifies refusal of legal representation at CCMA that cannot be imposed without giving consideration to the Constitution. The study will highlight the South African case on position with regards to legal representation at CCMA. A literature study will be done using current and researched sources such as textbooks, law journals, and legislation, case law, conferences papers and internet sources. La représentation légale du mineur est un attribut général et impérieux de l'autorité parentale. Elle pallie l'incapacité générale d'exercice du mineur en dépassant la distinction classique entre l'autorité parentale sur la personne et l'autorité parentale sur les biens mais elle est indissociable du pouvoir de direction et de contrôle de la personne de l'enfant. Elle demeure cependant soumise au clivage s'agissant de la détermination des représentants légaux ou du régime des actes. En tant que prérogative parentale, elle est mise en œuvre de manière autoritaire car la volonté du mineur est exclue, mais la modération du pouvoir et l'association permettent d'atténuer les contraintes de la représentation. En dépit des obligations qu'elle implique, la nature familiale et parentale de la prérogative contribue par ailleurs à limiter le contrôle qui est exercé sur celle-ci. / The legal representation of the minor is an imperative and a general attribute of the parental authority. It compensates the general incapacity of the minor exceeding the classical distinction between parental authority over the person and parental authority over the goods, but it is inseparably linked with the power of direction and control over the person of the child. It remains however subject to division regarding the determination of legal representative or the regime of legal acts. As a parental prerogative, it is implemented in an authoritarian way because the will of the minor is excluded, but the moderation of the power and the association mitigate the constraints of the representation. In spite of the obligations that legal representation implies, the domestic and parental nature of the prerogative contribute furthermore to limit the control exercised over it

L'objet de la thèse est de faire une synthèse de la manière dont le droit est représenté dans la musique classique occidentale. Elle constitue une réponse à M. Carbonnier qui, dans son précis de Sociologie juridique, appelle de ses voeux une recherche sur la possibilité pour la musique de "suggérer" du droit. Un premier axe de recherche aura pour ambition - après une confirmation de la présence de phénomènes juridiques et d'acteurs du droit dans des oeuvres musicales - de circonscrire les raisons de la présence du droit dans une oeuvre, ainsi que la place du droit et les fonctions attribuées au droit dans cette oeuvre. Un second axe de recherche consistera, au décours des nombreux moyens utilisés par un compositeur (instrumentation et voix, harmonie et contrepoint, phrases et motifs musicaux) à identifier la façon dont l'écriture musicale représente le droit. Cette partie sera naturellement illustrée par des exemples musicaux. Ces deux premiers axes de recherche sont susceptibles de faire ressortir en facteur commun les différents caractères que la musique attribue au droit (l'importance de consensualisme, un monde contraignant, un cadre formaliste, un milieu conservateur,...) ainsi que la singularité du regard de la musique sur le droit. / This thesis, the subject of which is “Rights and law in according to music” is in response to Mr Carbonnier's “Précis de sociologie juridique” (Précis of legal Sociology) in which the writer suggest doing a research about the rights and law’s representation in music. The aim of this thesis, accordingly, is to enquire whether music does indeed involve rights and law – an associated legal phenomenon – and if so, what extent. In this context, all aspects covered by the terms “rights and law” are considered: the law, the judgement, the contract and the basis of authority – whether human or divine. As used here the term “music” represents solely that which falls within the scope of western classical music, be it of a religious or non-religious nature. The wording “in according to” refers therefore to the different aspects inherent in “the rights and law’s representation in music” which is the subject’s problematic: - rights and law for the use of music: after confirmation of the presence of rights, law and legal actors in the five hundred or so works reviewed, the purpose of this first part is to explain why these legal requirements exist in a musical work, what these requirements define and how they apply in this work. - rights and law concerning musical composition: this second part , based on many of the musical procedures used by composers (instrumentation and voices, the use of harmony and counterpoint, musical phrasing and motifs, expression and rhythm), aims at identifying how the musical composition represents rights and law.

For the practical implementation ofthe Constitution extensive changes to the current Legal Aid Scheme are essential . This work is an investigation of the justification of an accused's right to legal representation and the right to be provided with legal representation at the expense of the State . The practical implementation of the Constitution is discussed and suggestions are made that might be a solution to the current problem of the provision of legal aid at the State's expense. / Die Grondwet van die Republiek van Suid-Afrika 200 van 1993 wat op 27 April 1994 in werking getree het, het konstitusionele erkenning verleen aan 'n beskuldigde se reg op regsverteenwoordiging . Although s 9 of the new Constitution 1 guarantees the right to life, there is no express provision which abolishes the death sentence. Whereas in the past the death sentence could only be avoided by the exercise of judicial discretion or political and public pressure, its imposition will now have to be entirely re-evaluated. Not only are all the laws of the country subject to the new Constitution, 2 but so too a Constitutional Court will be operational which will have the power to test the constitutionality of any such laws. By looking at the standards and relevant issues which are considered to define the constitutionality of the death sentence internationally, reviewing current application of the death sentence in South Africa, drawing comparisons, and by studying the problems unique to the South African situation, it will be the aim of this dissertation to determine how the death sentence will fare under a Constitutional Court. / Criminal & Procedural Law / LL.
