Procuramos demonstrar que os princípios basilares da doutrina dos direitos humanos: liberdade e autonomia individual, e igualdade, são ideais não concretizados pela democracia moderna; por extensão, os próprios direitos humanos tornaram-se promessa não cumprida. As políticas imigratórias implementadas pelos agentes estatais, principalmente nos principais países receptores de pessoas, colocam em evidência a problemática envolvendo o direito de “ir e vir”, a condição de “cidadãos do mundo”, as fronteiras da liberdade e dos direitos humanos. Às políticas estatais de cada país cabe a definição de novas cidadanias e, por pressuposto, dos novos sujeitos de direitos. No Brasil, verificamos a transição de ações que no passado visavam atrair imigrantes para práticas de restrição à entrada de pessoas no território nacional, além da instituição dos critérios de seleção como mecanismos regulamentares. O privilegiamento de determinadas categorias de imigrantes encontra respaldo nas diretrizes políticas voltadas para o desenvolvimento/progresso, em um mundo que prima pelo conhecimento especializado. A categoria de “indesejados” é representada pela parcela de indivíduos que passa a viver à margem dos direitos (objetivos e subjetivos) no país. _______________________________________________________________________________ ABSTRACT / This study is an effort to delineate the problem envolving migratory processes in a general way and, in particular, the Brazilian migratory policy, at the light of the relation with human rights, and within the controversies envolving notions of State-nation and national sovereignty. We try to demonstrate that the basic principles of the human right's doctrine: liberty and individual autonomy, and equality, are ideals not achieved by modern democracy; and therefore, human rights themselves became a promisse not fulfilled. The immigration policies implemented by the state agents, mainly in the countries which receive people, put in evidence, considering the recent migratory phenomenon observed all over the world, the problem envolving the right to "go and come", the condition of "world citizens”, the frontiers of liberty and of human rights. The state policies of every country should be in charge of the definition of new citizenships and, therefore, of the new subjects of rights. In Brazil, we observe a transition of actions, that in the past aimed at attracting immigrants, to practices of restricting the entrance of people in the national territory, besides the adoption of selection criteria as regular instruments. The privilege of certain categories of immigrants find shelter in the political lines committed to development/progress, in a world that esteems specialized knowledge. The category of "nonwanted” is represented by the group in individuals that start to live on the margin of rights (objective and subjective) in the country.

O estudo reflete sobre alguns processos vivenciados pelas classes marginalizadas da sociedade, e tem como elementos norteadores da investigação, os espaços e a realidade dos fenômenos sociais que permeiam os atores pesquisados. Conhecer essa realidade é requisito básico para poder compreender seus valores, suas culturas e sua subjetividade, nos espaços de inserção social. A pesquisa se desenvolve por meio de narrativas e depoimentos de adolescentes em situação de privação de liberdade, estabelecendo a relação entre o texto e o contexto explorados. Para tanto, principia-se com a depreensão do cenário onde se deu sua internação (Sinop/MT), anterior à transferência para Cuiabá/MT. Posteriormente, discute sua trajetória de privação de liberdade, bem como seus desafios, no contexto do Centro Socioeducativo. A pesquisa se concentra nas teorias que contemplam as discussões sobre os temas: igualdade e liberdade; liberdade e autonomia; relações de igualdade e liberdade negativa e/ou positiva; privações de liberdade e vulnerabilidade social. Através do recurso de entrevistas, o estudo assinala suas trajetórias, para discutir como esses adolescentes e a sociedade constroem um caminho de possibilidades e impossibilidades, diante da constituição de políticas públicas de processos de inclusão social. / This study is dedicated to knowing the trajectory of deprivation of liberty of some adolescents in the city of Sinop/MT, which were transferred to the Center of Socio Education of Cuiabá/MT. The study discusses some of the processes experienced by the marginalized classes of society, and is the guiding elements of research, space and reality of social phenomena that pervade the actors interviewed. To know this reality is a basic requirement in order to understand their values, their culture and subjectivity, in the spaces of social inclusion. The research is developed through narratives and interviews of adolescents in situations of deprivation of liberty, establishing the relationship between text and context explored. To do so, begins with the apprehension of the scene where he gave his internment (Sinop/MT) previous to the transference to Cuiabá / MT. Later, we discussed the trajectory of deprivation of liberty and its challenges in the context of the Center of Socio Education. The research focuses on theories that include discussions on the themes: equality and liberty, liberty and autonomy, relationships of equality and negative liberty and/or positive; deprivation of liberty and social vulnerability. Through the use of interviews, the study points out their careers, to discuss how these adolescents and society construct a path of possibilities and impossibilities, ahead the constitution of public politics of processes for social inclusion.
