Environmental licensing is one of the most important instruments of environmental management, seeking the realization of the fundamental right to an ecologically balanced and sustainable development. Despite its importance, the environmental licensing has not been more effective due the conflict related to the authority to regulate regardind environmental law. This essay will analyze the structure of competence distribution for conducting the environmental licensing processes, the conflict between laws, the performance of the municipal environmental agencies, the cooperation between the licensing agencies and the future about the additional regulatory law of article 23 of Federal Constitution / Em sistemas federativos complexos como o encontrado no Brasil, onde se prev? a atua??o simult?nea da Uni?o, dos Estados e dos Munic?pios em diversos aspectos, a defini??o dos limites de atua??o de cada um destes entes, seja sob o aspecto legislativo, seja sob o ponto de vista material, gera diversos conflitos (positivos e/ou negativos) de compet?ncia, trazendo inseguran?a para os administrados em geral. Presença do gênero autoajuda na formação de professores : práticas de leitura de estudantes em cursos de Pedagogia

Cette thèse étudie le phénomène de la présence et de la circulation de la littérature de développement personnel destinée à l’éducation dans les licences de Pédagogie. Elle se propose de comprendre et de problématiser l’insertion du genre développement personnel parmi les pratiques de lecture d’étudiants en formation pour l’exercice de la profession d’enseignant. Elle a pour objectifs d’analyser les modes par lesquels les étudiantes établissent des rapports avec ces lectures, leurs motivations et les répercussions dans leurs pratiques, ainsi que la problématisation des significations attribuées à l’ascension de la littérature de développement personnel tournée vers la profession d’enseignant. L’enquête a rassemblé des informations sur les pratiques de lecture de deux cents vingt-quatre (224) étudiantes de licence en Pédagogie dans cinq Institutions d’Enseignement Supérieur (IES), situées dans l’État de Rio Grande do Sul. L’empirie est constituée de données quantitatives et qualitatives, issues des réponses obtenues à partir d’un questionnaire et d’entretiens semi-directifs avec les étudiantes et les chefs de département de licence de Pédagogie. La problématisation théorique s’appuie sur des auteurs thématisant la littérature de développement personnel, la formation d’enseignants et les pratiques de lecture, dont Roger Chartier, Bernard Charlot, Francisco Rüdiger, Fernando Ampudia de Haro, Arquilau Romão e Dora Marín-Díaz. Les données recueillies nous permettent d’affirmer que la littérature de développement personnel pour les enseignants intègre les pratiques de lecture d’étudiantes de la licence de Pédagogie, soit comme lectures de formation, suggérées par les professeurs de la licence en question, soit comme lecture professionnelle ou lecture du temps libre. D’après les étudiantes, la littérature de développement personnel se présente comme une lecture accessible, pratique, facile à comprendre, stimulante et agréable. Une approche émotionnelle est évoquée par la discursivité caractéristique du genre et est fortement présente dans les publications d’Augusto Cury, Içami Tiba, Gabriel Chalita e Hamilton Werneck. D’après les récits des étudiantes, ces publications suscitent une réflexion sur leurs pratiques d’enseignement et les aident dans la préparation des cours. En outre, les ouvrages de développement personnel ont été indiqués par quelques professeurs de licence de Pédagogie, ce qui rend évident l’urgence de dialogues et d’appréciations critiques dans les licences des IES qui ont participé à cette étude sur les effets de légitimité produits à partir des indications issues du corps enseignant dans la formation initiale. / Trata-se de tese que investiga o fenômeno da presença e circulação da literatura de autoajuda voltada à educação em cursos de Pedagogia. Propõe compreender e problematizar a inserção do gênero autoajuda entre as práticas de leitura de estudantes em formação para o exercício da profissão docente. Dentre os objetivos, destaca-se a análise dos modos como as estudantes se relacionam com essas leituras, suas motivações e as repercussões em suas práticas, bem como a problematização dos significados que assume o ascenso da literatura de autoajuda considerando a profissão docente. A investigação reuniu informações sobre práticas de leitura de duzentas e vinte e quatro (224) estudantes de cursos de Pedagogia de cinco Instituições de Ensino Superior (IES), situadas no Estado do Rio Grande do Sul. A empiria está composta por dados quantitativos e qualitativos, resultantes de respostas obtidas a partir da aplicação de questionário e de entrevistas semiestruturadas com estudantes e coordenações de cursos de Pedagogia. A problematização teórica se pauta em autores que tematizam a literatura de autoajuda, a formação de professores e as práticas de leitura, em especial Roger Chartier, Bernard Charlot, Francisco Rüdiger, Fernando Ampudia de Haro, Arquilau Romão e Dora Marín-Díaz. Os dados coletados permitem afirmar que a literatura de autoajuda para professores integra as práticas de leitura de estudantes de cursos de Pedagogia, seja como leitura de formação, sugerida pelos docentes do curso, seja como leitura profissional ou de tempo livre. Segundo as estudantes, a literatura de autoajuda apresenta-se como leitura acessível, prática, fácil de entender, motivadora, prazerosa. Uma abordagem emocional é evocada pela discursividade característica do gênero e está fortemente presente nas publicações de Augusto Cury, Içami Tiba, Gabriel Chalita e Hamilton Werneck. Ainda segundo os relatos das estudantes, estas promovem a reflexão sobre suas práticas docentes e auxiliam no planejamento pedagógico. As narrativas das estudantes apontaram que títulos de autoajuda foram indicados por alguns professores de seus cursos de Pedagogia, o que evidencia a urgência de diálogos e apreciações críticas nos cursos das IES participantes sobre os efeitos de legitimidade que são produzidos a partir das indicações vindas do corpo docente na formação inicial. / This is a thesis that investigates the phenomenon of the presence and circulation of Education-focused self-help literature in Pedagogy courses. It aims to understand and discuss the inclusion of self-help genre among reading practices of students working to become teachers. Among the objectives, the highlight is the analysis of the ways in which students relate to these readings, their motivations and the impact on their practices, as well as the discussion of the meanings of the rise of self-help literature considering the teaching profession. The research gathered information about reading practices of two hundred and twenty four (224) students of Pedagogy courses from five Higher Education Institutions (HEI), located in the state of Rio Grande do Sul. The empiria is composed of quantitative and qualitative data resulting from responses to questionnaires and semi-structured interviews with students and coordinators of Pedagogy courses. The theoretical discussion is based on authors who thematise self-help literature, teacher education and reading practices, especially Roger Chartier, Bernard Charlot, Francisco Rüdiger, Fernando Ampudia de Haro, Arquilau Romao and Dora Marín-Díaz. The collected data enables to state that the self-help literature for teachers is part of the reading practices of Pedagogy students, both as class readings, recommended by the course teachers, and as professional or free time readings. According to the students, the self-help literature is easy to read and understand, practical, motivating, enjoyable. An emotional approach is evoked by the typical discursivity of this genre and is strongly present in publications of Augusto Cury, Içami Tiba, Gabriel Chalita and Hamilton Werneck. According to the students’ statements, these publications promote reflections on their teaching practices and are helpful for the pedagogic planning process. The students’ narratives indicated that self-help books were suggested by some of their teachers from the Pedagogy courses, which highlights the urgent need for dialogue and critical assessment in the participating HEI’s courses about the effects of legitimacy that are produced by course teachers’ reading suggestions in the early years of teacher education.

The introduction describes in brief the copyright, especially its inclusion in the law system, the definition of basic principles and sources of law. Further it concentrates on personal and property authors' rights in its specific forms. The next chapter deals thoroughly with the legal definition of fine art, including both its traditional and modern forms. The following part summarizes the means of legal protection of fine art, by both private and public actions. The fifth chapter presents a legal and philosophical reflection on the protection of art in public space, street art and graffiti, the unique art forms that come often into conflict with the third parties' rights. First, it offers an excursion to the basics of copyright, its development and contemporary issues. The work provides classification of copyright in the system of intellectual property rights and briefly explains the differences between continental and Anglo-American concepts. The following chapters attempt to define the terms "author", "work" and "painting". Then, it deals in more detail with specific types of artworks, such as restoration, book illustrations, derived works, parody and cartoon and street-art. In the next chapter, the thesis explains the relationship between the author and the owner of the work and some copyright restrictions that this situation brings, in the subchapter the work analyzes the export of painting artworks abroad. The thesis focuses on the current situation of legal regulation of small trades in the Czech Republic, in particular on the impacts following the so far latest of the more complex amendments of the trade law, implemented by the Act no. 130/2008 Coll. The sense of this amendment was to simplify the starting of trade activities and in maximal degree ease the bureacratic burden of businessmen in their contacts with Trade Licencing Offices. The most important changes brought by this amendment are described in the succession and context of the Trades Licencing Act content as a whole. The thesis deals with the historical evolution of the trade law,it also defines the basic concepts and institutes of trade activities, as subjects of trade law, trade licence, the Trades Register, Trade Licence Offices etc. The last part of the thesis delivers the results of a survey carried out among the traders and Trade Licence Offices.

The subject of this thesis is open source software and free software in term of utilization for business. The goal is to provide conditions and areas suitable for using of open source software and free software. The theoretical part gives basic terms, a list of organizations active in this area, classification of free software and a comparison of particular free software licenses. The practical part includes results of two inquiries of free software using: 1) personally made inquiry in Czech firms, 2) Internet inquiry of users. Further, a search of available free programmes has been made -- in term of utilization. The main benefit of the work is an evaluation of business opportunities for free software in particular utilization areas and determination of business models suitable for them. In the framework of this work, the author made an Internet portal on free software - to make the results of the work and external sources available to the public.

The thesis deals with legislative regulation of franchising in the Czech Republic and which areas of law have influence on franchise agreements and how is this relationship to other areas of law solved. The thesis focuses on content of franchise agreements, on typical provisons of franchise agreements according to antitrust law, on protection of intellectual property rights, on unfair competiton and on personal data protection. Some aspects are discussed according to laws of the USA and Germany and are compared to Czech legislation. Available court decisions which deal with franchising were also used in the thesis. Gained knowledge was used to analyze franchise agreement of NATURHOUSE and to suggest some improvemenst in the agreement.

Within the frame of the ecological policy, there exists a number of instruments for a protection of environment and to solve problems related to it. Single types of instruments are established on diferent principles which leads to long-lasting arguments of economists on fitness or unfitness for purpose. At the application of administrative instruments of regulation, as it is described by neoclassical economy theory, a question arises, if this strict solution is effective and practical in light of meeting targets of the environmental policy. Arguments which hold the view that the EU Directive on industrial emissions in the metallurgy sector implementation, as an above mentioned administrative instrument, is effective and practical can be displaced in case of comparison with well set alternative instrument - marketable emission licences.

Le sportif professionnel employé par une entreprise sportive est aujourd’hui généralement considéré comme un véritable salarié, titulaire de tous les droits et débiteur de toutes les obligations découlant de l’existence d’un contrat de travail. Pendant longtemps, la qualification de contrat de travail a pourtant paru incongrue, en raison de l’originalité de l’environnement normatif propre au domaine sportif.Il est vrai que la situation juridique du sportif salarié est empreinte d’une grande originalité : les transferts et les prêts de joueurs entre clubs, la mise à disposition d’un sportif auprès d’une fédération et l’exploitation commerciale de l’image d’un sportif posent des problèmes qui sont parfois très éloignés des préoccupations classiques du droit du travail.Les apparences sont pourtant trompeuses. Le sportif professionnel est avant tout un salarié, placé dans une situation certes spécifique, mais qui justifie l’application du droit du travail. Le contrat de travail du sportif professionnel est soumis aux exigences du droit : seule une prise en compte des données sportives permet de les adapter.Ces particularités de la relation de travail sportive méritent d’être étudiées, car les questions relatives à la formation, l’exécution et la rupture du contrat de travail du sportif professionnel supposent des réponses adaptées à ses conditions d’emploi. / The professional sportsperson who is employed by a sporting firm is generally considered nowadays as a bona fide worker, legally entitled to all of his or her rights and debtor of all the obligations entailed from the existence of a work contract. Yet for a long time the term ‘work contract’ seemed incongruous, given the originality and the normative environment pertaining specifically to the sportsperson.Indeed the legal situation of the wage-earning sportsperson (that is to say all his or her rights and obligations) is very specific; the issue of the transfers and loans of players between clubs, that of the provisioning of an athlete to a federation or of the commercial exploitation of a sportsperson’s image can be far removed from the standard issues of labour law.Appearances are however deceiving. The professional sportsperson is first and foremost a worker, admittedly one who is in a specific situation, but one for whom the application of labour law is justified, except in the case of more favourable conditions. A professional sportsperson’s work contract is subject to the requirements of state law; only when sporting data is taken into account can these requirements be adapted.These specificities in the sporting work relationship deserve to be studied, for the issues concerning training, the implementation and the breach of a sportsperson work contract require answers that are adapted to his or her employment conditions.
