Compliance Risk Analysis: The article is an updated version of a presentation by Dr. Christian Rosinus at the Liechtensteiner Gespräche

Zündorf-Girard, Julian 28 November 2023 (has links)
The text discusses the importance of risk analysis in the context of Compliance Management Systems for companies in German criminal law. It emphasizes that, despite personal criminal liability for individuals, companies can face consequences through special rules for fines or confiscation orders if their representatives commit offenses on behalf of the company. A common offense leading to such consequences is the breach of supervisory duties under Section 130 of the German Act for Administrative Offences (OWiG). The text highlights the necessity of a Compliance Risk Analysis as the foundation for any Compliance Management System. This analysis involves three key steps: identifying structural compliance risks, evaluating the existing compliance management system, and analyzing risks based on consequences and probability. The structural analysis examines existing compliance structures such as guidelines, training, and process descriptions. Key points include the significance of corporate culture in compliance, focusing on the 'tone from the top,' the 'zero-tolerance principle,' and the error culture. The text concludes with the definition and implementation of measures to avoid risks, encouraging regular risk analyses for continuous improvement of compliance management systems. In summary, the text addresses how companies can identify, assess, and manage risks related to legal compliance to establish and maintain effective Compliance Management Systems.

Cheshmmishi, Aylar, Sedin, Elsa January 2024 (has links)
A public-private partnership (PPP) is a collaborative partnership between the publicsector and a private entity. The adoption of PPPs has risen throughout the years, utilizedfor developing cultural infrastructure. With the increase in opting for PPPs, the numberof failed PPPs has shown to be due to inefficient risk management procedures. This thesisdelves into the realm of public-private partnerships (PPPs) and examines the integrationof stakeholder management in the risk identification process, aiming to answer thefollowing research question: How do the public sector and private sector in a public-private partnership respectivelyconsider stakeholder management when identifying risks? Through a qualitative single case study of a PPP project in Sweden, the research aims toprovide insights into how key actors in PPPs consider stakeholders when identifyingrisks. The study emphasizes the importance of stakeholder theory in enhancing riskidentification practices within the context of collaborative ventures. By exploring thecomplexities of PPPs and the dynamics of stakeholder engagement, this researchcontributes to the existing literature on effective partnership arrangements and riskmanagement in public-private partnerships (PPPs). The findings highlight thesignificance of incorporating stakeholder perspectives in risk identification strategies tofoster successful outcomes in PPP projects. To answer the research question, semi-structured interviews were conducted with thepublic and private entity involved in the PPP chosen for the case study. This study notonly offers theoretical implications for understanding the interplay between stakeholdertheory and risk management but also provides practical insights for organizations seekingto establish and maintain successful PPPs. The research underscores the critical role ofclear project objectives, defined partnership responsibilities, communication, andcollaboration in sustaining long-term partnerships. By bridging the gap betweenstakeholder theory and risk management, the study offers a theoretical contribution forunderstanding how stakeholder engagement can enhance risk identification strategies in PPP projects. Overall, this thesis contributes to advancing knowledge on stakeholder considerations inPPPs and offers recommendations for enhancing risk identification measures incollaborative ventures.

To adapt, organizations began to implement changes in its administrative and operational structures and, hence, improved their internal control systems. This study aims to identify and analyze the internal control and risk management practices implemented on the Brazilian commercial aviation companies. The commercial aviation industry, in addition to working with small operating margins, deal directly with lives of passengers and their own employees every day, which requires an alignment of internal control practices and risk management within the company culture. It is an empirical research, qualitative and descriptive, supported by bibliographic and documentary research. To achieve that goal interviews have been conducted with managers and representatives of the accounting / financial areas as well as areas involved in operation and maintenance. The results show there is a big diversity between the internal control and risk management procedures when you compare administrative and operating areas, but also between companies. It has been noted that the internal control settings usually used are related with the duties the airline companies have with national and international institutions.

LIBRACE, GIOVANNI 03 April 2008 (has links)
This thesis outlines the importance that risk management is getting in the life of organizations. Stakeholders, ranging from employees to investors, must understand how to quantify the tradeoffs of risk against the potential return, because the failure to identify and manage the essential nature of risk can have consequences on the possibility for an organization to achieve its objectives. After introducing the concept of risk, it is analyzed the Enterprise Risk Management (ERM) approach and the benefits for companies that decide to adopt it. In particular there is a focus on its importance in some circumstances in the life of an organization and it is shown how evaluation of risk profile and responses can be critical in mergers and acquisitions, public offer of securities and other corporate finance decisions. Due diligence process and, in particular, risk management and insurance due diligence is described as an effective instrument to understand to what risks a company is exposed to and how it manages them. In conclusion, some transaction solutions (i.e. representations & warranties insurance, public offering of securities insurance, environmental solutions) - that can be used to mitigate the company risk profile, transferring some risks to specialized insurance markets - are illustrated.

Genuskonstruktionen inom tillfälliga kriscentra : Förstås med hjälp av Bacchis; What’s the problem represented to be? / Genderconstruction in emergency shelters : Understood with help from Bacchis; What’s the problem represented to be?

Marner, Charlotte January 2014 (has links)
This essays main focus will be on emergency shelters in disasters, and their understanding in gender awareness, by focusing on the way gender is constructed and seen. This dissertation will examine documents from Australian Red Cross and IASC (Inter Agency Standing Committee) in order to explore how they work with gender and shelter related issues. The objective is to examine and with help from these documents see how gender is constructed. The method and theory is based on Carol Bacchis; What’s the problem represented to be approach? (WPR-approach). This means that the essay have a discourse analysis basis, which the essay is built on. This was chosen because Bacchis approach interrogates the documents and therefore it is easier to get different views of how gender is constructed. Which way it is constructed and what is not constructed as a problem. The main research question is: How is the construction of gender perspective in the documents that are intended to steer the planning of the emergency shelters?   The questions will be; What or which problems seem to represent these documents, regarding gender understanding in emergency shelters? Are there any assumptions behind these formulated problems? If so, what are they? During the review of the documents, is there anything left that is seen as a non-problem, not problematized? Are there any gap or invisibility or can the problem be seen as something else? This essay will show how gender is constructed based on power imbalance. The way gender is constructed is complex and difficult. One thing is clear and that is that the way gender is constructed and how gender is represented, matters in emergency shelters. Gender is still also a topic for crisis management to integrate.

Innovation and new product development by SMEs : an investigation of Scottish food and drinks industry

Vyas, Vijay January 2009 (has links)
This dissertation reports the results of case studies on innovation and new product development in eight Scottish food companies and a subsequent triangulation survey of 85 innovative Scottish companies. The case studies are carried out using qualitative research methods and a realistic inductive research strategy. It is found that the case study companies use an informal and cross-functional innovation process, which is independent of the age of enterprise. It is also discovered that these companies develop new products, often luxuriant variants of their existing products, which are mainly indulgences rather than healthy foods and are sold mostly to large retailers. Use of production methods that are amenable to quick changes in final products and networking with customers, suppliers, other food companies and Scottish Enterprise is also observed. Creative people with high innovative proclivity, who often travel to new locations in search of product ideas, drive the process. The case study companies are high-variety-low-volume businesses, possess good understanding of customer needs and circumstances and are able to achieve a good fit between needs of the market and their own resources. Not facing financial constraints, these companies are able to attract and retain talent, needed to develop new products. Continuously learning from their NPD endeavours, they sell their products without any major advertising or marketing effort. The subsequent triangulation survey of 85 innovative Scottish companies, from food as well as non-food sectors, confirms most of the above-mentioned findings. Contrary to the case study results however, the survey discovers that innovative Scottish companies face financial constraints while developing new products, do not sell most of their new products to large retailers or undertake travel to new locations in search of product ideas. The main contributions to knowledge by this research include crystallisation of the new product development practices in Scotland, highlighting difference in product innovation between various sub-groups of enterprises, a new conceptual construct within which all notions and definitions of innovation can be accommodated and identification of a basic flaw in the present innovation policy in Scotland.

Management rizik ošetřovatelské péče / Risk management of nursing care

HANZLOVÁ, Eliška January 2008 (has links)
The aim of our work was to map the process of identification, evaluation, and implementation of activities directed at prevention or management of nursing safety risks in organizations providing urgent ward care in the Czech Republic from the point of view of top management of nursing. Our work traced a quantitative research. For collecting data we used a non-standard questionnaire made up only for the purposes of this work. The questionnaire was distributed by the top representative of nursing management (ward sister/deputy in charge of nursing care) of the above specified health centres. The research was carried out in the period February - April 2008 and for assessment of the results obtained we used 110 questionnaires. For the purposes of our work we determined six hypotheses. Hypothesis 1 saying that hospitals create conditions for the development of safe organizational culture proved true. For the future it is essential to discuss this topic more profoundly, as well as to get rid of the fear of punishment for acknowledging a mistake and accept the fact that we all make mistakes, therefore we must minimalize their frequency and consequences and above all learn from them. Hypothesis 2 stating that hospitals watch risk factors for occurence of emergencies proved true, too. As a negative finding we can consider proving hypothesis 3 saying that hospitals do not reveal particulat risks of nursing care until the elimination of their consequences. Uncovering insufficient use of proactive strategy led us to a more detailed description of a FMEA method. Hypothesis 4 saying that hospitals have created a procedure for occurence of emergency and hypothesis 5 - nursing personnel is obligated to observe and report at minimum three kinds of emergencies related to nursing care proved true, too. The last hypothesis 6 presenting the fact that hospitals do not make their patients/clients involved in prevention of mistakes of medical workers was also confirmed by the results, but it was pleasant to find out that 43,3% of respondents stated that this possibility is being used at their place. We suggest to include the prevention of mistakes in the nursing process whether by means of particular nursing diagnoses or global education of patients/clients. As a suggestion of a feasible content of education we translated and adapted a document SPEAK UP into Czech named 7P.

It is effective in bringing the much needed awareness and relief to devastated communities. There are four main challenges that impact on this disaster relief partnership have been realized by this study. These namely are the delays in the reimbursement process, the constant change of government personnel dealing with relief partners, absence of a disaster relief official on the sites of distress and unsubsidized expenses incurred by the relief partners. Having realized these challenges, the study makes policy implementation recommendations.
