Searching for breakdowns on the diversion routes from SEN tribunals : an exploration of disagreement resolution processes

Study One: Special Educational Needs and Disability Tribunals (SENDIST) provide independent adjudication of parental appeals against Local Authority (LA) decisions. The Parent Partnership Service (PPS) and Disagreement Resolution Services (DRS) are both arranged to reduce disagreements and, specifically, to prevent tribunals. Study One aimed to explore parental experiences of Local Disagreement Resolution Services (LDRSs) including the PPS and DRS. A secondary aim of Study One was to identify barriers to and facilitators of disagreement resolution from a parental perspective. Methods: Study One utilised semi-structured interviews as a means of exploring seven parents' experiences and constructs. Interview transcripts were analysed using thematic analysis in order to specify key themes relating to the resolution of disagreements about SEN. Results: Parents reported a sense of embattlement with the Local Authority that appeared to act as a barrier to the resolution of disagreements. Parents also identified a number of facilitators of disagreement resolution including: Feeling 'listened to'; Having access to a 'legitimate decision-maker'; and becoming better informed. A number of barriers to disagreement resolution were also reported, including but not limited to: a perception that no one is listening to them; a perception that LA staff lack independence; a perception that the LA cannot be trusted to deliver SEN provision. Methods: Study Two utilised semi-structured interviews as a means of exploring six LA-employed professionals' experiences and constructs. Interview transcripts were analysed using thematic analysis in order to specify key themes relating to the resolution of disagreements about SEN. Findings emerging from Study Two were integrated with findings from Study One using the themes generated through thematic analysis. Results: Professionals reported a number of parental factors that were perceived to act as a barrier to disagreement resolution. These included but were not limited to: weak understanding of SEN systems and a lack of confidence to engage in mediation processes. Professionals did not identify any parental factors perceived to be conducive to disagreement resolution. A smaller number of facilitators of disagreement resolution were reported, including: early intervention; and face-to-face meetings. Synthesis of findings from Studies One and Two resulted in the creation of clusters of themes that can inform future policy and practice. Findings from Studies One and Two indicate that disagreement resolution is best supported where Local Authorities can promote: collaboration, information-sharing, and reassurance for parents.

The impact of modes of mediation on the web retrieval process

This research is an integral part of the effort aimed at overcoming the limitations of the classic search engines. This thesis is concerned with the investigation of the impact of different modes of mediation on the web search process. Conceptually, it is divided into three main parts. The first part details the investigation of methods and mechanisms in user profile generation and in filtering search results. The second part deals with the presentation of an approach and its application in the development of a mediation framework between the user and the classic Web Search engines. This involved the integration of the explicit, implicit and hybrid modes of mediation within a content-based method, and was facilitated by the adoption of the Vector Space Model. The third part presents an extensive comparative evaluation of the impact of the different types of mediation systems on web search, in terms of precision, recall and F-measure. The thesis concludes by identifying the contribution of the research programme and the satisfaction of the stated objectives.

Abstract This study analyzes an attempt at integration of a pre-school class, a leisure-time center and an elementary school in Sweden. The integration was organized in the form of Vertical Track which implies a successive development of groups comprising children between six and twelve years old, pre-school teachers, recreation pedagogues, and schoolteachers. The integration was prompted by state governed reforms such as the 1992 law allowing six-year olds to start compulsory school. The study is based on cultural-historical activity theory and was carried out as participant observation and action research. The study addresses the question of the potentials and alternative goals for change and development of the present school pedagogy and classroom practice that integration implies. Special attention has been paid to what tools might potentially mediate in processes of integration. A research and educational program, the 5thD, was jointly created between researchers and teachers and located in a Vertical Track. The capacity of this complex tool as a mediator in the multicultural Vertical Track structure was explored. It is argued that the Vertical Track as an instantiation of the integration reform represents an arena for potential expansive transformation. However, in order for integration to have an impact on the pedagogical practice in schools, teacher interactions need to be mediated by communicative and conceptual tools. It is suggested that the 5thD program is an example of such tools. Civic experiences and public connection : media and young people in Estonia

How do young people in Estonia experience the political, politics and citizenship? How are these civic experiences connected to young peoples’ experiences with the media? Anne Kaun’s thesis Civic Experiences and Public Connection presents a theoretical and empirical investigation of how civic experiences, particularly public connection, emerge in the context of contemporary Estonia. Employing open-ended online diaries and in-depth interviews, she aims to develop an in-depth understanding of how young people experience democracy today, and how they express themselves as citizens; expression not only through the physical performance of citizenship, but also through orientation, interest in, and reflection about issues that are of common concern or should be seen as such. The empirical investigation of public connection as critical media connection, playful public connection and historical public connection, is based on narrative analysis and embedded in a theoretical exploration of key concepts in the context of civic culture studies, namely the political, politics and citizenship. Combining Chantal Mouffe’s conflict theory with Paul Ricoeur’s narrative identity, Kaun aims to shed light on contemporary democracy from the citizens’ perspective. The author proposes a holistic approach to both civic experiences and the role that media might play in relation to them. Following a non-media- centric approach, she shows that media, despite their ubiquity, are an important but not exclusive source of the civic experiences of young adults in Estonia.

Mediating adolescent-caregiver conflict : guidelines for social workers

Thesis (M Social Work (Social Work))--University of Stellenbosch, 2007. / An exploratory and descriptive research was conducted and the predominant research approach employed for this study is a qualitative research approach, however, elements of a quantitative research approach was included for the purpose of obtaining the goal of the research. The outcome of qualitative research is in the form of descriptive data in the participant’s own words, thereby identifying the participant’s beliefs and values that underlie the phenomena of adolescent-caregiver conflict. Consequently, this qualitative study is concerned with non-statistical methods and small samples that were purposively selected. However, some of the processed data were presented in a quantitative manner, by means of tables and figures. By means of observation within the field of social work, it has been noted that there is an increasing need for intervention between adolescents and caregivers, as disputes occur increasingly between caregivers and their children, especially during the adolescent years. Social workers often take on the role of mediator, or use elements of mediation, acting as intermediaries and emphasizing collaborative and consensual processes when dealing with conflict. However, mediation has been utilized in many different situations and problems, but the social work profession has not kept pace with the rapid development of mediation as both a conceptual framework and a practice approach to conflict resolution in diverse settings. Therefore, in doing this research study, the researcher’s motivation is to provide the necessary knowledge in this relatively new field by means of a theoretical framework and practical guidelines in using mediation.

Conflict resolution theory and practice have been increasingly criticised for ignoring the centrality of culture in their attempts to find theories and models that are applicable universally, not only across cultures but also across levels of society. Mediation is one form of conflict resolution, which has come to occupy a central position in the resolution of disputes both at international and local levels. At the level of family disputes, family mediation has failed to engage users from different ethnic groups in England and Wales. This thesis explores the hypothesis that culture and, in particular, culturally defined concepts of gender are the important factors determining the success or failure of mediation in divorce disputes.

Dispute resolution in Muslim minority communities: the theory, practice, and potential of Islamic mediation

Mediation is a type of dispute resolution in which a third party intervenes to help disputing parties reach a mutually satisfactory agreement. In recent years, individuals and organizations have begun advertising Islamic mediation services. The development of this field has important implications for Muslims living in Western countries, as Muslim minority communities have long sought ways to resolve disputes according to their personal religious beliefs. Avenues for family dispute resolution—including the civil courts, informal Islamic courts, family counseling, and informal mediation by an imam—each have distinct drawbacks. Professional Islamic mediation could fill a significant gap in services. Although some work has been done on theoretical models of Islamic conflict resolution, little information exists on the current practice of professional Islamic mediation in Muslim minority communities. This study addresses this gap in knowledge through case studies of practicing Islamic mediators. Results indicate wide variation in the field in terms of how practitioners themselves define Islamic mediation. There were also distinct differences in the role the mediators played in relation to the disputing parties, what types of cases they mediated, and how they organized and funded their services. The lack of standardization in the field may be a positive thing, however, as different services may fill different needs in Muslim communities. / text
