Die ersten beiden Kapitel befassen sich mit Themen der Industriökonomie und Wettbewerbstheorie, wohingegen das dritte Kapitel Fragestellungen von Cheap Talk Spielen untersucht. Kapitel 1 untersucht die Folgen, die sich aus einer partiellen Akquisition zwischen Wettbewerbern ergeben. Kapitel 2 analysiert die Auswirkungen einer Forschungs-und Entwicklungs (FuE)- Kooperation auf die Investitionsanreize in einem Markt, in dem eine Mehrproduktunternehmer mit einem Einzelproduktuntfirma konkurriert. Kapitel 3 untersucht die Funktion der Mediation zur Erleichterung der Kommunikation mit privaten Informationen. / This dissertation consists of three independent chapters in the field of microeconomics. The first two chapters are concerned with topics of industrial organization and competition policy, whereas the third chapter addresses some problems in cheap talk games. Chapter 1 studies anti-competitive issues that arise from partial acquisition between competitors. Chapter 2 analyzes the effects of cooperation on R&D investment incentives in a market where a multi-product firm competes with a single-product firm. The third chapter examines the role of mediation in facilitating communication with private information.

It had two primary goals: characterizing the pedagogical mediation in semipresencial subject matters taken in VLE in Pedagogy courses; identifying the didactic mediation practices employed by the teachers teachers in VLE, and relating them to the basis of Cultural Historical Theory. As for the concept of mediation, this study was based on Vygotsky and other scholars Cultural Historical Theory. For pedagogical mediation through the use of digital technologies in education our references were: Toschi, Freitas, Durán and Peixoto. We aimed to clarify the following issues: How does the pedagogical-didactic mediation take place in semipresencial subject matters taken in VLE? What teaching practices characterize pedagogical mediation practices in semipresencial subject matters taken via VLE offered by the Pedagogy course? What relationships can be identified between the mediation concept based on the Cultural Historical Theory and the mediation practices employed by the teachers in the VLE pedagogical process? This qualitative study was carried out in two higher education institutions in Goiânia assessing five teachers conducting semipresencial subject matters in the Pedagogy courses. Data was gathered through questionnaires, interviews, VLE peerwatching, as well as the analysis of both pedagogical process and lesson plans. We compared both field research data and review of literature on pedagogical mediation in distance education and in VLE in light of the Cultural Historical theory. Data analysis pointed towards three types of mediation practices which we labeled as: practices related to the course dynamics and the use of VLE tools; communication and pedagogical-didactic practices. These were not isolated practices. Rather, they related back to specific aspects of each mediation process developed. We concluded that the teacher must be aware of how and when to make the pedagogical interventions with the aid of technology. This depends on how such mediation is planned, organized and carried out in the students knowledge acquisition process so as to meet the pedagogical agenda. It is crucial that the teachers practices are grounded in an educational theory that allows for the mediation of the students knowledge acquisition process. To do so, it is necessary to implement technology-based teacher training projects so that they can reassess their practice, and improve it in light of learning theories which guide the pedagogical mediation of semipresencial VLE- taught subject matters. / A pesquisa teve como objetivo principal analisar o processo de mediação pedagógica em disciplinas semipresenciais nos ambientes virtuais de aprendizagem (AVA) dos cursos de Pedagogia. Apresentou os seguintes objetivos: Caracterizar mediação pedagógica nos AVA em disciplinas semipresenciais dos cursos de Pedagogia; identificar as ações de mediação didática dos professores dos professores nos AVA e relacioná-las com os fundamentos da Teoria Histórico-Cultural. Quanto ao conceito de mediação a pesquisa fundamentou-se na Teoria Histórico-Cultural, de Vygotsky e alguns teóricos. Quanto à mediação pedagógica com uso das tecnologias digitais na educação as referencias foram: Toschi, Freitas, Durán, Peixoto Buscou-se esclarecer as seguintes questões: Como ocorre a mediação didático-pedagógica nos AVA das disciplinas semipresenciais? Que ações docentes caracterizam as práticas de mediação pedagógica nos AVA das disciplinas semipresenciais oferecidas pelo curso de Pedagogia? Que relações podem ser identificadas entre o conceito de mediação fundamentado na Teoria Histórico-Cultural e as ações de mediação dos professores no processo pedagógico nos AVA? A pesquisa de abordagem qualitativa, foi realizada em duas instituições de educação superior de Goiânia, tendo como sujeitos cinco docentes que atuam em disciplinas semipresenciais nos cursos de Pedagogia. Os dados foram coletados por meio de questionários, entrevistas, observação das aulas nos AVA, análise de projeto pedagógico do curso e dos planos de ensino. Foi realizado o cotejamento entre os dados da pesquisa de campo e a revisão de literatura sobre mediação pedagógica na EaD e nos AVA, com base no referencial da Teoria Histórico-Cultural. A análise dos dados apontou para três tipos de ações de mediação que denominamos: ações quanto ao funcionamento do curso e uso-operação das ferramentas do AVA; ações de comunicação e ações pedagógico-didáticas. Essas ações não ocorreram isoladas, mas relacionadas aos aspectos específicos de cada processo de mediação desenvolvido. Concluímos que o docente precisa saber como e quando fazer as intervenções pedagógicas com uso das tecnologias, o que depende da maneira como ele planeja, organiza e conduz a mediação do processo de conhecimento pelo aluno para que cumpra com a sua finalidade pedagógica. É necessário que o professor seja orientado por uma teoria de ensino que o instrumentalize em sua prática pedagógica de modo a que ele possa mediar o processo de construção do conhecimento do aluno. Para tanto, é necessário implementar projetos de formação de professores com tecnologia para que eles possam rever a prática, entendê-la e aprimorá-la à luz de teorias de aprendizagem que venham nortear a mediação pedagógica nos AVA das disciplinas semipresenciais.

Labour dispute resolution in Kenya: compliance with international standards and a comparison with South Africa

The thesis examines the effectiveness of the Kenyan labour dispute resolution system by undertaking a comparative analysis of South African and international labour standards. A comparative approach is adopted, which relies on primary and secondary sources of data, thereby undertaking an in-depth content analysis. The study provides a comprehensive discussion of the current legislative provisions and alternative dispute resolution (ADR) framework as recognised in both countries' national labour legislation as well as in a number of international labour standards instruments. In particular, the study illuminates and discusses the bottlenecks in the current Kenyan system and argues that it does not adequately respond to the needs of parties in terms of the international labour conventions. The study argues further that labour disputes should be resolved as quickly and informally as possible and at the lowest level possible. Similarly, disputes should ideally be resolved with little or no procedural technicalities, and without allowing them to drag on indefinitely. However, this study observes that there have been notable concerns in the current dual system of labour dispute resolution in Kenya. The problems include protracted referral timeframe for dismissal disputes, non-regulation of maximum timeframe for the agreed extension after 30 days conciliation period has lapsed, the absence of a statutory timeframe for appointing a conciliator/commissioner and arbitration process under both the Labour Relations Act, 2007 and the Employment Act, 2007. The study argues for Kenya to incorporate provisions in its labour laws of a proactive and expeditious dispute resolution thereby helping to resolve labour disputes in the most effective and efficient manner without necessarily having to resort to the courts. Likewise, the responsibility of resolving statutory labour disputes in Kenya is still heavily under the control of the government of Kenya through the Ministry of Labour. There is still no independent statutory dispute resolution institution (Conciliation, Mediation Commission) as envisaged by the Labour Relations Act, 2007. As a result, the Kenyan dispute resolution system has been criticised for lack of impartiality leading to the increases in strikes and lockouts. Similarly, it has made the attainment of effective and efficient labour dispute resolution difficult. In view of that, a comparative approach with South Africa is adopted with a view to informing Kenya how the establishment of independent institutions similar to the Commission for Conciliation Mediation and Arbitration, Bargaining Councils and specialised labour courts can lead to effective dispute resolution in Kenya. Given above, the study provides a wide range of remedial intervention intended to address the gaps and flaws highlighted in the study. Systematically, the study provides important suggestions and possible solutions for a better institutional framework and processes to address them. However, the study acknowledges that making effective and efficient labour dispute resolution a reality calls for renewed commitment from government and social partners and investment in appropriate human and financial resources. This requires a strong political will as well as concerted efforts from all role players in the labour relations community in the two respective countries.

Der umfangreiche Forschungsstand zum Thema Parteien weist in verschiedenen Bereichen Unklarheiten auf. So wird beispielsweise ein Zusammenhang zwischen dem Mitgliederrückgang der deutschen Parteien, gesellschaftlichen Modernisierungsprozessen und einem Funktionserfüllungsdefizit, speziell im Bereich der Vermittlungsleistung der Parteien, angenommen. Unklar hierbei sind u.a. folgende Punkte: (1) was genau unter dem Prozess der Mediation zu verstehen ist, (2) welche Modernisierungsprozesse beteiligt sind und (3) ob und wenn ja, wie sich er Mitgliederrückgang auswirkt. In der Summe führen diese ungeklärten Fragen dazu, dass letztlich auch keine verbindlichen Aussagen zum antizipierten Mediationsdefizit getroffen werden können. Explizit aus einem soziologischen Fokus heraus gibt diese Arbeiten systematisch Antworten. Im ersten Kapitel wird geklärt, was unter einer Partei im soziologischen Sinne zu verstehen ist und was die Mediationsfunktion der Partei konkret ausmacht. Im zweiten Kapitel rücken die Parteien und deren Mitglieder in den Mittelpunkt. Es geht um die Frage, welche Aufgaben von dieser Seite erfüllt werden müssen, damit die Vermittlung reibungslos stattfinden kann, d.h. im Umkehrschluss wo sich gegebenenfalls Defizite verorten lassen. Neben allgemeinen Merkmalen von Mitgliederparteien, rücken hier auch sozialstrukturelle Merkmale der Parteimitglieder sowie erste Modernisierungsprozesse in den Vordergrund. Im dritten Kapitel wird die Problematik von der anderen Seite, der Gesellschaftsseite, angegangen. Auch hier wir danach gefragt, welche konkreten Schritte für die Umsetzung der Mediationsfunktion realisiert werden müssen. Zudem werden weitere Modernisierungsprozesse betrachtet. Es wird sich im Abschlusskapitel zeigen, dass die Vermittlungsfunktion der Parteien zu keinem Zeitpunkt fehlerfrei realisiert werden konnte, sich die Problematik seit den 1980er Jahren verstärkt hat was heute dazu führt, dass unkonventionelle Gruppen und Institutionen, z.B. neue soziale Bewegungen oder NGO´s, immer stärker in den politischen Vermittlungsprozess einbezogen werden (müssen). / The extensive research on the subject parties shows ambiguities in various areas. For example a correlation between the decline in membership of the German parties, social modernization processes and functional performance deficit, special in the mediation of political parties, is assumed. Unclear in this context are inter alia the following points: (1) what exactly is meant by the process of mediation, (2) which modernization processes are involved, and (3) whether, and if so, how it affects members of decline. In sum these unresolved issues cause ultimately no binding statements can be made to the anticipated deficit mediation. Explicitly from a sociological focus publishes this work systematically answers. In the first chapter will clarify what is meant by a party in a sociological sense and what constitutes the mediation function of the party concrete. In the second chapter the parties and their members in focus. It is about the question of which tasks must be performed by this page so that the mediation can take place smoothly, a contrario where optionally can locate deficits. In addition to general characteristics of member parties socially structural features of party members and first modernization processes move in the foreground. In the third chapter the problem from the other side, the company side, addressed. Again we asked what concrete steps for the implementation of the mediation function must be implemented. In addition, further modernization processes are considered. It will show in the final chapter that the mediation function of the parties could be realized without errors at any time, the problem has intensified since the 1980s, which leads today that unconventional groups and institutions, for example new social movements and NGOs, are becoming more involved in the political process of mediation (have to).

This contribution describes an experiment carried out by a team within the ReMath (Representing Mathematics with Digital Media) European Project (http://remath.cti.gr). Within this project six digital dynamic artefacts (DDAs) have been developed, thirteen experiments have been planned (Artigue & al., 2007) and carried out, analysis of the collected data are still in progress. In this contribution, we focus on the case of the Aplusix DDA (http://aplusix.imag.fr), from the point in which the designers deliver their product to the team in charge of planning the experiment, up to the point in which the artefact is experimented within the ReMath project.

Tem como objetivo geral conhecer e analisar o discurso dos bibliotecários da BC/UEL quanto à mediação implícita da informação, e como objetivos específicos localizar a literatura científica dentro da CI documentos que abordam os seguintes termos: biblioteca universitária, mediação, mediação da informação, mediação implícita e explícita da informação, interferência e apropriação, e discuti-los; discutir o conceito de mediação da informação na literatura da área de CI; identificar qual é a relação entre mediação implícita da informação e o fazer do bibliotecário; investigar se o discurso dos bibliotecários a respeito da mediação implícita é referido a processos do ambiente de trabalho em que atuam e se faz referência ao usuário final; realizar um contraponto entre o que a literatura diz a respeito da mediação implícita e o discurso de mediação implícita no discurso dos bibliotecários; verificar se existe um consenso entre o saber dos bibliotecários pesquisados em relação ao tema e as condições de produção de discurso. Realizou-se uma pesquisa de caráter exploratório e descritivo. A pesquisa é de natureza aplicada com uma abordagem qualitativa, sendo bibliográfica de início e posteriormente valendo-se de uma coleta de dados. Utiliza a entrevista semiestruturada como instrumento de coleta de dados e como método de análise dos dados a Análise do Discurso. Como resultado apresenta: o discurso dos bibliotecário entrevistados quando ao processo e o conceito de mediação implícita em forma de quadros e citações, a posição que cada bibliotecário ocupa dentro da BC/UEL, as condições de produção em que o seu discurso é produzido e o interdiscurso desses sujeitos. Conclui-se que os bibliotecários conhecem o termo mediação da informação, mas ainda se referem a ele como “ponte”. Já o conceito de mediação implícita ainda é desconhecido por alguns, mas desperta a curiosidade entre os participantes. Os bibliotecários reconhecem que são mediadores e afirmam desempenhar suas tarefas para disponibilizar a informação e promover o acesso ao usuário. Contribui para a busca da informação por parte dos pesquisadores e profissionais interessados na área de Mediação da Informação, mas também e principalmente, quanto à Mediação Implícita da informação relacionada ao fazer do bibliotecário. / Mediation of Information and university library are the aims of this research, which discusses the process of mediation and the librarian on duty. It presents a discussion regarding Implicit Mediation of Information within the work environment of librarians at the Central Library (CL) from the State University of Londrina (UEL). Its general purpose is to understand and analyze the discourse of librarians from the CL/UEL as for the implicit mediation of information, and as specific purposes: to locate in the Information Science (IS) scientific literature, documents that discuss the following terms: university library, mediation, mediation of information, implicit and explicit mediation of information, interference and appropriation, and discuss them; discuss the concept of mediating information in the IS literature; identify what is the relationship between implicit mediation of information and the librarian performance; investigate whether the librarians’ discourse about the implicit mediation is related to processes of the work environment in which they operate and if it refers to the end user; make a counterpoint between what the literature says about the implicit mediation and the implicit mediation discourse in the librarians’ discourse; verify if there is a consensus between the knowledge of librarians surveyed on the topic and the conditions of discourse production. This is an exploratory, descriptive applied-natured research with a qualitative approach, firstly bibliographical and then making use of a data collection. It uses a semi-structured interview as a tool for data collection and the Discourse Analysis as a data analysis method. The results show: the discourse of respondent librarians concerning the process and the concept of implicit mediation in tabular form and quotations; the position that each librarian occupies within the CL/UEL; the discourse production conditions and the inter-discourse of these subjects. It concludes that librarians know the term mediation of information, but still refer to it as a "bridge"; however, the concept of implicit mediation is still unknown to some of them, but arouses curiosity among participants. Librarians recognize they are mediators and state that they perform their duties to provide information and promote access to the user. Contribute to the search for information by researchers and professionals interested in the field of Information Mediation, but especially to what the Implicit Mediation of information concerns in terms of the librarians’ work.

Determining jurisdiction at conciliation and arbitration

Jurisdiction is the power or competence of a Court to hear and determine an issue between parties, as well as the power to compel the parties to give effect to a judgment. The approach of a CCMA commissioner faced with a jurisdictional challenge is therefore an important issue that requires legal certainty. Unfortunately, our case law has not been uniform with regard to the various issues surrounding jurisdiction of the CCMA, for example: what facts need to be established in order for the CCMA to have jurisdiction and at what stage of the process should a commissioner deal with the issue of jurisdiction. The purpose of this treatise is to consider the various approaches of our courts to the issue of the jurisdiction of the CCMA and to determine what approach is practically best suited for CCMA commissioners when the issue of jurisdiction is in dispute. The research methodology is based on the various approaches of our courts to the jurisdiction of the CCMA as set out in Bombardier Transportation v Mtiya [2010] 8 BLLR 840 (LC). The more practical “third” approach as proposed by van Niekerk J, in Bombardier Transportation v Mtiya [2010] 8 BLLR 840 (LC), has been favoured by the Labour Court and the CCMA following the judgment. The correct approach of a commissioner when dealing with specific jurisdictional facts such as condonation and the jurisdiction of a bargaining council will further be considered. However, the predicament that commissioners face is that the Labour Appeal Court’s approach to jurisdiction is in conflict with that of the Labour Court’s approach. In conclusion, it is submitted that the Labour Appeal Court must pronounce on the issue of jurisdiction, taking into consideration the approach of the Labour Court as to create certainty regarding the correct approach of a commissioner when faced with a jurisdictional challenge.

L'actualisation du patrimoine par la médiation de l'architecture contemporaine / The actualization of heritage through the mediation of contemporary architecture

Dans la rencontre entre l’architecture contemporaine et le patrimoine bâti, la thèse propose de s’affranchir de la polarité conservation-création en analysant l’actualisation patrimoniale en tant que phénomène culturel à l’œuvre. La cohabitation entre le nouveau et l’ancien en architecture, si elle se pratique depuis plus de deux mille ans, est devenue un enjeu au XXe siècle.L’explosion des formes en architecture contemporaine, parallèlement à la montée d’une prédominance de la signature de l’architecte, semble a priori difficilement réconciliable avec l’extension de la notion de patrimoine, extension autant sémantique que géographique et spatiale. Or, que ce soit pour des raisons économiques et environnementales, fonctionnelles ou patrimoniales, les insertions d’éléments d’architecture contemporaine sur des bâtiments patrimoniaux transforment désormais le patrimoine d’objet-relique en un projet dynamique, constituant un genre architectural particulier et indépendant.L’actualisation est une façon de réinterpréter le patrimoine en lui donnant un sens actuel grâce à une action (en l’occurrence, un ajout architectural dans un style contemporain), ce qui modifie les représentations du lieu tout en lui ajoutant une couche de significations. Ce processus communicationnel se pose ainsi comme une réponse à l’obsolescence patrimoniale ; en transformant les représentations d’un lieu par un langage contemporain et en s’immisçant dans son processus de patrimonialisation.À travers trois cas espagnols récents, l’actualisation est observée dans trois types de manifestations : la « ponctuation » à l’œuvre dans l’accès au centre CaixaForum de Barcelone (Arata Isozaki), la « prolongation » du musée national Centre d’art Reina Sofía à Madrid (Jean Nouvel) et, finalement, la « révélation » du musée du Théâtre romain de Carthagène (Rafael Moneo) / In the relationship between contemporary architecture and built heritage, the concept of actualization (as a cultural phenomenon) offers an alternative to the opposition between old/new. Even if new architecture in old buildings has existed for 2,000 years, it became an important issue in the field of conservation during the 20th century.The explosion of new forms in contemporary architecture, together with the rise of iconic architecture and so-called starchitects, seems difficult to reconcile with the extension of heritage signification—semantically, geographically and spatially. However, new architecture within an existing fabric is sometimes necessary for economic, environmental or functional reasons, as well as for the sake of heritage. It is thus part of the actual praxis. From relic-object, heritage converts itself into a dynamic project, thus creating a particular and independent architectural style.Actualization is a way of reinterpreting heritage by giving it meaning through action (as in this case of grafting contemporary designs onto existing structures). This process of communication acts as a response to the obsolescence of heritage; by transforming a site’s representations and significance with a contemporary language and by intertwining itself in the patrimonialization process.The resulting architectural hybridity helps to create a mediation space that is both physical (with the architectural forms) and symbolic (through heritage and its representation).
