Cost Overrun in Swedish Infrastructure Transport Projects : An Analysis of Cost Overrun in Swedish Infratructure Transport Projects between 2010-2022

Cost Overrun is something that plagues infrastructure projects, both in Sweden and globally. The repercussion of it can be severe since it not only hurts the public’s perception of how the public authorities manage and allocates its resources, but also due to the immense opportunity costs that arise when the increased costs need to be covered. In general, the factors that lead to cost overrun in infrastructure transport projects can often be derived from technical, psychological, political, and economical factors, and it is not uncommon that there is a combination of these factors, which is why the subject of cost overrun is so complex. With a highly unique dataset, this paper examines cost overrun in Swedish infrastructure transport projects to see if there is a statistical relationship between cost overrun and the size of a project, its regional location, and whether it is a road- or railway project. Furthermore, an evaluation of the process of estimating and forecasting costs will be conducted. The results shows that the characteristics of regional locations have a significant relationship with projects experiencing cost overrun and that cost overrun is more common in smaller projects. There were no significant differences in cost overrun between types of projects, but it was found that between the period 2018 to 2022, cost estimates had been underestimated by approximately 34%.

Disability Bias and the Misrepresentation of Chronic Illness and Invisible Disability in Contemporary YA Fiction

Despite the success illness novels have acquired in the last decade, the misrepresentation of chronic illness in the Young Adult genre is still going unnoticed. In an ableist society that still needs to be educated about invisible disabilities, most of the contemporary YA writers insist on finding miraculous solutions and questionable happy endings to their stories. The aim of this thesis is therefore to study the different ways in which YA writers fetishize and understate invisible disability and to find a way to subvert it. By focusing on the miracle cure trope and romanticization in the case of Nicola Yoon’s Everything Everything, it attempts to highlight the characteristics of low-quality disability fiction and demonstrate why and how the use of disability biases can affect negatively both disabled and nondisabled young readers. In addition, through the scrutiny of the author’s first YA novel, Nothing Wrong with Snails, it then illustrates how the in-depth analysis of past disability literature improved the author’s personal craft and enabled them to portray chronic illness and invisible disability avoiding stereotypes, biases, and tropes. In conclusion, it argues that writers ought to rely on disability studies in order to reach higher standards in the representation of invisible disability in YA fiction.

In Sonap Petroleum (formerly known as Sonarep) (SA) (Pty) Ltd v Pappadog1an1s 1992 (3) SA 234 (A) the Appellate Division apparently approved the direct application of the reliance theory, without reference to prejudice or fault, to determine contractual liability in the absence of consensus. The various approaches to contractual liability in South African law are examined, and a comparative study of English law and the law of the Netherlands is conducted. It is submitted that the element of fault is not crucial to the enquiry, but rather, the elements of conduct , inducement and a reasonable reliance upon consensus. It is concluded that the test for contractual liability in the absence of actual consensus, as formula ted by the court in Sonap's case, without reference to prejudice or fault, has established sound precedent in South African law. / Criminal and Procedural Law / LL.M.

The (Mis)representation of the Middle East and Its People in K-8 Social Studies Textbooks: A Postcolonial Analysis

Critical examinations of cultural groups and the ways in which they are presented in schools are missing from current elementary and middle school curricula. Issues of this nature often fall under the umbrella of “multicultural education” or “cultural pedagogy,” but this rhetoric is dismissive in nature. Constructing the non-Western child as “culturally deprived,” “culturally disadvantaged,” or “at-risk” perpetuates an “us/colonizer” versus “them/colonized” mentality. The purpose of this study was to examine critically how the Middle East and its people are represented in U.S. social studies textbooks. Through the use of qualitative content analysis, 10 elementary and middle school social studies books from Florida, Texas, and Virginia were analyzed. Drawing largely from the postcolonial Orientalist work of Edward Said (1978/2003), this study unveiled the ways in which American public schools other children, specifically children of Middle Eastern or Arab descent. Othering occurs anytime an institution in power constructs a certain reality for a marginalized group of people.

Cette thèse intitulée "Le rôle des représentations dans l'enseignement du chinois à l'école élémentaire"s'inscrit dans le domaine de l'acquisition d'une langue étrangère. Elle cherche à rendre compte des modes de représentations de la langue chinoise induits au sein de dispositifs éducatifs nécessitant des contenus d'apprentissage, des enseignants, des pratiques pédagogiques et des acteurs sociaux. Ces représentations dépendent aussi de processus qui façonnent les usages linguistiques du chinois dans l'espace mondial. La thèse observe leur rôle pour mettre en question la façon dont on enseigne le chinois aux enfants. L'introduction relativement récente de la langue chinoise au programme scolaire de l'école élémentaire et la promotion de la langue chinoise comme lingua franca du futur témoigne de l'importance que la société accorde à cet apprentissage. L'auteur a rassemblé les représentations des différents acteurs : enseignants, parents et élèves, qui sont confrontés à l'enseignement du chinois, pour évaluer leur impact sur la façon dont on oriente le contenu de cette discipline afin de mesurer les enjeux linguistiques de ce choix.Les chapitres de cette thèse se sont inscrits dans un double cadre. D'une part, on a tenté d'analyser d'un point de vue pédagogique les rapports entre la représentation de la langue chinoise et les pratiques existantes qui sont trop souvent impensées. Ces pratiques étant d'ailleurs effectuées conjointement par des professeurs sinophones et des professeurs de chinois de langue seconde. It tries to account for the means of representations of the Chinese language induced within educative deployment requiring some contents as learnings, teachers, educational methods and social players. These representations depend also on the process that mould the linguistic uses of Chinese in the world. The Thesis observes their role to question the way of teaching Chinese to the children. The introduction relatively recent of the Chinese language into the scholar syllabus of the primary school and the promotion of Chinese language as lingua franca for the future show the importance that societ y attaches to this learning.This Thesis’s chapters are inscribed on a double bounds. On the one hand, we have tried to analyze from an educational point of view the links between the representation of Chinese language and the existing practices which are too often unthought. These practices are jointly carried out by the Chinese teachers and by teachers of Chinese as second language. On the other hand, we draw on the empirical material necessary to this analysis as part of the increasing role of Chinese as international language in the context of the growing importance of China in the heart of globalization.

Aujourd’hui, il n’est pas rare qu’une personne se trouve en position de faiblesse lorsqu’elle contracte. Une entreprise en situation de dépendance économique, un consommateur face à un professionnel, l’utilisation de plus en plus fréquente de contrats d’adhésion, sont autant de facteurs pouvant conduire à la vulnérabilité d’un contractant. Le risque est alors que la partie dite « forte » abuse de sa position pour pousser l’autre à s’engager dans une convention fortement déséquilibrée, profitant essentiellement à l’auteur de l’abus. Ce type blâmable de comportement se manifestant lors de la formation des contrats, la partie lésée devrait pouvoir trouver une protection à travers la théorie des vices du consentement. Toutefois, cette théorie se révèle aujourd’hui inadaptée pour protéger efficacement les contractants victimes d’abus. Ce constat s’explique principalement par le fait qu’elle est restée inchangée depuis 1804. Basée sur une conception individualiste du contrat, les conditions d’admission propres à chaque vice, que sont l’erreur, la violence et le dol, sont trop restrictives. Or, les inégalités contractuelles étant à ce jour plus prononcées, elles entraînent nécessairement davantage d’abus, c’est pourquoi il convient de restaurer une telle théorie pour protéger comme il se doit les contractants. C’est à travers la notion de dol que nous proposons de le faire. Ce choix n’est pas le fruit du hasard. Il se justifie par le fait que le dol est un délit civil, avant même d’être un vice du consentement. Plus précisément, il est la manifestation de la déloyauté précontractuelle. Le consacrer comme un fait altérant la volonté engendre alors deux effets négatifs. Le premier tient au fait qu’il apparaît, en droit positif, comme une notion complexe, source de contradictions. Le second consiste à ne pouvoir réprimer la malhonnêteté perpétrée lors de la formation des contrats que de manière imparfaite et ce, en raison du champ d’application trop restreint du dol, celui-ci étant cantonné à une erreur provoquée. En lui redonnant sa véritable nature, celle de délit civil viciant le contrat, id est d’atteinte à la bonne foi précontractuelle, on remédierait à ces deux imperfections. / Professional, or the increasing use of adhesion contracts (“take it or leave it agreements”), all are factors that can lead to the contractor’s vulnerability. The risk is, for the so-called “strong” party, to abuse its position in order to force the other party into a strongly unbalanced agreement, mainly in its own benefit. Since such a reprehensible behavior occurs during the contract formation, the weakened party should be able to find protection through the use of the defects of consent theory. However, this theory has proven inadequate to effectively protect abused contractors today. A major explanation is due to the fact that this theory remains unchanged since 1804. Based on an individualistic conception of the contract, conditions of admission of each defects of consent, such as error, abuse and fraud, are too restrictive. However, the more contractual inequalities exist, the more they will turn into abuse. Therefore, this is why such a theory should be restored in order to protect contractors. It is through the notion of “dol” (willful misrepresentation or fraudulent concealment) that we propose to do so. This choice is not a coincidence. It is justified by the fact that “dol” is a tort, even before being a defect of consent. Specifically, it is the manifestation of pre-contractual disloyalty. Its recognition as a fact altering willpower will generate two negative effects. The first is linked to the fact that “dol” appears to be a complex notion and a source of contradiction in substantive law. The second is not permitting to properly penalize the dishonesty perpetrated during the contract formation due to a too narrow scope of the “dol”, the latter being understood as an induced error. Giving it back its real nature of a civil tort defecting the contract and undermining the pre-contractual good faith, our work aims at finding a remedy to these two shortcomings.

Construction companies, in particular, abuse the objectives of BEE in order to secure multimillion-rand contracts. Misrepresentations, specifically to the Department of Public Works, are made in various forms and stages during the submission of tender documentation by contractors. The status of BEE company owners is abused in order to secure contracts. Apartheid in South Africa prevented black citizens from entering the corporate world and thereby attaining a quality education. The South African government has, since 1994, adopted the BEE policy in order to redress racial and economic imbalances of the past. Fronting (which is regarded as fraud) is detrimental to the objectives of BEE, which are governed by legislation. Fronting further negatively affects the transformation of the South African economy which could be globally competitive. The emphasis is on the remedies applicable to breach of warranty because insurers use these more frequently. The following solutions are suggested. An insurer should not be allowed to cancel in the event of misrepresentation (nondisclosure) if it would still have concluded the contract, knowing the truth. In the event of affirmative warranties a right to cancel should be available if breach of warranty reasonably affected the particular insurer's assessment of the risk, but not if the contract would still have been concluded. In the event of promissory warranties, cancellation should only be available if breach of warranty reasonably caused the loss.
