A comparative analysis of EIA report quality before and after 2006 in South Africa / Aletta Johanna van Heerden

On 18 June 2010 new NEMA 2010 EIA Regulations were promulgated and came into effect on 2 August 2010 in order to improve the effectiveness of EIA. The question of effectiveness, therefore still remains. The quality of EIRs under the 1997 regulations in South Africa has been researched, although not as extensively as in other parts of the world. It was concluded that the quality of EIRs in South Africa are generally satisfactory, although a number of problems were identified, e.g. timing of the EIA, the identification of activities which require authorization or not, the consideration of alternatives, the absence of any time limits, the absence of requirements for monitoring and enforcing compliance, and objectivity. The National Environmental Management Act (NEMA), (Act no 107, 1998) was amended and new regulations promulgated in 2006. No research has been published regarding the quality of EIRs produced in South Africa under the 2006 regulations. Since it was the intent of the new regulations to improve EIA effectiveness, it is necessary that the quality of EIRs produced under the new EIA system be investigated. As in the other studies in South Africa, the Lee and Colley review model was used as basis for the comparative analysis of the EIRs before and after 2006. A sample of 26 EIRs, 11 under the 1997 EIA system and 15 under the 2006 EIA system, obtained from the then Impact Assessment Directorate of the National Department of Environmental Affairs and Tourism (DEAT) archives in Pretoria were reviewed. The main conclusions were that the majority of the EIRs under the 1997 system were of an acceptable standard and that the overall quality of the EIRs did not improve after the promulgation of the 2006 regulations. The descriptive and presentational parts of the EIRs were more satisfactorily addressed, while the analytical parts such as impact significance were addressed less satisfactorily. EIR quality appears to be on par with international standards, but there are areas of distinct weaknesses. As the 2006 EIRs included some of the first EIRs conducted under the new regulations, there is potential for the quality to improve over time. However, the areas that still need attention are the identification and evaluation of impacts, impact magnitude and monitoring programmes. / Thesis (M.Sc. During the past few decades the focus of waste management in South Africa has been emphasised, especially in view of the increase in economic development which has resulted in an increase in commercial, industrial, hazardous, mining, power generation as well as radioactive waste. The iron and steel making industry in South Africa provides for a vast amount of recycling opportunities of various materials resulting from the iron and steelmaking process. The regulation of waste management in South Africa may have some significant implications on this particular industry. In this dissertation the history of waste management legislation in South Africa is researched. It is found that initially only waste disposal was regulated, but over time, in addition to disposal, other aspects were also regulated in terms of other pieces of environmental legislation, such as the recycling, recovery and storage of waste. In an attempt to provide for uniform waste management regulation in South Africa, and in order to achieve sustainable development by the provision of a new waste hierarchy, the National Environmental Management: Waste Act was introduced. As part of this legislation, a new definition of waste was also introduced. It is indicated as part of this dissertation that various interpretations of the definition of ‘waste’ are possible. It is also indicated that these various interpretations may not only have some significant implications for the iron and steelmaking industry in South Africa, but may also have significant implications for the implementation of the waste hierarchy, as envisaged in terms of current waste management legislation. In the light of the above, and after taking comments by the members of the South African Iron and Steel Institute into consideration, recommendations are made for an improved legislative framework for waste management in South Africa. It is recommended that there should be a trade–off between the protection of the environment and the re–use, recovery and recycling opportunities of materials available to industry in the short–term as well as the long–term. In order to achieve such a trade–off, it is suggested that the ‘End–of Waste’ criteria in South Africa be reconsidered and re–evaluated to ensure more legal certainty with regard as to exactly constitutes waste and to provide for a definition of ‘waste’ which is clearly defined. / Thesis (M. An evaluation of the gaps and barriers that exist between the national waste management policy and its implementation in formal and informal urban areas in the Ekurhuleni Municipality, South Africa

Waste management is a global challenge due to high waste generation resulting from high industrialization, urbanization and challenges relating to the efficient implementation of waste management policies acts and standards. Although South Africa has established a number of good waste management policies and related acts and standards, most municipalities still find it challenging to efficiently implement waste management strategies. Ekurhuleni Municipality is facing challenges with the implementation of effective waste management strategies and compliance to the National Environmental Management Waste Act (2008), (NEMWA) (Act No 59 of 2008). An evaluation of the gaps that exist between NEMWA and the local implementation in the formal and informal parts of the Ekurhuleni Municipality was undertaken in this study. Data on the waste management scenario as collected through questionnaires, interviews and observations revealed that differences relating to the poor establishment of an integrated approach to waste management exist between NEMWA and the local implementation of the act. This was realized through the fact that there is limited community education on waste management, no waste recycling facilities in some residences, irregular and insufficient collection of waste and non compliance with tariff payments for most informal residents and some formal residents. Differences also exist in the waste management strategies between the formal and informal areas of the municipality primarily due to the fact that the informal settlements are mostly unplanned and considered illegal. According to this study, informal residents are not billed for waste management services and as such most of them do not pay for waste management services. To that end, waste is not efficiently managed due to municipal financial constraints. Tre kommuners arbete med PFAS i dricksvatten : En kvalitativ intervjustudie om svårigheter och möjligheter

Today there are many uncertainties in the form of a lack of knowledge about perfluorinated and polyfluorinated substances (PFAS) regarding long-term risks to health and the environment, there is no efficacy data for many environments. The fluorocarbon bond is the strongest chemical bond, which means that PFAS can be transported long distances, for example through water streams and into the atmosphere. If surface water and groundwater are contaminated by PFAS, people are at risk of exposure to PFAS through the drinking water. It is therefore important to investigate and identify what difficulties and opportunities the municipalities see in their work to influence and reduce the occurrence of PFAS in drinking water with PFAS in water revenues and drinking water. The purpose of the study is to map what Halmstad, Linköping and Uppsala municipality see for difficulties and opportunities in their work on influencing and reducing the occurrence of PFAS in drinking water and how the result relates to scientific research about national environmental management. We have chosen to do a qualitative interview with an analysis of the interview using previous research on national environmental management about actions, cooperation and policy, directives, guidelines, and legislation. Some of the conclusions the study came to where that the municipalities see similar difficulties and opportunities in working with PFAS and have similar ways of working with PFAS. But there are still some differences and similarities in what they see for difficulties and opportunities in their work with PFAS. Difficulties that have been identified are inadequate or unclear guidelines, directives, legislation and insufficient limit values. It is also a difficulty that the municipalities do not know where all sources of PFAS pollution come from. Opportunities that have been identified are collaborations, knowing where certain parts of PFAS's pollution come from. One possibility that exists is to influence certain polluting activities by means of distribution routes, to submit activities to improve purification methods and to set requirements for sampling and remediation. / Det finns idag många osäkerheter i form av bristande kunskap om perfluorerade och polyfluorerade ämnen (PFAS) när det gäller långsiktiga risker mot hälsa och miljö, det saknas effektdata för många miljöer. Fluor-kol-bindningen är den starkaste kemiska bindningen vilket leder till att PFAS kan transporteras långa vägar, genom till exempel vattenströmmar och i atmosfären. Om ytvatten och grundvatten blir förorenat av PFAS så riskerar människor att exponeras för PFAS genom dricksvattnet. Det är därför av vikt att undersöka och identifiera vad för svårigheter och möjligheter kommunerna ser med sitt arbete med att påverka och minska förekomsten av PFAS i dricksvatten med PFAS i vattentäkter och dricksvatten. Syftet med studien är att kartlägga vad Halmstad, Linköping och Uppsala kommun, ser för svårigheter och möjligheter i sitt arbete med att påverka och minska förekomsten av PFAS i dricksvatten och hur resultatet förhåller sig till vetenskaplig forskning om nationell miljömanagement. Vi har valt att göra en kvalitativ intervju med en analys av intervjun med hjälp av tidigare forskning om nationell miljömanagement med avseende på åtgärder, samarbete och direktiv, riktlinjer och lagstiftning. Några av slutsatserna studien kom fram till var att kommunerna ser liknande svårigheter och möjligheter i arbetet med PFAS och har liknande sätt att arbeta med PFAS på. Men det finns ändå en del skillnader och likheter i vad de ser för svårigheter och möjligheter i deras arbete med PFAS. Svårigheter som har identifierats är otillräckliga eller otydliga riktlinjer, direktiv, lagstiftning och otillräckliga gränsvärden. Det är även en svårighet att kommunerna inte vet vart alla källor av PFAS-föroreningar kommer från. Möjligheter som har identifierats är samarbeten, att veta vart vissa delar av PFAS föroreningar kommer från. En möjlighet som finns är att påverka vissa förorenande verksamheter genom spridningsvägar, förelägga verksamheter att förbättra reningsmetoder och sätta krav på provtagning och sanering.

Comparative analysis of environmental impact assessment compliance by two developers in the Northern Cape province, South Africa

The study was undertaken to investigate the following: limiting factors faced by the developers in complying with the EIA conditions and to determine whether the various developers comply with the conditions. The study was undertaken by use of questionnaires, site visits, meetings, photographs, group interviews. Trained fields assistants were also used to administer the questionnaires in order to collect data. Data from two sites were collected between 2012 and 2014 and were intentionally collected in order to provide information regarding the implementation of mitigation measures. The collected data was subjected to SAS (statistical software). Chi-square test for independence was performed in order to compare the differences (Snedecor & Cocharen, 1978) between the two sites. Based on the results of the study, it is therefore recommended that competent authorities should consider drafting and supplying follow-up guidelines and these guidelines should also apply to all the relevant role players involved. / Environmental Sciences / M.
