Mezinárodní režimy proti obchodování s lidmi: Evropská zkušenost / International Regimes against Trafficking in Human Beings: European Experience

The target of this research is to reveal causal factors that influence the way policy goals and instruments of international organizations in the domain of human trafficking are designed. By tracking evolutions of anti-trafficking policies undergone by the Council of Europe and the Organization for Security and Cooperation in Europe, the thesis demonstrates impact of specific factors on changes in the functioning of international organizations. To unravel mechanism explaining the internal workings of a policy formation within an IO, the thesis considers and tests theoretical assumptions of three rivalling theories on institutions; the realism, historical institutionalism and neoliberal institutionalism. Premises of respective theories, which offer contrasting perspectives on the functioning of international organizations, will help to formulate corresponding independent variables. The dependant variable being the changing design of institutions, the detailed cross-case analysis spanning a period of one decade uncovers causal relations between independent dependent variables. Thus, by means of time series data collection, patterns revealing which of independent variables can be designed as responsible for observed changes becomes visible. La présente étude est consacrée à la politique étrangère de l'Azerbaïdjan entre grandes puissances et puissances régionales. Ce pays du Caucase du Sud accédant à l'indépendance en 1991 affirme sa singularité, entre confrontation et coopération avec ses voisins proches ou lointains. La question centrale est donc de savoir comment l'Azerbaïdjan peut justifier et éventuellement renforcer sa présence sur l'échiquier international alors qu'il se trouve au cœur des grands enjeux géopolitiques et économiques. Sa position le place au centre des rivalités entre des puissances telles que la Russie, l'Iran et la Turquie et, au-delà de son voisinage immédiat les États-Unis et l'Union européenne. Le pays est contraint à une politique étrangère équilibrée afin de ne pas s'aliéner les partenaires de l'ouest comme de l'est. Il tente également de tirer profit de l'exploitation des hydrocarbures de la Caspienne en vue de résoudre la question cruciale du conflit du Haut-Karabakh. / This thesis deals with the Azerbaijan policy between great powers and regional powers. Since its independence in 1991 the country of South Caucasus asserted its singularity. It sometimes confronts, sometimes cooperates with its neighbors. The key question is, therefore, how Azerbaijan can justify and possibly strengthen its presence on the international stage as it stands at the heart of great geopolitical and economic issues. Because of its location it is the center of rivalries between powers such as Russia, Iran and Turkey or the United States and the European Union. The country is compelled to a balanced foreign policy not to lose the support of either western or eastern partners. Baku also attempts to use the exploitation of Caspian oil in order resolve the crucial issue of the conflict over Nagorno-Karabakh.

On the basis of the revision of the power to impose on government procurement matter, the author analyses the content and scope of Plenary Court agreement 1/2015-TCE; to the light of the juridical and factual that will occur with the emission and issue of this binding precedent.In addition, the author works a prediction of the eventual contradictions on the application of the Plenary Court agreement that may occur in the juridical administrative system and the harmful consequences of the effectiveness of it. / A partir de la revisión de la potestad sancionadora en materia de contratación pública, elautor analiza el contenido y los alcances del Acuerdo de Sala Plena 1/2015-TCE; a la luz de las implicancias jurídicas y fácticas que se presentarán con la emisión y publicación de este precedente vinculante.Adicionalmente, se prevé las eventuales contradicciones en que la aplicación de este Acuerdo de Sala Plena puede generar en el ordenamiento jurídico administrativo; así como las nefastas consecuencias de su vigencia.
