The reform of criminal asset confiscation in Taiwan

In the end of 2015, the legislative yuan of Taiwan reformed the criminal confiscatory system in a significant way. The core idea of the new provision is to abolish the quality of subordinate sentence of criminal confiscation and make it an independent effect different from penalty and rehabilitative measure. The most important reforms are types the confiscation of criminal benefits a balanced measure quasi-unjustified enrichment, adds provisions about confiscating criminal incomes of third-party, and judges can announce confiscation independently, which are based on the spirit of depriving criminal benefits as far as possible. Besides, legislators also proclaimed the retroactive effect of the new provision. Nevertheless, this article will point out that the new provision promotes the modernization of criminal confiscatory system, but in some places violates the constitutional law.

On the punishment of white-collar and tax crime

Economic and tax crimes account for a significant proportion of criminal activity and result in considerable economic damage. In Germany, two of the most prominent offenders in this area in recent years were Thomas Middelhoff and Uli Hoeneß, both of whom served jail sentences. Taking advantage of the widespread media coverage of both cases, the following paper draws on economic theory to compare prison terms with fines. It argues that fines are preferred from an economic perspective and can therefore be considered a useful firstchoice punishment in cases involving white-collar and tax crimes. The paper sees itself in this regard as a plea.

This article focuses on putting this quest to an end, dissecting multidisciplinary approaches to solve the compliance glocalization problematics. It starts with the saga of the glocalization neologism, followed by the philosophical- and psychodynamics of compliance and its moral foundations in Kantianism, the development of integrity into actual business ethics and the vehemence of crosscultural awareness and management when doing business internationally. Finally, it establishes the Three Stages Theory and the EMB Guidelines for the glocalization of leadership, as the ordinary solution to compliance glocalization.

News media attention in Climate Action: Latent topics and open access

The purpose of the thesis is i) to discover the latent topics of SDG13 and their coverage in news media ii) to investigate the share of OA and Non-OA articles and reviews in each topic iii) to compare the share of different OA types (Green, Gold, Hybrid and Bronze) in each topic. It imposes a heuristic perspective and explorative approach in reviewing the three concepts open access, altmetrics and climate action (SDG13). Data is collected from SciVal, Unpaywall, Altmetric.com and Scopus rendering a dataset of 70,206 articles and reviews published between 2014-2018. The documents retrieved are analyzed with descriptive statistics and topic modeling using Sklearn’s package for LDA(Latent Dirichlet Allocation) in Python. The findings show an altmetric advantage for OA in the case of news media and SDG13 which fluctuates over topics. News media is shown to focus on subjects with “visible” effects in concordance with previous research on media coverage. Examples of this were topics concerning emissions of greenhouse gases and melting glaciers. Gold OA is the most common type being mentioned in news outlets. It also generates the highest number of news mentions while the average sum of news mentions was highest for documents published as Bronze. Moreover, the thesis is largely driven by methods used and most notably the programming language Python. As such it outlines future paths for research into the three concepts reviewed as well as methods used for topic modeling and programming.

More Obstacles for the Graduate Student Author: Open Access ETDs Trigger Plagiarism Detectors

Supporting graduate students as authors is one of the many services we provide at the University Library, University of Saskatchewan (USask). Graduate students often submit articles to journals based on content from their electronic theses or dissertations (ETDs). Recently, we have noticed an increase in the number of such article submissions being flagged for possible rejection on “plagiarism” or “prior publication” grounds. We suspect this may be because plagiarism detection software is increasingly being integrated into publishers’ article submission systems. This software is triggered by the existence of the student’s open access (OA) ETD in our institutional repository. This happens despite OA ETD inclusion in repositories being a common practice and despite journal policies often allowing submission of articles based on ETDs. We review common practices and guidelines around publishing of ETD content, two recent cases of journals initially rejecting such submissions by graduate student authors of our institution, and our reflections on this issue and how to address it.

Going digital? : The work processes with e-books at academic libraries in Sweden

Research regarding e-book management at academic libraries is scarce, especially referring to Swedish university libraries. The work with e-books regarding selection, acquisition, promotion etc. can give insight into the stance towards e-books and their use at Swedish academic libraries. Challenges and problems such as accessibility, licensing as well as DRM restrictions may hinder e-books from becoming worthy complements to printed books. This thesis gives more insight into the acquisition, work and distribution and general working processes with e-books at Swedish academic libraries. A total of eight Swedish university libraries with 13 representatives agreed to participate in semi-structured interviews. The main results are that selection and acquisition of e-books are both influenced by librarians themselves and by user demand, and that e-books are frequently used and sometimes even favored over print books. Complex licensing and DRM restrictions may lead to e-books not being fully appreciated, which is further complicated due to a lack of promotion of e-books by academic libraries. Academic e-books are offered in English due to a lack of Swedish titles. In some situations, print books are acquired, e.g. if electronic titles are not available or too expensive. Both formats have advantages and disadvantages regarding access, availability, usage and preference. While print books are cheaper and offer a tactile experience, e-books can be read by multiple users simultaneously and do not require storage space in contrast to print books.
