Les libertés publiques sont connues et réclamées par tous et partout. Elles doivent être protégées contre toute atteinte. Les atteintes portées aux libertés publiques le sont souvent par l'administration. La première institution à garantir les libertés publiques contre l'administration est le juge administratif, son juge ordinaire. Le juge administratif est le juge de l'administration, il juge son action, annule ou confirme ses décisions et lui adresse même des injonctions. La jurisprudence administrative montre que le juge administratif utilise souvent tous les instruments dont il dispose pour protéger les libertés publiques contre les atteintes qui leur sont portées par l'administration. Parmi ces instruments figurent l'interprétation étroite des cas d'incompétence du juge administratif en la matière, l'assouplissement du régime de recevabilité du recours, l'application extensive du référé-liberté, la faculté de compléter la lacune législative qui est d'ailleurs large et voulue dans le droit administratif, la création des principes généraux du droit, dont les plus importants sont le principe du caractère exceptionnel des limites aux libertés publiques et surtout des mesures de police et le principe d'égalité, l'interprétation restrictive des lois défavorables aux libertés publiques, l'interprétation extensive des lois favorables aux libertés publiques et l'engagement de la responsabilité publique au service des libertés publiques. / Public freedoms are known and demanded by everyone, everywhere. They must be protected against any attack. The infringements of public freedoms are often by the administration. The first institution to guarantee public freedoms against the administration is the administrative judge, his regular judge. The administrative judge is the judge of the administration, he consider his action, rescind or conform its decisions and directed her orders. The administrative case law shows that the administrative judge often uses all the instruments at its disposal to protect public freedoms against violations by the administration. These instruments include the narrow interpretation of the cases of incompetence of the administrative judge in the matter, easing the admissibility of the action plan, the extensive application of the petition for freedom, the ability to complete the legislative gap that is to also broad and deliberate in administrative law, the creation of general principles of law, the most important being the principle of the exceptional character of limits on public freedoms and especially of the police measures and the principle of equality, the restrictive interpretation of laws unfavorable to public freedoms, the broad interpretation of laws favorable to public freedoms and the commitment of public responsibility in the service of public freedoms.

No presente trabalho, explicitam-se os pressupostos para a pré(compreensão) da recuperação judicial, dentre os quais os deveres de medida aplicáveis ao processo de ponderação realizado com o intuito de interpretar os artigos da Lei n. 11.101, de 2005, e investigam-se os princípios constitutivos e gerais do instituto. Em seguida, realiza-se uma releitura dos pontos estruturais da recuperação judicial, tendo como ponto de partida os seus elementos essenciais, de modo que as propostas formuladas, inclusive quanto à natureza jurídica, ao conceito e aos objetivos do instituto da recuperação judicial, por eles serão norteadas. O trabalho, então, é direcionado para a interpretação do artigo 67, caput, da Lei n. 11.101, de 2005; dispositivo que determina a qualificação dos créditos concedidos ao devedor durante a recuperação judicial como extraconcursais em caso de a sua falência vir a ser decretada. O conteúdo normativo pertinente ao artigo 67 mantém relação material estreita com praticamente todas as decisões a serem tomadas pelos credores e pelo devedor no campo da recuperação judicial. No entanto, a doutrina, até o momento, cingiu-se a emitir comentários breves e bastante contraditórios a seu respeito; nenhuma decisão judicial dedicada a interpretá-lo e aplicá-lo transitou em julgado. / The present study explains the assumptions for the (pre) understanding of judicial reorganization, among which are the duties of measurement for the weighting process carried out in order to interpret the articles of Law no. 11.101, 2005. It also investigates the constituent and general principles of the Bankruptcy Law. In the sequence, there is a rereading of the reorganization structural points, beginning by its essential elements, so that the formulated proposals, including its legal nature, its concept and its judicial reorganization goals, are guided by them. The study is then directed to the interpretation of Article 67, caput, Law no. 11.101, 2005; provision which determines the eligibility of credits granted to the debtor during judicial reorganization as post-petition claims in case its liquidation comes to be enacted. The normative content of Article 67 maintains close material relation with virtually all decisions to be taken by creditors and by the debtor in the judicial reorganization field. However, the doctrine, so far, has confined itself to issue brief and very contradictory comments upon this subject; no court decision directed to interpret it and apply it became final.

Little Sewickley Creek: The Redesignation Process of a High Quality Stream to an Exceptional Value Stream

The Pennsylvania Department of Environmental Protection has set designated uses for all of the 83,000 miles of waterways based on their quality. Only the highest quality streams are afforded the highest protection with a High Quality (HQ) or Exceptional Value (EV). Little Sewickley Creek is designated as a High Quality-Trout Stocking Fishery and may warrant redesignation as an Exceptional Value waterway. The aim of the study was to provide technical data on the stream to support an EV reclassification. The report has compiled previous data and collected new data in order to file a formal petition to the PA DEP. The petition process involves consideration of physical, chemical, biological data on the stream, along with the land use of the watershed. Im ersten Teil der Arbeit wird zunächst aus der Perspektive der Staats- und Parteiführung untersucht, welche Rolle die Eingabe für ihr Verständnis von Verwaltung, Recht und Demokratie spielte. Dieser Frage wird in der Arbeit vor allem anhand der Geschichte der Eingabengesetzgebung und der in diesem Zusammenhang geführten Diskurse nachgegangen. Hierbei ist es besonders interessant herauszufinden, inwiefern die Eingabe als Mittel der Konfliktregulierung zwischen Regierung und Bürgern funktionierte und worin ihre Möglichkeiten und Grenzen bestanden. Aus der Perspektive der Bürger hingegen hatten Eingaben andere Funktionen. Sie wurden eingesetzt, um Alltagsprobleme zu lösen, um das Nichteinverstandensein mit Entscheidungen der Verwaltung oder der Regierung zu bekunden, um über Mißstände in der Gesellschaft zu informieren, um Behörden in Bewegung zu setzen, um Sonderzuteilungen zu ergattern oder einfach nur, um Streß abzubauen. Bei der sozialhistorischen Untersuchung der Eingaben liegt der Schwerpunkt einerseits bei ihrer rechtlichen Konstruktion und Wirkung, und zum anderen bei ihrer kulturellen Verankerung. So lassen sich anhand der Eingaben die Vorstellungen von Normen, Werten und Moralvorstellungen sowohl der Eingabenschreiber, als auch der Entscheidungsträger herausarbeiten. Zum anderen ist die Eingabe selbst nicht nur als ein Rechtsmittel, sondern vor allem als ein kulturell es Instrument zur Konfliktbewältigung interessant.

This thesis compares political participation by the public through the Swedish Parliamentary Ombudsman (PO) and the German Petitions Committee of the Bundestag (PC). Through studies of literature and statistics I examine how citizens can participate through the institutions, how frequently they do and the likelihood of sparking a debate while participating. Using media theories as well as theories of participatory and representative democracy I study how citizens can use these institutions for purposes of control and proposition. Both institutions deal with complaints but the PC also deals with propositions for legislation, making the institution more versatile. The PO deals with more cases than the PC and has more far-reaching competences and areas of inspection, although neither institution has binding decisions. Thus the direct advantage for citizens using the institutions is the chance of reaching out to media and the public through freedom of information laws and the German online petition forum. The PC to a larger extent fits the representative model while the PO in some respects is more a legal than a political institution, being managed by lawyers instead of MPs. Neither institution meets the ideals of participatory politics although the German official petition is closer to it.
