Tal linha de pesquisa foi eleita principalmente porque acreditamos que o universo redacional jurídico muito ganharia com o subsídio dessa ciência do léxico para o fim de debater a problemática da escolha do Direito, oferece-nos subsídios para analisarmos um corpus composto de petições jurídicas em um dado sincrônico considerando neles a presença de um vocabulário específico marcado pela ornamentação e/ou rebuscamento. Verificamos as manifestações de ornamentação e rebuscamento considerando as categorias expressivas: arcaísmos léxicos, expressões latinas, termos laudatórios e preciosismos. De acordo com nossa hipótese, as unidades lexicais singulares selecionadas segundo tais categorias remontariam a uma tradição vocabular do direito brasileiro resistente às mudanças temporais que se fariam necessárias desde o século dezenove. / The main purpose of this dissertation is to evaluate peculiar lexical units used in legal writing with the exclusive purpose of flourishing the style, using resources from Lexicology. We chose this line of research because we believe that legal writing could benefit from a critical lexical theory analysis in order to assist lawyers in improving their style in legal documents. Consequently, this study has tried to establish an interface between Lexicology and Law, offering instruments to analyze the legal vocabulary employed in legal petitions. For the purpose of this research, we took a set of legal pettions in a synchronic corpus and scrutinized the vocabulary regarding questions related to ornate style and/or rhetorical forms. The results were analyzed in accordance with the following categories of expression: archaisms, Latin phrases, laudatory terms and figures of speech. In conclusion, these categories fo lexical units are so rooted in traditional Brazilian legalese that they have resisted changes since the nineteenth century.

This study was also done with the object of ascertaining that socio- discursive imaginary was expressed in the discourses of the petitions. To achieve the aims, it was developed the following steps: the research contextualization, exposition of the main presupposition of semiolinguistica and argumentation, explanation about judicial argumentation and about the resources of logos and pathos as dimension of argumentative discourse; depiction of the genre Initial Petition from theories developed by Charaudeau (2004); description of the argumentative of the petitions; analysis constructed in verification, description and explanation of use of techniques and dimensions of logos and pathos by lawyers who intended to achieve the judge s accession; identification and description of socio-discursive imaginary in the petitions. In the end of the analysis, it was concluded that the notion of communication contract is very outstanding and guiding of petition discourses and the use of techniques of this dimension is regular. This regularity confirmed the peculiarity inherent to the judicial discourse. It was found out that the emotional arguments was also very important to emphasize argumentation, because once a moral damage is related to an emotional shock of the applicant by violation of his rights, the argumentation only based on logos would be not very consistent. It was also ascertained regularity in the use of pathos techniques, such three discursive movements was developed by the lawyers to touch the judge emotionally: the respondents were qualified in a pejorative way; the applicants were represented as honest people, victims of the respondents and, finally, the emotional shock suffered by the applicants were evidenced. It was clear that the lawyers voice is from the collectivity, with which they share values and principles, data confirmed by the verification of socio-discursive imageries of time notion as something valuable, a good name as a requisite for the subject has a good image in front of society and the contact, which is essential for human being s relationships. / Pautando-se na perspectiva da Teoria Semiolinguística articulada a teorias argumentativas, esse trabalho se propôs a investigar petições iniciais que envolvem ação de indenização por danos morais nas relações de consumo, verificando e descrevendo como os recursos das dimensões do logos e do pathos foram empregados pelos advogados na tentativa de persuadir a juíza de que o pedido de indenização por danos morais é válido. Esse estudo objetivou também averiguar quais imaginários sociodiscursivos foram expressos nos discursos das petições. Para alcançar os objetivos pretendidos, as seguintes etapas foram desenvolvidas: contextualização da pesquisa; exposição dos principais pressupostos da teoria semiolinguística e da teoria da argumentação; explanações sobre a argumentação jurídica e sobre os recursos do logos e do pathos enquanto dimensões do discurso argumentativo; descrição do gênero Petição Inicial a partir do arcabouço teórico exposto em Charaudeau (2004); descrição da organização argumentativa das petições; análise pautada na verificação, descrição e explicação do emprego das técnicas das dimensões do logos e do pathos pelos advogados que visavam alcançar a adesão da juíza; identificação e descrição dos imaginários sociodiscursivos presentes nas petições. Ao final da análise, chegou-se à conclusão de que a noção de contrato de comunicação é realmente muito marcante e norteadora dos discursos peticionais. Verificou-se a predominância da dimensão do logos nesses discursos e, ainda, uma regularidade no uso das técnicas dessa dimensão. Essa regularidade confirmou a peculiaridade inerente ao discurso jurídico. Averiguou-se que os argumentos de ordem patêmica também tiveram grande importância para fortalecer a argumentação, pois estando o dano moral ligado diretamente ao abalo emocional do requerente pela violação de seus direitos de personalidade, a argumentação baseada apenas no logos seria pouco consistente. Foi constatado também certa regularidade no emprego das técnicas do pathos, de modo que três movimentos discursivos foram desenvolvidos pelos advogados para tocar emocionalmente a juíza: os requeridos foram qualificados de maneira pejorativa; os requerentes foram representados como pessoas honestas, vítimas dos requeridos e, por fim, os abalos emocionais sofridos pelos requerentes foram evidenciados. Ficou claro que a voz dos advogados é oriunda da coletividade com a qual compartilham valores e princípios, o que foi confirmado pela verificação dos imaginários sociodiscursivos da noção de tempo como algo valioso, do bom nome como requisito para que um sujeito tenha boa imagem perante a sociedade e do contrato como indispensável às relações humanas.

No presente trabalho, explicitam-se os pressupostos para a pré(compreensão) da recuperação judicial, dentre os quais os deveres de medida aplicáveis ao processo de ponderação realizado com o intuito de interpretar os artigos da Lei n. 11.101, de 2005, e investigam-se os princípios constitutivos e gerais do instituto. Em seguida, realiza-se uma releitura dos pontos estruturais da recuperação judicial, tendo como ponto de partida os seus elementos essenciais, de modo que as propostas formuladas, inclusive quanto à natureza jurídica, ao conceito e aos objetivos do instituto da recuperação judicial, por eles serão norteadas. O trabalho, então, é direcionado para a interpretação do artigo 67, caput, da Lei n. 11.101, de 2005; dispositivo que determina a qualificação dos créditos concedidos ao devedor durante a recuperação judicial como extraconcursais em caso de a sua falência vir a ser decretada. O conteúdo normativo pertinente ao artigo 67 mantém relação material estreita com praticamente todas as decisões a serem tomadas pelos credores e pelo devedor no campo da recuperação judicial. No entanto, a doutrina, até o momento, cingiu-se a emitir comentários breves e bastante contraditórios a seu respeito; nenhuma decisão judicial dedicada a interpretá-lo e aplicá-lo transitou em julgado. / The present study explains the assumptions for the (pre) understanding of judicial reorganization, among which are the duties of measurement for the weighting process carried out in order to interpret the articles of Law no. 11.101, 2005. It also investigates the constituent and general principles of the Bankruptcy Law. In the sequence, there is a rereading of the reorganization structural points, beginning by its essential elements, so that the formulated proposals, including its legal nature, its concept and its judicial reorganization goals, are guided by them. The study is then directed to the interpretation of Article 67, caput, Law no. 11.101, 2005; provision which determines the eligibility of credits granted to the debtor during judicial reorganization as post-petition claims in case its liquidation comes to be enacted. The normative content of Article 67 maintains close material relation with virtually all decisions to be taken by creditors and by the debtor in the judicial reorganization field. However, the doctrine, so far, has confined itself to issue brief and very contradictory comments upon this subject; no court decision directed to interpret it and apply it became final.

This thesis investigates the problem of commencement of insolvency proceedings, content of an insolvency petition, the effects of insolvency proceedings and the decission about insolvency petition. In connection with the filing of insolvency petition focuses on issues of international jurisdiction. The paper also analyzed the empirical data relating to insolvency proposals. The aim is examining whether the current legal system of commencement insolvency proceedings can be misuse and whether the legal framework of international jurisdiction can be misuse. There are also examine various possibilities of misuse legislation. Also, the thesis focuses on the possible regulatory considerations.

Promotion of influence and design features of e-petitions : A quantitative study of relationships and digitalization

E-democracy may promote influence in political processes. A new e-democratic tool in Sweden is the e-petition. This thesis studies to what extent the e-petition implementations by Swedish municipalities promote citizen influence in political processes and the relationship between variations in citizen influence and e-petition design features. Considering the dynamic nature of digital artefacts and characteristics of digital innovation the design could be diverse, which could impact influence. A quantitative study was conducted through e-mail surveys and review of municipal websites, ranked and compared in two influence groups. This study revealed that influence varied to a high extent, indicating three design features impacting influence. The e-petition promoted influence and a relationship between the influence and design features existed. Future research should investigate the digitalization of the e-petition and characteristics of digital innovation to understand the social and institutional contexts better. If not understood, the consequences may be that organizations are unable to adapt to new circumstances.

E-petitions, or electronic petitions, are a relatively new form of political engagement that allow individuals to voice their opinions and concerns directly to their government. This case study examines the use of e-petitions in a Swedish municipality, with a focus on the experiences of both petitioners and policy makers. Through interviews with local officials, participants, and a review of relevant documents, this study explores the motivations behind the adoption of e-petitions, the processes by which they are implemented and managed, and the outcomes that have resulted from their use. Through a review of the literature and case studies, this essay explores the potential of e-petitions to facilitate meaningful dialogue between citizens and policy makers, as well as the challenges that must be addressed in order for them to achieve their full potential. The findings of this study suggest that e-petitions have had a positive impact on the municipality's democratic processes, providing a convenient and accessible way for citizens to engage with their government and have their voices heard. Overall, this case study offers valuable insights into the potential of e-petitions to facilitate citizen participation in local democracy.

Living well through story: land and narrative imagination in indigenous-state relations in British Columbia

Students of colonialism know well that the stories we tell have the capacity to make, maintain, or transform our relationships as well as our material futures. As earlier work has shown, Indigenous and settler peoples encountered and apprehended one another through story at first contact and in all subsequent contact moments, reaching right up to present-day mechanisms for negotiating conflicts over rights, resources, sovereignty, and historical injustice. In this dissertation, I explore in depth the role of story as a social practice in Indigenous-state relations, examining a series of key encounters over the last 150 years in which Indigenous peoples challenged and contested the state’s possession of their lands in what would become British Columbia. Informed by archival and community-based research with two Indigenous nations – the Stó:lō and the Haida – this study offers a history of Indigenous tactics in pursuit of the larger objective of decolonization, especially since the 1960s. Each of the four main chapters explores how Indigenous peoples have engaged distinct state-sanctioned mechanisms for addressing the state’s dispossession of their lands. The first chapter examines the dynamics of orality and literacy in a series of Stó:lō petitions from the late nineteenth century, a time when reserves were being reduced in order to accommodate a rapid influx of settlers seeking agricultural lands. Chapter 2 looks at Stó:lō experiences of treaty negotiation in the early twenty-first century, and how they are attempting to re-write the master narrative of Stó:lō -state relations. Chapter 3 focuses on the Haida blockade of logging in the mid-1980s, examining how the Haida acted into being what would become an iconic story of Haida nationhood. Finally, chapter 5 explores story and belief through a close study of the narrative dynamics of Haida participation in the Joint Review of the Enbridge Northern Gateway Project between 2012-2014. In each of these encounters, Stó:lō and Haida people exceed the limited narrative spaces they are assigned for communicating who they are and how they relate to their territories and to the state, while attempting to shift the established narrative. Recent scholarship on Indigenous-state relations has focused on how liberal settler states continue to exclude Indigenous peoples even through their gestures at including them into the body politic. While such work on the state is critical, I suggest that it is equally important to understand Indigenous peoples’ demonstrated capacity for collective cultural endurance, and how it exists in tension with the forces acting to assimilate and subsume Indigenous difference within the normative structures of settler society. This study attempts to grasp the nature of this endurance, and demonstrates how narrative is as central to Indigenous peoples’ repossessions of their land as it was to the state’s original dispossession of it. / Graduate / 2018-08-08

Im ersten Teil der Arbeit wird zunächst aus der Perspektive der Staats- und Parteiführung untersucht, welche Rolle die Eingabe für ihr Verständnis von Verwaltung, Recht und Demokratie spielte. Dieser Frage wird in der Arbeit vor allem anhand der Geschichte der Eingabengesetzgebung und der in diesem Zusammenhang geführten Diskurse nachgegangen. Hierbei ist es besonders interessant herauszufinden, inwiefern die Eingabe als Mittel der Konfliktregulierung zwischen Regierung und Bürgern funktionierte und worin ihre Möglichkeiten und Grenzen bestanden. Aus der Perspektive der Bürger hingegen hatten Eingaben andere Funktionen. Sie wurden eingesetzt, um Alltagsprobleme zu lösen, um das Nichteinverstandensein mit Entscheidungen der Verwaltung oder der Regierung zu bekunden, um über Mißstände in der Gesellschaft zu informieren, um Behörden in Bewegung zu setzen, um Sonderzuteilungen zu ergattern oder einfach nur, um Streß abzubauen. Bei der sozialhistorischen Untersuchung der Eingaben liegt der Schwerpunkt einerseits bei ihrer rechtlichen Konstruktion und Wirkung, und zum anderen bei ihrer kulturellen Verankerung. So lassen sich anhand der Eingaben die Vorstellungen von Normen, Werten und Moralvorstellungen sowohl der Eingabenschreiber, als auch der Entscheidungsträger herausarbeiten. Zum anderen ist die Eingabe selbst nicht nur als ein Rechtsmittel, sondern vor allem als ein kulturell es Instrument zur Konfliktbewältigung interessant.

The following diploma thesis is called "The writ of execution and authorization of a licensed executor". I have chosen this theme because this execution and execution procedure is a dynamically developing part of the civil law and has been changed substantially in recent years. I deal mainly with the legislation in regards to the petition for an execution order, an execution order as well as a termination of authorization of an licensed executor to carry out the execution. The aim of the thesis is to acquaint the reader with current legislation, compare current legislation with previous legislation and identify ambiguities and issues encountered in practice. The thesis is divided into five chapters. The first one is a preface and the last a conclusion. The second chapter deals with the petition for an execution order, especially requirements, defects and their remedies. Further, I pay attention to execution title and its particular types. In the end I outline the possibility of the proposed limitations on the territorial scope of an licensed executor de lege ferenda. The third chapter deals with the execution procedure and authorization of a licensed executor. I describe how the court can decide on the petition for the execution order.
