Vydržení vlastnického práva / The prescription of the ownership rigt

This diploma thesis is devoted to the topic of acquiring the right of ownership by prescription (usucaption). The purpose of my thesis is to analyse one of the oldest institutes of the civil law and to clarify its significance in the Czech Law. The content of the thesis is divided into five chapters. A brief introduction is followed by the chapter one, where I have defined some basic concepts, which are related to usucaption and in the conclusion of this chapter I have also defined the term "usucaption" as such. The second chapter is a historical excursion describing the principal periods of the development of the usucaption institute from the Roman law through the Common Civil Code until nowadays. The main part of the thesis is chapter three, which is divided in four subchapters named after the particular presumptions of usucaption. In this headstone of the thesis I on the first place focus on the institute of lawful possession, within which I explain the issue of consideration of a good faith, an excusable mistake and admissibility of the lawful possession so-called "contra tabulas". The second subchapter explains, which subjects of the Civil law are qualified for usucaption and which are, or in the past were, diqualified from usucaption. Daugiausia dėmesio ir platesnės analizės reikalauja pati agentūrų decentralizavimo sąvoka bei pridėtinė vertė. Dėl didėjančios Europos agentūrų įtakos, naudinga platesnė jų veiklos organizavimo analizė. Tikslinga moksliškai ištirti šiandieninį agentūrų veiklos organizavimą: struktūrą, valdymą bei sugebėjimą derinti ES ir nacionalinius interesus. Tik išanalizavus tyrimų rezultatus, galima kalbėti apie Europos agentūrų veiklos administravimo tobulinimą. Šio darbo tikslas - išanalizuoti Europos agentūrų bendrus organizavimo bruožus, jų veiklos valdymo bei bendrų interesų derinimo pagrindines ypatybes. Pirmame skyriuje pristatomi Europos agentūrų teoriniai pagrindai. Pradžioje pateikiama „Agentūros teorijos“ samprata ir priežastys, lėmusios agentūrų kūrimąsi. Antrajame poskyryje apibrėžiamos „Užsakovo – vykdytojo“ modelio savybės ir galiausiai pateikiama mokslininkų kritika šios teorijos ir modelio atžvilgiu. Antrajame skyriuje pateikiama Europos agentūrų išorės ir vidaus struktūrų bei valdymo lyginamoji analizė, siekiant išanalizuoti agentūrų bendruosius organizavimo bruožus ir skirtumus. Analizuojant pateikiamos įvairios Europos agentūrų finansavimo ir biudžetų planavimo schemos. Trečiame skyriuje per kokybines dviejų tyrimų, siųstų Europos Sąjungos agentūrų valdybų vadovams bei agentūrų vadovams, analizes, apžvelgiamas agentūrų veiklos efektyvumas, Europos Sąjungos ir nacionalinių interesų derinimas ir organizaciniai ypatumai. / More attention and wider analysis should be done on the concept of agencies decentralization and added value. Due to the increasing European agencies influence, it is useful a broader analysis of the organization activity. It is appropriate to investigate the organization: the structure, management and the ability to combine the EU and national interests. Only after the analysis of the results, it is possible to talk about the agency operational improvements The aim of this work - to analyze the common characteristics of the European Union, their management and coordination of interests in basic features. The first section presents the theoretical foundations of the agencies. At the beginning the Agency theory is presented: the concept and the reasons given for the creation of agencies. The second subsection defines principal-agent model characteristic. Las armas en el Perú: una propuesta para el análisis sobre su regulación y control

El objetivo de la presente investigación corresponde a analizar la normativa peruana relacionada a la posesión de armas de fuego de uso civil desde la Constitución Política del Perú de 1979, ello a fin de determinar si el marco legal e institucional ha resultado eficaz respecto al control de la posesión de armas de fuego de uso civil por parte del Estado, debido a la presencia cada vez más notable del arma de fuego como instrumento del delito en el país. Įgyjamoji senatis kaip nuosavybės teisės įgijimo pagrindas / Acquisitive prescription as a basis for acquiring the ownership right

Įgyjamoji senatis yra vienas iš nuosavybės teisės įgijimo pagrindų. Šio instituto, reglamentuoto Lietuvos teisinėje sistemoje, ištakos siekia senovės Romą. Šiame darbe nagrinėjamas įgyjamosios senaties institutas, įvardijama teisinė jo taikymo problematika. Įgyjamosios senaties institutas atskleidžiamas analizuojant jo kilmę, raidą teisinėje sistemoje, ir įvardijant teisinį reikšmingumą. Nuosavybės teisė įgyjamosios senaties pagrindu yra įgyjama tik įvykdžius visas įstatymo numatytas sąlygas, todėl šiame darbe skiriamas didelis dėmesys šių sąlygų viseto analizei. Išsamiai analizuojama kokie daiktai gali būti įgyjami nuosavybėn, atsižvelgiant į įstatymo leidėjo numatytus draudimus. Remiantis Lietuvos Aukščiausiojo Teismo praktika pateikiama plati daikto valdymo, kurio pagrindu įgyjama nuosavybė, sąlygų turinio analizė ir įvardijamos problemos šių sąlygų taikymo atveju. Akcentuojant įgyjamosios senaties tinkamą taikymą yra analizuojamas atvejis, kada asmuo neturėdamas statybos teisėtumą patvirtinančių dokumentų, siekia įgyti nuosavybės teisę į statinį šio instituto pagrindu. Darbe taip pat nagrinėjamas įgyjamosios senaties ir kitų nuosavybės teisės įgijimo pagrindų atribojimo klausimas, analizuojant probleminius aspektus susijusius su įgyjamosios senaties taikymu, tuo pagrindžiant šio instituto svarbą. / Acquisitive prescription is one of the bases of property rights acquisition. The beginnings of this institute, regulated in the legal system of Lithuania, date back to ancient Rome. This work analyses of acquisitive prescription institute, names legal topic of its application. The institute of acquisitive prescription is revealed through the analysis of its origin, development in legal system and naming of its legal significance. Property right on the basis of acquisitive prescription is gained only after the implementation of all conditions, provided in law, therefore much attention is paid to the analysis of these conditions totality. The work presents thorough analysis of what objects may be acquired as property, regarding the prohibitions contained in legislation. Sustaining the practice of the Supreme Court of Lithuania, a wide analysis of conditions content of an object tenure, on the basis of which property is acquired, is given, and the problems in the case of application of these conditions are listed. Emphasizing proper application of acquisitive prescription, a circumstance is analyzed, when a person, without documents, validating construction legitimacy, seeks to acquire property right for a building on the basis of this institute. The work also analyzes dissociation issue of acquisitive prescription and other property right acquisition elements, analyzing problematic aspects related to the application of acquisitive prescription.

This research has focused the legislative treatment to the right to housing receives in the brazilian legal system, constitutional and infra-constitutional. The right to housing was established in article 6° of the Constitution of the Republic of 1988 as a social right and it is also integrates individual rights and guarantees. The housing is prominent institute in brazilian Magna Carta, in the Civil Code and in the statute of the city. This applies in the cases of adverse possession with tight deadlines, in the collective occupations and in the concession of special use. In all these legal predictions the purpose of housing is constitutive element of norm and confers differentiated possession discipline phenomenon and its legal consequences. The housing connects to the principle and foundation of human person dignity, so that in many situations the housing shortage hampers or prevents the achievement of that principle. The occupations that are focus in housing, confers to the social function of property special understanding, once that accentuates the need for exercise proprietary faculties inserted in the community / Esta dissertação tem como tema central a posse iniciada com a intenção principal de estabelecer moradia nas áreas urbanas. A pesquisa enfatiza o tratamento legislativo que o direito à moradia recebe no ordenamento jurídico brasileiro (constitucional e infraconstitucional). O direito à moradia está previsto no art.6° da Constituição Federal de 1988 como um direito social e integra também o rol de direitos e garantias individuais. A moradia é um instituto de destaque na Carta Magna brasileira, no Código Civil e no Estatuto da Cidade. Isto se verifica nas hipóteses de usucapião com prazos reduzidos, nas ocupações coletivas e na concessão de uso especial. Em todas estas previsões legais a finalidade de moradia é o elemento constitutivo da norma além de conferir disciplina diferenciada ao fenômeno possessório e suas consequências jurídicas. A moradia relaciona-se também ao princípio e ao fundamento da dignidade da pessoa humana, de maneira que em muitas situações a falta da moradia dificulta ou inviabiliza a consecução desse princípio.
