The work analyses the principle of publicity of judicial proceedings as established in both international and national legislation.The content of the principle of publicity is defined and its components are identified,i.e.the open hearing,the pasing and pronouncing of a sentence at the hearing,the publicity and accessibility of a case file,and the publication of the court decisions.The exceptions from the principle of publicity related to the criminal acts committed by minors,protection of private life of the participants in the proceedings,and witnesses or suffered parties to whom anonymity is applied, are examined in greater detail.

Šio darbo pagrindinis tikslas buvo išsiaiškinti ar žiniasklaidoje galima viešinti ikiteisminio tyrimo duomenis jei tai gali įtakoti nešališką, nepriklausomą baudžiamąjį procesą. Atsakant į iškeltus darbo tikslus nagrinėjama tiek Lietuvos, tiek užsienio praktika (JAV, Anglija ir kt.). Daug diskusijų dėl šių principų konfrontacijos kyla JAV. Šios valstybės teismai jau seniai pripažino galimą viešumo pavojų, kai prisiekusieji, įtakoti visuomenėje, per žiniasklaidą, formuojamos nuomonės, priima subjektyvius, šališkus, neteisingus sprendimus. / Aim of this work was to find out whether the media can serve to promote the pre-test data if media, public opinion can affect the fair, impartial and independent court. In order to verify the these assumptions, it is important to clarify the application of the principle of publicity characteristics and limits of the criminal process, the analysis of both the pre-trial stage and trial, to examine public awareness and the importance of boundaries. It is also necessary to assess whether public opinion on a fair and impartial court, is it possible to maintain a balance between these two principles. In response to the issue raised by the work targets both Lithuanian and foreign law (the U.S., UK, etc.) are analysed. Much of the debate on the principles of the U.S. confrontation arises. Courts of this country had recognized the potential public risk, when the jury, influenced by society through the media, which formed the opinion, makes subjective, biased, incorrect decisions.

Previous issue date: 2008-10-30 / The objective of this essay is to demonstrate the importance of the Principle of
Publicity towards the concretization of democracy in front of the power system. For
this, we delined a brief scenery of the brasilian military dictatorial period in order to
demonstrate the first fase of the process of democratization transition from the
dictatorial regime to democractic regime and that the second fase consolidation
is not concluded. We concepted the term principle to emphasize its importance in the
legal system and we delineated the Democratic Principle as structuring or politicalconstitutional,
therefore dependent on other principles or sub-principles for its
implementation. Considering the existence of the interrelationship and the
interdependency between the principles, we analyzed the Principles of Legality and
the Supremacy of Public Interest; we discoursed about the Principle of Publicity as
intrinsic to democracy and we passed to the fundamentals rights of truth and of
information as logic developments of that Principle. Then we developed an
explanations about the power system and its implications in actual society, like the
individualism that leads to the loss of public space, and the occultation of
informations that places us in a scenary where the democracy loses its strength. The
result of all analysis was the confirmation of the relevance of the Principle of Publicity
to make the people conscious of its role as citizen and that it is necessary to combine
the people conscience with its mobilization to consolidate the democracy / O objetivo do presente trabalho é demonstrar a importância do Princípio da
Publicidade para a concretização da democracia diante do sistema de poder.
Para isso, traçamos um breve panorama do período ditatorial militar brasileiro com o
fim de demonstrar a primeira fase do processo de democratização transição do
regime ditatorial para o regime democrático e que a segunda fase consolidação
permanece inconclusa. Conceituamos o termo princípio para ressaltar sua
relevância e delineamos o Princípio Democrático como estruturante ou políticoconstitucional
e, como tal, dependente de outros princípios ou sub-princípios para
sua efetivação. Considerando a existência da inter-relação e da interdependência
entre os princípios, analisamos os Princípios da Legalidade e da Supremacia do
Interesse Público; discorremos sobre o Princípio da Publicidade como intrínseco à
democracia e passamos aos direitos fundamentais à verdade e à informação como
desdobramentos lógicos de tal Princípio. Desenvolvemos então, uma explanação
sobre o sistema de poder e suas implicações na sociedade atual, tais como o
individualismo que leva a perda do espaço público, e a sonegação de informações
que nos coloca num cenário onde a democracia perde sua força. O resultado de
todas as análises foi a confirmação da relevância do Princípio da Publicidade para
que o povo se conscientize de seu papel de cidadão, e que é necessário combinar a
consciência do povo com a sua mobilização para que a democracia seja
consolidada

often held to be simulated contracts and as such they are enforced as
disguised pledges. One of the few alternative security options available to
money lenders, is a notarial bond registered in terms of the Security By
Means of Movable Property Act 57 of 1993. This act has been criticised
for creating an ineffective form of security that is costly and cumbersome
to put in place. It is suggested that the current security options available
to money lenders are supplemented with the creation of a more user
