There are situations, even in which the contractor is led to execute these non-contractual installments, regardless of the inclusion in the scope of the contract by means of a previous addition. In this study, we identified how the legal system deals with this issue in the face of the constitutional duty to maintain the economic-financial balance of administrative contracts. We deal with the aspects related to the general theory of private contracts and the specifics involved in the legal regime of administrative contracts for public works. We delimit the scope of subsidiarity from the application of the former in reaction to the latter. We evaluate the theory of unilateral acts, especially business management and unjust enrichment. In the end, we rehearse the application of the theory of unilateral acts to public works contracts as a basis to guarantee the fair remuneration of the services executed at the risk of the particular in the context of these contracts, without previous modification contractual / Ao longo da execução de um contrato de obra pública, é muito comum que o contratado se depare com imprecisões nos projetos franqueados pela Administração ou circunstâncias imprevisíveis que demandam a adaptação do escopo da contratação. Há situações, inclusive, em que o contratado é levado a executar parcelas extracontratuais, independentemente da sua inclusão no escopo do contrato por meio de aditamento anterior. Neste estudo, identificamos como o sistema jurídico trata dessa temática em face do dever constitucional de manutenção do equilíbrio econômico-financeiro dos contratos administrativos. Enfrentamos os aspectos atinentes à teoria geral dos contratos privados e as especificidades incidentes no regime jurídico dos contratos administrativos de obra pública. Delimitamos a abrangência da subsidiariedade da aplicação da primeira em relação aos segundos. Avaliamos a teoria dos atos unilaterais, especialmente de gestão de negócios e de enriquecimento sem causa. Ao final, ensaiamos a aplicação da teoria desses atos unilaterais aos contratos de obra pública como fundamento para garantir a justa remuneração dos serviços executados mesmo que por conta e risco do particular no bojo desses contratos, sem a prévia alteração contratual

Gestão de obras públicas: um diagnóstico sobre aditivos de contratos / Public works management: a diagnosis on additive of contract

O objetivo principal com esta pesquisa é analisar as ocorrências de aditivos de tempo e de serviço em contratos de obras públicas para construção e ampliação de equipamentos de saúde e educação. O tema da pesquisa é o contrato de obra pública que pode ser entendido como o documento no qual ficam estabelecidos o prazo e o orçamento para a construção ou ampliação dos equipamentos públicos estudados. O aditivo de contrato é o instrumento jurídico utilizado para que se possa alterar limites de tempo e de serviço, sem que haja a necessidade de rescisão de contrato e da elaboração de um novo processo licitatório. O método de pesquisa fundamentou-se na abordagem qualitativa com uso de dados quantitativos e qualitativos. A coleta dos dados quantitativos baseou-se em análise de documentos e dos dados qualitativos em questionário com questões abertas respondidas pelos engenheiros da prefeitura estudada, os quais foram responsáveis pela fiscalização das obras. O principal resultado encontrado foi a excessiva quantidade de aditivos de tempo enquanto que os de serviço estão controlados, mas devido às leis brasileiras, e não em razão de um planejamento eficiente. A pesquisa deixa como contribuição um roteiro para análise de aditivo em obras públicas que pode ser replicada tanto em outras prefeituras municipais como em outras esferas do governo. / The main objective of this research is to analyze the occurrences of additives and time of service in public works contracts for the construction and expansion of health facilities and education. The research topic is the contract for public work which can be understood as the document in which are set the deadline and the budget for the construction or expansion of public facilities studied. The additive of contract is the legal instrument that can be used to change time limits and service, without the need for termination of contract and the drafting of a new bidding process. The research method was based on a qualitative approach with the use of quantitative and qualitative data. Data collection was based on quantitative analysis of documents and data in qualitative questionnaire with open questions answered by engineers studied the city, which were responsible for supervising the works. The main result was found excessive amounts of additives of time while the service are controlled, but due to Brazilian law, and not due to efficient planning. The research makes contribution as a roadmap for analyzing additive in public works which can be replicated in other municipalities as much as in other spheres of government.

However several physical location construction buildings of this program were delayed or got its structural modifications from original project that does not accomplish the terms and conditions established by the public administration; some of this constructions building suffer work interruption, causing a frustration to the citizen that created expectation on this program. In this vein, the objective of this research was to identify the most efficient building techniques construction to the execution of this works in countryside of the Amazonas State, as well as, to identify the agents that cause their delays and interruptions by comparing with the building techniques accomplished in other countries. The best construction techniques were evaluated by the Performance Identification of Production (IDP) idealized by Gosch and Cardoso (2012), where the companies with the best grades have the best performance. By bibliographic methodology survey to the base and identification of the theoretical point being verified the study case technique as the ideal object research form. The questionnaire to the companies and the users of the schools construction buildings in the countryside of the Amazonas State was the tool of data gathering to answer the research problem. In this research, it is presented the way of performance identification of the companies for comparisons process, as well as, the presentation of the building techniques applied nowadays by the winner companies of the bidding process of IFAM in the countryside of the Amazonas State. By the result obtained from this research, were analyzed the inputs received from construction companies administration staff interviewed, as well as, were consolidated the best practices and techniques for the way to improve the construction of building on the countryside of Amazonas State. / No período entre os anos de 2008 a 2013, o governo federal optou pela estruturação da rede de ensino técnico no interior do estado do Amazonas designando para tal o Instituto Federal do Amazonas (IFAM) para implantar Campus de ensino médio e técnico em municípios do estado do Amazonas. Contudo, diversas obras públicas no interior do estado do Amazonas não cumprem seus prazos, sofrem adequações de serviços e projetos onde em alguns casos até mesmo paralisam a execução destas obras causando frustrações à população que faz uso destas construções. Neste contexto, o objetivo deste trabalho de pesquisa foi identificar as técnicas construtivas mais eficientes para a execução de obras de engenharia no interior do estado do Amazonas, bem como, os fatores que causam os atrasos e paralisações das mesmas, comparando-os com técnicas construtivas executadas em outros países. As melhores técnicas foram avaliadas através do Identificador de Desempenho da Produção (IDP) idealizado por Gosch e Cardoso (2012), onde as empresas com as melhores notas possuem o melhor desempenho. A partir do levantamento bibliográfico para fundamentação e identificação do marco teórico foi verificada a técnica de estudo de caso como a forma ideal de pesquisa do objeto. O questionário às empresas e aos usuários da edificação construídas no interior do estado do Amazonas foi a ferramenta utilizada para a coleta de dados que permitiu buscar uma resposta ao problema da pesquisa. Foi apresentada neste trabalho a forma de identificação de desempenho das empresas para posteriores comparações e a apresentação das técnicas construtivas utilizadas atualmente pelas construtoras vencedoras de certames licitatórios do IFAM no interior do estado do Amazonas. Como resultados obtidos, foram analisados os comentários feitos pelos administradores das empresas entrevistadas assim como elencado um apanhado das melhores técnicas para a condução de obras em municípios do interior do Amazonas.

Implementation and outcomes of the Expanded Public Works Programme (EPWP) in Mabopane

Issues such as poor education outcomes, high disease burden, uneven public service performance, corruption and others have been listed amongst issues the country is facing however; poverty and inequality have been identified as the two main challenges facing the country (The National planning commission, 2012). This research attempted to understand unemployment and how the EPWP addresses the unemployment issues at a local level. The EPWP intends to provide temporary employment and provide training to its beneficiaries through skills programmes, learnership and artisan development. The skills and training provided intend to enhance the beneficiaries’ chances of being employable on other projects after exiting the EPWP (EPWP, 2016) Between 1994 and 2014 white labour force has increased with 9 percent, Indian/Asian labour force increased with 45 percent, 5 percent increase of coloured work force and a 95 percent hike of black African labour force (Stats SA, 2014). According to the National planning commission (2012) South Africa has made a remarkable transition from apartheid into democracy. The high growth experienced by the black African ethnic group has been attributed to the number of interventions implemented by the government to eradicate inequality such as Affirmative Action Act (AA). From the stats provided, one is able to deduce that the government has been able to make progress in terms of decreasing inequality and therefore needs to develop employment creation strategies to address unemployment. The literature review conducted in this study indicates a link between unemployment, economic growth, apartheid and skills development. Apartheid has not been pursued as an attribute as strategies to overcome it have become pre-eminent. This research utilised the qualitative strategy and cross-sectional research design. Semi-structured interviews were conducted with interview schedule as a guiding tool for basic questions, the researcher asked further questions when required to do so. / XL2018

The above challenge necessitated the researcher to investigate the effective implementation of Performance Management System in the Department of Public Works, Roads and Transport in Ehlanzeni District Municipality. The study is concerned with the development of effective implementation of Performance Management System on employees and production in the Department of Public Works, Roads and Transport. This study used the context of the Department of Public Works, Roads and Transport as its spring board in engaging the subject of performance management system. With all changes that are involved towards the implementation of performance management system, there is a need to review the way performance management system should be implemented, hence this study. In this study, a mixed research design approach was used in the investigation of the effective implementation of performance management system in the Department of Public Works, Roads and Transport. Questionnaires and semi-structured interviews were employed to collect data from the target population. The main findings of the study, confirmed that there are challenges associated with the implementation of performance management system in the Department of Public Works, Roads and Transport. Apart from these challenges, the study also revealed the factors that contribute towards the implementation of performance management system in the area of the study. Furthermore, the study also led to the suggestions and recommendations that may assist Ehlanzeni District Municipality to accelerate effective implementation of performance management system in the department.

Tampa's Lafayette Street bridge: Building a New South city

The late nineteenth and early twentieth century was a time of dynamic social and political change for Tampa, a growing city on Florida's west coast. These changes led Tampa's commercial-civic elite to look beyond the law, the militia, and the church for ways to maintain their sense of order. This thesis illustrates non-violent enforcement of the status quo via public works, specifically bridge construction over the Hillsborough River. Over a period of three decades, three different bridges were built at the same place, at Lafayette Street. Each time the bridge was built or replaced, it was ostensibly for a different reason. However, each time the financing, construction, and form of the bridge was the result of Tampa's social, political, and economic systems. Development and maintenance of public works involves questions of private rights, property ownership, acquisition of capital, fiscal policy, and labor relations. Thus, in Tampa, the history of a bridge over the Hillsborough River becomes a stud of class and power within a growing southern city.
