An evaluation of the process of restructuring in the National Department of Public Works in the North West Province / Motlhagodi Golda Keeme-Gaobepe

The focal point on this research project is restructuring which is intended at producing an efficient public service capable of meeting developmental and socio economic challenges facing the National Department of Public Works in the North West Province. The problem facing the department is that the department's operational plans could not be met due to high vacancies within the management/supervisory levels. One other problem that related to restructuring was that there was no clear description of what the department's strategic vision and plans were. Qualitative method was identified as the most suitable method for this research. The data was collected by means of questionnaires given to both senior and junior managers. A sample of 71 respondents randomly selected from a population of 182 employees. Questionnaires and interviews were conducted in order to get the perception of how people think about restructuring. The aim was to collect information from both senior managers and lower levels. The findings from the collected data is that employees do not understand the business processes in order to gain confidence in what the Department wants to achieve. The expectation from employees was that Human Resource division will develop an HR plan which will accommodate employees with lower qualifications, current and past experience expertise in the relevant fields of work. This emphasizes the need for more engagement between management and staff. Some of recommendations are:- • Information technology infrastructure must fully support new processes thereby enabling the achievement of departmental objectives. • Restructuring must create a conducive environment which encourages or facilitates effective utilization of resources. • Policies to be clear and applied uniformly • The department must consider the constitutional obligation to transform the Public Service to ensure the delivery of quality service in accordance with the mandate of a better life for all. / (MBA) North-West University, Mafikeng Campus, 2005

Controversial aspects of Commonwealth Construction and Engineering Procurement Law

This research exposes to examination and understanding the law governing procurement of construction and engineering works and services. The thesis captures both development of common law and judicial determination of statutory law. It takes the form of published journal articles and conference papers which discuss legal issues relevant to construction procurement and conclude with recommendations for clients and construction project managers on how to better manage the procurement process. The work reveals, inter alia, the extent to which contract law regulates the tendering phase of construction procurement and places the client under an obligation to the tenderer characterised as 'fair dealing' or 'good faith'. Chapter 1 is of an introductory nature. Chapter 2 sets the crime of manslaughter arising out of construction site fatality as a procurement issue. The author notes the UK government's intention to introduce the new offences of reckless killing, killing by gross carelessness and corporate killing. Chapter 3 discusses cases where disaffected parties to the tendering process have made private law challenges of that process seeking compensation for the other party's alleged irregularities. The client is generally obliged in law to treat all tenderers equally and fairly and to refrain from evaluating tenders and awarding contracts other than in accordance with the rules set down in the tender conditions. Chapter 4 addresses the question: do traditional tendering processes encourage, or merely permit, contractor innovation? Several tender codes are reviewed to establish whether these codes provide for, or encourage, innovative proposals from competing bidders. Chapter 5 provides updating case material for the period 1999-2000 which helps to underpin the conclusions and recommendations set out in Chapter 12. Chapter 6 is a criticism of the NJCC's Code of Procedure for Single Stage Selective Tendering and the CIB's Code of Practice for the Selection of Main Contractors. Suggestions are made as to what a new tender code might include in the light of selected decisions of the common law courts. It is argued that a set of 'standard' tender rules should become the terms of a 'tender contract'. Those rules would properly reflect decisions of the courts and would be accepted by all parties to the process as a tender contract document. Chapter 7 discusses how the common law protects the integrity of construction procurement by imposed or assumed contractual obligations. Procurement of subcontract works is also considered. The author concludes that the tendering contract operates between main contractor and subcontractor as it does between owner/ developer and main contractor, and that the 'two contract' analysis provides the best basis for upholding integrity of the bidding process. Chapter 8 sets out advice for quantity surveyors and project managers derived from the decisions of the common law courts. The author argues that practice should be shaped to reflect the obligations assumed by parties in common law so as to avoid claims from aggrieved bidders. In Chapter 9 the focus shifts from private to public law. A Scottish court denied a remedy to the unsuccessful bidder on the grounds that the contract award process was unfair, unreasonable and in breach of natural justice. The author argues that a successful case might have been made out in private law and concludes with recommendations as to how the tender process might be better conducted. Chapter 10 deals with public procurement under the rules of the European Union (EU), noting a particularly important decision by the European Court of Justice that contracting authorities are obliged to treat all tenderers equally and fairly, a duty that parallels that found in common law and discussed in Chapters 2 through 8. Chapter 10 concludes with an article on Rv Portsmouth City Council (1996), reviewing both decisions at first instance and in the English Court of Appeal. Chapter 11 considers the risks of developers and contractors by examining the effectiveness of 'controls' imposed by common law when the usual statutory controls are temporarily withdrawn. It can be seen that the common law has not evolved to protect the interests of neighbours and local residents from the perils and hazards of property development which result in environmental degradation. This chapter concludes with recommendations as to how developer and constructors might minimise their impact on adjacent property owners. Chapter 12 presents a summary of the conclusions drawn from the completed research project and the author's recommendations for further research within the procurement topic.

The implementation of affirmative procurement policy : the post tender role of the public client

Thesis (MTech (Construction Management))--Cape Peninsula University of Technology, 2005 / The study investigates the effectiveness of the Public Works Affirmative Procurement Policy in the Republic of South Africa, and the research being conducted in the Western Province. It is the intention of the researcher to determine the role of the public sector, and to determine if government's efforts to implement the policy of procurement have been successful. The aim of the Affirmative Procurement Policy was primarily to promote Affirmable Business Enterprises (ABE's i.e. small medium and micro enterprises which is owned mainly by previously disadvantaged communities or PDI's). The need to transform the public sector procurement system as current policies and procedures clearly favour large and established enterprises. In 1996 the State Tender Board approved the decision that the Department of Public Works implement the policy of APP, in all its construction projects. International models of procurement were explored, so to compare that with the current South African situation. Surveys conducted throughout the research targeted mainly previously disadvantaged individuals, in order to establish the ambiguity of the system. The countries discriminatory past laws contributed largely to the backlog of service delivery and to widespread impoverishment. Due to lack of resources, finance and skills training growth in the emerging sector hinders progress as contractors encounter numerous problems facing the industry. The introduction of the lO-point plan approved by Cabinet as a measure to achieve this goal was not fully successful as some provinces only implemented it partially whilst others have systems in place that differ from the proposal detailed in the plan. The implementation of affrrrnative procurement, which would ensure participation of, targeted groups would consequently address the development of SMME's, increase the volume of work and generate income among the marginalized sector of society.

nÃo hà / Este estudo avalia possÃveis determinantes do resultado das licitaÃÃes para contrataÃÃo de obras pÃblicas no estado do CearÃ, outrora submetidas à disputa com a presunÃÃo de igualdade entre os interessados em contratar com a AdministraÃÃo. Modelos economÃtricos foram desenvolvidos para analisar se a quantidade de participantes, o valor e a modalidade de licitaÃÃo ou o tipo de secretaria de governo podem influenciar o valor final e o respectivo desconto de cada certame. A amostra foi extraÃda de instrumentos de transparÃncia considerando dados de 2013, perÃodo em que o Poder Executivo cearense licitou mais de 5,6 bilhÃes de reais em obras ou serviÃos de engenharia. Estimativas robustas permitem inferir que o desconto obtido por meio de um certame licitatÃrio à afetado diretamente pelo nÃmero de participantes e inversamente pelo valor do objeto licitado, independente da modalidade e do tipo de secretaria de governo. Em conjunto, estes resultados sugerem que o processo licitatÃrio praticado em cada secretaria do estado do Cearà à homogÃneo, independe da modalidade e a reduÃÃo do poder de barganha dos participantes à a estratÃgia a ser considerada pelos gestores pÃblicos do estado. / This study examines the determinants of the outcome of bids for procurement of public works in the State of CearÃ, once submitted to dispute with the presumption of equality among those interested in contracting with the Administration. Econometric models were developed to analyze if the amount of participants, the amount and bidding modality or type of department government can influence the final value and the corresponding discount on each event. The sample was extracted from transparency tools considering data from 2013, a period in which the Executive Power of State of Cearà bid more than R$ 5.6 billions in construction or engineering services. Robust estimates allow us to infer that the discount obtained through a bidding is directly affected by the number of participants and inversely by the value of the intended object, regardless of the modality and the kind of secretary of government. Together these results suggest that the bidding process practiced in every department of the State of Cearà is homogeneous, does not depend on the modality and the strategy to be considered by public managers in the State is reducing the bargaining power of the participants.

The data were selected from the pertinent laws, documents, interviews, and articles from newspapers. The analysis of the data followed the principles of the technique of the content analysis and had a preponderant descriptive approach. Gestão de obras públicas: um diagnóstico sobre aditivos de contratos / Public works management: a diagnosis on additive of contract

O objetivo principal com esta pesquisa é analisar as ocorrências de aditivos de tempo e de serviço em contratos de obras públicas para construção e ampliação de equipamentos de saúde e educação. O tema da pesquisa é o contrato de obra pública que pode ser entendido como o documento no qual ficam estabelecidos o prazo e o orçamento para a construção ou ampliação dos equipamentos públicos estudados. O aditivo de contrato é o instrumento jurídico utilizado para que se possa alterar limites de tempo e de serviço, sem que haja a necessidade de rescisão de contrato e da elaboração de um novo processo licitatório. O método de pesquisa fundamentou-se na abordagem qualitativa com uso de dados quantitativos e qualitativos. A coleta dos dados quantitativos baseou-se em análise de documentos e dos dados qualitativos em questionário com questões abertas respondidas pelos engenheiros da prefeitura estudada, os quais foram responsáveis pela fiscalização das obras. O principal resultado encontrado foi a excessiva quantidade de aditivos de tempo enquanto que os de serviço estão controlados, mas devido às leis brasileiras, e não em razão de um planejamento eficiente. A pesquisa deixa como contribuição um roteiro para análise de aditivo em obras públicas que pode ser replicada tanto em outras prefeituras municipais como em outras esferas do governo. / The main objective of this research is to analyze the occurrences of additives and time of service in public works contracts for the construction and expansion of health facilities and education. The research topic is the contract for public work which can be understood as the document in which are set the deadline and the budget for the construction or expansion of public facilities studied. The additive of contract is the legal instrument that can be used to change time limits and service, without the need for termination of contract and the drafting of a new bidding process. The research method was based on a qualitative approach with the use of quantitative and qualitative data. Data collection was based on quantitative analysis of documents and data in qualitative questionnaire with open questions answered by engineers studied the city, which were responsible for supervising the works. The main result was found excessive amounts of additives of time while the service are controlled, but due to Brazilian law, and not due to efficient planning. The research makes contribution as a roadmap for analyzing additive in public works which can be replicated in other municipalities as much as in other spheres of government.
