Nos mercados dominados por compras de governo, os investimentos em inovação dependem, em grande parte, de subvenções públicas cujo sucesso de aplicação está relacionado a um produtivo arranjo das instituições envolvidas. Neste trabalho são investigadas e analisadas as práticas e mecanismos relacionados à inovação em projetos de estado. A pesquisa foi realizada empregando-se o método de estudo de caso, tendo sido conduzidas uma etapa exploratória e uma etapa de pesquisa de campono setor espacial brasileiro. Foram analisadas instituições e empresas com participação no setor espacial, sendo as empresas ligadas ao desenvolvimento e à manufatura de subsistemas para satélites. Na esfera governamental, foram analisados documentos oficiais relacionados ao setor espacial, bem como ao sistema nacional de inovação. Os diferentes elementos mapeados são leis e regulamentos, subvenção econômica, programas e políticas, recursos financeiros, mão de obra, contratos e produtos desenvolvidos e propriedade intelectual. Esses elementos foram analisadosà luz das teorias institucional, de sistemas nacionais e setoriais de inovação, triângulo de Sabato, tripla hélice, inovação aberta e contratação pública e caracterizados como determinantes dinâmicos que contribuem para o aperfeiçoamento do processo de geração de inovação. Os resultados do presente trabalho compreendem: a caracterização do universo organizacional do setor espacial brasileiro e dos contratos entre instituições públicas e as empresas; análise da legislação pertinente à inovação e confronto com a prática empresarial, e a identificação dos elementos relevantes nos mecanismos de governança e inovação no setor espacial. Em especial, identificaram-se os fatores promotores e inibidores da inovação na estrutura de governança do programa de satélites brasileiros à luz dos pressupostos teóricos condicionantes da inovação. No campo teórico este trabalho busca compreender as formas de interação governo – indústria no contexto de fomento à inovação, através da estruturação de uma ferramenta analítica para a análise de projetos nacionais de inovação. Futuras aplicações desse ferramental analítico poderão ser feitas no estudo de outros setores produtivos, além dos de alta tecnologia, que sejam dependentes da interação com o Estado. / In markets dominated by government purchases, investment in innovation depends mainly on public subsidies whose success in application is related to a productive arrangement of the institutions involved.In this work we investigate and analyze practices and mechanisms related to innovation in state coordinated projects. The research was carried out using a case study method, having been conducted in two phases: exploratory and field studyin the Brazilian space sector. Institutions and companies participating in the space sector were analyzed. The studied companies develop and manufacture satellite subsystems. In the governmental sphere, official documents related to the space sector and to the national system of innovation were analyzed. The different elements mapped are laws and regulations, economic subsidy, programs and policies, financial resources, labor, contracts and developed products, and intellectual property. In the theoretical field, this work aims to understand forms of government – industry interaction in the context of fostering innovation, through structuring an analytical tool for analyzing national projects for innovation. Future applications of this analytical framework may be in studying other productive sectors, besides high technology areas, which may be dependent of interaction with the State.

Previous issue date: 2017-09-28 / A presente dissertação foi desenvolvida no âmbito do Mestrado Profissional em Gestão e Avaliação da Educação (PPGP) do Centro de Políticas Públicas e Avaliação da Educação da Universidade Federal de Juiz de Fora (CAEd/UFJF). O caso de gestão estudado discute o trâmite processual para a formalização de contratos destinados à aquisição de materiais e serviços necessários para o desenvolvimento das atividades da UFJF, em especial, o ensino, a pesquisa e a extensão. Com efeito, os contratos são os instrumentos que regulamentam, em regra, a compra de materiais e a prestação de serviços na esfera da Administração Pública. O objetivo definido para esse estudo foi analisar os maiores desafios para o regular fluxo dos processos de trabalho desenvolvidos na UFJF, com o objetivo de celebrar contratos, visando municiar a instituição com instrumentos que permitam o aperfeiçoamento do trâmite processual. Assumimos como hipóteses para a ocorrência de incidentes que impedem o regular fluxo dos processos, a ausência de definição e normatização das atribuições do setor de Contratos, bem como a inexistência de uma padronização dos processos de trabalho e documentos produzidos na instituição. Com base em uma abordagem qualitativa, desenvolvemos o presente estudo de caso, concentrando esforços para conhecer a organização dos processos, na busca por desvendar os incidentes ocorridos durante sua tramitação. A partir da combinação de instrumentos de pesquisa consistentes em análise documental e entrevistas, constatamos a necessidade de organizar as equipes de trabalho através da definição de suas atribuições, dimensionamento e capacitação de pessoal, além da padronização das rotinas de trabalho. Assim, com suporte nos dados apurados por meio dos instrumentos que nortearam a pesquisa, apresentamos um Plano de Ação Educacional que envolve estratégias direcionadas à reformulação e otimização das rotinas de trabalho visando conferir suporte para o aperfeiçoamento dos processos de formalização de contratos. / This dissertation is developed within the Professional Master in Management and Evaluation of Public Education (PPGP) from the Center for Public Policies and Evaluation of Education of the Federal University of Juiz de Fora (CAEd/UFJF). The management case studied discusses the procedural process for the formalization of contracts for the acquisition of materials and services necessary for the development at UFJF activities, especially, the teaching, research and extension. In effect, contracts are the instruments that regulate, as a rule, the purchase of materials and the provision of services in the sphere of Public Administration. The objective of this study was to analyze the major challenges for the regular flow of the work processes developed at UFJF. In order to conclude contracts, aiming to provide the institution with instruments that allow the improvement of the procedural process. We assume as hypotheses for the occurrence of incidents that prevent the regular flow of processes, the absence of definition and standardization of the attributions of the contracts sector, as well as, the lack of a standardization of the work processes and documents produced in the institution. Based on a qualitative approach, we developed the present case study, concentrating efforts to know the organization of the processes, in the search to uncover the incidents that occurred during its process. Then, the combination of research tools consisting of document analysis and interviews, we verified the need to organize the work teams through the definition of their assignments, sizing and qualification of personnel, therefore, the standardization of work routines. Accordingly, with support in the data obtained through the instruments that guided the research, we present an Educational Action Plan that involves strategies directed to the reformulation and optimization of work routines in order to provide support for the improvement of the contract formalization processes.

The implications of late payments by government on emerging construction contractorsMayeko, Bathandwa R January 2014 (has links)
The public sector is the biggest consumer of construction works in South Africa. Public sector is known for late payments to its service providers. This led to the study’s problem statement that stipulates that, the construction industry; particularly emerging contractors generally experience late payments from clients and employers. This is due to the fact that emerging contractors are vulnerable to failing as these contractors have limited financial resources and experience. The primary objective of the study was to develop a better understanding of the implications of late payments by the government on emerging construction contractors. The study therefore investigated the experiences of emerging construction contractors in the Eastern Cape. The secondary objectives of the study were: to identify the reasons for late payments by the public sector; determine the payment norms applicable to, and expectations of emerging construction contractors; establish construction contractors’ experiences with government payment methods; and to examine the implications of late payment on emerging contractors and their businesses. The study was conducted within a qualitative research paradigm. The participants were identified through non-probability snowball sampling. The sample consisted of five emerging construction contractors mainly from the Civil Engineering and General Building sectors in the Eastern Cape. The data was collected using semi-structured interviewing and was analysed using Tesch’s qualitative analysis explained by Hesse-Biber & Leavy (2011:201). The key results of the empirical study show that late payments have incapacitating effects on the development of emerging contractors. The conclusion reached from the empirical study includes recommendation that construction industry stakeholders form payment legislation aimed at curbing the delay of payments.

The second part deals with internal legislation regulating procurement at the Ministry of Labour and Social affairs and the procurement system analysis of over-threshold (below-threshold) procurement and small-scale public contracts. The last part analyzes the data of public contracts between 2011-2015. The right system adjustment of procurement at the Ministry of Labour and Social affairs is questioned.

Odhad pasívneho a aktivneho plytvania pri zadávaní verejných zakaziek na Slovensku / Estimation of the passive and active waste in public procurement in the Slovak RepublicBachan, Milan January 2010 (has links)
The main object of this thesis is to estimate the waste in public procurement in Slovakia and estimate its active and passive components. The first part offers a theoretical explanation of legislation related to public procurement, as well as a theoretical explanation of active and passive waste. In the next section there is a brief description of similar study, which estimated the waste of public procurement in Italy. In the second part, which is empirical, there is a analysis of the results of public contracts related to construction work. Data were obtained from the electronic database of Public Procurement Office in Slovakia. From these data I created a regression model obtained by the method of least squares. The aim was to determine the truth of the hypothesis that if the contracts awarded through the procurement of external agencies, the procurement process becomes more efficient. The analysis did not confirm the truth of this hypothesis and thus I could not estimate the amount of passive and active waste. The results obtained from regression analysis were then used to estimate the amount of waste in the case of public procurement related to construction of residential buildings, reconstruction of schools and the revitalization of public spaces, when the public purchaser was the city or village. This analysis also estimates the percentage of the waste of public procurement, when process of public procurement was supervised by external procurement agencies.

Si l’on perçoit intuitivement la durée, il est plus délicat d’en donner une définition. L’exercice devient plus périlleux encore lorsqu’il s’agit de définir la durée des contrats administratifs. Face aux interrogations que sa définition et sa délimitation soulèvent, l’étude de la réglementation, de la jurisprudence ou de la doctrine publiciste n’est que peu instructive. La diversité du vocabulaire employé traduit les imprécisions de la notion étudiée. Parce qu’elle représente une donnée essentielle du contrat, à la fois objet et source de nombreuses réglementations, la notion de durée des contrats administratifs doit être définie. Son étude révèle une appréhension parcellaire de la notion par le droit public. Celui-ci n’envisage que la durée d’existence du contrat, qui est une durée juridique et prévisionnelle. Elle traduit le prisme sous lequel le droit public s’intéresse à la durée du contrat : c’est un outil d’encadrement de la rémunération du titulaire et d’organisation de la remise en concurrence régulière du contrat. À côté de cette durée d’existence, coexiste une durée d’exécution qui a pour caractéristique d’être une durée opérationnelle constituée d’un agrégat de délais. Si ces deux durées coïncident parfois parfaitement – ce qui explique leur confusion – cela n’est pas systématique. Elles possèdent, en outre, des fonctions distinctes qui justifient leur différenciation. Parce qu’elles représentent cependant les deux facettes d’une même notion, l’unité du régime de la durée prédomine. En ce domaine, c’est un mouvement d’influences réciproques mais d’inégale importance qui s’opère. Le contrat conditionne la durée : il régit sa fixation et son évolution. Dans le même temps, la durée influe sur le contrat. Celle-ci est en effet la source d’application d’éléments de régime au contrat et justifie l’intégration de certaines clauses au sein des contrats où son volume est important. / We can easily perceive the notion of duration. However, it is rather difficult to give it an exact definition. It becomes even more delicate when it comes to identify the duration of public contracts. Neither of the legal doctrine nor the legislation or case law are helpful in solving questions about both the definition and limit of a contract’s duration. The diversity of the legal vocabulary reveals the inaccuracy of this notion. However, the duration of public contracts has to be precisely identified as it is a crucial datum of any contract, as well as a source and the object of various existing rules. As far as the study of public contracts has lead us, we can only notice that the apprehension of their duration is fragmented. Public contract law exclusively develops one aspect of the duration, which represents the amount of time during which the contract stands. This shows how the notion of duration is analyzed: itis a sort of tool used in order to frame the contract holder’s wage, but also indicates when to use properly competitive procedures. It is correct to state that the duration identifies the period during which the contract stands, however, it covers another aspect, which we aim to expose here. The duration of contract also represents the amount of time during which the contract is fulfilled, or executed, which is composed by a sum of delays. These two aspects of duration may often coincide but this is not always the case. It must be noted that these two sides have different functions, which justifies why we study them separately. Nevertheless, the legal regime remains the same whether we talk about one aspect or another. At the end of this study, we can report mutual influences. The object of the contract conditions its very own duration as its clauses set its evolution through the execution. At the same time, the duration of the public contract conditions various elements of its regime, especially when the contract stands fora substantial period of time.

Beginning with reclamation projects in the western U.S., the heavy construction industry helped the federal government grow in size and sophistication in the twentieth century. The Morrison-Knudsen Corporation throughout the twentieth century represented one of the federal government's favored contractors. Following western reclamation projects, the U.S. federal government then used contractors to help move the U.S. economy out of the Depression, prepare for World War II, wage the Cold War at home and abroad, and win the space race. Thus, at key stages in United States history we observe the necessity of the U.S. federal government partnering with the heavy construction industry to achieve its policy objectives at home and abroad. Morrison-Knudsen was once the largest heavy contractor in the United States, participating in the construction of Hoover Dam, Pacific Naval Air Bases, Hanford Engineering Works, the U.S. Intercontinental Ballistic Missile System, and the Vehicle Assembly Building at the Kennedy Space Center.

Assessing good governance in procurement at the Lejweleputswa District MunicipalityStemele, Bulumko Mollman 03 1900 (has links)
Thesis (MPA (School of Public Management and Planning))--University of Stellenbosch, 2009. / The thesis evaluates the extent to which good governance has influenced the
procurement process at the Lejweleputswa District Municipality. Under good
governance, the manner in which goods are procured or disposed of, is supposed to be
unproblematic and conducted with the highest integrity, taking into account both the
costs involved in the process and the benefits of the delivery of the services. Good
governance should act as a “decontaminator or antiseptic in a germ infested area”
(Cloete 2006:6–19). To extend the analogy further, this process of disinfecting the
wound definitely requires some form of expertise and knowledge, as well as the
participation of different role players, such as doctors and nurses; in addition, certain
utensils to clean and cover the wound would be needed.
In the same way, the procurement process needs experts to handle and enforce correct
procedure. The values of good governance alone are meaningless unless there are
people who are willing and have the capacity to manage the required processes and
procedures. In South Africa, a new procurement process was adopted in the public
sector in 1994. To date it has been interpreted and implemented in favour of
historically disadvantaged individuals, like black people, women and disabled people
through a legislative framework, the Preferential Procurement Policy Framework Act,
2000 (RSA, Act 5 of 2000) and the Broad Based Black Economic Empowerment Act,
2003 (RSA, Act 53 of 2003).
It is crucial to point out, however, that the definitions given by these laws about black
people differ or contradict each other. Challenges like this have turned the procurement
process upside down. In an effort to attain uniformity in the procurement process in the
local sphere of government, both National and Provincial Treasury Departments have
instituted legislation and guidelines to steer the process. Despite all these efforts,
municipalities are still associated with allegations of corruption and nepotism when
awarding tenders to service providers.
The Lejweleputswa District Municipality has not been spared from such accusations,
as shown by the spate of riots that occurred in the Free State (Mail and Guardian
2007:6–12). This research has therefore been undertaken with the general objective of
determining whether the values of good governance have managed to sustain a good
procurement process in the municipality or whether the values are being ignored leading to procurement processes which do not fulfil the aims of the legislation and
guidelines and remain open to allegations of corruption and maladministration. The
specific objectives for the research were to investigate good governance in
procurement in the municipality context and to make recommendations, if appropriate,
on how to promote good governance in municipal procurement.
