O princípio da eficiência como fator transformador

O presente estudo tem por objeto o princípio da eficiência, concebendo-o como critério para a atuação administrativa voltada ao atingimento dos Objetivos Fundamentais da República brasileira. Tendo-se por meta a operacionalidade do princípio, são apresentados os conceitos de eficiência colhidos nas doutrinas econômica e jurídica. Além disso, são deduzidos os fundamentos da eficiência. Como questões atinentes à aplicabilidade do dever de eficiência são tratadas a participação popular, a atuação administrativa impessoal, a improbidade administrativa e a eficácia do princípio em comento. A eficiência também é abordada como fruto da ação discricionária e como limite dessa ação. Partindo-se do pressuposto de que a eficiência pode colaborar para a melhora da ciência jurídica e da Administração Pública brasileiras, discorre-se sobre os passos para se realizar uma atuação administrativa eficiente com esteio no texto constitucional, no Direito e na ciência da Administração, perpassando-se por alguns métodos empregados nos setores público e privado e se chegando a um caso concernente a um serviço público de cobrança judicial. / The present study introduces the efficiency approach as an element in to the management scenario, attainable by the Fundamental Objectives of the Brazilian Republic. The main operational aims of the efficiency approach are here presented in addition to the efficiency concepts, obtained on both economic and juridical doctrines. Also, the fundaments of efficiency are presented. As attained matters of the applicability of efficiency duty, popular participation, impersonal management activities, administrative improbability and effectiveness of the efficiency approach are analyzed. Efficiency is also part of discretionary activities and as limit of this action. Using as background the fact that efficiency can put to better use judicial science and the Brazilian Public Management, the present study discourses about the steps that leads to an effective management activity based on the Constitutional Transcripts. The study comprehends some of the methods employed in public and private sectors, achieving a concerning case to a public service of judicial encashment.

This reality has led to intense clashes that resulted in numerous treaties and agreements, and other normalizing both measures that constitute the institutional framework environment. There is thus, the global effort to preserve the environment and promote sustainable development. The impacts of global climate change are not threats to the future, this is already acutely compromised, because every day we are faced with the consequences of damaging acts and facts resulting from our actions. They imply a change of attitude on the part of individuals and organization, in both the public sector, and private. Using the method of action research, it is proposed this study, which consisted in implementing a program and integration of environmental criteria in public administration (A3P) and resulted in the reshaping of the patterns of comsumption and production of local public officials

Gerenciamento de projetos apoiando a gestão pública: uma análise para o Governo do Estado de Minas Gerais / Project management support to public management: an analysis of the implementation process

O objetivo principal do presente trabalho é analisar a aplicabilidade do gerenciamento de projetos na gestão pública e verificar a evolução de indicadores finalísticos de resultado da implantação de um método de gestão. O escopo do estudo é baseado na análise da gestão das políticas públicas, em âmbito estadual, em Minas Gerais, e a metodologia é fundamentada no gerenciamento de projetos, norteada pelo seu guia de procedimentos, contemplada no PMBoK. Este trabalho teve um tratamento qualiquantitativo apresentando resultados a partir da análise de indicadores finalísticos de áreas de resultados, em que é possível afirmar a incidência de mudança de comportamento na evolução desses indicadores na comparação dos períodos pré e pós-gestão de projetos e, também, apresentando resultados a partir da análise de questionário aplicado junto à SEPLAG. Das 13 (treze) áreas de resultados analisadas, em 7 (sete) delas os indicadores apresentaram melhoria no período pós a aplicação de gestão de projetos no seu comportamento em comparação ao período anterior. O comparativo dos indicadores macroeconômicos de MG com os demais estados da federação no período analisado demonstrou alterações positivas em relação à variação em percentual do resultado entre os anos de 2008 e 2003 em todos os indicadores analisados, indicativo favorável à utilização do gerenciamento de projetos na gestão pública de MG. É importante salientar a impossibilidade de isolar variáveis envolvidas neste conjunto de resultados, o que implica na necessidade de parcimônia nas conclusões sobre a evolução dos indicadores estudados e sua correlação com o gerenciamento de projetos. / The main objective of this study is to analyze the applicability of project management in public administration and to evaluate the evolution of finalistic result indicators in implementation of management method. The scope of the study is based on the analysis of public policy management in state, Minas Gerais, and the methodology is based on project management, guided by your guide procedures contemplated in the PMBOK. This work was handled by presenting qualitative and quantitative results from the analysis of finalistic result areas indicators. It is possible to state the incidence of behavioral change in the evolution about these indicators when comparing pre-and post-project management and also presented results from the analysis of the questionnaire addressed to SEPLAG. Of the 13 (thirteen) result areas analyzed in 7 (seven) of these indicators showed improvement in the period after the application of project management in their behavior compared to the previous period. The comparison of macroeconomic indicators of MG with other states on the period analyzed showed positive changes in relation of variation in percentage of income between the years 2008 and 2003 in all the indicators analyzed, indicating favorable to use project management in managing MG public. However, it is important to point out the impossibility of isolating variables involved in this set results, which implies the need for parsimony in conclusions on evolution of the indicators and their correlation with project management.

New Public Management inom myndigheters direktservice och hur det påverkar legitimiteten av det politiska systemet

New public Management-reformer har blivit allt vanligare inom svensk förvaltning. Detta har inneburit att den offentliga sektorn i allt större grad fokuserat på att uppnå kostnadseffektiviseringar och marknadslösningar. E-förvaltning har också blivit ett sätt att effektivisera den offentliga sektorn, genom användandet av digitala tjänster. Servicekontor ses i denna studie som ett uttryck för NPM-reformer och ökat inslag av e-förvaltning. Det är ett koncept som startade 2008 och innebär att Försäkringskassan, Skatteverket och Pensionsmyndigheten slagit ihop sin direktservice nationellt och därmed skapat en ny tjänstemannaroll i form av servicehandläggare. I och med flyktingvågen har en stor del av de som besöker kontoren varit nyanlända till Sverige. I denna studie görs en kritisk analys av vad servicekontorsmodellen inneburit för servicen till medborgarna och till nyanlända specifikt. Dessutom studeras utifrån Lipskys syn på gräsrotsbyråkraterna vikt vid utformandet av policys, hur tjänstemännens möjlighet att legitimiteten det politiska systemet har påverkats, samt vilka konsekvenser det har inneburit. För att studera detta har en kvalitativ metod i form av semistrukturerade intervjuer gjorts med tjänstemän på servicekontoren. Slutsatsen är att servicekontorsmodellen inneburit en ökad distans mellan myndighet och medborgare vilket försvårat tjänstemännens möjlighet att legitimera det politiska systemet. Detta drabbar inte minst nyanlända som inte får fullständig information om beslut eller ärenden vilket i förlängningen kan leda till minskat förtroende för myndigheterna i synnerhet, men också det politiska systemet i allmänhet.

The aim of this study is to identify and visualize what multilingual children in Swedish preschools are offered in terms of education in their first language/mother tongue. The analysis focuses on control documents, such as the education act and the curriculum for the preschool, and how they could be interpreted. If there are differences and equality problems as a result of the system of school governance, the visualization can lead to politicians and decision-makers making more informed decisions that take into account the consequences of the wording of the documents for the benefit of (multilingual) children - if the goal is equity. In the long run, the study may lead to new knowledge about the importance of word choice in control documents. The study's theoretical framework consists of a sociolinguistic perspective on the importance of language and mother tongue for the individual in society as well as on texts in governing documents. The method is text analysis of the education act and other control documents as well as reports published by Swedish school authorities/agencies, supplemented by official statistics regarding what is actually offered.

Repositioning BC ferries : from Crown corporation to administrative hybrid

In this paper. I analyze how political, economic, and administrative issues were major factors in the BC Liberal government's creation of a complex hybrid operating structure for BC Ferries. The model evolved as the result of a number of circumstances, including the former NDP government's "fast ferry" debacle and the Liberal government's decision to conduct a Core Services Review of all government services, including those provided by Crown corporations. BC Ferries' new structure has similarities to other administrative models that have been introduced as a result of New Public Management initiatives and other factors in a number of Westminster jurisdictions. Does Management Capacity Increase Organizational Performance? An Empirical Analysis of Public Housing Agencies

Since the 1990s, scholars have paid special attention to public management’s role in theory and research under the assumption that effective management is one of the primary means for achieving superior performance. To some extent, this was influenced by popular business writings of the 1980s as well as the reinventing literature of the 1990s. A number of case studies but limited quantitative research papers have been published showing that management matters in the performance of public organizations. My study examined whether or not management capacity increased organizational performance using quantitative techniques. The specific research problem analyzed was whether significant differences existed between high and average performing public housing agencies on select criteria identified in the Government Performance Project (GPP) management capacity model, and whether this model could predict outcome performance measures in a statistically significant manner, while controlling for exogenous influences. My model included two of four GPP management subsystems (human resources and information technology), integration and alignment of subsystems, and an overall managing for results framework. It also included environmental and client control variables that were hypothesized to affect performance independent of management action. Descriptive results of survey responses showed high performing agencies with better scores on most high performance dimensions of individual criteria, suggesting support for the model; however, quantitative analysis found limited statistically significant differences between high and average performers and limited predictive power of the model. My analysis led to the following major conclusions: past performance was the strongest predictor of present performance; high unionization hurt performance; and budget related criterion mattered more for high performance than other model factors. As to the specific research question, management capacity may be necessary but it is not sufficient to increase performance. The research suggested managers may benefit by implementing best practices identified through the GPP model. The usefulness of the model could be improved by adding direct service delivery to the model, which may also improve its predictive power. Finally, there are abundant tested concepts and tools designed to improve system performance that are available for practitioners designed to improve management subsystem support of direct service delivery.

Le contrat de partenariat public privé, est défini par l’ordonnance susvisée comme « un contrat administratif par lequel l'Etat ou un établissement public de l'Etat confie à un tiers, pour une période déterminée en fonction de la durée d'amortissement des investissements ou des modalités de financement retenues, une mission globale ayant pour objet la construction ou la transformation, l'entretien, la maintenance, l'exploitation ou la gestion d'ouvrages, d'équipements ou de biens immatériels nécessaires au service public, ainsi que tout ou partie de leur financement à l'exception de toute participation au capital.Il peut également avoir pour objet tout ou partie de la conception de ces ouvrages, équipements ou biens immatériels ainsi que des prestations de services concourant à l'exercice, par la personne publique, de la mission de service public dont elle est chargée ». La notion de partenariat public privé, est tout à fait adaptée et d'ailleurs utilisée pour le développement des équipements sportifs. Aujourd’hui les nouveaux équipements, au niveau de l’investissement et du fonctionnement, tendent à faire intervenir les financements privés. Cette tendance est, notamment remarquée pour les grands projets d’équipements structurants comme les grands stades, soit pour la France soit pour les pays du Golf Arabe. Dès lors, le contrat de partenariat public-privé, est une solution pour restaurer le parc d’installations et d’équipements sportifs.Pour la France, l’attribution de l’euro 2016à la France, a été l’occasion d’accomplir des projets de construction et/ou rénovation, à travers la forme de contrat de partenariat, des stades de Lille, Marseille, Nice et Bordeaux.Concernant la législation des pays du golf arabe, le contrat de partenariat public-privé, « est un contrat conclu entre la direction gouvernementale et la société du projet, dont ladite société s’engage d’exécuter le projet selon les disposition de cette loi, et les clauses prévues au contrat, dans une durée fixée et en contrepartie d’une rémunération ».Le droit saoudien, a précisé que le contrat de partenariat entre le secteur public et le secteur privé, porte sur la relation contractuelle, entre le secteur public et le secteur privé, cette relation est soumise à cette loi et au contrat de partenariat, et dont l’objectif est l’exécution partielle ou totale du projet pour garantir la réussite des projets PPP. Une telle réussite reste conditionnée par le cadre législatif dans lequel ce projet est mis en place et ses conditions de financement.Dans cette perspective, les pays du CCG ont mis en place des cadres législatifs pour contrôler la gestion et le financement desdits projets surtout après la chute des prix du pétrole et par la suite des ressources financières de ces gouvernements. Le cadre législatif régissant la pluralité des projets PPP dans ces pays sont régis par une cadre juridique largement inspirée du cadre français. / The public-private partnership contract is defined as an administrative contract by which the State or a public institution of the State entrusts to a third party, for a period determined according to the depreciation period of the investments or financing modalities retained, a global mission for the construction or transformation, maintenance, maintenance, operation or management of works, equipment or immaterial goods necessary for the public service, as well as all or part of their financing except for any shareholding.
