The gap between those international recommendations and the Brazilian penal execution, especially in Rio Grande do Sul, arouses certain repercussions on the present situation of Pres?dio Central de Porto Alegre, a prison that has motivated the representation against Brazil at OAS due to human rights violations. The text unfolds certain myths on Pres?dio Central de Porto Alegre, and the author reaches for an outside non institutional/institutionalized perspective coming from its visitors on the daily life in that institution. / Esta disserta??o tem por objeto o Pres?dio Central de Porto Alegre a partir do olhar de fora, dos visitantes que l? permanecem em fila para poderem visitar seus amigos e familiares. O ponto de partida ? um hist?rico da escolha da pris?o como meio de puni??o para situa??es problem?ticas e as diferentes formula??es propostas de sistema prisional, culminando com as recomenda??es internacionais quanto ao tratamento dispensado aos presos a partir do respeito aos direitos humanos. Emerge, ent?o, o descompasso entre as recomenda??es internacionais e a execu??o penal no Brasil e, em especial, no Rio Grande do Sul, repercutindo na situa??o atual do Pres?dio Central de Porto Alegre, casa prisional que suscitou a representa??o do Brasil ? OEA por viola??o de direitos humanos. To restrict the object of research, the study is focused on the socio-educative confinement measure in cases involving the commitment of an offense analogous to the crime of theft, through the analysis of the main pleas and arguments present in judgments of the Superior Court of Justice. Highlighting the fact that adolescence is not just a life phase in which there is an acceleration of physical and mental maturation, we based on comprehensive theoretical references in order to facilitate the involvement of a multitude elements that involve transit through physiological changes, cognitive and intellectual, personality and identity, socio-cultural, political-economic, moral, axiological, among others. Given the need for a broader criminological also matrix that behaved different looks on the interfaces between adolescence, transgression and control, found himself in cultural criminology some propositions that we could verify that the bases of these phenomena may reside elements in common. It is to offer a distinctive criminological approach, since it goes beyond the purely structural analysis, to capture widespread tensions arising from processes of economic and cultural globalization. Moreover, amid other theoretical frameworks, it was necessary to resort to some concepts formulated by Pierre Bourdieu, from which it was possible to understand the dynamics of functioning of the legal field and its mechanisms of social reproduction. At the end, we tried to understand how it is possible to make use of the equation Judiciary "pedagogical needs reiteration infraction" to apply the socio measure of internment in response to illegal acts committed without the use of violence or serious threat to person. / Este trabalho se prop?s a realizar uma an?lise criminol?gica sobre os sentidos atribu?dos ? socioeduca??o pelo Judici?rio brasileiro na contemporaneidade. A fim de restringir o objeto da pesquisa, enfocou-se o estudo na medida socioeducativa de interna??o aplicada a casos envolvendo a pr?tica de ato infracional de furto, por meio da an?lise dos principais fundamentos e argumentos presentes em ac?rd?os proferidos pelo Superior Tribunal de Justi?a. Destacando que a adolesc?ncia n?o se resume a uma etapa da vida humana em que h? um aceleramento do amadurecimento f?sico e ps?quico, buscou-se refer?ncias te?ricas de cunho abrangente, a fim de possibilitar o envolvimento de uma multiplicidade de elementos que transitassem pelas mudan?as fisiol?gicas, cognitivas e intelectuais, de personalidade e identidade, socioculturais, pol?tico-econ?micas, morais, axiol?gicas, entre outras. Diante da necessidade de uma matriz criminol?gica tamb?m mais abrangente, que comportasse olhares distintos sobre as interfaces entre adolesc?ncia, transgress?o e controle, encontrou-se na criminologia cultural algumas proposi??es que possibilitaram perceber que nas bases desses fen?menos podem residir elementos em comum. Trata-se de uma proposta de abordagem criminol?gica diferenciada, pois vai al?m das an?lises exclusivamente estruturais, para capturar tens?es generalizadas oriundas dos processos de globaliza??o econ?mica e cultural. Al?m disso, e em meio a outras matrizes te?ricas, foi necess?rio recorrer a alguns conceitos formulados por Pierre Bourdieu, a partir dos quais foi poss?vel compreender a din?mica de funcionamento do campo jur?dico e seus mecanismos de reprodu??o social. It is considered an evolutionary puzzle, because the theory of evolution by natural selection predicts that self-interested individuals tend to be selected. Different theories have been proposed to explain the evolution of cooperation, which the most important are kin selection and reciprocal altruism. Considering the evolutionary continuity between species, humans and other primates have several common traits that help to promote cooperation between individuals of these species. Two features, however, seem to be particularly humans: inequality aversion and preferences in relation to others. Although human cooperation is not necessarily related to morality, cooperative traits are the basis for moral tendencies. The development of human morality is a combination of early prosocial tendencies, cooperative skills displayed at different ages, social learning and cultural transmission of norms. The social stimulus seems to be particularly important in promoting cooperative behavior in children and adults. In order to study the influence of social stimuli, as verbal feedback, on children cooperation, a study was conducted with children in a public goods game. 407 children from public schools in Natal / RN, divided into 21 groups, between six and nine years, participated in eight rounds of this game. After each round, seven groups received praise for larger donations, seven groups have been criticized by smaller donations, and the other seven received no comment. Children cooperated more when criticized, without significant differences between sexes, although young children have cooperated more negative than older children. The results are likely related to the anticipation and avoidance of punishment associated with the feedback (although this did not occur), and greater sensitivity to the authority in younger children. Nevertheless, the cooperation decreased in all groups until the last day of play. The results suggest an early sensitivity to moral punishment, whose role in the maintenance of social relations must have been important in the evolution of cooperation in humans / A coopera??o humana ? um tra?o distintivo da esp?cie, devido ? sua ampla extens?o ? n?o aparentados e elaborada divis?o do trabalho. ? considerada um quebra-cabe?a evolucionista, tendo em vista que a teoria da evolu??o por sele??o natural prev? que indiv?duos auto-interessados tendem a ser selecionados. The main objective was to study how the functioning of the different care and protection services performed by the Civil Police, Military Police and Judiciary in Porto Alegre - RS, and what the consequences of the Law option for both women situation of violence met, and for the institutions activated to the formal processing of cases. The hypotheses are a) the violent conflicts that result in victimization of women in their home environment have a specificity as delivery mechanisms offered by the criminal justice system are not able to consider; b) the choice of criminal hardening, which has characterized the current context of punitive demand from social movements, is connected with the state adherence to the punitive populism and regulative state model development and c) the use of criminal law as a means to ensure gender equality and prevent violence implies harm to the administration of domestic and family conflicts, since the criminal logic colonizes all the mechanisms aimed at preventing violence and guarantee of rights. / Esta tese procura identificar quais as consequ?ncias geradas pela op??o tomada pela Lei 11.340/06 (Lei Maria da Penha) ao utilizar o sistema de justi?a criminal como mecanismo central para a administra??o de conflitos violentos contra a mulher e, al?m disso, busca compreender se esta op??o considera a complexidade que envolve estes conflitos, atendendo as demandas das mulheres em situa??o de viol?ncia que buscam o auxilio do Estado para administra-los. O objetivo central ? o de verificar como se d? o funcionamento dos diferentes servi?os de atendimento e prote??o realizados pela Pol?cia Civil, Brigada Militar e Poder Judici?rio na cidade de Porto Alegre ? RS, e quais as consequ?ncias resultantes da op??o da Lei tanto para mulheres em situa??o de viol?ncia atendidas, quanto para as institui??es acionadas para o processamento formal dos casos.
