A presente tese propõe-se a contribuir para a investigação das dinâmicas recentes de reprodução do capital no setor imobiliário residencial no país, a partir da análise do boom imobiliário que tomou a metrópole paulistana na segunda metade dos anos 2000. Esta produção, caracterizada pela expansão territorial do mercado formal de moradia sobre as periferias consolidadas, bem como pela ampliação da demanda atendida, incorporando camadas de média e média-baixa renda, resultou na inserção de novas regiões nas dinâmicas imobiliárias formais. Este processo, protagonizado pelas grandes incorporadoras, implicou um acirramento da disputa por terras urbanizadas nestas novas fronteiras, o que restringiu os espaços disponíveis para a produção de habitação social, bem como para a atuação do mercado informal, restando às camadas de mais baixa renda as poucas áreas ainda descartadas pelo mercado formal, mais distantes e precárias, e, por vezes, ambientalmente frágeis, numa redefinição da cartografia da segregação socioespacial na Região Metropolitana de São Paulo. Este movimento contou com forte participação do Estado, tanto na construção de um ambiente regulatório favorável às atividades do setor, reduzindo os riscos dos agentes privados, quanto na injeção de recursos públicos e semipúblicos para garantir a continuidade de sua expansão, ao manter a demanda aquecida, através da retomada do financiamento habitacional e da concessão de subsídios, que têm, em grande medida, sustentado a recente explosão dos preços imobiliários. Neste contexto, gestões municipais dos mais diversos matizes político-ideológicos se mobilizaram em torno ao imperativo do crescimento, associado à valorização imobiliária, definindo-o como um dos principais objetivos das políticas urbanas. Deflagrou-se, com isto, entre os municípios, a guerra dos parâmetros urbanísticos, visando à atração do capital imobiliário, através da permissividade na ocupação e no adensamento construtivo do solo urbano, reduzindo as possibilidades de ações integradas em escala metropolitana, fundamentais para o enfrentamento dos atuais problemas urbanos. / This thesis aims at contributing to the investigation of the recent dynamics of reproduction of capital in residential real estate in the country, from the analysis of the real estate boom that took hold the metropolitan area of Sao Paulo in the second half of the 2000s. This production, characterized by territorial expansion of the formal housing market on the consolidated peripheries, as well as by the expansion of the attended demand, incorporating middle and lower-middle income segments, resulted in the insertion of new regions in the formal real estate dynamics. This process, carried out by large developers, led to an intensification of competition for urbanized land in these new frontiers, which has limited the available space for the social housing production, as for the informal market activities, leaving to the lowest income population, few áreas still ruled out by the formal housing market, more distant and precarious, and even environmentally fragile, in a redefinition of the mapping of socio-spatial segregation in the Metropolitan Area of São Paulo. This movement had strong participation of the State, both in constructing a propitious regulatory framework for the real estate sector\'s activities, reducing the risks of private agents, as in the injection of public and semi-public resources to ensure their continued expansion, by keeping the demand heated by the housing finance resumption and the provision of subsidies, which have largely supported the recent explosion in housing prices. In this context, municipal administrations of various political-ideological hues were mobilized around the imperative of growth, associated at real estate valuation, defining it as one of the main objectives of urban policies. That flared-up a \"war of urban parameters\" between the municipalities, aiming at the attraction of real estate capital, through the permissiveness in occupation and in constructive densification of the urban land, reducing the possibilities of integrated actions in the metropolitan scale, which is fundamental to facing the current urban problems.

Este trabalho estuda o novo produto imobiliário que ganhou espaço na última década no Brasil: os loteamentos fechados. Mudanças estão sendo sentidas na configuração do espaço urbano brasileiro, notadamente nas grandes metrópoles, pois emerge em nossas cidades um novo padrão de segregação urbana, especialmente no que se refere às áreas residenciais, com a proliferação de condomínios e loteamentos fechados. A pesquisa empírica foi realizada na Região Metropolitana de Campinas, região de destaque por apresentar altos índices de dispersão. O objetivo principal do trabalho é investigar os motivos pelos quais os loteamentos fechados tornaram-se o principal produto imobiliário a partir dos anos 1990, no Brasil e em diversos países do mundo, especialmente da América Latina. Para tanto, resgata-se o processo de urbanização brasileira e os impactos da globalização sobre o território das cidades, como a fragmentação do território e a urbanização dispersa. O trabalho aborda também a discussão jurídica sobre o tema dos loteamentos fechados. Traz a discussão entre prefeituras, loteadores e Ministério Público, no sentido de entender de que forma a burla da lei se dá. Quanto à motivação para a moradia intramuros, discute-se o assunto sob a luz de estudos elaborados por pesquisadores em diversos paises, buscando localizar a realidade brasileira e compreender suas origens, referências e conseqüências do processo. / This work studies a new real estate practice that has proliferated in the last decade in Brazil: Private gated communities. Changes can be seen in the Brazilian urban space configuration, especially in the great metropolis. Emerges in our cities a new pattern of urban segregation, especially in what makes reference to the residential areas, with condos and gated community proliferation. The empirical research was carried at Campinas Metropolitan Region, a featured region by its \"high dispersions index\". The main objective of this work is to investigate the reasons why gated communities became the main real estate choice from the 90\'s, in Brazil and in different countries in the world, especially in Latin America. Therefore, the Brazilian urbanization process is rescued and the globalization impacts on the cities territories, as the territory fragmentation and the dispersed urbanization. The work also approaches the Law discussion on gated communities. Brings the discussions between the city halls, real estate agents and the Public Ministry, in the sense of understanding in which way the law has been broken. Referring to the reasons for the \"within the walls\" residence, the subject is discussed through studies carried by researches in different countries, seeking to locate the Brazilian reality and understand its origins, references and process consequences.

Este trabalho propõe considerar o processo de formalização legal das transações de terras ocorrido após 1822 - ano da independência do Brasil - como mais uma condição de valorização da terra no Brasil paralelo às classicamente discutidas pela historiografia da História Agrária.O referido processo foi desencadeado pela necessidade de dinamizar o crédito em uma economia pouco monetizada e antecedeu e influenciou o surgimento da propriedade privada no Brasil. Pode ser percebido pela elaboração de leis que visaram promover maior clareza e segurança jurídica nos contratos. Para isso, as mudanças legais não só reformaram e produziram regras e procedimentos contratuais, como o sistema cartorial com a criação dos Cartórios de Registros ao lado dos Cartórios de Notas, integrando suas atividades: o Cartório de Notas passou a controlar a produção dos contratos dentro das formalidades ditadas pela Lei e o Cartório de Registro a lhes dar publicidade. Para concentrar as informações contratuais nos cartórios e disponibilizá-las para o conhecimento público, o Estado paulatinamente desestimulou os negócios feitos por títulos particulares por meio de sucessivas leis, que de forma gradual restringiram a sua segurança jurídica e validade legal. A maior clareza e segurança jurídica produzidas nesse processo tiveram o efeito não só de dinamizar o crédito hipotecário, como também as compras e vendas, catalisando o ganho de valor da terra em condições favoráveis. / The purpose of this dissertation is to assess the process of legal formalization of land purchase after 1822 when Brazil became independent as yet another condition of land valuation in the country, parallel to the reasons that have been traditionally discussed by the historiography on Agrarian History. Such process was triggered by the need to render credit more dynamic in a seldom monetized economy, having both preceded and influenced the rise of private property in Brazil, and included the drafting of laws to promote greater clarity and legal safety for the respective contracts. To this end, the legal modifications not only reformed and produced contractual rules and procedures, but also provided for the establishment of the notarial system and the relevant Real Estate Registry Offices (Brazils registers of deeds) and the Notary Public Offices, whose activities were integrated: the Notary Public Offices were used to control contract drafting according to the formalities set forth by law, whereas the Real Estate Registry Offices were used to render the contracts public. In order to concentrate contractual information at the registries and offices and ensure the public awareness thereof, the State gradually discouraged contractual transactions closed by means of private instruments upon the enactment of successive laws that gradually limited the legal safety and validity thereof. The greater clarity and legal safety brought forth by this process not only enabled mortgage credit to become more dynamic, but also provided for new scenarios in land purchase, thereby resulting in land valuation in favorable conditions.

A crise evidenciou a extensão dos vínculos entre o imobiliário e o financeiro, intensificados nos anos 1980 em diversos países. O crescimento dos empréstimos de tipo subprime (de segunda linha) fez parte do salto ocorrido na massa de capital fictício nesse período, o que, combinado a formas antigas de espoliação, caracteriza a globalização. As famílias recorreram ao endividamento em um contexto de estagnação de salários, de liquidez propiciada, parcial e paradoxalmente, pelo financiamento da China ao enorme déficit comercial dos EUA, de falta de política pública ampla de educação e saúde e de uma história repleta de esforços para manter a habitação como frente de acumulação capitalista e não direito social: a homeownership society. A mundialização financeira incide, no Brasil, sobre um circuito imobiliário que se configurou de modo muito diferenciado em relação ao norte-americano. O circuito imobiliário não segue necessariamente o movimento geral das transformações econômicas e sociais e, assim como outros setores, exige um esforço de compreensão específico. A retrospectiva de diversos arranjos que o circuito imobiliário assumiu no Brasil ao longo do tempo, desde a constituição do mercado de terras até o pacote habitacional Minha Casa Minha Vida, passando pelo BNH, contribuiu para identificar como a financeirização atinge essa trajetória. Os fluxos de capitais - alterados pela lógica financeira - impulsionam transformações na concorrência e na estrutura de propriedade das empresas, em suas estratégias territoriais e de mercado, no canteiro de obras e na forma imobiliária. Superam ou contornam barreiras para alargar o campo de ação do circuito imobiliário - historicamente restrito a uma parcela minoritária da população - e voltam a encontrá-las quando os limites e as contradições se manifestam. Amplas parcelas da população continuam sujeitas aos ciclos de despejo, assentamento precário e irregular, e expulsão. As transformações identificadas colocam novos problemas para o pensamento crítico sobre o urbano e para os estudos sobre financeirização. Sugerem, ainda, que a luta pelo direito à cidade enfrenta novos desafios com o aumento da capacidade do capital de impor seus requerimentos e das dificuldades para que a paisagem urbana responda a critérios não mercantis e universais, no campo dos direitos sociais / Abstract: The wave of evictions in the wake of the worldwide financial crisis, that began in 2007, hit over 4,5 million American families, and left whole neighborhoods to their own devices in American cities. The crisis has revealed the extent of the links between real estate and finance, which, in several countries, intensified during the 1980s. The growth of subprime loans was part of the increase in the mass of fictitious capital in this period, which, combined with early forms dispossession, characterizes globalization. Families resorted to debt in a context of wage stagnation, of liquidity partially and paradoxically propitiated by China's funding of the USA's enormous trade deficit, of a lack of a wide-ranging public policy on education and health, and of a history of efforts to keep housing as a site for capital accumulation and not as a social right. In Brazil, the financial globalization has impacted a real estate market that had been configured very distinctively from the American case. Besides, the real estate market does not necessarily follow the general movement of economic and social transformations. Thus, along the lines of other sectors, such a market demands a specific comprehension effort, to which this thesis contributes. The retrospective look at the diverse arrangements that the real estate circuit has taken up in Brazil over time, since the constitution of the land market up to the housing set of policies ?My Home, My Life?, as well as those of the National Housing Bank, has contributed to identify how financialization has impacted this trajectory. The flows of capital - changed by financial logic - have driven transformations in competition and in the enterprises' property structure, in their territorial and market strategies, in the building site, and in the real estate form. They overcome or circumvent barriers in order to widen the field of action of the real estate market, and find them again when the limits and contradictions are manifested. The identified transformations pose fresh problems for critical thinking about urban issues and for studies on financialization. Este trabalho tem como objetivo discutir o modelo de moradia mínima destinado ao povo sob as condições do sistema capitalista neoliberal e apontar suas latentes contradições sociais e ambientais. Para isso, busca-se construir uma revisão histórica que recupera as origens da habitação operária durante o desenvolvimento da cidade industrial, ou seja, o momento em que a questão da moradia se estabelece enquanto uma dimensão de conflito. E, a partir disso, refletir sobre o modo como a habitação mínima foi sendo assimilada dentro do desenvolvimento do capital, inclusive através do movimento moderno, de modo a desmobilizar as resistências sociais através de uma cultura pautada pelo consumo. A presente pesquisa se concentra no esforço de desnaturalizar algumas das questões constitutivas do imaginário que cercam a questão da moradia a fim de apontar a gravidade dos efeitos da lógica econômica, que se baseia na acumulação de capital e que distancia a habitação de sua real finalidade enquanto direito social. / The aim of the present investigation is to discuss minimum housing standards intended to a society under the conditions of the neoliberal capitalism system and to highlight its social and environmental latent contradictions. So, this work seeks to construct a historical review that recovers the origins of the workers dwellings during the development of the industrial city, in other words, this is the moment when the housing issue is established as a dimension of conflict. From this, reflecting on how minimal housing has been assimilated by the currency development, including by the the modern movement, in order to demobilize social resistance through a culture based on consumption. Therefore, this research focuses on the effort to rethink the common sense that surrounds the housing issue, aiming to emphasize the impact of the economic effects, which is based on capital accumulation and that distances the housing from its real purpose as a social right.

Analytical part analyzes data from e-auction and direct sale of apartements, and research questions are answered.

The present Master Thesis tries to summarize and assess individual aspects of a decision-making process connected with a housing purchase. In the theoretical part, ways and methods of market survey, in particular so called mystery shopping, are outlined and explained. Further on, basic concepts connected with the housing market are defined and clarified. The first section of the practical part of the present Master thesis explores opinions of a selected representative group of potencial clients, based on the original author´s questionnaire (with analysis and assessment of answers). In the second section, a client-oriented approach of four selected development companies is explored and analysed in detail, with the evaluation and listing of pros and cons of marketing / business communication of selected developers. Finally, there is a third section of the second part, providing interviews with experts with considerable expertise in the field of (housing) real estate market and banking sector.

The aim of this work is to describe the phenomena of bubble in the financial, but especially in the real estate market; based on gained information, the current situation of Chinese real estate market is described. This work is divided into theoretical and more practical part. The theoretical part is devoted to the definition of bubble, bubbles in asset market, real estate market bubbles specifics and its causes analysis, identification and implications for the economy. Also, the Japanese real estate bubble is described. The second part describes the evolution of Chinese real estate market and provides overview of the milestones in its evolution. Moreover, it deals with specifics of the Chinese real estate market and explains the factors behind the rise in prices. Further in second part, situation on Chinese housing market is compared with the one in Japan during real estate bubble. Furthermore, this thesis explains how state government can coordinate, regulate and intervene on the market and comes up with short-term outlook.

This thesis is dedicated to the economic development in Spain in the times of the longlasting economic expansion which was terminated by the crisis in 2006-2007. The purpose is to summarize the development, identify the main factores causing the crisis and to evaluate the impacts. Great part of this thesis is dedicated to the sector of construction and the real estate market. It analyses the process of formation of the price bubble on the real estate market and its subsequent crack. The problematic internal situation was in a short time period exposed to the impacts of the global financial crisis. A special part of this thesis is therefore dedicated to the Spanish banking sector and its stability.
