Sexual harassment of academic staff at higher education institutions in South Africa / Pierre André Joubert.

The efforts to create an equal non-discriminatory South African society should also manifest in the workplace and, more specifically, in the academic arena. Academics are regarded as the leaders of society and the shapers of the future of a country. Their conduct should be of the highest ethical and moral standards, and no form of discrimination should be allowed by or against them. In terms of the Employment Equity Act, sexual harassment is a form of unfair discrimination and carries a substantial penalty should an employer be found guilty of vicarious liability. The purpose of this study was to determine the perceived incidence of sexual harassment of academic staff at higher education institutions in South Africa, as well as their awareness of the policies dealing with sexual harassment. The sufficiency of the grievance procedures designed to deal with complaints of sexual harassment was also evaluated. A cross-sectional survey design was used to reach the research objectives. The Sexual Harassment Questionnaire (SHQ) was randomly distributed amongst a sample of 710 academic staff members from 10 higher education institutions in South Africa. A response rate of 22,8 percent (n = 162) was achieved. The statistical analysis was carried out using the SPSS 15.0 program (SPSS 2007), a program that is used to conduct statistical analysis regarding reliability and validity of the measuring instruments, descriptive statistics, /-tests, analysis of variance, correlation coefficients and multiple regression analysis. Article 1 focuses on the perceived incidence of sexual harassment. In this article, five categories of sexual harassment were used as indicators of the incidence thereof, namely verbal, non-verbal, physical, gender and quid pro quo harassment. A statistically significant correlation coefficient with a large effect was found between verbal and non-verbal harassment. A practically significant correlation of a medium effect was also found between physical, verbal, non-verbal and quid pro quo harassment and sexism, as well as between the control item of sexual harassment and physical, verbal, non-verbal and quid pro quo harassment. Analyses of variance were performed on the different demographic groups using various variables and the findings indicate no practically significant effect of gender, age, population group or years of service on sexual harassment. In Article 2, the awareness of sexual harassment policies and procedures were determined. Various aspects of policies were investigated, such as content, development, types and implementation. The results show that despite indications that sexual harassment policies do exist and that they are regarded as effective tools in addressing sexual harassment, the implementation of such policies is not effective. In addition, few academic staff members receive training/guidance on the utilisation of these policies. Significant correlation coefficients were found between the elements of an effective policy and between population groups and some of the elements. Article 3 reports on findings regarding the sufficiency of grievance procedures in dealing with complaints of sexual harassment. The results show a positive correlation between confidence in the grievance procedure, the amount of attention that supervisors pay to grievances, regular feedback to employees regarding the progress of grievances, willingness of supervisors to take decisions, the amount of confidence in supervisors and the effectiveness of the procedure. The aim of this thesis was to analyse remedial measures in the field of environmental protection first from the perspective of legal theory in general and then specifically by analysing individual provisions regulating remedial measures in selected laws in this field. The selected remedial measures were subjected to an evaluation of the effectiveness and efficiency of the current legislation, one of the tools used being an excursion into the practice of the relevant authorities. Following this evaluation, the work also includes de lege ferenda considerations reflecting the identified shortcomings, in particular the low use of corrective measures in practice. However, these conclusions should be considered only partial, as the ambition of this work was not to present an exhaustive analysis of this institute nor to present a complete overview of the established practice of the competent authorities. The first chapter focuses on the general characteristics, definition and setting of remedies in the context of environmental law. It also looks at the relationship of remedies to sectoral legal principles and finally offers possible criteria for the classification of remedies. Planning permission procedure: process, decision and means of defence Abstract The topic of the thesis is the planning permission procedure, which is regulated in Act No. 183/2006 Coll., on town and country planning and building code (Building Act) and its goal is to issue one of the types of planning permission. Planning permission procedure follows town and country planning and at the same time other administrative procedures follow planning permission procedure. In many cases successful planning permission procedure is an indispensable and key precondition of the realization of applicant's intention. The thesis deals with the procedure itself, specifically elements of application for planning permission, commence procedure, types of delivery of written instruments, defining of participants of procedure, applying the principle of concentration, conditions and content of binding assessments for issuance of the decision, objections and remarks. In the field of environmental law, some people consider the most important provisions enforcing environmental standards. However, not only in law, it is necessary to think about situations in which the subjects do not respect the law and adjust their responsibility in the event of violation of their duties. Without adjusting the remedial measures, the restoration would only be a moral obligation. Under such circumstances, the measures would be mostly financed by the state and there would not be any possibility of regression to the originator. That is the reason, why effective remedial measures, which can be characterized as a frontier institute between prevention and sanctioning, are needed. At present, remedies can be imposed through a relatively diverse range of legislation, of which the most important should be Act No. 167/2008 Coll., On Prevention of Environmental Damage and its Remedy. Remedial measures are, however, usually imposed on the basis of constituent laws for which the imposition of sanctions and corrective measures is not linked to the occurrence of environmental damage but to a specific breach of the obligations laid down. Re-establishment of connectivity for fish populations in regulated rivers

<p>The hydropower industry has altered connectivity in many rivers during the last century. Many fish species depend on both an intact longitudinal connectivity to be able to migrate between spawning, feeding and winter habitats, and vertical connectivity for development and survival of incubating embryos and larvae in the gravel. The objective of this thesis was to examine problems and remedial measures associated with disrupted longitudinal and vertical connectivity in regulated rivers. The issue of longitudinal connectivity was studied in the River Emån by evaluating the efficiency of two nature-like fishways for anadromous brown trout. Telemetry studies showed that the combined efficiency for the two fishways in 2001-2004 was 60.5%. The passage efficiencies of both fishways were high for trout (89-100%), but also for other species such as chub, perch, tench, burbot and roach (74%). The attraction efficiencies were largely dependent on power plant operation, and generally high for the fishway situated next to the tail-race and low for the fishway situated inside the former channel. More than half of the trout spawners were also observed using the fishways for downstream passage. The densities of brown trout yearlings upstream of the fishways were higher after the fishways were built than during pre-fishway years. Smolts produced upstream of the fishways were observed migrating downstream in 2003-2005. The percentage of smolts that passed both power plants in was 51%, with losses being attributed to predation (15%), turbine-induced mortality (16%) and other reasons (18%). Turbine-induced mortality was higher (40%) at the power plant with four small Francis runners, than at the power plant with one large Kaplan runner (12%). The issue of vertical connectivity was studied in three rivers in Värmland, one unregulated, and two regulated, one of which had no minimum flow requirements. In the unregulated river, temporal patterns in hyporheic water chemistry correlated to variation in surface water chemistry and discharge as expected. In the regulated rivers, the hyporheic water chemistry showed little correlation to discharge or surface water chemistry. The intra-gravel water chemistry conditions for brown trout eggs were more favourable in the unregulated river, characterised by high oxygen levels, than in the two regulated rivers. The regulated river with no minimum flow requirements had critically low oxygen levels at the end of the incubation period.</p>

Theme of thesis The system of remedial measures Abstract This master's thesis deals with the issue of correction systems and remedial measures based on them in the Czech legislation. The aim of this work was to describe individual aspects of the appeal, cassation and revision correction system on the current regulation. This thesis includes the characteristics of correction systems from a theoretical point of view and the application of the principles of correction systems in the Czech legal regulation of remedial measures. The master's thesis consists of seven chapters. The first chapter is a general introduction to the correction procedure. It explains the concept of a correction system and describes the general features according to which the individual systems are divided. The second chapter characterizes the individual correction systems. The chapter is divided into three parts. First, the appeal system is characterized, which is divided into the complete and incomplete appeal system, then the cassation system and finally the revision system.
