Deductions from employees' remuneration :seeking clarity in the law

<p><font size="3" face="Arial"><font size="3" face="Arial"> <p align="left">In this study, I will look at the common law principle of offset to see whether it can be applied to employers making deductions against employees for loss or damage. Notice is a quantifiable amount and is a legal debt / therefore. it should be able to be applied as an offset. Two subsections deal with deductions / after looking carefully at the wording of theses subsections I will try to determine whether the one is alternate to the other, or whether the narrow interpretation that the Department of Labour gives to the statute is accurate. A narrow interpretation of the law states that the employee must sign an acknowledgement of debt. However, employees often refuse to sign an acknowledgement of debt, thereby frustrating the law. Could this possibly have been the intentions of the drafters? Surely not, yet the Department of Labour, by having a narrow interpretation of the law, see it as such and as a result the employer is left out of pocket. In this mini-thesis, I will look at the way the law should be interpreted and the way it should be applied in practice.</p> <p>&nbsp / </p> </font></font></p>

Magistro baigiamajame darbe siekta įvertinti verslo įmonių vadovų naudojamas galias, kaip darbuotojų motyvacijos veiksnį, teoriniu bei empiriniu aspektais. Teorinėje darbo dalyje atskleistos galių bei motyvacijos sampratos ir esmė, išanalizuoti motyvaciją sąlygojantys veiksniai, išskirtos svarbiausios vadovų galios bei jų poveikis darbuotojų motyvacijai. Praktinėje darbo dalyje, remiantis kiekybiniais ir kokybiniais metodais, pateikiami vadovų galių naudojimo motyvuojant darbuotojus tyrimo rezultatai. Juose atsispindi, kaip verslo įmonių vadovai naudoja savo formalią, atsilyginimo, baudimo, ekspertinę ir patrauklumo galias motyvuoti darbuotojus dirbti. Atlikus tyrimą nustatyta, kad vadovų naudojamos galios, ypač formali, baudimo ir ekspertinė skatina darbuotojų motyvaciją. Išnagrinėjus teorinius ir praktinius vadovų galių naudojimo motyvuojant darbuotojus aspektus, pateikiamos baigiamojo darbo išvados ir rekomendacijos. / In this master thesis it was striven to assess powers used by business companies’ managers as the factor for employees’ motivation in the theoretical and empirical aspects. Conceptions and essence of powers and motivations have been revealed, factors predetermining motivation have been analysed and the most significant powers of managers and their impact on employees’ motivation have been emphasized in the theoretical chapter. In the practical chapter of the thesis, referring to quantitative and qualitative methods, the research results related to the use of managers’ powers when motivating their employees have been provided. They reflect how business companies’ managers use their formal, remuneration, punishment, expert and attraction powers in order to motivate their employees for work. After having completed the research it was established that powers used by managers and especially formal, punishment and expert ones encourage motivation of the employees. Having analysed theoretical and practical aspects related to the use of managers’ powers in motivation of their employees, conclusions and recommendations have been provided in the thesis.

Resumo: No bojo das discussões a respeito da melhoria da qualidade da educação, frequentemente surgem questões relacionadas ao trabalho e aos salários dos professores. Muitas pesquisas defendem que os salários recebidos pelos professores brasileiros contribuem para o quadro de precarização e intensificação do trabalho docente, trazendo consequências negativas para o trabalho do professor. Por outro lado, existem pesquisas que afirmam ser nulo ou muito pequeno o impacto dos salários sobre o trabalho docente. Para compreender melhor esse complexo quadro, essa pesquisa buscou verificar a forma pela qual os salários docentes são tratados nas pesquisas e documentos que abordam o assunto, tendo como objetivo central analisar e compreender as implicações dos baixos salários dos professores da Educação Básica do Brasil para o trabalho docente. Para tanto, foi realizada uma pesquisa de caráter bibliográfico-documental que teve como corpus de análise as pesquisas relacionadas à remuneração docente produzidas, principalmente, por pesquisadores da educação e da economia e documentos relativos à temática elaborados por organismos internacionais como o Banco Mundial e a Organização das Nações Unidas para a Educação, a Ciência e a Cultura (UNESCO), por duas organizações sindicais de professores, no caso, a Confederação Nacional dos Trabalhadores em Educação (CNTE) e o Sindicato dos Professores do Ensino Oficial do Estado de São Paulo (APEOESP), pelo Conselho Nacional de Secretários de Educação (CONSED) e pela União Nacional de Dirigentes Municipais de Educação (UNDIME), além da legislação brasileira pertinente ao estudo e dos dados da Pesquisa Nacional por Amostra de Domicílios (PNAD) de 2008. A partir da análise realizada é possível afirmar que os salários dos professores brasileiros podem ser considerados baixos e se configuram como um dos aspectos... Many studies have argued that the salaries received by Brazilian teachers have been contributing to the symptoms of instability and intensification of teachers' workday, bringing negative consequences for the teacher's work. On the other hand, there are studies which have been shown to be nil or very small the impact of wages when considering the teacher's work. To better understand this complex situation, this work analyzes the way in which the teacher‟s salaries have been taken based on the researches and documents which have discussed this subject, having as a main objective to analyze and understand the implications of Brazilian teachers‟ low salaries in the Basic Education. Therefore, a bibliographic - documentary survey had been conducted, having as the analyses corpus the study related to teacher‟s wages, mainly the ones made by education and economy researchers together documents related to the theme elaborated by international organizations, e.g. the World Bank and the United Nations Educational, Scientific and Cultural Organization (UNESCO), and two Teacher‟s Trade Unions, as the National Confederation of Education Workers and the Sao Paulo State Official Trade Union of School Teachers (APEOESP) and by the National Council of Education Secretaries (CONSED), the National Union of Municipal Education Managers (UNDIME), as well the Brazilian legislation relevant to the study and data from the National Household Sample Survey (PNAD) 2008. The aim of the thesis is to evaluate personnel activities in the selected company and to suggest changes to improve them. This thesis consists of theoretical and practical parts. The theoretical part explains the basic personnel activities. It explains the following activities: job analysis, personnel planning, recruitment, selection and adaptation of employees, performance management and appraisal, placement and termination of employment, remuneration of employees, motivation and employee benefits, education and development, interpersonal relationships, employee care and personnel information system. The practical part describes the personnel activities in the limited liability company GEFOS Inženýring, based on an interview with directress of the company. She allowed me to look into company´s documents. The next chapter analyzes the results of the questionnaire inquiry. These results are supplemented by information from my direct observation. The final part of this thesis evaluates the personnel activities of the company and suggests changes to improve the current situation.

We also sought adocumentary analysis, based on a quantitative approach, comparing the remuneration valuesreceived by the various public workers. To conclude we used a field research, applying a surveymodel questionnaire.Findings- The study shows that employees relationships go far beyond simple exchanges basedon material resources; however, workers still perceive positively the influence of rewardsystems and pay on their motivation. And as important as the value of these rewards is the senseof justice perceived by the worker.Research limitations – The activities of the positions belonging to the study sample, althoughsimilar, have different complexities according to the organization in which they are performed.In addition, the results of the study cover only part of management analysts’ reality. Anotherpoint is the variation of the remuneration values received by the different careers in the year2017, data that have not yet been available until the conclusion of this study.Practical implications – This study should contribute to the strengthening of existing literatureon motivation in the public service, pushing new research to seek solutions to the salarydistortions that occurred between different careers in public administration.Social implications - The current society’s demand is for an efficient public service, meetingthe needs of the citizen in the best way and at the lowest possible cost. Public job and salaryplans must be in line with this reality. The presented literature has foundations able to assist thepublic agents in the development of policies directed to the management of people in thegovernmental area. / Objetivo - O objetivo da pesquisa é estudar os possíveis impactos das iniquidades remuneratórias sobre aspectos motivacionais dos trabalhadores públicos, tendo como foco os analistas de gestão em saúde da Fundação Oswaldo Cruz (FIOCRUZ). Metodologia - Foi realizada pesquisa bibliográfica, buscando-se artigos e estudos acadêmicos que abordassem a correlação entre remuneração e motivação. Buscou-se também uma análise documental, a partir de uma abordagem quantitativa, comparando os valores remuneratórios recebidos pelos diversos servidores. Ao final, utilizou-se a pesquisa de campo, aplicando um questionário modelo survey. Resultados - O estudo demonstra que as relações de trabalho vão muito além de simples trocas pautadas em recursos materiais; entretanto, os trabalhadores ainda percebem positivamente a influência dos sistemas de recompensas e da remuneração sobre sua motivação. E tão importante quanto o valor dessas recompensas está o senso de justiça percebido pelo trabalhador. Limitações - As atividades dos cargos pertencentes à amostra embora sejam similares, possuem complexidades diferentes de acordo com o órgão em que são exercidas. Além disso, os resultados do estudo abrangem a realidade apenas de parte dos analistas de gestão. Outro ponto é a variação dos valores remuneratórios recebidos pelas diversas carreiras no ano de 2017, dados estes que ainda não disponíveis até a conclusão do estudo. Aplicabilidade do trabalho – O presente estudo deve contribuir para o fortalecimento da literatura existente acerca da motivação no serviço público, fazendo com que novas pesquisas busquem trazer soluções para as distorções salariais ocorridas entre as diferentes carreiras na administração pública. Contribuições para a sociedade - A demanda da sociedade atual é por um serviço público eficiente, atendendo as necessidades do cidadão da melhor forma e ao menor custo possível. Os planos de cargos e salários públicos devem estar alinhados a essa realidade. A literatura apresentada traz fundamentos capazes de auxiliar os agentes públicos no desenvolvimento de políticas voltadas para a gestão de pessoas na área governamental.

Notre siècle a consacré le principe de l’égalité professionnelle entre les femmes et les hommes. L’étude comparée en France et en Algérie, deux systèmes juridiques distincts, permet d’aborder ses aspects tant théoriques que pratiques. La distinction entre Orient et Occident peut-elle impacter sur la réalisation de l’égalité professionnelle entre les sexes ? L’étude révèle une convergence évidente. L’égalité juridique entre les sexes est reconnue en droit positif français et algérien (Partie 1). L’omniprésence et la complexité de la notion seront exposées. S’en suit une reconnaissance internationale et nationale du principe, qui a fait abstraction des considérations culturelles. Toutefois, les constats de situations inégalitaires demeurent. Bien que l’application du principe soit étendue, la portée relative du principe s’affirme (Partie 2). La recherche d’un équilibre social entre les sexes progresse pour garantir un principe effectif. / Our century established the principle of professional equality between women and men. A comparative study in France and Algeria, two distinct legal systems, allows us to underline both theoretical and practical aspects. Can the distinction between East and West impact on the achievement of professional equality between the sexes? Another study reveals a clear convergence. Legal equality between the sexes is recognized in french and Algerian law (Part 1). The pervasiveness and complexity of the concept will be shown. Ensues international and national recognition of the principle, which was to ignore the cultural considerations. However the findings of unegalitarian situations remain. Although the principle is extended, the relative significance of the principle asserts (Part 2). The search for a social balance between men and women progresses in order to ensure effective the principle.
