The aim of the diploma thesis is to try to provide a comprehensive interpretation and analysis of the legal institute of easements and their individual aspects in the current legal regulation, taking into account the judicial decisions of the Czech courts after year 1989 as well as the case law of the First Republic related to the General Civil Code. The thesis consists of four parts. The first part deals with the interpretation of the concept of iura in re alinea as the institute superior over easements. In the last chapter of this first part the institute of easements and their basic aspects are generally defined. The second part of the diploma thesis describes the individual stages of the historical development of the institute of easements. The concept of easements in Roman law is being analyzed, taking into account some differences from its conception and modification at present. The following is an interpretation of medieval easements, and finally, the author deals with the modern legal regulations of the easements in the civil law legislation starting from the General Civil Code through the civil codes issued under the Communist regime in 1950 and 1964. Les biens ne semblent exister que pour être classés, distingués et appropriés, mais ne sont guère envisagés indépendamment des droits réels qui s’y rapportent. Or, la multiplication pléthorique des droits réels pourrait bien révéler la diversité des objets possibles du droit réel. Ces objets ne sont pas des choses du monde extérieur, mais une réalité abstraite que le droit construit au terme d’une opération de qualification: ce sont des objets juridiques, parce qu’ils sont déjà envisagés par le droit objectif à l’occasion de l’application d’une règle de droit positif qui impose l’appréciation de certains éléments de fait propres à en révéler l’existence. Le droit objectif construit donc une réalité qui lui est propre, avant même qu’il soit fait référence à un éventuel droit réel. Pour autant, la technique juridique n’est jamais inerte. Il existe des mécanismes permettant à la volonté de modifier la consistance ou l’affectation des objets juridiques et, partant, d’agir sur le régime des biens. Ces opérations sont à la fois caractéristiques et spécifiques de la technique du droit réel, employée pour façonner la réalité que perçoit le droit objectif. Les prétentions subjectives à la jouissance des objets juridiques rejaillissent, cependant, sur la conception que l’on se fait du droit réel, au point d’occulter sa dimension technique derrière les prérogatives qu’il semble conférer aux sujets de droit. / In French property law, things only seem to exist in order to be classified or owned. They are scarcely described in themselves, independently from rights in rem. The multiplication of these rights suggests, however, that they only reflect the diversity of underlying property objects. Such objects are not things from the external world, but an abstraction which the legal system constructs upon characterising certain facts and giving them a legal denomination. The application of a legal rule requires the appreciation of factual elements which, in turn, reveal the existence of an object filled with juristic qualities, before a property right even exists. Yet, legal technique is never entirely passive. The law provides certain mechanisms through which it is possible to modify the legal consistency and the purpose served by juristic objects and, therefore, to change the rules applicable to them. These results are both characteristic of and specific to in rem legal techniques. However, when legal subjects assert claims to the possession of an object, their pretensions also transform our understanding of in rem mechanisms, obscuring their technical function beneath the rights and powers which they seem to grant these individuals.

The aim of this thesis is to try to provide an analysis of the legislation of easements contained in the Civil Code, to take into account the case law related to the General Civil Code as well as the recent court decisions and express controversy over some aspects that the new legislation offers. The thesis is divided into four chapters, the first chapter is devoted to a brief definition of easements and the kinds of easements. The second chapter analyzes the historical development of the easements. In the first part of the chapter the Roman law, which was the first to regulate the easements, is discussed. Furthermore, the chapter deals with the development of the easements during the Middle Ages, when the easements were joined by the institute of real burdens. The third part of the chapter discusses the legislation of easements in the General Civil Code, which is an inspiration for the current legislation; the relevant case law is not omitted. Finally, the chapter contains a section dealing with the legislation of easements in the so called Middle Civil Code from 1950 and the legislation in the Civil Code from 1964. The aim of the diploma thesis is to provide a description and analysis of the current legal regulation of easements in the Czech Civil Code, especially with regard to its sources of inspiration in the form of the General Civil Code and Government draft of the Civil Code of 1937. The diploma thesis focuses on problematic issues of current legislation, including interpretive methods of their removal and proposals de lege ferenda. The first chapter generally characterizes the easements and describes their theoretical division. The second chapter deals with the historical development of the institute of easements. The concept of servitude in Roman law, which played a key role in shaping the following legislation, is discussed. A treatise on the General Civil Code and the Government Draft Civil Code of 1937, on which the current legislation is mainly based, is published. Attention is also paid to the civil codes adopted during the communist era in 1950 and 1964, which deviated from the traditional concept of easement. Problematic provisions of these legal regulations are analyzed in selected places. Servitudes Abstract The aim of this thesis is to analyse the legal institute of servitudes and its issues, especially focusing on its current legal regulation in the Civil Code and related case law. The thesis deals with the problematic issues that arise in connection with the examined institute and tries to find possible ways of overcoming the flaws of the legal regulation. The thesis is divided into four parts. The first chapter briefly outlines the theoretical concept of servitudes. The second part of the thesis analyses the historical development of servitudes from their beginnings in Roman law, when the foundations of the institution under study were formed and, in many ways, survive to this day. It then continues with an explanation of the codifications regulating servitudes. It continues with an explanation of the codifications regulating easements in the Czech territory from the General Civil Code through the communist codifications of 1950 and 1964, in the latter case the most important amendments are described. Easements Abstract The aim of this thesis is to provide readers with a comprehensive view of the legal institution of easements. Thus, easements are analysed not only in the context of the existing legal regulation, but also in the context of their historical development. The aim of this thesis is also to analyse the points of contention in the existing legal framework. To this end, the readers of this thesis are offered relevant expert opinions on the controversial issue. These opinions are supplemented, where appropriate, by the opinion of the author of this thesis, who also gives his view on the issue. Relevant case-law is continuously offered in the thesis to supplement the analysis of the individual sub-aspects. The thesis is divided into three chapters. Darbe analizuojamos nuosavybės teisė bei daiktiniai prievolių vykdymo užtikrinimo būdai – hipoteka ir įkeitimas. [toliau žr. visą tekstą] / The thesis analyses the concept of rights in rem, the circumstances of their establishment in the legal systems of Continental Europe. The author gives a brief description of rights in rem, emphasizes the features of them, investigates the genesis of objects falling under the definition. The author criticizes the concept of a material thing as an obsolete and unsuitable for the needs of a modern legal system. In the second section of the thesis, the author examines a substance of specific rights in rem, the protection of the right holders in the executory process and in the processes of bankruptcy and restructuring. The thesis is concentrated upon the law of property, mortgage and pawn. In the subsections regarding the latter two, the matters and mechanisms of right holders protection are being analyzed: firstly in a context of executory process, secondly - their transformations in the processes of insolvency. The insights concerning recent novelties in the regulation of compulsory mortgage in the Republic of Lithuania are given. Now, despite the fact that the remuneration the worker perceives is also a credit, the Law of Movable Collaterals has expressly excluded security possibilities on it, limiting the property right of the worker and economically damaging him. Is this right?In this article, the author develops the answer to this question, through a systematic interpretation of Peruvian legislation and the credit figure as an object of movable collateral. / El crédito es un activo del acreedor que puede ser transferido, permitiéndose, incluso, que se constituya garantía sobre el mismo. Parallèlement à la dernière réforme française du droit des sûretés, les sûretés réelles chinoises ont été rénovées par la loi sur les droits réels promulguée à la même période. En s’appuyant sur une étude compréhensive des normes législative et réglementaire autour du sujet, cette thèse, essentiellement basée sur le droit chinois, révèle qu’en matière de sûreté réelle, le droit chinois se nuance du droit français et analyse les raisons et les effets de ces différences au-dessous des termes ou notions similaires. Après l’étude comparative, la thèse arrive à la conclusion que le droit chinois des sûretés réelles nécessite un futur regroupement en dépit de la nouvelle loi sur les droits réels. / During the same period, a reform of security law had completed in France, while the Chinese real rights law which has renovated security rights in rem was about to be promulgated in China. This thesis, based on Chinese law and drawing upon a comprehensive study of laws and administrative regulations on the subject, reveals the differences between Chinese and French law and analyze their cause and effect behind similar terms and notions. Grounded on the comparative study, the thesis draws the conclusion that the Chinese system of security rights in rem requires a further reform despite the arrival of new law.
