Cette thèse de doctorat a pour objectif d’interroger les relations entre littérature, droit et sciences médicales à l’intérieur de ce qu’on appelle le roman « judiciaire », genre qui s’est développé en Italie dans une période comprise entre l’Unité nationale et le tout début du XXème siècle. Dans ce cadre, nous nous questionnons essentiellement sur l’élément principal qui émerge de cette relation interdisciplinaire, à savoir la construction de la figure du criminel. Dans cette perspective, nous avons pu en effet dégager que la construction de cette figure est centrale dans de nombreux romans de la période post-unitaire. En nous concentrant ensuite sur la notion de genre, nous nous sommes départis de la querelle désormais séculaire inhérente à la naissance (voire à l’existence même) du roman policier italien. Notre analyse souligne enfin que c’est dans la relation entre littérature, droit et sciences médicales que se révèle toute la valeur de ces romans judiciaires dans le processus de construction de l’identité nationale italienne.Notre travail est composé de deux parties. La première, à caractère historique, entend proposer une nouvelle définition du genre dit « judiciaire », après avoir examiné avec attention, et parfois révoqué en doute, les hypothèses avancées jusqu’à nos jours, sur le sujet, par la critique. La seconde partie s’appuie sur deux cas spécifiques – Colonia felice de C. Dossi et Romanzo di Misdea de E. Scarfoglio – qui nous ont permis d’étudier la composition des différentes figures du criminel, attestant de l’efficacité de la méthode interdisciplinaire adoptée, et en portant une attention toute particulière aux théories de Cesare Lombroso. / This doctoral thesis aims to investigate the relations between literature, law, and medicine in the so-called “legal novel”—a genre that has developed in Italy between the national unification and the very beginning of the 20th century. My discussion examines the centrepiece of this interdisciplinary connection—namely, the literary construction of the figure of the criminal. Through this argument I show that the characterization of the criminal is central to several novels of the period following the unification. Turning then to the notion of genre, my thesis considers the long-standing debate surrounding the origins (and the existence itself) of the Italian detective novel. Finally, I suggest that the intersection between literature, law, and medicine sheds an important light on the role played by the legal novel in the construction of Italian national identity.My study falls into two parts. The first section is historical; it seeks to offer a new definition of the “legal” novelistic genre, building on—and partially questioning—the existing literature on the topic. The second part centres on two case studies, C. Dossi’s Colonia felice and E. Scarfoglio’s Romanzo di Misdea. These close readings enable me to further examine the characterization of different criminal figures, demonstrating the fruitfulness of this interdisciplinary methodology while placing a particular emphasis on Cesare Lombroso’s theories.

Cette thèse tente de présenter la vie et les ouvrages de Cheng Xiaoqing (1893-1976) et d’analyser les Huo Sang tan’anji [Enquêtes de Huo Sang], sa série policière, ainsi que leurs liens avec Les Aventures de Sherlock Holmes d’Arthur Conan Doyle d’une part, et avec Shi gong’an [Jugements de Shi], recueil anonyme traditionnel chinois, d’autre part. Cheng Xiaoqing, pionnier et promoteur des récits de déduction/détection chinois, fut le fer de lance du genre policier en Chine. Il a été le touche-à-tout de génie de ce mouvement littéraire : à la fois traducteur et écrivain, rédacteur en chef et éditorialiste de revues spécialisées et même auteur d’essais et d’études sur la technique du roman policier, on lui doit la série la plus importante centrée sur un seul héros : Huo Sang. Patriote, Cheng Xiaoqing n’a jamais rejeté le passé de son pays ni quitté le sol de la Chine. Héritier des caractéristiques du biji des dynasties Ming et Qing et de celles du huaben des Song, il a voulu jeter un pont entre la littérature narrative traditionnelle et un contexte en constante évolution, en faisant des emprunts stylistiques aux romans d’importation tout en laissant le devant de la scène à des personnages à l’identité chinoise fortement marquée. Son héros Huo Sang parvient ainsi à être une sorte de trait d’union entre le Juge Shi Shilun et le Holmes britannique. / This thesis attempts to present the life and works of Cheng Xiaoqing (1893-1976) as well as to analyze the Huo Sang tan’anji [Investigations of Huo Sang], his detective series and its links with The Adventures of Sherlock Holmes by Arthur Conan Doyle on one hand, and with Shi gong’an [Case Decisions by Shi], a traditional anonymous collection, on the other hand. A pioneer and promoter of Chinese stories of deduction and detection, Cheng Xiaoqing was the spearhead of the genre in China. He was the ingenious Jack of all trades of this literary movement: both translator and fiction writer, chief editor and leading writer of magazines specializing in detective stories, he even published essays analyzing these stories with their technical tricks. We can thank him for the creation of the most important series centered on one protagonist: Huo Sang. A true patriot, Cheng Xiaoqing never turned his back on the history of his country nor did he ever leave it. As heir to the tradition of the biji of the Ming and Qing dynasties, and that of the huaben of the Song dynasty, Cheng strove to unite the traditional literary narrative with the ever changing society of his times, by borrowing stylistic devices from foreign sources, but allowing protagonists with clear Chinese identities to take the spotlight. His main character Huo Sang thus turns out to be a kind of link between the Judge Shi Shilun and Sherlock Holmes.

L'entrée de Gianrico Carofiglio sur la scène littéraire, en 2002, a permis l'affirmation d'un genre qui, jusque-là, semblait l'apanage de la production américaine. Le roman de procédure italien, écrit par des juristes et offrant une représentation réaliste de l'univers judiciaire, est en plein essor en Italie et rencontre un lectorat important. Cette thèse tente d'en dégager les spécificités et d'en expliquer le succès au travers de l'analyse des cinq romans centrés sur le personnage de ''l'avvocato Guerrieri" . / The entry of Gianrico Carofiglio on the literary scene in 2002 allowed the affirmation of a genre that until then seemed the preserve of the American production. The ltalian legal thriller, written by jurists and offering a realistic representation of the judiciary, is growing in Italy and meets an important readershp. This thesis attempts to identify its specificities and explain its success through the analysis of the five novels centered on the character of the avvocato Guerrieri.
