教育部公費留學行政契約書實務作業之探討 / A Study on the Administrative Agreement

行政契約在行政法及公共行政領域往昔均兩遭忽略,稽其緣故應與過往國內相關實體法規不明及法律救濟途徑結構欠完整所致。行政訴訟法修訂及行政程序法實施後,行政契約之實施與爭訟處理產生正式法源,然因歷程短淺,各行政機關尚屬陌生,故仍極為少見,亦無法形成是類契約形式之範例,致行政契約在公共行政實務上仍有廣闊之探討空間。教育部於行政程序法2001年施行後,即首創以「行政契約書」為名,與公費留學生間建立更為公平對等之給付行政權利義務關係,惟其間在法制面及實務面運作情形如何,殊值探討。針對行政法制與留學實務,本文以文獻探討法與參與觀察法為主要研究方法,復因探討過程中必定涉及法制與行政實務應用之關係,故以法律解釋學為涵攝,另就適用本契約書已返國服務之五位公費留學生佐以質性之問卷法,以瞭解契約相對人對於本契約書執行之意見與態度。本研究結論認為,在法制基礎方面,教育部公費留學行政契約書係本於給付行政理念,基於公權力行政性質,無論就契約形式、形式效力及內容效力,均應具備相關之法制基礎要求,以符合依法行政原則;在實務運作之主要層面,則涉及政策組織、行政管體及爭議處理,行政契約雖具公權力行政之約制性,但在實務之認定,依據有關法理原則,仍可為較開闊的運作,非不得無調整之空間。 / With regards to administrative law and public administration, administrative agreements were once neglected. A probing study shows that this was supposed to be related to ambiguities of relevant substantial laws and the lack of integrity for the structure of legal rescues. With the enactment of the administrative procedure act law and the administrative adjudication law, legal sources were brought forth for the enforcement of administrative agreements and solutions to their disputes. Nevertheless, due to brief effect and unacquaintedness, this has seldom been applied and cannot form a paradigm. Therefore, there still exits wide space for study on administrative agreements, with regards to the practicing of public administration. Following the administrative procedure law carrying into effect in 2001, the Ministry of Education initiated the “Administrative Agreement” and established in this name, a fairer reciprocal relationship with students who were studying abroad with funding support from the Government, regarding rights and obligation of “pay the administration.” Aimed at the administrative legal system and the study-abroad actual situations, this text applies literature review and participant observation as main research approaches. With the involvement of the relationship between legal system and the application of administrative actual cases, the Juristische Hermeneutik is also applied to all the text. Besides, as a qualitative supporting approach, questionnaire is adopted to five government-funded students who were involved in the “Administrative Agreement” and have returned, from their overseas study to Taiwan for mandatory service. Through this approach, the relative people of the agreement may share their opinions and views of its enforcement for study. This research concludes that with regards to legal foundation, the “Administrative Agreement” for overseas study on Ministry of Education funds, originates from “pay the administration.” In terms of the attribution of the public power administration, all the contractual forms, effect of forms, and effect of contents should possess legal foundation, so as to meet the principal of “administration by law.” On the main level of operation in the actual situations, it involves the organization of policy, administrative management system, and dispute solutions. From a pragmatic perspective, a more flexible management can be adopted for administrative agreements when relevant legal theories are applicable, in spite of the enforcement of the public power administration. Accordingly, there still exits space for adjustment within.

This research tries to identify and analyze what are their perceptions of these administrators in S??o Paulo city about the inclusion in the program. Because when included in the program the colleges have some taxes exceptions and this may provide more profit. Another point is that they can reduce the empty places, and socially, provide access to college to low income people. To achieve the objectives first it was made an exploratory study through bibliographic revision and documental research in the legislation about this subject to promote the theoretical basis on this theme. The second part was an interview with the administrators - rectors, administrative pro-rectors and controllers - of three colleges. The obtained data were classified in four analysis blocks and evaluated by the content analysis's technique, trying to identify agreements and disagreements in the perceptions in the interviewed people's statements. It could find that to the administrators, PROUNI is a government's program to send students of low income to private colleges, while they concede scholarships and receive some taxes exceptions and help when renewing their philanthropic and public utility certificates. It was verified that the perception of the rectors about PROUNI is deeper, more philosophic, while the administrative pro-rectors ideas are related to financial aspects and, controllers perceptions are related to the operational aspect, it means, how operate its functioning. Based on this facts, it is concluded that the perception of the administrators interviewed about PROUNI is incomplete, as each one tried to know aspects with relation to his or her area and not about everything. / Desde antes do seu lan??amento, o PROUNI vem revelando as percep????es de v??rios representantes da sociedade, mas n??o dos principais envolvidos - os gestores das IES privadas. Esta pesquisa buscou identificar e analisar qual ?? a percep????o destes gestores, na cidade de S??o Paulo, quanto ?? ades??o a este programa. Ao aderir ao PROUNI, as IES recebem isen????es de alguns tributos, o que poderia proporcionar maiores lucros. Outro fator refere-se a uma poss??vel redu????o de vagas ociosas e, socialmente, proporciona o acesso ?? educa????o superior privada ?? popula????o de baixa renda. Para atingir o objetivo deste trabalho, foi utilizado, em uma primeira etapa, o estudo explorat??rio atrav??s da revis??o bibliogr??fica e pesquisa documental da legisla????o concernente ao assunto, com a finalidade de promover a fundamenta????o te??rica do tema proposto. Análise dos programas da Capes de concessão de bolsas de estudos para a formação doutoral no exterior : estudos de egressos

O presente trabalho tem como objetivo principal analisar comparativamente os egressos dos programas de doutorado pleno e doutorado sanduíche no exterior das áreas de Ciências Agrárias, Ciências Biológicas, Ciências da Saúde e Ciências Exatas e da Terra para identificar a contribuição desses programas de mobilidade internacional para o Sistema Nacional de Pós-Graduação no Brasil - SNPG. Para isso foram coletados dados dos egressos dos programas de doutorado pleno e doutorado sanduíche no exterior da Capes do ano de 2006 e então realizada a comparação com a base de dados dos docentes do SNPG. A partir dessa análise foi possível obter os dados da taxa de entrada dos egressos dos programas no SNPG, a qualidade desses pesquisadores e a produção científica qualificada desse grupo nos anos de 2007 a 2014. Para responder aos questionamentos levantados nessa pesquisa sobre qual dos dois grupos de egressos formam mais doutores que retornam para o SNPG brasileiro e qual deles possui taxa mais expressiva de produção científica qualificada, chegou-se a algumas conclusões. Em relação ao indicador de taxa de entrada do doutor no SNPG e qualidade desse pesquisador verificou-se que o programa de doutorado sanduíche possui maior entrada embora a diferença seja muito pequena quando comparado ao grupo de doutorado pleno, desses, o programa de doutorado sanduíche possui maior número de pesquisadores qualificados com bolsa de Produtividade em Pesquisa do CNPq. Em relação à produção científica, os egressos do programa de doutorado sanduíche produzem a uma taxa semelhante em relação aos egressos de doutorado pleno, no entanto, na avaliação da produção científica qualificada, de acordo com o Qualis da Capes, os egressos do programa de doutorado pleno no exterior possuem 69% das publicações nos estratos A1, A2 e B1 enquanto que os egressos do programa de doutorado sanduíche possuem 62% nesses mesmos estratos. Essa análise nos leva à conclusão que a formação no exterior é extremamente benéfica para as duas modalidades de bolsa, no entanto, quando o foco é a produção científica qualificada, que possui maior impacto, há indicativos que a formação plena no exterior seja mais eficiente. / The main objective of the present work was to analyze comparatively the alumni of the full doctorate and sandwich doctorate programs abroad in the areas of Agrarian Sciences, Biological Sciences, Health Sciences, Exact and Earth Sciences to identify the contribution of these international mobility programs to the National Postgraduate System in Brazil - SNPG. The purpose of this bachelor thesis was to illuminate and analyze the working conditions of visual artists in the Swedish region of Värmland. As a profession which is known to have many problems concerning income and the fact that most artist are unable to get by on their art sales alone it becomes interesting to look closer on cultural policy’s affecting the artists, where the problems lie and what possible help they can get. I have used previous research and different sources to map out the working conditions in Sweden and Värmland alike and also interviewed five different visual artists in Värmland to get a general view of the working conditions in the country as a whole and their perception of the situation and special circumstances in Värmland. I have also used discourse analysis to compare the source material with the answers of my respondents to see which discourses that exists, that have hegemony, and to see how this subject is talked about. The results of this study showed how political decisions may force artists to become self-employed entrepreneurs even though many artists do not self-identify as such or even have any interest in profitable gain. The study also shows among other things that most artists have another occupation on the side but that there are some aids to help the artists with income. The situation in Värmland appears to both good and bad for artists, it seems easier for them to get exposure, but the artists complain about the regions lack of interest and contributions to the visual arts.

A critical examination of the graduate assistant scholarship programme at Technikon Natal as a staff development mechanism.

This exploratory case study investigated the Graduate Assistant (GA) Scholarship Programme at Technikon Natal (TN) as a staff development mechanism. Although GA programmes are not a new concept and have been used internationally for decades as a means to develop academic staff, the programme at TN has some differences. This programme was initiated to address the development of young Black, and in the main African, academics in order to assist with meeting future employment equity requirements. The programme in its simplest form offers the GA the opportunity to gain teaching experience while studying for a post graduate qualification. Between 1995 and 2000, fifty GAs were involved in the programme at TN, with the majority of GAs studying at the BTech qualification level. This case study identified the juxtaposition of two perspectives of influence, those of the institutional and the individual issues. The institutional issues identified were categorised into policy and procedural issues and the individual issues focused on staff development and mentorship issues. Although the findings cannot be generalised, significant issues have been identified which could prove of value to a wider audience. In addition to developing Black academics, the programme makes a significant contribution to increasing the achievement of higher qualifications from the technikon sector. This is desirable in order to produce the technological foundation for South Africa's future economy. The study identified great potential in the GAs and in the community at TN who have embraced this opportunity to develop young academics of the future. Although there are a number of issues to be addressed, the key stakeholders of this study; the GAs and their Heads of Departments, are well supported by the management and relevant units at TN. / Thesis (M.Ed.) - University of Natal, Durban, 2000.
