Veřejnoprávní aspekty nakládání s komunálním majetkem / Public law aspects of municipal waste management

The thesis called Public law aspects of municipal property management deals with the topic of property management of the territorial self-governing units. The basic units are municipalities and the higher-level territorial administrative units are regions. Municipalities and regions have a legal personality and are public corporations which may have their own property and manage their own budget. Management and disposal of the self-governing units own property and it is one of the fundamental aspects of local government in the Czech Republic. The aim of this thesis is to provide an analysis of the main public law aspects disposition of the property of self-governing units. The thesis is composed of the three sections. The first two sections are focused on the general terms and principles, without which it would be impossible to comprehend more details the disposal of municipal property itself which is discussed in the third section. The first section describes the definition of territorial self-governing units, especially its position as a subject of property rights. This thesis analyzes the involvement of senior class pupils in self-governing committees and public organizations, discusses the participation of the pupils’ in the social processes, stressing values and social roles. Schoolchildren’s committees are reviewed in the context of changes in the Lithuanian educational system. The proportion of youth participation and non-participation in the organizations operating at the schools is also analyzed. A review is made of which organizations operate in schools and which organizations schoolchildren can actively participate in. A Pupil questionnaire was carried out, in order to find out the particularities of the senior class pupils participation in the activity of public organizations and school committees. 757 respondents were interviewed in large and small cities. The number of respondents is described by requirements of 95 percent reliable intervals and 4 percent inaccuracies, which are considered to be sufficient for representation in quantitative research. The research that was carried out revealed that according to the interview data of the senior class pupils, one quarter of the pupils takes part in a school commitee and one fifth of 16 – 18 year old schoolchildren take part in youth organizations. The proportion of children who participate both in self–governing committees and in youth organizations does not reach one tenth and about two thirds of the respondents do not participate in any activities. Therefore, this study arises out of the critique about our own practice as a dance teacher in public education, specifically at Escola Municipal em Tempo Integral Professora Silene de Andrade (EMTIPSA), in the city of Goiânia – Goiás. Our search is centered in systematically developing students’ potentiality through dance and its teaching, taking pedagogical actions as a means to develop the students’ critical and autonomous capability of expression within the world surrounding them. The social justification of this study is in the fact that it is scheduled in an education that fosters the reflection on the student´s own power of reflection, i.e. the development of the capability of his/her autonomous and self-governing critical expression of the EMTIPSA; make them the subject of themselves, through the expression of their authenticity in dance, what will reflect in their life expression. We aim to propose through the research-action, the development and the analyzing of the art-educational performance in dance, though the questioning of the sociocultural context of the student. Voice and body had autonomy so that this student were able to participate effectively in the process and the product of this performance, in the search of a “consummatory” experience towards the development of their selfgoverning. / Apresentamos nesta dissertação uma pesquisa na área de Performances Culturais no universo da arte-educação, tendo como eixo o debate analítico entre a dança-educação crítica e a tecnicista. Assim, este estudo surge com a crítica sobre a nossa prática, como professor de dança na educação pública, especificamente na Escola Municipal em Tempo Integral Professora Silene de Andrade (EMTIPSA), na cidade de Goiânia – GO. Nossa busca se centra em potencializar sistematicamente, pela dança e seu ensino, ações pedagógicas por meio das quais se possa desenvolver a capacidade de expressão crítica e autônoma dos alunos no mundo que os cerca. A justificativa social deste estudo está no fato de que se pauta em uma educação que propicia a reflexão sobre o próprio poder de reflexão do estudante, ou seja, o desenvolvimento da capacidade de expressão crítica, autônoma e autogovernativa dos estudantes da EMTIPSA, torná-los sujeitos de si, pela expressão de sua autenticidade em dança, o que refletirá na sua expressão de vida. Objetivamos, pela pesquisa-ação, propor, desenvolver e analisar a performance arte-educativa em dança pela problematização do contexto sociocultural do estudante. A voz e o corpo tiveram autonomia para que este estudante fosse capaz de participar efetivamente no processo e no produto dessa performance, na busca de uma experiência consumatória em prol do desenvolvimento de sua autogovernança.

"Ústavněprávní vymezení kontrolních mechanismů územních samosprávných celků" / Constitutional definition of the mechanisms of control of territorial self-governing units

The aim is to answer the question of whether effective control mechanisms exist in the Czech Republic which would guarantee the fulfilment of legal regulations by municipalities and regional authorities dealing with public property. It is also my aim to explore whether such control mechanisms result from the constitutionally guaranteed rights to local government and, if they do, to what extent they may be incorporated in the Czech legislation. My diploma thesis is based on specific case studies, the case law of general courts and the current jurisprudence of the Czech Constitutional Court. After the description of the current state of affairs in the Czech Republic, I further focus on the definition of the control mechanisms of local governments in Czechoslovakia between the two world wars (1918 - 1938) and partly also during the Austro-Hungarian Empire. This diversion leading to this era has been selected to reflect the efforts to resume the local government traditions in the context of the renewal of the local government scheme in the Czech Republic after 1989. It is proven towards the end of the historical survey that unlike today, there were effective control mechanisms available before World War II, with several alternatives. The Study of Kaohsiung City Legal System of Dangerous Driving Prevention

The scene of dangerous driving (street racing) has been seen in 1986; however, the situation has not been redressed a bit after the long-term prevention by police force. Nevertheless, since the problem of dangerous driving first appeared in 1955 in Japan, by the long-term prevention, the situation has been well redressed and some talented F1 racing drivers have been cultivated. On May, 11th, 2012, a Japanese racing driver, Kamui Kobayashi, took the 5th place in Spanish Grand Prix. Dangerous driving has been banned by force in our nation; yet, the auto racing industry has not been developed in line with modern society. In a long period of time, the prevention of dangerous driving has been ineffective due to the banning manner, instead of venting, that the government adopted, which leads to a huge waste of human power and resources. Police force is the current administrative authority for preventing dangerous driving. The legal basis for police to enforce or exercise its power or right is officially available since the Police Duties Enforcement Act was promulgated on Dec. 12th 2003, followed by the interpretation of Shih-Zih No. 535 made by the Council of Grand Justices. The Police Duties Enforcement Act does not only regulate that the enforcement of police powers should be complied with proportionality by specific manner, but also provides the legal basis for the enforcement of police powers. Human right and police itself are also safeguarded. Nevertheless, whether the enforcement of the Act can redress dangerous driving, or weather it can represent that dangerous driving can be corrected only by police is worth discussing in this study. Dangerous driving has been a troublesome problem to Kaohsiung City. By this study, I found out that banning dangerous driving by strict force affects little to the prevention of it. Through the analysis of the five major frameworks of administrative law, I suggest that the government should not regard dangerous driving as a pure event of public disorder, but a social phenomenon. Except for banning illegal dangerous driving, the central government should take the advantage of the situation to allow local self-governing to promote auto-racing industry. The government should also play the role of leading and changing the illegal and dangerous driving to the legal auto racing game with reasonable and effective management, and to set a managing mechanism in terms of the platform for modified parts. Through this manner, the government can not only benefit from taxing, but also control dangerous deriving effectively, which leads to a win-win situation for both of the government and its people.

Optimalizace základních škol / Optimization of primary schools

The main goal of this thesis is to describe the current situation of capacity of primary schools in the selected area of Prague and suggest optimization options. In the first part of my thesis the theoretical apparatus needed to understand the issue of education is presented. The main focus here is on the legislation related to the issue of education. The practical part of my thesis is based on the results of questionnaire survey focused on primary schools and additional e-mail survey focused on the founders of these schools. The public elementary schools established by the Prague 1 to Prague 10 municipalities were selected for the survey. On the basis of the information found, the practical part is closed by suggestions for solving the unsatisfactory situation both from the viewpoint of individual primary schools and from the point of view of their founders.

This dissertation thesis deals with the establishment and practical functioning of the higher territorial self-governing units in the Czech Republic and in the Slovak Republic. It contains information on the development of the territorial division of former Czechoslovakia between the years 1918 and 1993, with an emphasis on the establishment of a regional system during the communist regime. The dissertation is focused on the process of the establishment of regional level of self-government in the Czech and Slovak Republic in 1990s. Debates over the most appropriate territorial and administrative division took place in parliaments of both countries after 1993. Two models of territorial division were considered in the Czech Republic - a provincial system, based on historical lands, and a regional system. Two alternatives were discussed in Slovakia - a county system and regional system. The territory of the Czech Republic was ultimately divided into 14 higher territorial self-governing units (13 regions and the Capital City of Prague), and the territory of Slovakia into 8 regions. Legal status and economic management of organizational units of municipalities and regions Legal regulation of organisational units of municipalities and regions in the Czech Republic is comparatively succinct; there are not many academic texts that would offer any detailed commentary relating to this topic. In practice, organisational units are often neglected and in fact, no academic texts are even available for the regional level. In my thesis I aim to summarise the key important findings about the organisational units of municipalities and regions. My objective is to create a document that would deal with the functioning of these units from their origination, through financial management to their eventual abolishment. I methodically introduce the necessary sources of law and also aim to draw the attention to the controversial provisions of the relevant statutes. The introductory chapter is historical; subsequently, I define the principal signs of and the issues relating to the origination (the trust deed, etc.) and the abolishment of the units. Trajectory from government-managed to farmer-managed smallholder irrigation and its effects on productivity, operation and maintenance: An analysis of Mamina Smallholder Irrigation Scheme in Zimbabwe

Magister Philosophiae - MPhil (LAS) (Land and Agrarian Studies) / Government's decision to devolve irrigation management to farmers was partly influenced by international policy imperatives, which were propounded mainly by institutions associated with the Consultative Group for International Agricultural Research (CGIAR) and the inability by the government to continue funding operation and maintenance costs. The central question of the study is to understand the effects of Irrigation Management Transfer (IMT) on productivity, operation and maintenance in the Mamina Irrigation Scheme. Interviews with various primary and secondary stakeholders that included the irrigators, local political leadership and locally-based agriculture extension officers were carried out. The interviews were aimed at getting an insight on land tenure, participation and representation of women, water and electricity supply system and pricing, effects of irrigation management arrangements on equity and productivity, understanding the irrigators' food security status, operation and maintenance arrangement after Irrigation Management Transfer (IMT). Findings of this study suggest that the existing governance arrangements have partly led to low crop productivity, increased water and electricity bill arrears, poor water distribution, change to uneconomic plot sizes, unsustainable increase in the number of irrigators, failure to organise for operation and maintenance. The key factors influencing the poor performance include poor collaboration, pumping system that utilised more electricity, inability of the irrigators to replace leaky pipes, failure of the irrigators to contribute towards electricity and water bills, failure of the irrigators to contribute towards operation and maintenance. The study identified nine challenges that affected the success of IMT. The challenges that lay at the heart of Mamina irrigation scheme were mainly caused by the poor irrigation technology design, pricing structure of electricity, water permit system, inequalities in water distribution, low gender participation and representation, non-availability of formal markets for certain crops, food insecurity, plot alloction and land disputes. Poverty analysis has shown that the irrigators' ability to escape from poverty or food insecurity is critically dependent upon their access to assets. Different assets are required to achieve different livelihood outcomes. The cycle of accumulation of utility bill arrears continued even after devolution because the same defective irrigation infrastructure was transferred to the irrigators. In the case of Mamina irrigation scheme, modernisation of the scheme was required to achieve different livelihood outcomes, but because this did not happen the recurrent utility bill arrears, low productivity and food insecurity continued to be a very serious challenge even after IMT.

地方自制為民主憲政的基礎,由於民主政治並非一蹴可幾,而是漸進、累 積的結果,地方自治正提供了一個參與與學習的機會。無論是個人民主素 養之培養或國家社會民主化之推動均有賴於地方自治。晚近,復鑑於環保 ,都市、教育及消費者方面爆發嚴重問題,非中央所能獨自解決,更顯示 出地方自治之重要性。我國地方自治深富憲政性,憲法第十章「中央與地 方之權限」及第十一章「地方制度」之規定即係對地方自治之設計。民國 三十六年憲法頒行後,我國地方自治本應依憲法規定實施,唯不久政府即 播遷台灣,國家處於非常時期,所以現行台灣地區地方自治之實施多係以 行政命令為基礎,與憲法規定不符;地方自治法制化的問題事實上自民國 三十九年台灣地區開始實施地方自治起即已存在。隨著時間的遞移,人民 自由權利伸張,對民主層次之要求也日益提高。加以解嚴後,我國社會、 政治、經濟變化極大,地方自治法制化之呼聲遂與時俱增。在這時代的轉 捩點上,地方自治法制化的方向實關係國家政治、社會未來的發展。本研 究乃首先釐清地方自治的意義、探討其特質及功能,繼而介紹我國地方自 治制度發展的沿革,以建立對歷史脈胳的瞭解,接著討論地方自治法制化 問題存在的原因及背景及其所引發的其它相關問題,試圖找出關鍵所在, 進一步對各方所提法制化的途徑(包括政府所採行之方案)予以歸納、整 理分析、評估,並提出作者之建議,冀能為健全地方自治發展奠立良好的 法制基礎,使我國在改革中能轉型成功,為民主政治立下萬年根基。
