Validade e obrigatoriedade dos contratos de adesão eletrônicos (shrink-wrap e click-wrap) e dos termos e condições de uso (browse-wrap): um estudo comparado entre Brasil e Canadá / Validity and enforceability of shrink-wrap, click-wrap and browse-wrap: a comparative study of Brazil and Canada

Esta tese tem por objeto a investigação dos aspectos legais decorrentes do comércio eletrônico, com ênfase na validade e obrigatoriedade dos contratos de adesão eletrônicos e os denominados termos e condições de uso. Estes negócios jurídicos eletrônicos podem ser divididos em três espécies: a) licenças do tipo shrink-wrap, terminologia reservada às compras de software no estabelecimento físico do fornecedor, cujos termos contratuais que vincularão as partes não podem ser visualizados antes da compra do produto, mas tão somente no decorrer da instalação do software, garantindo-se ao adquirente a possibilidade efetiva de devolução do produto se não concordar com os termos da licença; b) contratos do tipo click-wrap, contratos celebrados inteiramente em meio eletrônico, em que o consumidor tem a oportunidade de ler as cláusulas contratuais antes de manifestar, expressamente, sua anuência ou não, clicando em uma caixa de diálogo indicativa de expressões como eu aceito, ou outra semelhante; e, c) os termos e condições de uso, denominados pela doutrina estrangeira como browse-wrap, disponibilizados no canto inferior de uma página da internet em um hiperlink, vinculando toda e qualquer pessoa, que tão-somente acesse o respectivo site, sem ao menos chamar a atenção do usuário para a existência destes termos ou nem exigindo a manifestação da anuência a tais termos. Os tribunais estrangeiros têm enfrentado a problemática em torno da validade e obrigatoriedade destas práticas comerciais, em especial os browse-wrap, cujo formato em que são utilizados descaracteriza-nos com contratos ou condições gerais de contratação, pois o usuário nem ao menos tem consciência da existência de tais termos. Portanto, parte da doutrina e da jurisprudência entende que o browse-wrap não se encaixa na definição de contrato, mas são termos unilateralmente propostos por uma das partes sem que a outra possa ter efetivo conhecimento a respeito. Se, por um lado, há necessidade de reconhecer os efeitos obrigatórios dos contratos de adesão eletrônicos, fortalecendo o comércio eletrônico; por outro lado, a sociedade global exige a efetiva proteção dos consumidores e usuários contra abusos praticados por multinacionais, que operam sem fronteiras geográficas. Assim, juristas e doutrinadores enfrentam um enorme desafio: desenvolver um comércio eletrônico sustentável, equilibrando os interesses comerciais e os direitos dos consumidores. Este trabalho pretende determinar os requisitos jurídicos para a validade dos contratos eletrônicos de maneira científica, analisando o processo de formação contratual em meio eletrônico. Por fim, investiga-se a dúvida acerca da lei aplicável e da jurisdição na era digital, enfatizando a cláusula de eleição de foro, de escolha da lei aplicável e compromissória, bem como seu impacto no acesso à justiça do consumidor. Em suma, esta tese destaca a necessidade de uma legislação uniforme sobre comércio eletrônico e a proteção do consumidor, tendo em vista o alto nível de globalização, para que se possam tutelar os direitos dos consumidores aliados aos interesses econômicos do mercado. / This thesis intends to investigate some of the legal issues raised by e-commerce, specifically the validity and enforceability of the electronic adhesion contracts and the terms and conditions of use. Such electronic juridic acts can be grouped into three subspecies: a) the shrink-wrap licences, reserved for purchase in the store, but yet the consumer can not view the terms and conditions that she or he will be bound by, once the product (often a software) is installed; the consumer is granted with a period of time within she or he can return the product to the store if she or he does not agree with the terms and conditions; b) the click-wrap agreements are contracts presented to the consumer, when dealing on-line, stating the terms and conditions of the purchase, and then, once its read, she or he may point and click in a dialog box indicating her or his consent (such as I agree or some other synonymous expression); and c) the browse-wrap, composed by terms and conditions listed in a hyperlink on the bottom of a web page, which obliges the consumer only because she or he surfs on the Web, nevertheless it is not require that the consumer shows any kind of consent to the terms and conditions. Even though some courts have ruled in favor of the validity and enforceability of browse-wrap, it is very questionable to accept the fact of being bound by something that one never knew that it even existed. Thus, some other courts are of the view that browse-wrap is not technically a contract according to the legal doctrine. Instead it is a sort of private regulation of the disposal of products and services written by the supplier. On one hand, there is a need to enforce electronic commerce in order to stimulate and consolidate it by making electronic contracts binding on consumers. On the other hand, there is a need to protect consumers from the abuse of unequal bargaining power in such contractual relation, which may pit them against a multinational corporation, which operates throughout the world. Thus, jurists and academics must combine efforts to find a sustainable balance between these two sides. Besides there is a need for a uniform and scientific solution, given that a prerequisite to valid contract formation is the unequivocal meeting of the minds which may not happen in this means of contract formation, especially if the supplier does not require any clear and effective sign of assent from the consumer. The touchstone of e-commerce is the law and jurisdiction conflicts since such contracts often include a forum selection clause or a mandatory arbitration clause, which can deprive the consumers of their day in court. In short, it highlights the need for a uniform legislation and a strong consumer protection system to ensure the growth of ecommerce. This would foster a reliable electronic environment meeting the consumers expectations and the market standards.

Assessing Amendment Treatments for Sodic Soil Reclamation in Arid Land Environments

Plugged and abandoned well pads throughout the Uintah Basin face reclamation challenges due to factors including a harsh climate, invasive species, and high salt loads. Finding ways to alleviate soil sodicity could improve soil reclamation success. Gypsum, sulfur, activated carbon, and Biochar are being applied to improve soil parameters negatively impacted by sodicity, but the direct impact of these amendments on Uintah Basin soils is still largely unknown. The aim of this study was two-fold. (1) Evaluate the effectiveness of gypsum, sulfuric acid, Biochar, activated carbon, and combinations of these amendments in reducing the impact of soil sodicity of the Desilt and Conglomerate soils by measuring amendment impact on percent dispersion, saturated hydraulic conductivity, crust bulk density, infiltration, and crust formation. (2) Compare a crust bulk density method using ImageJ to the clod wax density method and a modified linear extensibility percent equation to the linear extensibility percent equation to assess whether the novel methods can be used to accurately measure and calculate soil crust bulk density and shrink swell potential while reducing human error and analysis time.

Engineering Behaviour Of Ash-Modified Soils Of Karnataka

During a survey of black cotton soil zones of Karnataka, indigenously stabilized black cotton soil deposits were encountered in Belgaum, Bijapur, Bagalkot and Gadag Districts of Karnataka. These modified black cotton soils have low swelling and negligible shrinkage tendencies. Owing to their low volume change potential on moisture content changes, these soils are widely preferred in earth construction activities. The exact origin of these modified black cotton soil deposits is not known. According to anecdotal references, these soils were prepared by mixing unknown proportions of wood ash, organic matter and black cotton soil and allowing them to age for unknown periods of time. As wood-ash was apparently used in their preparation, these modified black cotton soils are referred to as ash-modified soils (AMS) in the thesis. The practice of preparing ash-modified soils is no longer pursued in black cotton soil regions of Karnataka and the available supply of this indigenously stabilized soil is being fast depleted. Also, attempts have not been made to characterize the physico-chemical and engineering properties of AMS deposits of Karnataka. Given the widespread utilization of ash-modified soils in black cotton soil areas of Karnataka, there is a need to understand their physico-chemical and engineering behaviour and the physico-chemical mechanisms responsible for their chemical modification. Swelling and shrinkage of expansive soil deposits are cyclic in nature due to periodic climatic changes. Chemically stabilized black cotton soil deposits are also expected to experience cyclic wetting and drying due to seasonal climatic changes. The impact of cyclic wetting and drying on the swelling behaviour of natural expansive soils is well-documented. However, the impact of alternate wetting and drying on the swelling behaviour of admixture stabilized expansive soils (these include natural - ash-modified soils and laboratory - lime stabilized black cotton soils) has not been examined. Such a study would be helpful to assess the long term behaviour of admixture stabilized soils in field situations. To achieve the above objectives, experiments are performed that study: 1.The physico-chemical and engineering properties of ash-modified soils from different Districts of Karnataka. The physico-chemical and engineering properties of natural black cotton soil (BCS) specimens from locations adjacent to ash-modified soil deposits are also examined to understand and evaluate the changes in the engineering characteristics of the ash-modified soils due to addition of admixtures. 2. Identify the physico-chemical mechanisms responsible for the chemical stabilizationof ash-modified soils. 3.The influence of cyclic wetting and drying on the wetting induced volume changebehaviour of admixture stabilized black cotton soils, namely, ash-modified blackcotton soils and lime stabilized black cotton soils.

Untersuchungen zur Ermüdungsfestigkeit von Pressverbindungen

Pressverbindungen gehören zu den klassischen Maschinenelementen und werden insbesondere in der Antriebstechnik häufig eingesetzt. Zur sicheren und zugleich wirtschaftlichen Auslegung derartiger Verbindungen unter zyklischen Lasten fehlen generell gültige sowie abgesicherte normative Vorgaben bzw. Richtlinien für den Anwender. Insbesondere ist dies dann zutreffend, wenn Geometrien vorkommen, für welche keine Tabellen- bzw. Erfahrungswerte existieren. In dieser Arbeit werden ausführliche experimentelle Untersuchungen zur Ermüdungsfestigkeit von Pressverbindungen einer Standardgeometrie vorgestellt. Im Fokus der Untersuchungen steht die Dauer-, Zeit- und Betriebsfestigkeit der biege- sowie torsionsbelasteten Verbindung. Auf Basis der erzielten Festigkeiten und Lebensdauerwerte erfolgt die Ableitung normspezifischer Kennwerte für die Praxis. Weiterhin steht die Übertragung der erzielten Ergebnisse auf andere Pressverbindungs-Geometrien, wie beispielsweise die Verbindung mit Wellenabsatz, im Vordergrund. Hierbei wird das Verhalten hinsichtlich der Kerbwirkung im Vergleich zu gekerbten Wellen sowie zu anderen reibdauerbeanspruchten Verbindungen untersucht. Zudem erfolgt eine ausführliche Analyse simulationsspezifischer Einflussgrößen auf die Beanspruchungshöhe der Pressverbindung. Auf Grundlage dieser Erkenntnisse wird ein neues Auslegungskonzept erarbeitet und an Ergebnissen aus der Literatur gespiegelt.

Sudden Gains: A Pluralistic Approach to the Patient and Therapist Experience

Qualitative and quantitative research methods were used to study instances of sudden gains within the case load of a private practice practitioner. Five clients whose progress was marked by such changes were contrasted with the views of five clients whose progress was marked by significant setbacks. Results from the quantitative analyses indicated that clients who experienced sudden gains during therapy tended to retain their therapeutic gains over a 2-year time period. In contrast, individuals who experienced setbacks in therapy generally continued to be distressed at the 2-year reassessment. Clients who experienced sudden gains were more distressed prior to treatment and were more satisfied with their experience looking back. A stronger working alliance was found amongst those who experienced sudden gains, although there was no difference between the groups' ratings regarding the strength of the therapeutic bond. Qualitative results suggested that therapy was helpful in bringing about many changes in clients' lives, but clients who experienced sudden gains generally recalled more positive aspects of therapy, demonstrated greater utilization of therapeutic techniques, endorsed more long-term changes, accepted more responsibility for their treatment outcomes, and were less likely to react negatively to therapeutic techniques. Clients who experienced setbacks in therapy were generally less optimistic about the future, felt that they had regressed since termination, and demonstrated more resistance to therapeutic techniques.

This thesis work describes how to apply the stochastic analysis framework, presented in [1] for general priority-driven periodic real-time systems. The proposed framework is applicable to compute the response time distribution, the worst-case response time, and the deadline miss probability of the task under analysis in the fixed-priority driven scheduling system. To be specific, we modeled the task execution time by using the beta distribution. Moreover, we have evaluated the existing stochastic framework on a wide range of periodic systems with the help of defined evaluation parameters. In addition we have refined the notations used in system model and also developed new mathematics in order to facilitate the understanding with the concept. We have also introduced new concepts to obtain and validate the exact probabilistic task response time distribution.    Another contribution of this thesis is that we have extended the existing system model in order to deal with stochastic release time of a job. Moreover, a new algorithm is developed and validated using our extended framework where the stochastic dependencies exist due to stochastic release time patterns. / This is Second Version of the report.
