longo prazo. / Nowadays the crisis of the Social Welfare is a major concern worldwide. The deficits of social security state systems are to demand rethinking of the structure of the Governments and of the financing regime as imperative to assure the solvency of the same ones. This dissertation brings a brief discussion on theoretical aspects related to the financing regime and, specifically, on historical and legal aspects of the Brazilian Social Welfare trying to highlight the impacts of macro-economical and demographical variables that they make the Pay-As-You-Go as form of financing the system, pointing, in the sequence of the analysis, the objectives of the one of the
constitutional reforms of 1998 and 2003, the ones which, although they have not caused a structural change of the financing regime, they promoted changes in the Brazilian legislation system that they seek to turn the General Social Welfare Regime make feasible in a long-term
run.

This section limits the deceased’s freedom of testate by placing the death benefits and the control of the board of trustees who are tasked to distribute such benefits equitably among the dependants and nominees of the deceased. Section 37C of the Act was enacted to protect dependency by ensuring that the dependants of the deceased are not left in destitute. In order to achieve this, three duties are placed on the board of trustees namely, to identify the dependants and nominees of the deceased member; to effect an equitable distribution of the benefit among the beneficiaries; and to determine an appropriate mode of payment. This section sees to all the interest of the dependants without discriminating consequently there are three classes of dependants that are created under section 37C namely; legal dependants, non-legal dependants, and future dependants.

These proposals have been highlighted in the Retirement Reform Discussion Paper issued by National Treasury in 2004 and the Social Security and Retirement Reform paper, issued by both National Treasury and Department of Social Development, 2007. Further, the recent discussion papers entitled ‘Strengthening Retirement Savings and a Safer Financial Sector to Serve South Africa Better’ published in 2011 and 2012 respectively have strengthened social security and retirement reforms debate in South Africa. This mini-dissertation will incorporate both social security and retirement reforms.

Previous issue date: 2012-02-28 / Alongside with the establishment of the Brazilian Social Security, the Professional Rehabilitation of the National Institute of Social Security (INSS) has been created. It aims to provide its beneficiaries, partially or totally incapacitated for work, the indicated means to reenter the labor market and the context in which they live. This study intended to understand, identify and comprehend, from the perspective of occupational therapists, practices and conceptions that have been delineated by the profession in the area of Professional Rehabilitation at INSS, in the state of Sao Paulo. Based on a survey and an analysis of bibliographical and documental material on the theme in general and at the Institute in particular, the empirical research made use of a questionnaire applied with 40 of the 43 occupational therapists who act in the state. In-depth interviews were conducted with 6 of these participants. Also an interview with another occupational therapist, who works at INSS since 1980, was conducted in order to collect background data about the Professional Rehabilitation as well as the insertion of occupational therapy at the Institute. The resulting data of the questionnaires provided a general prospect of conceptions and practices of occupational therapists in the studied field and were related to those collected in the interviews. This allowed for the deepening of the themes, providing opportunities for further reflection and discussion about them. The main findings allow us to state: occupational therapists are amidst the construction of a new professional identity at INSS; most of them deemed to have taken specific actions of occupational therapy at the Institute and point out the job analysis and the evaluation of compatibility of the proposed new functions for the insured workers in this specificity. The therapist-patient relationship was indicated like fundamental to their practice. Overall, they identify series of factors that would implicate an evaluation more negative than positive about their performance at the Institute, caused principally by structural questions of the Program of Professional Rehabilitation, what is independent of them. However, they still keep the belief in the improvement of this structure, claiming for the need to increase the possibilities offered by even greater participation and accountability by companies, the construction of joint work with other sectors of society and government, as well as for the redesigning and expansion of the legislation that deals with professional rehabilitation in Brazil. / Paralelamente à constituição da Previdência Social, foi-se constituindo a Reabilitação Profissional do Instituto Nacional do Seguro Social (INSS) que visa proporcionar aos seus beneficiários, incapacitados parcial ou totalmente para o trabalho, os meios indicados para o reingresso no mercado de trabalho e no contexto em que vivem. O presente estudo teve como objetivo conhecer, identificar e compreender, a partir da ótica de terapeutas ocupacionais, as práticas e as concepções que vêm sendo delineadas pela profissão na área da Reabilitação Profissional no INSS, no estado de São Paulo. Com base em levantamento e análise de material bibliográfico e documental acerca da temática em geral e no Instituto em particular, a pesquisa empírica lançou mão de um questionário aplicado a 40 das 43 terapeutas ocupacionais que atuam no estado. Posteriormente, foram realizadas entrevistas em profundidade com 6 delas. A fim de compor o levantamento histórico com relação à Reabilitação Profissional no Brasil e à inserção da terapia ocupacional no Instituto, entrevistou-se também outra terapeuta ocupacional, que nele atua desde 1980. Os dados dos questionários forneceram um panorama geral das práticas e concepções das terapeutas ocupacionais no campo estudado e foram relacionados aos coletados nas entrevistas, o que permitiu o aprofundamento das temáticas abordadas, oportunizando maior reflexão e discussão sobre elas. As principais conclusões permitem-nos dizer que: as terapeutas ocupacionais estão sendo levadas a lidar com a construção de uma nova identidade profissional no INSS; a maioria delas considera ter implementado ações específicas da profissão no Instituto e destacam, nesse âmbito, a análise de posto de trabalho e a avaliação de compatibilidade das novas funções propostas aos segurados. Ainda, assinalam a relação terapeuta-paciente como fundamental para suas práticas. Apontam uma série de fatores que implicariam uma avaliação mais negativa do que positiva da sua atuação, por fatores que independeriam delas ou da profissão e que estariam mais vinculados a questões estruturais do Programa de Reabilitação Profissional no INSS. Creem, todavia, na melhoria dessa estrutura, colocando a necessidade do incremento das possibilidades oferecidas pelo Programa, de uma maior participação e responsabilização por parte das empresas, da construção de um trabalho articulado com os demais setores governamentais e da sociedade civil, além da reformulação e ampliação da legislação que trata da Reabilitação Profissional no Brasil.

Avaliação da eficácia e da eqüidade das aposentadorias no meio rural. / Evaluation of efectiveness and equality of social security in brazilian rural areas.Ana Cecilia de Medeiros Kreter 15 December 2004 (has links)
O objetivo desta dissertação é avaliar a eficácia e a eqüidade do sistema de aposentadorias pagas no meio rural do Brasil na década de 1990. Entende-se por eficácia o cumprimento por parte do poder público dos benefícios estabelecidos no sistema previdenciário e o seu impacto na redução da pobreza e na melhoria das condições de vida da população beneficiada. Já a eqüidade implica ausência de favorecimento no acesso aos benefícios previdenciários por diferenças de sexo, cor (ou raça) e nível de educação. As aposentadorias pagas no meio rural podem ser divididas pelo seu rendimento, quais sejam, igual a um salário mínimo (proxy da aposentadoria por idade) e maior que um salário mínimo. Os que se enquadram no primeiro grupo são considerados como segurados especiais da previdência rural, pois podem se aposentar sem necessariamente ter contribuído para esta instituição. A Constituição Federal de 1988 e suas modificações dadas pelas Leis no 8.212 e no 8.213 de 1991 instituíram o princípio da universalização e, com ele, ocorreram mudanças significativas no sistema previdenciária. No caso dos trabalhadores rurais, pode-se citar como principais mudanças a criação de um piso mínimo para os benefícios, garantindo o recebimento de pelo menos um salário mínimo, a fixação de idades diferenciadas para o requerimento da aposentadoria por idade (55 anos para as mulheres e 60 anos para os homens), e a igualdade de direitos entre trabalhadores e trabalhadoras rurais, deixando de excluir as mulheres casadas ou com vida marital ao acesso dos benefícios previdenciários. Após estas mudanças, houve grande aumento do número de aposentados no meio rural. A análise tabular dos dados das PNADs, segregando os idosos(as) aposentados(as) pelo seu rendimento de aposentadoria, mostra que a previdência social tem sido eficaz em pagar aos seus beneficiários pelo menos um salário mínimo e que esta renda tem sido utilizada não somente para alimentação e vestuário, mas também para melhoria em seus domicílios. No entanto, a análise tabular e econométrica dos dados das PNADs indicam que houve favorecimento dos homens em relação às mulheres, dos brancos em relação aos negros (considerados como pardos e pretos) e dos mais escolarizados em relação aos menos escolarizados na obtenção das aposentadorias pagas no meio rural, indicando que a eqüidade não tem ocorrido na distribuição destas aposentadorias. O trabalho termina sugerindo algumas medidas que possam reverter este quadro, principalmente no acesso à aposentadoria por idade. / The proposal of this dissertation is to evaluate the effectiveness and the equality of the pension system paid in the agricultural areas in Brazil in the 1990s. The effectiveness occurs when the government assures the benefits of the social security system reducing the poverty and improving lifes conditions to this population. The fairness implies equality access to the social security benefits, regardless sex and ethnic differences, as well as education levels. The paid pensions in the rural areas can be clustered according to its income groups, which are, equal to a minimum salary (proxy of the old ages pension) and more than a minimum salary. The ones who are in the first group are called special insured of the rural social security, therefore they can retire without contribution. The Federal Constitution of the 1988 and its modifications, given according to the Laws n. 8.212 and n. 8.213 (both from 1991), had instituted the universal principle, and with it, significant changes in the social security system. As to the rural workers, it can be considered as main changes the creation of a minimum value for the benefits, which guarantees the act of receiving at least a minimum salary, different ages to require the old age pension (55 years or older for women and 60 years or older for men), and equal rights among rural workers and urban workers, including the married women who worked in rural activities. After these changes, the number of pensioners increased in rural areas. The tabular analysis using the PNADs dataset, segregating the old age pensioners for theirs retirement income, points out that the social security system has been efficient in paying at least a minimum salary. This income has been used not only for food and clothes, but also for improvement in theirs houses. However, the tabular and econometrical analyses using the PNADs dataset indicate that males, white people, and those with higher education had an easier access to pension than females, black people and those with lower education. These results also indicate that the fairness has not completely occurred in the distribution of these pensions. The work finishes with some suggestions to improve the equality in Brazilian social security system.
