Implementace služebního zákona v praxi / Implementation of Service Act in practice

The master thesis focuses on the new Act no. 234/2014 Coll., of State Service, which introduces a new law regulation of labour relations of employees in the state administration. Service Act has been frequently a discussing theme in recent years, especially in connection with a threat from the European Commission which by accepting this law conditioned a drawing of European grants from structural funds for the period 2014 - 2020. This dissertation analyses the issue of the state service, here are an outlined principles of the state service in selected European countries and the historical development of the state service in the Czech Republic. The goal was to highlight the possible problematic provisions which appear in the law, and the problems that have shown up during the implementation of this law, even the example of the Labour Office of the Czech Republic.

Etikos valdymas Lietuvos valstybės tarnyboje / Ethics management in Lithuanian state service

Siekiant skatinti valstybės tarnautojus vadovautis nustatytais etikos standartais, užtikrinti etišką jų elgesį profesinėje veikloje, užkirsti kelią etinių problemų atsiradimui ir plitimui valstybės tarnyboje, reikalinga vadybinė perspektyva, t.y. etikos valdymas, padedantis pasiekti aukštesnių elgesio standartų, kelti valstybės tarnautojų profesionalumo lygį, didinti visuomenės pasitikėjimą valdžia ir jos institucijomis, formuoti teigiamą valstybės tarnybos įvaizdį. Darbe analizuojama etikos valdymo problematika bei tobulinimo galimybės Lietuvos valstybės tarnyboje. Darbo tikslas – išanalizuoti etikos valdymo priemonių sklaidą ir jų realizavimą Lietuvos valstybės tarnyboje. Tikslui pasiekti keliami šie uždaviniai: apibrėžti etikos sampratą mokslinių diskursų kontekste, atskleidžiant jos svarbą valstybės tarnyboje; įvardinti etikos valdymo priemones, padedančias užtikrinti nustatytų etikos standartų laikymąsi valstybės tarnyboje; įvertinti etikos valdymo institucinę ir įstatyminę infrastruktūrą Lietuvos valstybės tarnyboje; atskleisti etikos valdymo tobulinimo galimybes Lietuvos valstybės tarnyboje. Darbe naudoti metodai – mokslinės literatūros, teisės aktų ir dokumentų analizė bei kokybinis tyrimas – pusiau struktūruotas interviu. Atliktas tyrimas atskleidė, kad Lietuvos valstybės tarnyboje etika užtikrinama teisiniu reglamentavimu, institucine priežiūra, įvadiniu valstybės tarnautojų mokymu. [toliau žr. visą tekstą] / In order to induce state servants to follow the established standards of ethics, to guarantee their ethical behavior in professional activity, to prevent the emergence of ethical problems and their spread in state service, managerial perspective is necessary, i.e. ethics management, which helps to achieve higher standards of behavior, to raise the level of professionalism of civil servants, to increase public confidence in the government and its institutions, to form positive image of state service. The work elaborates on the problems of ethics management and its improvement opportunities in Lithuanian state service. The aim of the work is to analyze the spread of ethics management measures and their realization in Lithuanian state service. The following objectives were set to achieve the aim: to define the concept of ethics in the context of scientific discussions by revealing its significance in the state service; to list ethics management measures that contribute to the guarantee of observance of established ethical standards in the state service; to evaluate ethics management institutional and legitimate infrastructure in Lithuanian state service; to reveal ethics management improvement opportunities in Lithuanian state service. Magistro baigiamajame darbe analizuojamas valstybės tarnautojų pasitenkinimas darbu. Pirmojoje pagrindinėje darbo dalyje aptariamos valstybės tarnautojų pasitenkinimo darbu teorinės prielaidos: valstybės tarnybos ir valstybės tarnautojo sampratos, pasitenkinimo darbu samprata, valstybės tarnautojo pasitenkinimą darbu įtakojantys veiksniai, sudarytas valstybės tarnautojų pasitenkinimą darbu įtakojančių veiksnių modelis. Antrojoje darbo dalyje analizuojamas ir lyginamas dviejų Lietuvos savivaldybių – Radviliškio ir Vilkaviškio rajonų savivaldybių - valstybės tarnautojų pasitenkinimas darbu (bendras respondentų pasitenkinimo darbu lygis; nuo pačių respondentų ir nuo savivaldybių administracijos priklausantys pasitenkinimą darbu įtakojantys veiksniai). Trečiojoje darbo dalyje pristatomos abiejų analizuotų rajonų savivaldybių valstybės tarnautojų pasitenkinimo darbu didinimo kryptys. Darbe bandoma išsiaiškinti, ar abiejose tyrime dalyvaujančiose savivaldybėse darbuotojų pasitenkinimas darbu atitinka modernaus viešojo valdymo reikalavimus. / In the Master thesis the work satisfaction of employees on the basis of their work is analyzed. In the first main part of the thesis the theoretical assumptions of employees’ satisfaction on the basis of work are described: the concepts of state service and state employees, the concept of work satisfaction, the factors influencing the work satisfaction. The author presents the model of factors influencing the satisfaction of work. In the second part the work satisfaction in two municipalities (Vilkaviskis and Radviliskis) is analyzed and compared (the basic level of work satisfaction of the respondents; the factors depending on the respondents themselves and on the management of the municipalities). In the third part the directions improving work satisfaction in both municipalities are presented. The thesis includes the concept connected with the fact if the work satisfaction in both municipalities is equivalent to the requirements of modern public management.

The process of the personnel activity rating, that is one of the most crucial points of the human resources rating was studied in the Master degree working paper. Rating system that is organized properly and applied effectively, help the person and the organization to get the useful information and to make an important managerial decisions on duties and responsibilities distribution, conditions of payment, promotion, needs for qualification raising and for the establishing the potential. Although the rating process instigates many problems that are connected with organizational, administrative and human resource rating aspects. To define possible imperfections and problems of the system, and to find development possibilities, the procedure of the service activity rating of the Lithuanian state service was analyzed in the paper. The Master degree working paper consists of three parts. In the first part of the paper the importance and the relevance of the activity rating was described, as well as the rating importance for both, the organization and for the person rated. The second part was theoretical. In order to clear up main aspects, those ensure effective and reliable rating system implementation and use in organization, the theoretical basics of personnel activity rating was examined. 俄羅斯官僚體制研究—由葉爾欽到普欽

在經歷了長時間俄國的官僚體制演進歷程,俄國由原先俄帝國「官階表」(Table of Ranks),到蘇聯時期產生了所謂的「職官名錄制」的體制,這龐大的官僚傳統,經過逐漸演化,衍生出了貪污、效率緩慢、特權制、為特定國家組織服務的「恩庇侍從」的脈絡。一九九一年解體後,葉爾欽繼承了蘇聯這龐大的官僚,而且其規模還逐年增加,但效率卻沒有明顯的上升,反而在國家公務人員體系內部產生了嚴重的性別、教育、以及工作年資上退化的情形;葉爾欽看到了,設立了「國家公務人員部」(Roskadry) 、「俄羅斯國家公務人員學院」(Russian Academy of State Service, RAGS)等一連串的機關,並通過「俄羅斯聯邦公務人員原則法」(Fundamentals of State Service)等,想要解決這種情形;但這段時間的地方、中央衝突,解體初期俄羅斯未完善的法律、官僚貪腐集團的阻礙,加上葉爾欽健康上、政權上的不穩定,使得他的改革沒有多大的成效。 兩千年總統大選後,俄羅斯的公務人員改革再度透過四份文件展開:「俄羅斯聯邦國家公務人員制度改革構想」(The Conception of the State Service System Reform of the Russian Federation)、「俄羅斯聯邦國家公務人員體制」(About the System of State Service of the Russian Federation)、「俄羅斯聯邦公務人員體制」(About the Civil Service of the Russian Federation)、「俄羅斯聯邦國家公務人員改革計畫」(State Service Reform in the Russian Federation):二零零三~二零零五年的改革計畫。 以上四份文件,加上普欽上任後,逐漸中央集權,收回其權力,並打擊寡頭,使得俄羅斯的公務人員的人才教育、與培訓制度地逐漸上了軌道,並確立了公民公平進入公職體系、軍事和法律執行領域的職員加入公務體系的三種類劃分方法、層級劃分,加上競爭性的升遷、和職業性任用的「功績制」到此逐漸地成熟,根除腐敗公務人員的決心,可以看出俄國的確做了很大幅度的進步。然而,俄羅斯的公務人員在薪水、社會地位仍嫌低下,使得俄國的公職體系沒有開放改革後的私有部門、私人企業等的吸引力,而其公務人員在職業資格上,仍是需要改進的地方,作者認為俄羅斯的官僚政治改革,並不會在短時間之內成功,除非改革能由俄羅斯大眾的基本社會意識型態轉變下手,由基礎的意識形態、社會觀感下手,加上改善上述官僚利益的阻礙、公務人員的薪水、職業任用程度等問題,俄羅斯的公務人員才能享受更高的社會地位,更符合韋伯的官僚效率,使得俄羅斯國家機器運轉地更順,更有效率。

The master thesis discusses the legal regulation of employment of the state administration and its comparison with the labour regulations in other areas with similar characteristics. The thesis analyzes the theory of public administration, its development and the segmentation within the Czech Republic and the current state of it. The thesis also includes analysis of the areas which are directly related to the topic, such as human resources management in the public administration. Finally, the thesis is showing a comparison of the main bills of the public service with the bills which are covering the employment private sector, i.e. Labour Code. Thesis provides an overview of positive and negative aspects of the current state of the bill of state administration.

The thesis is a design of a bridge crossing the valley of the Hrabyňka creek as a part of road I/II. Firstly, three possible structures are designed and according to their advantages and disadvantages, the best of them is selected. In this case a cable stay bridge was selected. Following is a design of span lenghths, collumn heights and the cross-section. Then the loads are detremined and applied on a numeric model cretaed in software working on the basis of FEM. In continuation internal forces are calculated and their propriate combinations for service limit stay and ultimate limit state with time dependent analysis taken into account. In the end the reinforcement steel is designed for one part of the structure. Detailed drawings are also part of the thesis.

Some space of the work is devoted to the characteristics of public and state administration. The diploma thesis emphasizes the institutions of state administration and their division. The following chapter deals with information institutions and information folders in the state administration and their categorization. The core of the thesis is the definition of the concept of an information specialist. The final chapter summarizes not only the overview of the information science study in the Czech Republic but also the analysis of the professional application of Information Studies and Librarianship graduates in the state administration institutions.
