Prosecutorial Discretion and Punishment Motives in Ambiguous Juvenile Sex Offense Cases

abstract: This study hypothesizes that prosecutors would be more likely to prosecute juveniles who engage in sexual activity with an underage same-sex partner than those who engage in underage sexual activity with a member of the opposite sex. To test this hypothesis, surveys were mailed to 1,000 prosecutors around the United States with a between subject design, meaning that each participant was only exposed to one condition in the vignette they read. There were a total of four vignettes, creating four conditions of different “offender” sex and “victim” sex in sexually appropriate relationships. The vignettes contain conditions in which either a male or female junior in high school was videotaped having oral sex with either a male or a female freshman in high school. Prosecutors were asked questions about whether they would prosecute the older student for statutory rape. Results indicated that manipulations of “offender” sex and “victim” sex were not statistically significant on prosecutorial discretion or punishment severity/motives; however, these manipulations did alter the prosecutors’ perceptions of the offender. / Dissertation/Thesis / Masters Thesis Criminology and Criminal Justice 2017

It is about this unsubmissive poet, his poetry and his poem that we worked in this thesis. For this, we enlarged the limits of the studies of the literary text, in a proposal for a poetic epistemology, that it associates theories and methods of literary investigation to the paradigm of the complexity, taking into account the poet's relationships, of the poetry and of the poem with the world. The dissertation grows based in the Theory of Residuality and in the unsubmissive poetry of Roberto Pontes, in the revision of Theories of the Literature with readings in Aristoteles, Theodor Adorno, Bachelard, Vítor Manuel of Aguiar and Sílva, Antoine Compagnon, Terry Eagleton, Tzvetan Todorov, Antonio Candido, Pedro Lyra and still ruled in Edgar Morin complex thought. The thesis brings an organized study according the textual structure of a statute, with Preamble, Sections and General Dispositions. Like this the sections are divided: "Of the poet, of the poetry and of the poem", that it explains the construction and recital of the theme and of the research; "Of the poet", that brings association and the man's dissociation and of the I-lyrical and the poet's commitment with the society, He speaks about the unsubmissives poets and the Thiago de Mello’s political poetry path; "Of the poetry": with studies on poetry and reality and unsubmissive poetry (of the servants to the political poetry of Thiago de Mello) and identification of the unsubmissive poetry of the Statutes of Man; "Of the poem": with poetic characteristics of the Statutes of Man, identifying the context and the texts that dialogue with the poem in residual, intertextualities and Amazonian theme. / Os Estatutos do Homem, de Thiago de Mello, é poema cujo transbordamento ocorreu em 1º de abril de 1964, no Chile, no calor da notícia do golpe militar no Brasil. É sobre este poeta insubmisso, sobre sua poesia e sobre seu poema que trabalhamos nesta tese. Para isto, ampliamos os limites dos estudos do texto literário, numa proposta para uma epistemologia poética, que associa teorias e métodos de investigação literária ao paradigma da complexidade, levando em conta as relações do poeta, da poesia e do poema com o mundo. Cinematography in the Czech lands went through a dynamic development during first decades of the 20th century. Original nomadic theatres and vaudevilles were replaced by permanent cinemas. The first one of this kind in the Czech lands was opened in 1907 in Brno. Movies became soon one of the most common way of spending free time as it was obtainable to all sorts of public. The biggest amount of movie theatres were obviously located in bigger aglomerations, the highest level of cinemas in Czech lands were concentrated in Prague. Here, in the center of the Czech capital, had also started a new trend of building a big screening halls, for a first time originaly projected only for a cinema purpose. These venues, builded in the 20's of 20th century as a part of commercial and financial palaces, were unique for reason to be premiere cinemas. Owners of majority of these special cinemas got together into a special ellite club called The association of the premiere cinemas. In the first part of this Thesis is will be described a social-culture context of the defined time period, with focus on a life of society in big aglomerations, together with coherencies of the community life and cinematography in the Czech lands. OF MASTER'S DEGREE THESIS STATUTES OF FLAT OWNERS ASSOCIATION The purpose of this thesis is to analyse particular requirements of the Statutes of the Flat Owners Association. The thesis is composed of three main chapters, each of them dealing with different aspects affecting the form of the Statutes. Chapter One is introductory and presents basic conceptions and historical background of a flat ownership. The chapter is subdivided into two parts. Part One describes theoretical conceptions of ownership of flats and explains main differences between them. Part Two deals with introduction to the history and examines relevant Czech legislation. Main accent is paid to the Act on Ownership of Flats No. 72/1994 Collection of laws and new Civil Code No. 89/2012 Coll. Chapter Two examines the Flat Owners Association (also known as "condominium"). This chapter consists of five parts. Part One focuses on foundation. Foi realizado um estudo teórico fundamentado no pensamento materialista dialético, visando identificar as principais questões que sustentam a biologia, considerando a sua história de construção e o olhar da filosofia da ciência sobre ela. Fez-se um levantamento documental principalmente nas fontes secundárias sobre a história e filosofia da biologia, também em algumas fontes primárias. Tendo realizada esta etapa, fez-se uma análise do conteúdo disciplinar dos Parâmetros Curriculares Nacionais do Ensino Médio (PCNEM), PCNEM+ e as Orientações Curriculares. O estudo foi direcionado por três questões: Quais são os elementos que caracterizam a biologia como tal ao longo da sua construção? Como estes elementos se caracterizam e se articulam? Os documentos curriculares oficiais consideram estes elementos na sua formulação? Como resultado, é trazida a história das ideias sobre os seres vivos na Antiguidade à Idade Média, sendo possível identificar algumas das questões que a biologia veio a se debruçar nos séculos seguintes. Em seguida, enfatiza-se a mudança ocorrida na visão de mundo na Idade Moderna que se opôs a Escolástica e suas implicações na organizaçãoda ciência que culminou na Revolução Científica. There was a documentary survey mainly on secondary sources on the history and philosophy of biology, also in some primary sources. Having performed this step, there was a review of disciplinary content of National Curriculum of Secondary Education (PCNEM) PCNEM + and Curriculum guidelines. The study walked directed by three questions: What are the elements that characterize the biology as such throughout its construction? How these elements are characterized and articulate? Documents of curriculum consider these elements in its formulation? As a result, it brought the history of ideas on living in antiquity to the Middle Ages, it is possibile to identify some of the questions that biology came to look over the following centuries. Then, we seek to emphasize the change in worldview in the modern era who opposed scholasticism and its implications to the science that culminated in the Scientific Revolution.
