Translating Sustainability : Sustainable Public Procurement Practices in Swedish and German Public Organizations

The idea of sustainability is widespread, but it often remains unclear how the idea travelled and how it is translated into practice. In this thesis it is analysed how public organizations translate sustainability into action through Sustainable Public Procurement (SPP). First, an overview of translation theory and previous research on SPP is given. Basing on an empirical analysis, two cases of public organizations in Sweden and Germany that integrated SPP in their strategies are described and analysed. It is revealed that translation theory applies to the two cases and that the theory is useful to explain how the concept of sustainability is acted upon. Characteristics of processes of translation can be observed in both cases, indicating that the translation of the same idea can result in different practices and outcomes. It is found that although both public organizations use the same term, the way SPP is implemented and practiced differs highly. The thesis includes reflections on this different outcome and considers the importance of local contexts and actors.

The increase in discussion regarding the consumption patterns of industrial societies and subsequent environmental impacts has led to the perception of the State as a significant consumer of goods and services. In response, various countries have adopted and passed guidelines and methodologies, including sustainability criteria, within their procurement practices, a practice that became known as sustainable public procurement (SPP). This study analyzes the implementation of SPP within the Brazilian Federal Executive Power. Probability sampling was used to achieve the established goals of the analysis. 24 ministries were considered as populations from which a sample of 12 ministries was obtained using a confidence level of 95% and a percent error level of 3. The procurement practices from 2010 to 2013 of the sampled agencies were analyzed. An analysis of the implementation practices used by SPP of the Federal Executive Power was realized observing the stages of the PDCA cycle. Primary data was collected from representatives of each agency through verbally administered structured questionnaires. The research demonstrated that the instruments developed for the implementation of SPP practices emphasize the mitigation of environmental impact at the expense of social aspects. Taking into account the legal and institutional instruments created by the Federal Executive Power since 2010, it was concluded that the SPP policy utilized by the Brazilian Federal Executive Power has a solid basis. However, the research highlights the underuse of these tools, particularly by sample agencies. The underutilized goals of SPP implementation within the Plan of Action for Sustainable Production and Consumption (PSPC) are duplicated in the Sustainable Logistics Plan (SLP), and elaborated by the sampled agencies. Limiting factors identified were the absence of clear targets and goals within the entities and agencies of the Federal Public Administration, and the lack of managerial support within the sampled populations. Furthermore, it was observed that the absence of systemized data makes it impossible to evaluate progress toward achieving the goals set by the agency, as well as evaluating the effectiveness of the Brazilian Federal Executive Power’s SSP policy. / O uso dos recursos naturais sempre se mostrou como elemento essencial para o desenvolvimento e reprodução da vida humana. A ampliação dos debates sobre os impactos ambientais decorrentes dos padrões de consumo da sociedade industrial despertou para a percepção do Estado como um expressivo consumidor de bens e serviços. Diversos países passaram a adotar guias e metodologias para inserir critérios de sustentabilidade em suas aquisições, prática que ficou conhecida como contratação pública sustentável (CPS). As CPS são definidas como um fenômeno no qual os órgãos governamentais procuram inserir critérios de sustentabilidade socioambiental na aquisição de bens e contratação de serviços. Assim, o objetivo principal deste ensaio foi analisar a inserção de critérios de sustentabilidade nas compras de bens e contratação de serviços dos órgãos do Poder Executivo Federal brasileiro. Para possibilitar o alcance dos objetivos estabelecidos, promoveu-se a utilização da amostragem probabilística. O total de 24 ministérios foi considerado como população a partir da qual foi obtido uma amostra de 12 ministérios, utilizando-se um nível de confiança de 95% e um erro máximo de 3 pontos percentuais. Foram analisadas as contratações realizadas pelos órgãos da amostra nos anos de 2010 a 2013. A análise da implementação da política de CPS do Poder Executivo Federal foi realizada observando as etapas do “ciclo PDCA”. Foram utilizados dados primários, levantados através de questionários estruturados aplicados oralmente junto ao representante de cada órgão integrante da amostra. A pesquisa evidenciou que os instrumentos desenvolvidos para a implementação de práticas de CPS privilegiam as medidas voltadas para a mitigação dos impactos ambientais, em detrimento dos aspectos sociais. Restou demonstrado que a política de CPS do Poder Executivo Federal brasileiro expressa uma sólida base, considerando os instrumentos legais e institucionais editados pelo Poder Executivo Federal desde o ano de 2010. No entanto, a pesquisa evidenciou o subaproveitamento desses instrumentos, em especial, pelos órgãos integrantes da amostra. As metas pouco ousadas do Plano de Ação para Produção e Consumo Sustentáveis (PPCS), acerca da implementação das CPS, se repetem nos PLS dos órgãos integrantes da amostra. Restaram identificados como principais fatores limitantes a ausência de metas claras e objetivas que abrangessem todos os órgãos e entidades da Administração Pública Federal e a falta de apoio do grupo de direção dos órgãos integrantes da amostra. Além disso, constatouse que a ausência de dados sistematizados impossibilita a avaliação do progresso no alcance de metas estabelecidas pelo órgão, bem assim da efetividade da política de CPS do Poder Executivo Federal.

Specifically, a diagnosis was made in these IFES and a Sustainable Purchasing Guide was developed. Regarding the methodology, this research was characterized by being qualitative, applied nature, exploratory, bibliographic, documentary, and based on multicaso study. The research's diagnosis was developed based on data obtained from the Purchasing Panel of the Federal Government and Management Reports on sustainable public procurement developed between the years 2012 to 2017 in the IFES of the Center West of Brazil. After that, it was proposed to use the sustainable public procurement guide, which includes environmental, social, economic and political criteria. Among the results obtained, the diagnosis showed that the degree of maturity in all the IFES is initial, since the sustainable purchases still cover few products, little budget, and thus the proposed Sustainable Procurement Guide proved to be appropriate for UFG. Sustainable public procurement should be used as a public policy instrument to promote sustainable development, as well as foster innovation and reduce costs. / Este estudo refere-se a uma pesquisa desenvolvida sobre o tema Compras Públicas Sustentáveis e sua aplicação nas Instituições Federais de Ensino Superior do Centro Oeste. Especificamente foi realizado um diagnóstico nestas IFES e desenvolvido um Guia de Compras Sustentáveis. Quanto à metodologia, esta pesquisa caracterizou-se por ser qualiquantitativa, natureza aplicada, caráter exploratório, bibliográfica, documental, e baseada em estudo multicaso. O diagnóstico da pesquisa desenvolveu-se a partir de dados obtidos do Painel de Compras do Governo Federal e de Relatórios de Gestão sobre as compras públicas sustentáveis desenvolvidas entre os anos de 2012 a 2017 nas IFES do Centro Oeste brasileiro. Após isso, propôs-se a utilização do guia de compras públicas sustentáveis, que inclui critérios ambientais, sociais, econômicos e políticos. Entre os resultados obtidos, o diagnóstico demonstrou que o grau de maturidade nas IFES é inicial, vez que as compras sustentáveis ainda abrangem poucos produtos e pouco orçamento e, assim, o Guia de compras sustentáveis proposto mostrou-se apropriado para UFG. As compras públicas sustentáveis podem ser utilizadas como um instrumento de política pública para promover o desenvolvimento sustentável, além de fomentar inovações, e diminuir custos.

Seeking sustainability in the construction sector: opportunities within impact assessment and sustainable public procurement

Growing concerns regarding sustainability have led the construction sector to adopt various policy instruments for reducing the impacts caused by construction activities. One such policy instrument includes impact assessment, which enables the construction sector to evaluate the environmental consequences of proposed developments at project (environmental impact assessment) and strategic (strategic environmental assessment) level. In recent years, the construction sector has also adopted green public procurement, which is a process whereby contracting authorities aim to procure services and products that meet environmental requirements. In certain contexts, green public procurement has extended to sustainable public procurement, which involves the incorporation of both environmental and social considerations in the procurement of services and products. Promoting sustainability in the constructor sector is a significant challenge. This challenge is primarily due to the requirement of high levels of cooperation among project stakeholders, on the one hand, and a lack of coordination between project planning and implementation on the other hand. Therefore, procurement plays a significant role as it establishes the tone for the interaction between contracting authorities and contractors. The overall aim of this thesis is to bolster the knowledge of promoting sustainability in the construction sector, with the specific aim of analysing the ways in which policy instruments such as environmental impact assessment and green public procurement can be reinforced to improve the coordination between planning and the implementation of sustainability considerations. This thesis conceptualises an inter-link between impact assessment and green public procurement, and identifies the opportunities to develop the inter-link. It is appropriate to plan for green public procurement at the pre-decision phase of an environmental impact assessment. The inter-link can be strengthened by involving contractors in planning for green and sustainable public procurement. One way to involve contractors is with the aid of competitive dialogue procedure, which is a procurement procedure that allows contracting authorities to hold discussions with contractors regarding the authority’s requirements. This study strengthens the conceptualisation that competitive dialogue procedure can facilitate green and sustainable public procurement. The various elements in a competitive dialogue procedure can enable the contracting authorities to ensure the consistency between the weight for environmental considerations in contract award criteria and the relevant preferences. This thesis also discusses key concerns for progress towards sustainable public procurement, which includes among others the incorporation of sustainability values in procurement decisions. In addition, this study identified certain discourses on future trends for green and sustainable public procurement. The discourses provide an opportunity for reflection, and thereby indicate that analytical support is required to develop criteria in a way that enables the evaluation of sustainable public procurement against the background of sustainability and justice regarding natural capital. Innovation must be promoted with a focus on sustainability values. Moreover, green or sustainable public procurement must be discussed between contracting authorities and contractors in light of its contribution to sustainability. / <p>QC 20140509</p>

Proposta de implantação do sistema de compras públicas sustentáveis em uma instituição federal de ensino superior / Proposal for implementing the sustainable public procurement system in a federal institution of higher education

The sustainable public procurement represents a form of integration of environmental and social criteria in order to decrease the impacts that may harm people's health and the environment. This study aimed to present a proposal for implementation of sustainable procurement in a Federal Institution of Higher Education. For this, qualitative-quantitative research, with prescriptive character presents a study case at the Federal University of Santa Maria. Initially, the placement of external control organs was identified between 2010 and 2012, through documentary analysis. Then technique was applied to the questionnaire in order to show the scenario of Brazilian Federal Institution of Higher Education, 2010-2011 period, with respect to the inclusion of sustainable procedures in their bids. The politics procurement of the institution, analyzed between 2010-2012, took through interviews and procedures analysis. The results indicate that the recommendations proposed by Court of Auditors of the Union promoted joint actions of ministries for sustainable development within the Union. Moreover, identified that the decisions of that Court has been guiding institutions to adopt practices that enable adoption of sustainable environmental criteria in bids. Even partially, it can be seen that the inclusion of sustainable questions on procurement of Federal Institution of Higher Education presents the positive developments in the period under review. It was observed that the unit studied already taking actions relating to purchases of recyclable and reusable materials, energy efficiency and reduction of water consumption, which reveals, although partially, adopting a sustainable approach in their procurement processes. Given the diagnoses presented, it was possible to propose a procurement plan in order to direct the procurement and contracting of the institution from the perspective of sustainable development. / As compras públicas sustentáveis representam uma das formas de integração de critérios ambientais e sociais com vistas a diminuir os impactos que possam vir a prejudicar a saúde da população e o meio ambiente. O presente estudo teve como objetivo apresentar uma proposta de implantação de licitações sustentáveis em uma Instituição Federal de Ensino Superior (IFES). Para isso, a pesquisa quali-quantitativa, de caráter prescritivo, apresenta um estudo de caso na Universidade Federal de Santa Maria (UFSM). De início, o posicionamento dos órgãos de controle externo foi identificado, entre 2010 e 2012, por meio de análise documental. Em seguida, foi aplicada a técnica do questionário, com vistas a mostrar o cenário das IFES brasileiras, no período 2010-2011, com relação à inserção de procedimentos sustentáveis em suas licitações. A política de compras da instituição estudada, analisada entre 2010-2012, deu-se mediante entrevistas e análise processual. Os resultados indicam que as recomendações propostas pelo Tribunal de Contas da União (TCU) promoveram ações conjuntas dos Ministérios para o desenvolvimento sustentável no âmbito da União. Além disso, identificou-se que as decisões daquele Tribunal vêm orientando as instituições a adotarem práticas que permitam a adoção de critérios sustentáveis socioambientais nas licitações. Mesmo de forma parcial, pode-se verificar que a inclusão de quesitos sustentáveis nas licitações das IFES apresenta evolução positiva no período sob análise. Observou-se que a unidade estudada já vem adotando ações relativas às aquisições de materiais recicláveis e reutilizáveis, eficiência energética e à redução do consumo da água, o que revela, embora parcialmente, a adoção de uma postura sustentável em seus processos licitatórios. Dados os diagnósticos apresentados, foi possível propor um plano de licitações com vistas a direcionar as aquisições e contratações da instituição sob o prisma do desenvolvimento sustentável.

In this essay a quantitative empirical study with qualitative elements is performed. The purposeof the paper is to investigate whether public procurement can be applied as a political instrument. The empirical data consists of a selection of government agencies and how well these government's governing documents have implemented the current government's National Public Procurement Strategy. In order to analyze the degree of implementation, three different implementation theories are applied. The theories applied are implementation from an upside down perspective, implementation from a bottom and up perspective and implementation based on ability, will and understanding. In order to delimit the essay to a reasonable extent, the study aims to focus on how socially responsible public procurement have been included in the governing documents. The question that is aimed to be answered is: to what extent has the objective of socially responsible in public procurement been implemented in the governing documents? The second question is: Is social responsibility more prominent in governing documents that were updated after launching the national public procurement strategy. the third question is: what possible implementation barriers can be identified when implementing the national procurement strategy. The method used in the essay is essentially a quantitative content analysis that is complemented by a qualitative interview survey. The results of the empirical study show shortcomings in the implementation of the selected authorities, which indicates that the national strategy have a weak effect as a political instrument.

Sustainable Public Procurement as a Driver of Change : The Case of Surgical Instruments

Although Sustainable Public Procurement (SPP) is often seen as a powerful tool to drive sustainability across its supply chain, there is little available research in terms of how SPP actually influences its suppliers’ sustainability practices and what challenges are being faced during the process. In this study, we shed light on both issues by exploring SPP using Institutional and Power Dependence Theory in the context of the surgical instrument industry in Sweden. Methodologically, the study is grounded in an exploratory design and employs in-depth interviews with multiple stakeholders to gain a holistic understanding of the phenomena being studied. The study revealed that SPP mainly influences suppliers by requiring them to evaluate their own sustainability practices, engage in collaborative actions and make alterations when they fail to comply with the contractual terms.The most significant challenge resulted to be the lack of resources, resulting in the inability to perform sufficient follow-ups, engage in meaningful conversations with suppliers and procurers having to buy unsustainable products because of their tight budgets. Another major challenge was Sweden’s forerunner position when it comes to SPP on an international level, resulting in reluctancy on the part of international suppliers to alter their sustainability practices.

Empreende-se analise do modelo de Desenvolvimento brasileiro, focado no crescimento economico e as limitacoes decorrentes. A Sustentabilidade e estudada como valor e principio, em conteudo multidimensional que ultrapassa o classico tripe ambiental, social e economico, com destaque a Etica. A partir da jusfilosofia, o Direito e examinado em suas funcoes de contencao, legitimacao economica e manutencao do status quo, suas relacoes com o desenvolvimento economico, assim como em seu potencial de desencadear transformacoes sociais, pela substituicao de uma racionalidade calcada nos mitos da lei e do progresso por paradigmas emergentes fundados na Etica Ambiental e na Sustentabilidade como principio e valor. A pesquisa e conclusiva pelas contratacoes publicas sustentaveis brasileiras como vetores da consecucao de um ideal de Desenvolvimento que nao se restrinja aos aspectos economicos, mas que foque nas liberdades humanas, no bem-estar intergeracional, na preservacao ambiental e na reducao das desigualdades sociais, por meio de um Direito atuante e transformador e das conexoes entre teoria e pratica. Conclui-se que as contratacoes publicas sustentaveis brasileiras provocaram uma fissura na hegemonia da regulacao que caracteriza o Direito e a Administracao Publica pelo conteudo emancipatorio que a juridicidade e a articulacao dos atores em rede podem assumir. / This thesis analyzes the insertion of sustainability in Brazilian public procurement, from an interdisciplinary perspective that relates Law, Environmental Ethics and Development. The study puts under analysis the development model adopted in Brazil, focused on economic growth, and its resulting limitations. Sustainability is examined as a value and a principle, in a multidimensional content that surpasses the classical tripod based on environmental, social and economic dimensions, with emphasis on Ethics. From a Philosophy of Law approach, Law is scrutinized in its functions of contention, economic legitimation and status quo maintenance, its relations with economic development, as well as its potential to unleash social transformation, by replacing a rationality based on the myths of law and progress with emerging paradigms founded on Environmental Ethics and Sustainability as a principle and a value. The research demonstrates that Brazilian sustainable public procurement is a vector for the achievement of an ideal of development not restricted to economic aspects, but focused on human liberties, intergenerational welfare, environmental preservation and reduction of social inequalities, by means of an active and transforming Law and the connections between theory and practice. The work concludes that Brazilian sustainable public procurement breaks the hegemony of regulation that characterizes Law and Public Administration, due to the emancipatory content that can be assumed by Law and the articulation of the agents in network.

The theme of this research is about the perspective of the implementation of sustainable procurement, it was characterized as an instrument used by the public management, for the purpose to adopting sustainable criteria in the social, environmental and economic to your shopping process. Given its purchasing power and the impact this may have on the market, aims to promote the development as well. Even if the legal regulations this reasoning in a shopping process based on sustainability this practice only gains strength with the normative instruction 01/2010 and in sequence by Law No. 12,349 / 10, amending the text of the Law 8.666 / 93, giving the new legal purpose of promoting national development the buying public. This research was classified as analytical empirical, adopts descriptive about the objectives and has a quantitative approach. Data were collected through questionnaires during the second international seminary on sustainable public procurement held in Brasília- DF. The sample was characterized as non-probabilistic for convenience and intentional, which was made up of 77 public servants procurement agents participating in the seminary. The method of analysis was give by descriptive statistic and cluster analysis. The main results indicate that only a normative legislation is not sufficient to fulfill the application of public procurement, given that this is still little used, even among servers that have greater perception of knowledge and training on the subject. One group identified the biggest difficulties even after these having the highest scores as the realized training. One of the main delimiters indicated by the servers, in this aspect of culture, which leads to change in a process, in behavioral change. Question the effectiveness of the training carried out and needing for the expansion of the theme for all areas, since the Law 8.666 / 93 that is used by all public institutions in your shopping process. It highlights the need for sustainable public procurement they leave theoretical panel and take practical character and its purpose development sustainable national. / As compras públicas são responsáveis por aproximadamente um quinto do Produto Interno Bruto (PIB). Para que a finalidade de desenvolvimento efetivamente ocorra é fundamental que os agentes de contratações públicas apliquem critérios sustentáveis a este processo. Diante do presente contexto, o objetivo geral deste estudo é analisar a percepção de servidores, responsáveis pelas contratações públicas, quanto à aplicação e à finalidade das compras públicas sustentáveis. O tema desta pesquisa está sob a ótica da aplicação das licitações sustentáveis, essa se caracteriza como um instrumento utilizado pela administração pública, com o propósito de adotar critérios sustentáveis nas dimensões social, ambiental e econômica ao seu processo de compras. Tendo em vista seu poder de compras e o impacto que este pode causar ao mercado, objetiva-se assim promover o desenvolvimento. Observa-se que mesmo que o arcabouço jurídico já desse fundamentação a um processo de compras pautado na sustentabilidade esta prática só ganha força com a instrução normativa 01/2010 e na sequência, pela Lei nº 12.349/10, que altera o texto da lei 8.666/93, atribuindo a nova finalidade legal de promoção do desenvolvimento nacional às compras públicas. Esta pesquisa é classificada como empírica analítica, adota caráter descritivo quanto aos objetivos e tem abordagem quantitativa. Os dados foram levantados por meio de questionários durante o segundo seminário internacional de contatações públicas sustentáveis, realizado em Brasilia- DF. A amostra se caracterizou como não probabilística, por conveniência e intencional, a qual foi composta por 77 servidores agentes de contatações públicas que participavam do seminário. O método de análise deu-se por estatística descritiva e análise de clusters. Os principais resultados indicam que apenas uma legislação normativa não é suficiente para o cumprimento da aplicação das compras públicas, tendo em vista que esta ainda é pouco aplicada, mesmo entre os servidores que possuem maior percepção de conhecimento e capacitação sobre a temática. Ainda observou-se que o grupo que indicou maiores escores de dificuldade entre as variáveis é também característico com os maiores escores quanto às capacitações realiazadas. Questiona-se portanto a eficácia das formações realizadas e a necessidade de expansão da temática para todas as esferas, uma vez que a lei 8.666/93 é utilizada por todas as instituições públicas em seu processo de compras. A pesquisa permitiu reconhecer que um dos principais delimitadores, indicados pelos servidores, está no aspecto cultura, o que remete à mudança de um processo, ou seja, mudança comportamental. Evidencia-se portanto, a necessidade de que as compras públicas sustentáveis saiam do painel teórico e assumam caráter de instrumento de promoção ao desenvolvimento nacional sustentável.
