Recurso ordinário constitucional em processo civil / The recurso ordinário constitucional appel in the civil procedure

Esta dissertação analisa o recurso ordinário constitucional, espécie recursal autônoma e heterogênea, em Processo Civil. Apenas dois tribunais superiores, o Supremo Tribunal Federal e o Superior Tribunal de Justiça, possuem competência para julgar esse recurso. Inicia conceituando recurso e duplo grau de jurisdição, bem como apontando as semelhanças e as diferenças entre esses dois institutos jurídicos processuais. Em seguida, define o critério de classificação dos recursos entre ordinários em sentido amplo e extraordinários em sentido amplo no ordenamento jurídico brasileiro, para apontar em qual categoria se enquadra o recurso ordinário constitucional. Verifica a origem histórica do recurso ordinário constitucional, com enfoque na sua disciplina pelas Constituições Federais do Brasil republicano, para que identifique quais são os motivos pelos quais essa espécie recursal existe e deve ou não ser mantida atualmente. Define cada uma das hipóteses de cabimento do recurso ordinário constitucional, priorizando a definição daquelas interessantes para o Processo Civil. Delineia os aspectos procedimentais desse recurso (requisitos de admissibilidade, efeitos devolutivo e suspensivo, procedimento perante o juízo a quo e perante o juízo ad quem, possibilidade da sua interposição adesiva e cabimento de embargos infringentes e de embargos de divergência). Aponta as funções dos tribunais superiores brasileiros, comparando-as com as funções e com os recursos de competência de Cortes Constitucionais e de tribunais superiores estrangeiros. Conclui pela necessidade de manutenção do recurso ordinário constitucional no ordenamento jurídico brasileiro, com algumas alterações das hipóteses de cabimento. / This dissertation analyses the recurso ordinário constitucional, a heterogenic and autonomous kind of appeal, in its Civil Procedure forms. Only two superior courts, the Supremo Tribunal Federal (the Brazilian Supreme Court) and the Superior Tribunal de Justiça (the Brazilian Federal Court of Appeals) can judge that kind of appeal. It starts conceptualizing what is an appeal and what is a two-tier judicial exam, as well as their resemblances and differences. It follows defining the standard on how to classify the appeals between ordinary and extraordinary in the Brazilian law, so the recurso ordinário constitucional can be appointed to a category. It verifies the historical origin of that kind of appeal, with special focus on its constitutional discipline, since Brazil has being a republic, so it is possible to identify the reasons why that kind of appeal exists and should or should not be maintained nowadays. It defines each one of the cases that the recurso ordinário constitucional can be interposed, prioritizing the ones regarding Civil Procedure. It outlines the procedural aspects of that kind of appeal (its admissibility requirements, its staying and non-staying effects, its procedure before the judex a quo and the judex ad quem, the possibility of that kind of appeal being adhesive, and the acceptance of the embargos infringentes and the embargos de divergência, two different kinds of appeal). It points out the scopes of the Brazilian superior courts, comparing them to the scopes and the appeals judged by foreign Constitutional Courts and superior courts. It concludes that the recurso ordinário constitucional should remain on the Brazilian law, with some modifications regarding the cases it can be interposed.

The purpose of this thesis was to investigate different concepts and tools which could support the development of a middleware which persists a temporal and versioned relational data model in an enterprise environment. Further requirements for the target application was that changes to the data model had to be facilitated, so that a small change to the model would not result in changes in several files and application layers. Other requirements include permissioning and audit tracing. In the thesis the reader is presented with a comparison of a set of tools for enterprise development and object/relational mapping. One of the tools, a code generator, is chosen as a good candidate to match the requirements of the project. An implementation is presented, where the chosen tool is used. An XML-based language which is used to define a data model and to provide input data for the tool is presented. Other concepts concerning the implementation is then described in detail. Finally, the author discusses alternative solutions and future improvements.

It has already been established that animals have various constitutional effects on humans and influence quality of life and well-being in various ways (see Nestmann 2005). For a lot of people in all stages of their life, pets are important sources of support. They are able to contribute to our health as well as to buffer stress and illness. Especially elderly and frail people take profit from the human animal bond. Pets may be seen as important agents in support and therapy of people with dementia. Besides offering emotional support in times of struggle and loneliness, pets can even have a healing influence in situations of physical or mental illness. Since the 1960s animals have been used in professional and therapeutic settings. Even retirement and nursing homes experience the psychosocial benefits of animal assisted activities and integrate animals successfully in the daily routine of the residents. The longitudinal field study “Animals at the Johanniter-Stift Nursing Home” is the first to investigate the effects of animal assisted activities on the quality of life and well-being of elderly nursing home patients with dementia. In order to systematically establish the extent to which various forms of regular contact with animals can benefit such patients, psychological and social changes in patients with and without contact to animals were examined at three intervals over a three-year period, using research instruments such as non-participant observation (MTU), questionnaires completed by nursing staff (FSAK; NPI) as well as interviews with the nursing staff to examine the human-animal-contacts between the residents and the animals in the daily routine. The study demonstrates that elderly dementia sufferers with regular contact to animals tend to show greater agility, independence, strength of social network and communication abilities compared to those without contact to animals. The study shows the psychosocial effects and the options of animal assisted activities with and care of elderly people suffering from dementia as an alternative to pharmacological treatment.

A Component-based Business Continuity and Disaster Recovery Framework

IT solutions must be protected so that the business can continue, even in the case of fatal failures associated with disasters. Business continuity in the context of disaster implies that business cannot continue in the current environment but instead must continue at an alternate site or data center. However, the BC/DR concept today is too fragmented, as many different frameworks and methodologies exist. Furthermore,many of the application-specific solutions are provided and promoted by software vendors, while hardware vendors provide solutions for their hardware environments. Nevertheless, there are concerns that BC/DR solutions often do not connect to the technical components that are in the lower layers, which function as the foundationfor any such solutions; hence, it is equally important to connect and map the requirements accordingly. Moreover, a shift in the hardware environment, such as cloud computing, as well as changes in operations management, such as outsourcing,add complexity that must be captured by a BC/DR solution. Furthermore, the integrated nature of IT-based business solutions also presents new challenges, as it isno longer one IT solution that must be protected but also other IT solutions that are integrated to deliver an individual business process. Thus, it will be difficult to employa current BC/DR approach. Hence, the purpose of this thesis project is to design, develop, and present a novel way of addressing the BC/DR gaps, while supporting the requirements of a dynamic IT environment. The solution reuses most elements fromthe existing standards and solutions. However, it also includes new elements to capture and present the technical solution; hence, the complete solution is designatedas a framework. The new framework can support many IT solutions since it will havea modular approach, and it is flexible, scalable, and platform and application independent, while addressing the solution on a component level. The new framework is applied to two application scenarios at the stakeholder site, and theresults are studied and presented in this thesis.

Thesis Price models and SLA for shared services of data centers has as objective to establish best practice, so-called "best practices" of SLA and price models for data center services. Work is divided into two parts, theoretical and practical part. The theoretical section is wants to familiarize the reader with the basic concepts such as outsourcing, reasons and risks of use. I describe the base models for providing IT services as well as pricing models for services as described in the literature. I will focus on data centers and TIER standard categorization, too. The practical part is based on an analysis of information that I got from an interview with the experts working for the biggest data center companies in the Czech Republic. Based on this information, I tried to compile the best practices for creating pricing models for data center services that are actually used in practice. Specifically, the server housing, server hosting and virtual server services. Also, for these services create an SLA that can be used by some data center company in the Czech Republic.

Technologické a funkční inovativní trendy ERP / Technological and functional innovation trends of ERP

Current trends in ERP system were studied by conducting research and analyzes to see to what degree are current ERP trends reflected in existing ERP solutions that are being developed by both Czech and multinational vendors. For the purposes of the research a set of hypotheses was formulated and used to analyze the selected solutions. The research found two trends that are represented in the majority of selected ERP solutions. The application of cloud computing technology and the suitability to use particular solutions as two-tiered ERP. It was also found that all researched vendors to a certain degree implement the principles of Green ICT, although no vendor specifically labeled their software as Green ERP. It was also found that the term Social ERP doesn't appear to be an acceptable term for ERP vendors, although Social ERP functionality of some degree was found to be present in ERP solutions from multinational vendors.

Gottshall Early Reading Intervention: A phonics based approach to enhance the achievement of low performing, rural, first grade boys.

Learning to read is critical for quality of life and success in our society. Children who cannot read well face unsuccessful educational careers and limited job choices. Recently, policy makers and educators have made progress toward increasing the reading achievement of America's children. Still up to 60% of boys who live in poverty cannot read or read two years below grade level. In this experimental study, I designed and examined the effects of the Gottshall Early Reading Intervention (GERI) to determine if direct instruction with a small group, phonics based approach would increase the literacy achievement of low performing, rural, first grade boys. Participants were selected according to Texas Primary Reading Inventory (TPRI) scores, matched them across race, ethnicity, and socio-economic status, and randomly assigned them to experimental/control group. Three times per week for 15 weeks, boys in the experimental group attended 30-minute pullout sessions taught by trained professionals in addition to classroom reading instruction. Control group members received classroom reading instruction only. Findings reveal no significant differences in reading gains across all variables. However, descriptive data indicate higher percentages of gains for the experimental group on four out of five reading components with rate of gain higher on fifth. Statistics also show that Hispanics are more likely to benefit.

One-tier structure of a joint-stock company from the perspective of the prepared amendment to the Business Corporations Act Abstract This thesis analyses internal functioning of one-tier joint-stock companies, particularly from the perspective of the amendment to the Business Corporations Act, which will come into force in the beginning of the following year. First part of thesis offers comparative analysis of worldwide one-tier joint-stock company legislation, especially in American states, and in English and Italian law. The first two legislations of the above represent one-tier system in its traditional form and the development, that this system has undergone. Comparation with Italian legislation serves as an example of a legal system, in which one-tier model, as in Czechia, falls behind other model of governance of a joint-stock companies. Second part concerns the current legislation of a one-tier joint-stock companies in Czech corporate law, with emphasis to ambiguities in interpretation and application, which originate mainly in duality of elected bodies and conciseness of a special regulation, which was replaced by legislator with a reference to two-tier system. Human perspectivity, furthermore progress in all it's categories (for example technical, social or ethical progress) and finally the decline of a culture, are the main emphasizes of this thesis. It will address the issues of what human perspectivity is about and how it behaves towards progress and a cultural-socially overall structure. In historical context, the evolution of progress is set in relation to the evolution of human perspectivity. After the explaining of these two components and the connection between them, lastly, using a concrete example with the perished Easter Island in the southern pacific, it will be shown, how and why civilizations go through certain stages like early culture, high culture and late culture. So the point of this thesis is, to show, how and why human civilizations come to an end and what we should learn from them. Aside from other factors (for example military conflicts with enemies from the outside, which can lead also to a disaster of a culture), in this thesis the focus is on a cultural-ecological research of a self-inflicted catastrophe. The thesis is completed with a proposed solution for the above mentioned problems to improve the relationship between man and his environment, especially the animal.
