Esta tese de doutorado explora uma faceta ainda obscura nos estudos sobre a democracia e a participação, que consiste na difusão internacional de ideias e tecnologias de governança participativa. As pesquisas recentes sobre este tema têm insistido na influência de atores diversos para explicar o fenômeno da difusão, atribuindo ênfase especial às Organizações Internacionais. A indicação de modelos específicos da parte de tais instituições é frequente, como no caso do Orçamento Participativo (OP), que hoje conta com mais de 2800 experiências ao redor do globo. No entanto, seriam suficientes as orientações de instituições internacionais para explicar a difusão de ideias e tecnologias de governança participativa? Situada entre a análise de políticas públicas e o estudo das relações internacionais, a proposta da pesquisa de doutorado foi de examinar o processo de difusão do OP, por meio de metodologia qualitativa, combinando entrevistas em profundidade, observação participante e análise de documentos. O estudo foi desenvolvido a partir da análise de um caso de origem, Porto Alegre, e diversos casos de transferência na África Subsaariana e na América Latina. Os resultados de pesquisa apontam para a existência de um fluxo global, movimentos de difusão regional, como na região dos Andes, e movimentos pontuais de transferência, em que o OP se desloca de uma instituição à outra, como de Porto Alegre, no Brasil, para o município de Cotacachi, no Equador, ou ainda para Maputo, no Moçambique. Foi possível constatar que a ação de um conjunto de indivíduos foi fundamental para inserir o OP na agenda internacional, bem como para auxiliar nos processos de transferência no exterior. Uma vez que o OP se legitima no plano externo, as Organizações Internacionais passam a fazer mais diferença, pois financiam experiências, organizam oficínas de capacitação de quadros e produzem manuais de implementação. A técnica utilizada para realizar este estudo foi a do rastreamento do processo, que procura identificar as cadeias de mecanismos causais que afetam um determinado fenômeno. A dimensão empírica da pesquisa foi composta por fontes primárias. Para este estudo foram feitas mais de 120 entrevistas em profundidade em nove países (África do Sul, Brasil, Equador, Espanha, Estados Unidos da América, França, Moçambique, Peru, Senegal). Além disso, foi realizada observação participante em eventos internacionais e também foram coletados materiais in loco, como documentos oficiais, artigos da imprensa e arquivos multimídia. / This thesis explores an obscure facet in studies about democracy and participation, namely the international diffusion of ideas and technologies on participatory governance. Les relations internationales ont mis en évidence le rôle intégrateur du dialogue politique dans la promotion des objectifs, des intérêts nationaux, des engagements et des perceptions de l'État, et des organisations non gouvernementales. Les études consacrées à la relation entre l'UE et le Mexique concluent à une véritable transformation de la relation politique en raison de la signature de l'Accord global. Dès les premières années, les analyses se sont attachées à décrire les perceptions des négociations, le règlement ainsi que la perspective qui a complété les nouvelles composantes de la relation: le dialogue politique et la coopération. D'une façon générale, l'opinion commune semble faciliter le dialogue et les différentes propositions qui définissent la coopération, malgré l'ambiguïté de la situation qui résulte de la complexité de la communication entre les partenaires. L'objectif de cette recherche est d'analyser les interactions au sein du dialogue politique destiné à un approfondissement de la relation bilatérale, mais aussi d'analyser les éléments qui le composent et les formes de dialogue constituées par les autorités mexicaines et européennes. Deuxièmement, étant donné la nécessité de maintenir un programme commun bilatéral, il est important de réviser la coopération. Pour le cas de l'Allemagne et le Mexique, l'étude vise à présenter les effets de la relation dans des termes différents. Autrement dit, il y a de nouvelles formes de collaborations distinguées par l'action consensuelle afin de bénéficier d'une participation plus large. A ce processus il faut ajouter d'autres organisations non gouvernementales liées aux différents niveaux de gouvernement et des institutions qui mettent en évidence l'action des communautés épistémiques transnationales à travers les coalitions et les réseaux qui apparaissent entre les acteurs. / International relations have highlighted the integrating role of political dialogue in promoting objectives of national interests, commitments and perceptions of the State, and non-governmental organizations. Studies on the relationship between the EU and Mexico have established that there has been a genuine transformation of the political relationship because of the signing of the Global Agreement. From the early years, those studies focused on describing the perceptions of negotiation, the legal-normative framework, and the perspective that has complemented the new features of the relationship: namely, political dialogue and cooperation. In general, the common opinion seems to facilitate dialogue and different proposals that define cooperation, despite the ambiguity of the situation resulting from the complexity of communication between partners. The objective of this research is to analyze the interactions within the political dialogue aimed at deepening the bilateral relationship but also to analyze its components and forms of dialogue established by the Mexican and European authorities. Second, given the need for maintaining a joint bilateral agreement, it is important to review the nature of cooperation. This study highlights the special case of collaboration between Germany and Mexico, with the aim of presenting the effects of the relationship in different terms. In other words, there are new forms of collaboration distinguished by consensual action in order to benefit from wider participation. In this process one cannot leave out non-governmental organizations that have ties with different levels of government and institutions, which highlights the activities of transnational epistemic communities through coalitions and networks that emerge between the actors.

Cette thèse de doctorat porte sur une facette encore peu explorée dans les études sur la démocratie et la participation : la diffusion internationale d’idées et de technologies sur la gouvernance participative. Les recherches récentes sur ce thème ont insisté sur l’influence des différents acteurs afin d’expliquer le phénomène de la diffusion, en accordant une attention particulière aux organisations internationales. La préconisation de modèles spécifiques de la part de ces institutions est fréquente, comme dans le cas du Budget Participatif (BP), qui, de nos jours, compte plus de 2800 expériences réparties à travers le monde. Cependant, les orientations des institutions internationales suffisent-elles à expliquer la diffusion d’idées et de technologies de gouvernance participative ? Située entre analyse de politiques publiques et étude des relations internationales, cette recherche de doctorat se propose d’examiner le processus de diffusion du BP, au travers d’une méthodologie qualitative, combinant entretiens approfondis, observation participante et analyse de documents. L’étude a été développée à partir d’un cas précurseur, Porto Alegre, et de différents cas de transfert en Afrique Subsaharienne et en Amérique Latine. Les résultats de la recherche semblent indiquer l’existence d’un flux global, de mouvements de diffusion régionale – comme dans la région des Andes –, et de mouvements ponctuels de transfert, au sein desquels le BP se déplace d’une institution à une autre, comme de Porto Alegre, au Brésil, vers la municipalité de Cotacachi, en Équateur, ou encore à Maputo, au Mozambique. L’action d’un ensemble d’individus a été fondamentale pour introduire le BP dans l’agenda international, ainsi que pour aider les processus de transfert à l’étranger. La territorialité et l’Union européenne : approches de droit public / Territoriality and european union : public law approaches

La confrontation de la territorialité à l’Union européenne constitue une analyse originale, dans la mesure où la territorialité est traditionnellement exclusivement associée à l’Etat et à la souveraineté. La territorialité se caractérise par une polysémie, véritable « pêché originel » du concept. Elle peut cependant être utilisée à profit, afin de dégager toutes les virtualités de la confrontation entre un système politique en construction et un principe rattaché à l’Etat. En se fondant sur les mutations qui affectent ce dernier, et dans un contexte propice à la globalisation et à l’internationalisation des relations, l’analyse qui se dégage prima facie de cette confrontation tend à démontrer une perte de pertinence de la territorialité au sein de l’Union. Celle-ci s’est en effet construite sur un certain effacement des frontières et la constitution de territoires propres. L’affaiblissement du principe sera ainsi effectivement vérifié. Etudiée sous l’angle des matières publiques, l’étude apporte toutefois une approche transversale nouvelle de la problématique. La mise en contact des systèmes juridiques nationaux engendre des situations transnationales et nécessite l’élaboration de techniques juridiques qui bouleversent les cadres conceptuels nationaux. En outre, l’Union européenne ne constitue pas une entité abstraite, désincarnée ; elle est la créature de ses Etats membres. Elle est donc, dans une certaine mesure, structurée par la territorialité des Etats qui répercutent sur elle, leurs spécificités. Par conséquent, loin de s’inscrire dans des relations simplistes, la confrontation de la territorialité à l’Union européenne aboutit davantage à la démonstration d’une relation dialectique. / Juxtaposing the concept of “territoriality” and the European Union is a rather original analysis in so far as territoriality is traditionally associated with the State and with sovereignty. The term "territoriality" in itself, despite its "original sin", that is to say its polysemous feature, can be used favourably to reveal the potential of comparing a political system in the making with a State-related principle. Given the changes that the State is undergoing and the development of globalisation and the internationalization of relations, the comparison between “territoriality” and the EU would indicate, at first sight, that the former loses its relevance within the Union. The EU was indeed built upon the removal of borders and the creation of a “unified” territory. The weakening of territoriality is examined in this study which also offers an original, cross-cutting approach to the topic from a public law perspective. The divergence between the legal systems of each nation results in transnational situations and requires new legal approaches which profoundly alter national frameworks. However, the European Union is not an abstract or unreal entity; it is the product of its Member States, based upon the territoriality of these States, which, to a certain extent, bring their own specificities. Consequently, comparing territoriality and the European Union is more complex than a simplistic understanding of the two concepts may imply and leads more to a demonstration of dialectic tension.

Role transnacionálního aktéra na národní úrovni. Případ Americké obchodní komory v České Republice / Transnational Actor and the Nation State. The Case of American Chamber of Commerce in the Czech Republic

The purpose of this thesis is to analyze the role of the transnational actor at the national level in particular case of the American Chamber of Commerce in the Czech Republic. The study is divided into two main parts. The first, theoretical part focuses on three theoretical strands. The first chapter focuses on the development of theoretical perceptions of non-state actors in international relations since the 1970s. The goal of the first chapter is to examine concept of interdependence, global governance, the new transnationalism and transnational private governance. The second chapter focuses on multinational corporations. The analysis emphasizes the dynamics of research and development of transnational corporations and their relationship with the nation state. The goal of the third theoretical chapter is to explore the process of interest representation within the nation state. Attention is drawn to obstacles and conditions that transnational actor needs to overcome in order to successfully penetrate the process of interest representation and pursue its goals within the state. The second part of the thesis investigates activities of the American Chamber of Commerce in the Czech Republic that were carried out in an effort to amend the Public Procurement Act from 2010 to 2012.
