A model of performance management for the parole boards in South Africa : a penological perspective

One of the fundamental objectives of the criminal justice system in any country is to punish, rehabilitate, deter, incapacitate and reintegrate offenders into communities. The main motive of punishment therefore is to transform criminals into responsible and law-abiding citizens. Parole is acknowledged as an internationally accepted mechanism that allows for the conditional release of offenders from correctional centres into the community and forms one of the most important components of the criminal justice system value chain. The release of the offenders on parole therefore, does not negate the objectives of punishment but entrenches them through setting conditions by which all parolees must abide by. In other words, all offenders released on parole are supervised at all times by parole officials within their communities to ensure that they comply with their conditions. It is for this function- to grant parole to offenders, that the parole boards have been established in different countries. The Department of Correctional Services in South Africa has adopted the independent model of parole which provides for the parole boards that are headed by independent members from the public appointed by the Minister of Correctional Services. Parole is administered by the parole boards and has, as one of its main functions the release of offenders based on their eligibility. The absence of the performance management system for the parole board makes parole board decision making less transparent and government accountability difficult to establish. Performance management systems have been used to strengthen good governance. The purpose of this study is to contribute to the design of a model of performance management of the parole boards in the Department of Correctional Services in South Africa. / Penology / D.Litt. et Phil. A survey on the extent and nature of poly-victimization of adolescents in Heideveld

The goal of the study was to conduct a survey on the extent and nature of poly-victimization of adolescents in Heideveld. This researcher used a quantitative approach, administering an altered form of the Juvenile Victimization Questionnaire to achieve the goal. This questionnaire had 34 screener items exploring victimization events across a broad range of possible victimization types. Convenience sampling of grade 8-10 learners was used from a school in Heideveld. Ninety-one respondents completed the questionnaire, the age range spread from 13 – 18 years of age. Descriptive statistics were used to analyse the results. Responses of respondents to victimization (directed either at themselves or a peer) were explored through open-ended questions. Content analysis was performed to describe the data collected. The results showed that the extent of poly-victimization of adolescents in Heideveld is high. The role of the department of correctional services in the rehabilitation of child molesters

This report is the result of a literature study and questionnaire which gave insight on the role of Department of Correctional Services in the rehabilitation of child molesters. Correctional Services has adopted a new approach, where offenders need to change their negative behavior and be rehabilitated. Corrections have a societal responsibility towards the community to guide the offender on his rehabilitation path. This study was conducted to give a better understanding of rehabilitation to child molesters. It seems that child molesters will re-offend if they are not included in a thorough treatment programme. The purpose of this research is to determine if the Department of Correctional Services delivers on its legal and social responsibility towards the rehabilitation of child molesters. It is evaluated against international benchmarks. In this study the researcher gathered information on the profile of a child molester, the programmes currently available in Correctional Services, and also the involvement of the community in this process. Corrections cannot work alone, and needs the help of the community and leaders in the community to assist it in this process. Correctional Services faces many challenges in order to succeed in the rehabilitation of offenders. Currently there is a shortage of social workers and psychologists in the Department of Correctional Services, and the Department cannot, therefore, fully succeed in its rehabilitative role. Another aspect is that treatment is voluntary, and offenders can decide if they want to become involved or not. Understanding the experiences of adolescents trafficked for sexual exploitation : informing social work services

The impact of adolescent human trafficking for sexual exploitation is of such a nature that it interferes with the attainment of adolescent developmental tasks that would lead to the ability to become independent adults. This interference offers specific challenges to service providers. The goal of this study was therefore to develop an in-depth understanding of service providers’ perceptions of the experiences of adolescents trafficked for sexual exploitation with a view to inform social work services. The research methodology entailed the use of the contextual, explorative and descriptive research designs within a qualitative approach. Semi-structured interviews were used to collect data. Data analysis led to the identification of themes, sub-themes and categories that addressed the goal of the study. Experiences of forensic nurses regarding the provision of care to victims of sexual assault in selected public hospitals of Limpopo Province, South Africa

Purpose: The purpose of this study was to explore the experiences of forensic nurses when providing care to victims of sexual assault in selected public hospitals of Limpopo province. Methods: A qualitative, explorative, descriptive and contextual research design was employed in this study. A sample of 7 registered nurses was purposively selected to partake in in-depth unstructured interviews. Results: Four themes associated with the experience of providing care to victims of sexual assaults emerged during data analysis. These included (1) psychological experiences of nursing victims of sexual assault, (2) physical challenges associated with implementing the forensic nursing specialty in a clinical setting, (3) psychological coping strategies to deal with challenges experienced, and (4) the experience of managerial support. Conclusion: Participants reported negative psychological and physical experiences of providing care to victims of sexual assault, which resulted to occupational stress. Reflections on the legal and psychological constructions of women's resistance to sexual harassment

Despite the extensive research conducted on sexual harassment, very little work has focused on the legal and psychological constructions of women's resistance to sexual harassment. In exploring the legal and psychological constructions of women's resistance to sexual harassment, we are confronted with salient issues pertaining to the determination of the welcomeness requirement which call for a reflection. A key characteristic of sexual harassment is that it is unwanted by the recipient. It is for each person to decide what behaviour is acceptable to them and what they regard as offensive. Thus, although there is general agreement about what can constitute sexual harassment, the experience of sexual harassment is subjective in nature and the precise quantification of workplace sexual harassment is problematic. The present study aims to: (a) identify the reasoning/history behind the "unwelcomeness/unwanted" requirement, (b) assess the reasonableness of· the requirement of "unwelcomeness/unwanted" conduct, taking into account the various pieces of legislation and case law, (c) determine how the courts have interpreted this requirement and what factors are looked at, (d) determine whether the test is subjective or objective, (e) identify the struggle and debilitating effects sexual harassment has on women in the workplace. The results of this study will assist in gaining knowledge and understanding of the concept of "unwelcomeness/unwanted" conduct in sexual harassment cases and the effects it has on the victim which will go a long way in assisting management in any business to effectively implement strategies and disciplines to manage the problem of sexual harassment in the workplace. / Private Law / LLM (Labour Law)

消費者保護法第51條之研究 / The study of Article 51 of Consumer Protection Act

懲罰性賠償金係透過課予加害人超出被害人損害之賠償,達成制裁加害人,並嚇阻加害人以及其他行為人從事相類行為。該制度係源自於英國,並自英國傳遞自美國,並於美國廣泛盛行。懲罰性賠償金制度具有懲罰、嚇阻、設立典範之功能、執行法律等功能,惟其係私法下之概念,卻帶有懲罰目的之公法性質,跨越兩種領域使其極具爭議性。 消費者保護法第51條將英美法之懲罰性賠償金制度引進,致使我國民刑分立之法體系產生模糊地帶。關於我國實務對於懲罰性賠償金之態度,得以自其就消費者保護法第51條要件之解釋觀察。然實務就要件之解釋未盡統一,如此將導致當事人無所適從。 2015年6月17日修正之消費者保護法第51條,明確將「重大過失」納入規定,顯見立法者對於企業經營者採取更為嚴格之態度。如此修正固解決長久以來「過失」是否應限縮於「重大過失」之爭議,惟關於消費者保護法第51條其他要件之解釋,仍有尚未解決之問題。 觀諸消費者保護法第51條之要件,「依本法所提之訴訟」於「本法」及「訴訟」即存在寬嚴不同之解釋。另關於該條文之責任主體,企業經營者是否就其受僱人之懲罰性賠償金責任負責,又企業經營者間之責任關係為何,皆有釐清之必要。請求權主體之部分,消費者保護法第7條規定之「第三人」並未出現於第51條懲罰性賠償金之規定中,產生消費者以外之「第三人」是否為請求權主體之爭議。另外,被害人死亡時懲罰性賠償金之歸屬,亦為立法者制定該條文規定時,未審慎思考致生之法律漏洞。究竟被害人死亡時,應由間接被害人抑或繼承人請求懲罰性賠償金,無論如何結論之擇採,皆有賴縝密之法律邏輯推演。最後於懲罰性賠償金之計算,2015年6月17日明確懲罰輕過失行為以及提高倍數上限之修正,其妥適性為何;又消費者保護法第51條規定之計算基礎「損害額」之意義、計算時酌定之因素、與有過失之考量等,皆有待解決。本文以整理消費者保護法第51條懲罰性賠償金適用上之爭議,並嘗試透過學說及實務見解之分析歸納出合理之結論,並就結論之推演,參考部分日本法學說,期能對於消費者保護法第51條要件之解釋提供另一種思考方向。 / Punitive damages are extra monetary burdens which make the offender to pay more than those the injured has lost, in order to deter the offender and other offenders from behaving the same. The doctrine of punitive damages is originated from England and swept America. Punitive damages have the functions of punishment, deterrence, setting examples to the society, law enforcement and so on. However, it is controversial that the doctrine of punitive damages is the concept under civil law, but with the function of punishment, which makes the doctrine in the borderland between public and private law. Article 51 of the Consumer Protection Act is the doctrine of punitive damages in Taiwan, which causes a gray area among the separation of civil law and criminal law, and makes Art. 51 controversial. It is not difficult to know the attitude of the judges toward punitive damages by understanding the explanation of Art. 51. But there is no consistency in the explanation of each element of Art. 51, which makes the Article bewildering. On June 17, 2015, gross negligence has been added to the amended Article 51 of the Consumer Protection Act, which shows the strict attitude of the legislators toward the business operators. This amendment solves the problem that whether negligence should be limited to gross negligence or not, but there still are other issues about Art. 51 Which should be solved. Among Art. 51, “this law” and “litigation” in the element of “in a litigation brought in accordance with this law” are explained in both strict and easing ways. About the subject of the legal responsibility of Art. 51, whether the business operators should be responsible for the act of their employees, and whether business operators should be jointly and severally liable for punitive damages are issues should be discussed. About the claimers of Art. 51, comparing Art. 7 to Art. 51, we can find that “third party” isn’t showed in Art. 51, which brings up to the issue that whether third party other than consumer can claim for punitive damages. Also, who can claim for punitive damages when the victim dies is an important issue. The legislators did not think of this kind of situation, which caused legislation imperfection among Art. 51. Whether the indirect victim or the successor should be the claimer of punitive damages in this kind of situation should be explained carefully and logically. Last but not least, in related to the calculation of punitive damages, the amendment of Art. 51 in June, 17, 2015 specifies that objective negligence and subjective negligence should be punished and the maximum limit on the amount of damages has been raised. Whether the amendment is proper or not, and whether “the amount of damages” should be confined to “property damages” should be clarified. It is also necessary to figure out the considerations of determination of the amount. Whether comparative negligence should be considered while deciding the amount of punitive damages is also controversial, which should be investigated prudently. This thesis will focus on Article 51 of the Consumer Protection Act and the issues about it. This thesis will analyze those issues according to the theories and opinions of practice in Taiwan. American theories and Japanese theories will also be discussed in this thesis in order to solve the problems, and to provide a different view of Article 51 of the Consumer Protection Act.

Identification des indices comportementaux reliés à la présence d'intérêts sexuels déviants chez les agresseurs sexuels d’enfants

Lors de l’élaboration du diagnostic de trouble pédophilique (DSM-5; APA, 2013), un critère basé sur un minimum de victimes avait été proposé pour poser le diagnostic lorsque les agresseurs sexuels d’enfants ne se reconnaissent pas d’attirance sexuelle déviante, et qu’une évaluation pléthysmographique de leurs intérêts sexuels n’est pas disponible ou invalide. Il avait aussi été proposé de créer des sous-types selon le groupe d’âge préféré sexuellement ou l’âge des victimes : pédophilique (victimes prépubères, 10 ans et moins), hébéphilique (victimes en début de puberté, 11-14 ans) ou pédohébéphilique (les deux). Ces propositions ont soulevé la controverse parmi les chercheurs et cliniciens et n’ont pas été acceptées en raison du manque de soutien empirique les appuyant. Cette thèse tente de répondre aux principaux questionnements soulevés : 1) Quels indices comportementaux devraient être utilisés pour évaluer la déviance sexuelle chez les agresseurs sexuels d’enfants intrafamiliaux et extrafamiliaux respectivement? 2) Le nombre d’interactions sexuelles avec un même enfant et la durée de la période des agressions sont-ils reliés à la déviance sexuelle? 3) Les agresseurs sexuels d’enfants en début de puberté présentent-ils des intérêts sexuels déviants? Le premier article est un commentaire sur le DSM-5 présentant les grandes lignes de la thèse et les résultats préliminaires des deux articles suivants. Le deuxième article vise à répondre aux deux premières questions. Des agresseurs sexuels d'enfants intrafamiliaux (n = 76) et extrafamiliaux (n = 93) sont comparés quant au nombre, l’âge et le sexe de leurs victimes, le nombre d’interactions sexuelles avec une même victime et la durée de la période des agressions, et leurs intérêts sexuels autorapportés ou évalués avec la pléthysmographie pénienne. Les relations entre ces indices comportementaux et la présence d'intérêts sexuels déviants sont évaluées pour les deux groupes. Les résultats suggèrent que : 1) différents indices comportementaux devraient être utilisés lors de l’évaluation des intérêts sexuels selon les groupes d’agresseurs; 2) des agressions répétées et de longues durées sur une même victime suggèrent la déviance sexuelle chez les agresseurs intrafamiliaux, alors qu’aucune relation n’est observée entre ces variables chez les agresseurs extrafamiliaux. Cette recherche ii constitue une première étape vers l’utilisation du nombre et de la durée des agressions sexuelles avec un même enfant lors de l’évaluation des intérêts sexuels des agresseurs sexuels d’enfants. Le troisième article vise à répondre à la dernière question énoncée. Des agresseurs sexuels d'enfants regroupés selon l’âge de leurs victimes, pédophilique (n = 75), hébéphilique (n = 44), pédohébéphilique (n = 49), sont comparés quant à différentes variables : nombre et sexe des victimes, historique criminel, et intérêts sexuels autorapportés ou mesurés avec la pléthysmographie. Les résultats montrent la présence d’intérêts sexuels déviants dans les mêmes proportions pour les trois groupes. Quant aux autres variables, les groupes « pédophilique » et « hébéphilique » se distinguent peu, mais ils diffèrent du groupe « pédohébéphilique ». Ces résultats appuient le chevauchement entre l’attirance sexuelle envers les enfants prépubères et l’attirance envers ceux en début de puberté, et soutiennent leur regroupement dans le diagnostic de trouble pédophilique. / Revisions proposed for the pedophilic disorder (DSM-5; APA, 2013) included a criterion based on a minimum victim count to diagnose pedophilia when child molesters do not acknowledge having sexual attraction towards children, and phallometric evaluation of their sexual interests is not available or invalid. It was also proposed to divide the diagnostic with subtypes based on the preferred age category or the victims’ age: pedophilic (10 year-olds and younger), hebephilic (11-14 year-olds), or pedohebephilic (both). These revisions generated controversies among researchers and clinicians, and they were not adopted due to the paucity of empirical evidence supporting these propositions. This doctoral thesis aims to answer the main questions that were raised: 1) What indicators should be used when assessing deviant sexual interests among intrafamilial and extrafamilial child molesters respectively?; 2) Are the number of sexual interactions and the period duration of the offenses on the same victim associated with sexual deviance? 3) Do early pubescent child molesters have deviant sexual interests? The first article is a commentary on the DSM-5 outlining the thesis and presenting the preliminary results of the two following articles. The second article aims to answer the first two questions. Intrafamilial child molesters (n = 76) and extrafamilial child molesters (n = 93) are compared on their victim count, victims’ age and gender, the number of sexual interactions and the period duration of the offenses on the same victim, and their sexual interests acknowledged or measured with penile plethysmography. Associations between these indicators and deviant sexual interests are assessed for both groups. The results suggest that: 1) different indicators of deviant sexual interests should be used according to the offenders’ group; 2) repeated sexual interactions on a long period on the same victim suggest sexual deviance among intrafamilial offenders, while there is no association between these variables among extrafamilial offenders. This research is a first step towards using the number of sexual interactions and the period duration of the offenses on the same victim when assessing sexual deviance among child molesters. iv The third article aims to answer the last question. Child molesters grouped according to their victims' age category, pedophilic (n = 75), hebephilic (n = 44), and pedohebephilic (n = 49), were compared on different variables: victim count, victims' gender, criminal history, and sexual interests measured with penile plethysmography and acknowledged. The results show deviant sexual interests in the same proportions among the three groups. As for the other variables, the pedophilic and hebephilic groups do not differ much, but they both differ from the pedohebephilic group. The results highlight the overlap between sexual attraction to prepubescent and attraction to early pubescent children, and support their inclusion in the same diagnostic.

Paraphilic Coercive Disorder : Behavioral Markers and Validity of Diagnostic Criteria

Le présent projet doctoral vise à considérer les lacunes dans la documentation scientifique sur le Trouble Paraphilique Coercitif (TPC) en mettant l’accent sur la validité des critères diagnostiques proposés pour inclusion dans le DSM-5 et les marqueurs comportementaux. À ce fait, les données archivées d’individus ayant sexuellement agressé des femmes adultes ont été étudiées. La thèse est constituée de trois articles empiriques. Le premier article présente des résultats clés découlant des analyses, élaborés dans les articles subséquents. Le second (N = 47) évalue les fréquences observées du TPC, la validité et l’impact du recours au nombre minimal de victimes comme critère diagnostique, ainsi que les indices prédisant la récidive sexuelle. Le troisième article (N = 52) compare les groupes diagnostiques sur une série de comportements délictuels, tels que les gestes sexuels et les comportements violents, dans le but d’identifier les marqueurs comportementaux associés avec la propension au viol qui pourraient assister dans le processus diagnostique. Dans le même ordre d’idées, nous avons créé des typologies de violeurs à partir des gestes sexuels commis, d’un côté, et des comportements violents, de l’autre côté. Conséquemment, les caractéristiques des typologies ainsi obtenues et leur association avec le TPC furent examinées. Dans l’ensemble, nos résultats ne soutiennent pas le recours au nombre de victimes. Nos données suggèrent que, globalement, les violeurs avec le TPC utilisent un niveau de gestes sexuels plus envahissant et un niveau de violence moindre que les violeurs n’ayant pas ce diagnostic, et que l’exhibitionnisme et l’attouchement pourraient servir de marqueurs comportementaux pour le TPC. En outre, les violeurs avec le TPC sont caractérisés davantage par demande indécente, exhibitionnisme, attouchement, masturbation, tentative de pénétration et pénétration digitale que par pénétration vaginale et sodomie. De plus, ces derniers font moins recours à l’utilisation d’armes, semblent ne pas frapper/donner des coups à la victime et sont caractérisés par la manipulation plutôt que par le recours aux menaces de mort, force excessive et utilisation d’armes. En somme, nos données soulignent la nécessité de s’appuyer sur une combinaison de méthodes d’évaluation afin d’améliorer la validité diagnostique et discriminante du TPC. / The present dissertation aims to address the shortcomings in the current literature on Paraphilic Coercive Disorder (PCD) by focusing on two main objectives: assessing the validity of the diagnostic criteria proposed for inclusion in the DSM-5 and investigating behavioral markers. To this end, archival files of rapists who offended against adult women were studied. The thesis consists of three empirical articles. The first article presents a succinct account of some of the key results emanating from the analyses. The second article (N = 47) examines the observed frequencies of PCD and assesses the validity and impact of relying on minimum number of victims as a diagnostic criterion. Furthermore, a number of variables of interest are examined to determine predictors of sexual recidivism. The third article (N = 52) compares diagnostic groups on a number of offense conduct characteristics – specifically sexual acts and violent behaviors – in an attempt to identify behavioral markers associated with rape-proneness that could aid with the diagnosis of PCD. Similarly, rapist typologies were created by classifying the sample into groups of sex offenders based on their sexual acts, on one hand, and violent behaviors, on the other hand. Consequently, their characteristics and association with PCD were examined. Our results do not support the reliance on number of victims. Our findings suggest that rapists with PCD are more sexually intrusive and resort to less violence overall than sex offenders without such a diagnosis and that exhibitionism and fondling could serve as behavioral markers for PCD. Moreover, rapists with PCD are characterised more by indecent request, exhibitionism, fondling, masturbation, attempted intercourse and digital penetration rather than by intercourse and sodomy. In terms of violent behaviors, rapists with PCD resort less to the use of weapons, seem not to hit their victims, and are likely characterised more by manipulation rather than by the use of death threats, excessive force and weapons. In sum, the present study highlights the necessity of relying on a combination of assessment methods in order to improve diagnostic and discriminant validity of PCD.

Title The awareness about domestic violence among the Czech community Author Jana Trochtová Abstract Presented diploma thesis had for the object the theoretical processing of development of the phenomenon of domestic violence in historical contexts, the identification of variety and classification of domestic violence, the specification of victim and perpetrator of domestic violence and of course the identification of the effects that domestic violence in the family or intimate relationship brings to the victim or the perpetrator. Theoretical part of the thesis deals with the structure of professional organizations in the Czech Republic, the possibilities of the prevention and especially with the therapy of the perpetrator as well. The practical part of this diploma thesis was focused on evaluation of awareness about domestic violence among the Czech community, whereas the main output was the analysis of Czech community's readiness for perpetrator's therapeutic programs and the expression of its own preferences for improving the awareness of discussed issue. The method of questionnaire research was used for data collection. The diploma thesis is supplemented by information obtained from professionals working in specific organization helping people affected by domestic violence.
