Responsabilité civile et responsabilité pénale : à la recherche d'une cohérence perdue / Civil liability and criminal liability : in search of lost consistency

La responsabilité civile est traditionnellement attachée à la réparation des préjudices individuels. Pour sa part, le droit pénal est présenté comme la branche du droit qui assure la protection de l’intérêt général par la sanction de comportements attentatoires à un socle commun de valeurs sociales. Cette distinction de finalités justifie une hiérarchie des disciplines qui se traduit par une primauté accordée au droit pénal. Pourtant, on se propose de démontrer que le législateur, au même titre que le juge d’ailleurs, semble s’engager dans une direction contestable en considérant qu’il y a une différence de degré entre droit civil et droit pénal là où existe en réalité une différence de nature. De ce postulat inexact naît une confusion généralisée qui conduit chaque discipline à s’approprier les considérations de l’autre : le droit civil devient punitif tandis que, dans le même temps, le droit pénal accorde une place sans cesse accrue à la réparation du préjudice. Ce mouvement nous semble porteur d’un double danger : en premier lieu, le droit pénal délaisse sa fonction protectrice de l’intérêt général lorsqu’il s’attache à réparer des préjudices purement individuels ; en second lieu, le droit civil punitif, délié des garanties fondamentales dont est assortie la matière répressive, peut se révéler être une menace pour les libertés individuelles. Ce mouvement croisé des deux disciplines met en péril la cohérence de leurs régimes respectifs : leurs influences réciproques doivent être révélées afin de mieux cerner les faiblesses du droit de la responsabilité et de proposer des remèdes en vue d’assurer un agencement cohérent et complémentaire des responsabilités civile et pénale. / Studying two separate disciplines, such as Civil and Criminal liability, it would not be expected to find any interactions between them: Civil Law repairs the damage caused to private interests; while Criminal Law punishes, thereby ensuring public interests. These differences in purpose justify a hierarchy of disciplines resulting in the supremacy of Criminal Law over Civil Law. However, it will be shown that the legislature and the judge are going in the wrong direction by considering that there is a difference of degree between Civil Law and Criminal Law where there is actually a difference in nature. This incorrect assumption has given rise to a widespread confusion where each discipline takes ownership of the considerations of the other: Civil Law becomes punitive, while, at the same time, Criminal Law becomes increasingly compensatory. The present work aims to denounce a double danger: first, Criminal Law abandons its protective function of public interests when it attempts to repair purely individual damages; second, a punitive Civil Law, detached from the fundamental safeguards that are attached to criminal matters, may prove to be a threat to individual freedoms. This cross-movement between the two disciplines jeopardizes the consistency of their respective systems: reciprocal influences must be revealed in order to better understand the weaknesses of legal liability and to propose remedies that ensure a consistent and complementary arrangement of legal rules.

Bemagtiging van adolessente slagoffers van gesinsgeweld / Empowerment of adolescent victims of family violence

The research deals with the empowerment of adolescent victims of family violence. The purpose of the study was to give an account of the therapeutic intervention process of two case studies, by means of a descriptive, qualitative type of research. This research was executed via semi-structured interviews by the researcher. The population in the study was limited to adolescent victims between the age of twelve to eighteen years, who are victims of family violence. The sample in this study was two respondents. The children are students at a high school in Roodepoort. After completion of the empiric study it was concluded that the adolescent who is exposed to family violence, is empowered if a therapeutic process - like the one suggested by Oaklander (1994:289) which applies gestalt play therapeutic techniques - is followed. As clearly shown in the literature, the researcher came to the conclusion that family violence has a destructive effect on the adolescent and that he can be empowered by gestalt play therapy. OPSOMMING Die navorsing handel oor die bemagtiging van adolessente slagoffers van gesinsgeweld. Die doel van die studie was om deur middel van 'n beskrywende, kwalitatiewe tipe navorsing die terapeutiese intervensieproses van twee gevallestudies te beskryf. Hierdie navorsing het met behulp van semi-gestruktureerde onderhoudvoering geskied. Die populasie in die studie was begrens tot adolessente slagoffers tussen die ouderdom twaalf tot agtien jaar wat slagoffers van gesinsgeweld is. Die steekproef in hierdie studie was twee respondente. Die kinders is verbonde aan 'n hoërskool te Roodepoort. Daar is na afloop van die empiriese studie tot die gevolgtrekking gekom dat indien 'n terapeutiese proses - soos wat deur Oaklander (1994:289) voorgestel word met die benutting van gestaltspelterapeutiese tegnieke - deurloop word, die adolessent wat aan gesinsgeweld blootgestel word, bemagtig word. Domestic violence in Ghana : exploring first-hand accounts of incarcerated male perpetrators and views of government officials

Although male perpetration of violence against female partners is a global concern, there continues to be insufficient research attention on this phenomenon. The current study aimed at exploring experiences of male perpetrators of violence against their female partners in intimate relationships. The specific objectives were to get an understanding of the reasons and beliefs contributing towards perpetration of domestic violence, explore the barriers that perpetrators encounter with regard to receiving reformative support, and to suggest possible strategies that can be adopted to reduce or prevent domestic violence. Adopting a qualitative approach, data were obtained through in-depth interviews and participant observations involving 22 convicted male perpetrators in the Nsawam Prisons in the Eastern Region of Ghana, followed by interviews with stakeholders at the offices of the Domestic Violence & Victim Support Unit (DOVVSU) of the Ghana Police Service. The Interpretative Phenomenological Analysis (IPA) was used to analyse the data. Each transcript went through a thorough analysis to extract themes which were subsequently Synchronised. Overall, the findings from the present study elucidated some theoretical and practical implications. It reveals the following major themes: perception of inequality between sexes, bride price, childhood experience/witness of abuse, and victim blaming as contributory factors to the phenomenon of male violence against women. / Psychology / Ph. Thesis Transgeneration transfer of aggressive behaviour in families as a cause of domestic violence has theoretically - empirical nature and is divided into two parts, theoretical and practical. The theoretical part is defined by the family, its functions, types, and family pathology is described in the context of domestic violence and CAN syndrome. The central chapters of this section also deal with educational styles, parental attitudes, characteristics of domestic violence and child development in families with the occurrence of domestic violence. The practical part includes a qualitative analysis of documents, families affected by domestic violence, held at the Municipal Office Prachatice, department of Social and legal protection of children. The analysis examined whether these families can be considered the transgeneration transfer patterns of behaviour and styles of upbringing family to multiply family. The analysis is complemented by interviewed case study. The diploma thesis called "The process of moving towards the optimal supervision system of crisis interventions of the Police of the Czech republic" is connected with the future deriving of the project within the structural fund of European Union. The aims of the project is to support, implement and move to optimal supervision for crisis interventions of the Police of the Czech Republic. The thesis is a first research step for initial ideas about supervision and its systematic implementation to individual regional directorates of the Police of the Czech Republic. The theoretical part is focused on the basic concepts in the field of crisis intervention and supervision. The main chapters are supplemented by topics with an overlap into the system of the Police of the Czech Republic. The empirical part was performed using an online questionnaire survey. The research sample was a set of police crisis interventions from all regions of the Czech Republic, where the crisis assistance is provided by the team of the crisis intervention. There are several aims in the diploma thesis. The main one is to map and to describe the current system of supervision of crisis interventions and to compare individual regions in the area of providing supervision. Understanding bullying in three inclusive secondary schools in Johannesburg : a wellness perspective

This research is about bullying in schools. The aim of the study was to investigate how the problem of bullying is understood in schools, its causes, types, effects, general patterns and strategies to curb this bullying problem in schools derived from the bioecological theory, through interviewing teachers, learners and principals at secondary school level. Qualitative approach and a case study were used. This qualitative research was conducted at three inclusive secondary schools in Johannesburg North District in Gauteng province in South Africa through engaging eighteen learners in Grade Eleven and Twelve in focus groups. One focus group composed of six learners was conducted at each of three participating schools. Nine teachers, three from each of the three participating schools were involved in semi- structured interviews to solicit data on how they understand bullying, its causes, types, effects, general patterns and ways of addressing bullying in schools. Three principals, one from each of the selected schools also participated in this study. All the participants participated in this research through invitation to voluntary participation after being made aware of the purposes of the study by the researcher. Thus, a purposive sample of three principals, nine teachers and eighteen learners was used by the researcher. Semi- structured interviews and focus group interviews were used as research instruments in this study. Teachers and principals were engaged in semi- structured interviews and learners were involved in focus group interviews. The bio- ecological theory and the wellness theory were used as theoretical frameworks in this research to understand bullying, its causes, types, effects and general patterns, so as to come up with strategies to address bullying that target the learners’ social contexts rather than the learners themselves as is with the case with the psychological model. Before conducting this research, the researcher obtained ethics clearance from the University of South Africa’s ethics committee, clearance was also obtained from Gauteng Department of, clearance from Johannesburg North District as well as acceptance letters from participating inclusive secondary schools. The researcher also obtained assent from the eighteen Grade eleven and twelve learners who participated in this study. Assent was also obtained from parents of learners who participated in this research. Consent was also obtained from the nine teachers and three principals who participated in this research. After conducting focus group discussions and semi- structured interviews with teachers and principals, the researcher transcribed data verbatim for the purposes of analysing it. After transcribing data, it was colour coded, then categorised and categories were further fused into themes which were discussed in chapter five in relation to literature reviewed in chapter two. Some interesting findings were discovered in this research. Lack of resources, violence and violent video games were found to be causes of bullying in schools. ‘Gangsterism’ and peer influence were said to be general patterns of bullying in schools. Low academic performance and absenteeism were said to be effects of bullying in schools. Physical bullying, verbal bullying, emotional bullying, social bullying, sexual bullying, teacher- learner bullying, learner to learner bullying, gender based bullying and cyber bullying were said to be some types of bullying prevalent in schools. Working with various stakeholders in education such as organisations like Love Life, S.E.N.C.A, South African Police Services and Community Based Youth Centres as well as other professionals like social workers, psychologists and specialist teachers was found to be helpful address bullying in schools. Findings also indicated that involving parents and community leaders in school activities assist to address bullying in schools. Installing cameras and suggestion boxes, reporting all forms of bullying installing cameras, bullying awareness campaigns, training staff and having bullying lessons in the school timetable were mentioned effective methods of eradicating all forms of bullying in all schools. However, the study recommends that, teachers and principals be staff developed on issues related to how bullying is understood in schools in relation to its causes, types, effects, general patterns and strategies to stop it in school. / Inclusive Education / M. Vem har ansvar över de utsatta filippinska barnen? : En kvalitativ studie om svenska aktörers arbete kring live-streamade sexuella övergrepp på filippinska barn

Denna studie undersöker olika svenska aktörers arbete mot live-streamade sexuella övergrepp på filippinska barn samt deras syn på ansvarstagande gällande fall där svenska förövare begår detta brott. Det finns fyra svenska rättsfall där svenska män dömts för att ha beställt, regisserat och bevittnat sexuella övergrepp på barn i dagsläget. I dokumentärer och radioprogram som lyfter problematiken framkommer att dessa övergrepp sker i det dolda (på internet) och att det därmed finns ett stort mörkertal som innebär att övergreppen fortsätter att ske och att barnen riskerar att inte få rätt stöd och hjälp. Syftet med studien är därför att bidra med fördjupad kunskap inom området genom att undersöka huruvida svenska frivillighetsorganisationer samt myndigheter anser att deras arbete är tillräckligt eller behöver utvecklas. Det empiriska materialet bygger på fem intervjuer med ett urval av svenska myndigheter och frivilligorganisationer, där en aktör befinner sig på Filippinerna. Studien har en kvalitativ och induktiv ansats där resultatet analyseras utifrån Ludwig von Bertalanffys generella systemteori samt tidigare relevant forskning. Resultatet visar att informanterna anser att svenska aktörer har ett stort internationellt ansvar för de filippinska barn som blir utsatta för live-streamade övergrepp då förövarna är svenska. Två informanter menar att Sverige inte gör tillräckligt för dessa barn i nuläget. Samtidigt menar vissa informanter att ansvaret slutar någonstans och att Filippinernas egna aktörer behöver ta vid då vissa insatser inte anses kunna skötas från Sveriges håll. Resultatet visar även att nya idéer och resurser krävs för att de ska kunna uppfylla dessa ambitioner samt att det finns många utmaningar som försvårar och stoppar utvecklingen av arbetet. Empirin presenterar också möjligheter inom arbetet och förslag på nödvändiga åtgärder. I en avslutade diskussion lyfter vi fram bristen på ett barnfokus hos svenska aktörer samt några tankar kring vad detta kan bero på. Vi diskuterar även konsekvenserna av svenska rättsliga insatser för barnen och huruvida dessa gynnar eller skadar barnet. Avslutningsvis redovisar vi önskemål för framtida forskning inom området. / This study examines the work of various Swedish organizations regarding live-streamed sexual abuse of Filipino children and their view on responsibility for cases where Swedish perpetrators commit the crimes. There are four Swedish court cases where Swedish men have been convicted of this crime and documentaries and radio programs now highlight this problem. It appears that the crime is hidden, because it takes place on the internet, and for this reason there is a large number of hidden statistics that makes it difficult to protect and support the vulnerable children. The aim of this study is therefore to contribute with deeper knowledge in the area by examining whether Swedish non-governmental organizations and governmental authorities believe that their work is sufficient or needs to be developed. The empirical material is based on five interviews with a selection of Swedish authorities and non-governmental organizations. The study has a qualitative and inductive approach where the results are analyzed based on Ludwig von Bertalanffy's general systems theory and previous research. The result shows that the informants believe that Swedish actors have a great international responsibility for the Filipino children who are exposed to live-streamed abuse when the perpetrators are Swedish. Two informants believe that Sweden is not doing enough for these children at this moment. At the same time, some informants believe that their responsibility ends somewhere and that the Philippine government and non-governmental organizations have their responsibility. The result also shows that new ideas and resources are required for them to be able to fulfill these ambitions and that there are many challenges that stop the development of their work. The empiric also presents opportunities within the work and proposals for necessary measures for the future. Concluding in the discussion we highlight the lack of child focus among the work of Swedish governmental and nongovernmental organizations and what we believe is the reason for this. We also discuss the consequences of Swedish legal efforts for the children, such as damages, and whether these consequences benefit or harm the children. Finally, we come with suggestions for future research within the area.
