Essai d'une théorie générale des aménagements de peine / Towards a general theory of sentence adjustments

Les aménagements de peine sont devenus le fer de lance d’une politique pénale de lutte contre la récidivefondée sur l’insertion ou la réinsertion des condamnés. Le nombre de mesures qualifiées comme desaménagements de peine n’a jamais cessé de croître au fil du XXe siècle. Pourtant, au fur et à mesure ques’amoncelaient les réformes éparses, aucune réflexion d’ensemble relative aux aménagements de peine n’a eu lieu.Ainsi, la notion d’aménagement de peine n’a jamais été construite alors que la France est sûrement le payseuropéen qui recourt le plus à ces mesures. La France apparaît alors comme le pays le plus fertile en matièred’aménagement de peine avec une variété de mécanismes importante. Cette variété rend nécessaire une théoriegénérale des aménagements de peine dans la mesure où le sens technique de cette notion demeure obscur.Une théorie générale semble le moyen le plus sûr pour tenter de déceler une cohérence parmi les diversesmesures. En ce sens, il ne peut y avoir de théorie générale s’il est impossible d’identifier abstraitement ce qu’estune mesure d’aménagement de peine. En effet, le désordre normatif a effacé les frontières entre les modalitésd’exécution de la peine, les aménagements de peine et les mesures de sûreté. Aussi, le cadre d’une théorie généralepermet de construire la notion même d’aménagement de peine. En outre, la construction d’une notion unitaire doitpermettre d’apprécier la technique unitaire de ces mesures. Ce faisant, la théorie générale restaure une certainelisibilité du droit et met en lumière toute la cohérence d’un système tendant à responsabiliser le condamné. / Sentence adjustment spearheads a new criminal policy of fight against recidivism based on integration orrehabilitation of convicted people. The number of measures qualified as sentence adjustment increased throughoutthe XXe century. However, as scattered reforms kept accumulating, no overall study regarding sentence adjustmenthas taken place. As a result, even though France is surely the European country that uses them the most, the conceptof sentence adjustment has never been constructed. France indeed seems to be the most fertile country regardingsentence adjustment, creating many different mechanisms. Since the technical sense of the notion of sentenceadjustment remains blurry, a general theory of sentence adjustment is necessary.A general theory seems to be the surest way to try to find a coherence among those various measures. Butthere cannot be a general theory if it is not possible to identify abstractly what is a sentence adjustment. Nowadaysthe normative disorder blurred the lines between enforcement of a sentence, sentence adjustment and preventivedetention. Therefore, a general theory would help build the concept of sentence adjustment itself. Besides, theconstruction of a concept would make it easier to assess the one technique behind all those mechanisms. By doingso, the general theory of sentence adjustment would restore some clarity to the law and give all of its consistencyto a system tending to give a sense of responsibility to the convicted.

Esthétique et éthique du témoignage dans le nouveau roman africain d'expression française: Emmanuel Dongala, Tierno Monénembo et Ahmadou Kourouma

Cette thèse étudie l’esthétique et l’éthique du témoignage dans le nouveau africain d’expression française voire le roman de la guerre. Au centre est l’enfant comme une catégorie sociale menacée et menaçante. L’enfant africain reste « l’arme » et le « soldat » de choix dans la littérature postcoloniale tout comme il était à l’époque coloniale. Cependant, sa mission est devenue encore plus meurtrière car il est maintenant recruté pour mener des combats militaires soutenus par des idéologies dépourvues de logique. Nous examinons donc les enjeux esthétiques et éthiques du choix de donner la parole à l’enfant pour témoigner de la violence postcoloniale dans les romans d’Emmanuel Dongala, de Tierno Monénembo, et d’Ahmadou Kourouma. Que ce soit par le biais d’une confrontation qui imite la scène judiciaire (Dongala), un débat philosophique, religieux et socio-politique autours du sujet de génocide (Monénembo), ou encore de l’emploi du rire carnavalesque pour témoigner de la tragédie personnelle et collective (Kourouma), nos auteurs font de l’enfant le point de référence à partir duquel l’Afrique pense le présent et l’avenir. Ce faisant, ils démontrent une diversité conceptuelle du témoignage littéraire tant sur le plan esthétique qu’éthique, que nous qualifions de changement paradigmatique dans la littérature d’Afrique noire d’expression française. The effectiveness of the South African Truth and Reconciliation Commission in the contect of the five pillars of transitional justice

This study evaluated the effectiveness of the South African Truth and Reconciliation Commission (SATRC), using the theoretical and conceptual framework of the five pillars of transitional justice. Chitsike (2012) identified the five Pillars of Transitional Justice that the study uses. For that reason, Truth-Seeking and Truth-Telling, Trials and Tribunals, Reparations, Institutional Reform and Memorialisation are the Five Pillars of Transitional Justice that this study elected to use as the conceptual and theoretical framework. The Five Pillars of Transitional Justice that were delineated by Boraine (2005) are referred to for analytical purposes in the study. Methodologically, the study assumes a qualitative posture. Literature study through content analysis that uses description and exploration is deployed to make interpretation of the used literature. This study notes that each one of the pillars of transitional justice has its recommendations and limitations, and the pillars are much more enriched and enriching when applied in complementarity to each other rather than in isolation. The SATRC process also had its achievements and limitations, and its popularity was based on political impressions rather than concrete transitional justice achievements on the ground, in the view of the present study. Furthermore, it appears to the present study that more time is needed for much more reliable evaluations of the effectiveness of the Truth and Reconciliation Commission (TRC) to be made, some of its successes and limitations will take many years and or even decades to manifest because at the end of the day, TRCs are historical process and not events. / Political Sciences / M.A. (Politics)

Evaluation of modus operandi as a perpetrator identification technique in the investigation of rape cases

Rape is a serious crime and is a huge problem in Ethiopia. It has a devastating effect on the victim and society as a whole. The Ethiopian news is peppered with reports of this crime. Anorganized and sophisticated way in which the perpetrators of rape can be identified is by the use of modus operandi information. The aim of this research is to evaluate how modus operandi can be used as a perpetrator identification technique in the investigation of rape cases in the Gulele policing area. For any investigation to be successful, the investigator must have the objectives of crime investigation in mind. In the investigation of crime, the collection of evidence is important and there are two basic important principles, namely Locard’s principle and the chain of custody that investigator must comply with. These will ensure that evidence is admissible during a trial. Evidence is found on a crime scene. In rape cases, the body of the perpetrator and the victim can be seen as the crime scene. For evidence to be applicable to the investigation, it must first be identified and then individualised. It is important for investigators to be familiar with the concept of modus operandi, and the influencing factors. Beyond the victim : the traumatic effects of violent crime: an educational psychological perspective

Violent cnme is among the most prominent distinguishing characteristics of South African society, it has a severely traumatising effect on the populations concerned. Based on research :findings and existing literature, this study explores traumatic effects of violent crime on the most intimate associate of the victim (the partner). Accordingly, this study deals with the much-neglected topic of secondary trauma, by focusing on the following aspects of or conditions associated with violent crime and the secondary victim: cognitive, emotional and relational effects the experience of trauma, loss, vulnerability, depression and acute stress. It reveals that, depending on the severity of the incident, its consequences for the partner of the victim may range from post-traumatic stress to acute stress or secondary traumatic stress. From the similar results returned for primary and secondary victims, it is apparent that in the future, both victim and supporter should have their needs addressed with equal emphasis. / Educational Studies / M.Ed. An examination of the impact of residential security measures on the incidence of residential burglary in two selected northern suburbs of Johannesburg: a security risk management approach

Motivation This project was of specific importance to the private security industry, victims of residential burglary, community policing forums and the South African Police Service in providing detailed information regarding recommendations of how to manage and combat residential burglary in two selected northern suburbs of Johannesburg. Problem statement Residential burglary is categorised in the top three highest reported crimes according to the official South African Police Service statistics for the 2006/7 financial years. A series of victim interviews, docket analysis, case plotting and residential security audit surveys were conducted to determine the extent (or lack thereof) of security measures at a burgled residence in the selected area. Approach Field data was collected through docket analysis, plotting crime scenes (descriptive mapping), victim interviews and residential security audit surveys. Results The majority of victims of burglary interviewed did not have the minimum security system (integrated measures) in place. Those victims, who had security measures, appeared not to have made or implemented effective use of them. Conclusion Security at a residence extends beyond just the immediate house area and the focus (security risk assessment) should start with the immediate neighbourhood (community) area working inwards towards the property perimeter (boundary), inner perimeter (garden area) and then finally the immediate house area. / CRIMINOLOGY / MTECH: SECURITY RISK MAN

International and national resources on the application of Restorative Justice both in Corrections and as pre-sentence option had been studied. The background of the penal system and the development of Restorative Justice as part of the Criminal Justice System are investigated by looking at ancient practices, indigenous and modern practices. The study intends to draw on experience from other countries, while at the same time advocate for the development of a uniquely South African model or practice. A quantitative study on the culture of violence amongst learners in South African schools

The focus of this thesis falls on school violence. The research addresses the possibility that a culture of violence exists amongst some South African school-going youth. The researcher identified the attitudes and behaviour of learners towards violence as indicators of the culture of these learners. The research specifically focused on the pro-violence attitudes and violent behaviour of learners. The definition of ‘culture’ which was employed suggests the link between a person’s attitude, behaviour and culture. Information was gathered through literature and empirical research. The data was collected by means of a questionnaire with closed-ended questions and a well-tested tool, namely the Attitudes towards Violence Scale. The results of the empirical research were analyzed with the SPSS Windows data editor computer program. Conclusions and recommendations regarding school violence were made. Summaries in English and Afrikaans / This research explores the potential value for the application of the visual expressionistic arts, as well as the application of forensic art for the emancipation of victims of violent crime. Qualitative research methods are used in order to make certain assumptions and recommendations for the application of the forensic arts in the emancipation of traumatized victims. The research is based on the view that human behaviour is influenced by different internal and external contextual influences. The theoretical basis for the research is further supported by the grounding principals of the psycho-analytic, symbolic interactionistic and the phenomenological theoretical approaches. The potential for the application of the forensic arts during crisis intervention and trauma counselling as a therapeutic technique and a communication medium are investigated. The potential forensic value of the victims’ art for the criminal justice system is also explored during the research. / Die navorsing ondersoek die potensiele waarde vir die aanwending van die tradisionele visuele beeldende kunste asook die aanwending van die forensiese kunste vir die emansipasie van slagoffers van geweldsmisdaad.
